1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteDo not assume that a contractor can charge more—or that the contractor must absorb every increase—simply because labour, materials or freight became more expensive. Start with the signed contract and every document it incorporates. Identify the pricing model, any escalation or adjustment clause, the event that supposedly changed the price, and the notice and change-order procedure. Then require a written, clause-based explanation with records before agreeing to pay more.
Your location, contract wording and project facts control the result. Before withholding payment, stopping work or terminating, obtain advice from a construction lawyer or building/consumer authority familiar with the project’s jurisdiction.

First establish whether the contract allows a price adjustment
A higher supplier quotation is evidence of a cost change, not by itself a right to change your contract price. The answer usually turns on the bargain you signed and on any incorporated proposal, specification, schedule, addendum or standard terms.
Classify the pricing structure
| Contract structure | Ordinary fluctuation risk | Possible adjustment trigger | Documents and limits to check |
|---|---|---|---|
| Lump-sum or fixed price | The agreed scope is generally priced as one amount, so ordinary input changes may remain with the party assigned that risk. | An express escalation or economic-adjustment clause, a written scope change, an allowance, a covered site condition, a change in law or another contract-defined event. | Adjustment formula, baseline date, threshold, cap, exclusions, notice deadline and whether the formula permits decreases as well as increases. |
| Unit-price | The unit rate is agreed, while the final total depends on measured quantities. | Actual quantities differing from stated quantities, authorized changes, or a clause that adjusts rates for defined events. | Measurement rules, quantity thresholds, remeasurement records, rate build-up and notice requirements. |
| Cost-plus | The owner normally bears more of the documented cost risk, subject to the agreed fee and controls. | Allowable cost incurred under the contract, approved changes or specified reimbursable events. | Definition of allowable cost, invoices, labour records, markup, audit rights, caps and approval requirements. |
| Allowances or provisional sums | Only the allowance or provisional amount is included initially; the eventual selection or work may cost more or less. | Actual selected item, quantity or work cost replacing the allowance, using the contract’s valuation method. | What the allowance includes, credits for unused amounts, markup, approval process and supporting quotations. |
| Escalation or price-adjustment contract | Risk is shared according to the stated mechanism rather than a general promise to pay market increases. | A defined index movement, labour or material event, date range or other contingency identified in the clause. | Index or baseline, calculation formula, threshold, cap, covered items, proof, notice, timing and schedule treatment. |
A fixed-price label does not settle every issue. Scope changes, allowances, taxes, change-in-law provisions, owner-caused delay and concealed conditions may be treated separately. Read the complete agreement rather than relying on a heading or a sales description.

Use the contract’s definition of the trigger
Ask what actually changed:
- the market price of an input that was already in the agreed scope;
- the quantity or specification of work;
- an owner selection or design instruction;
- a concealed or differing site condition;
- a delay that extended the procurement or installation period;
- a tax, code or other legal requirement; or
- a supplier, subcontractor or labour problem within the contractor’s own arrangements.
Those events can have different contractual consequences. A generalized statement such as “inflation has made the job impossible” does not identify which clause, event or calculation is being invoked.
Gather the governing documents before debating the amount
Create one file containing the signed agreement, proposal, plans, specifications, schedules, incorporated standard conditions, addenda, amendments, payment applications, invoices, supplier quotations, photos, meeting notes and messages. Confirm who signed each document and whether the request comes from the main contractor, a subcontractor or a supplier. Check for conflicting versions and identify which document controls if terms differ.
Search for the clauses that usually decide the issue
- fixed, lump-sum or unit-price wording;
- allowances and provisional sums;
- economic escalation or price-adjustment provisions;
- change-order and owner-instruction clauses;
- differing-site-condition or concealed-condition clauses;
- tax, tariff or change-in-law provisions;
- delay, extension-of-time and suspension provisions;
- notice method and deadline;
- who is authorized to approve a change;
- payment, retention and certification rules; and
- mediation, adjudication, arbitration, court or other dispute procedures.
Notice requirements can be decisive. A clause may require written notice within a stated period, a particular address or email, and a contemporaneous record of the event. Send any required notice exactly as the contract specifies and keep proof of delivery. Do not assume that a casual conversation or text message satisfies a formal notice clause.
Request a written, verifiable explanation
Respond in writing. Keep the tone factual and reserve your position while you investigate. Ask the contractor to provide:

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
- the precise contract clause or written instruction relied on;
- the event said to trigger the adjustment and the date it occurred;
- the affected work, material, labour category or quantity;
- the original baseline price, date and assumptions;
- the current price and the source of the quotation or invoice;
- the calculation showing quantity, unit cost, overhead and markup separately;
- credits, substitutions, savings or avoided costs;
- the requested change to the completion date or other schedule effect;
- copies of relevant supplier quotations, invoices, delivery records and labour records, subject to legitimate confidentiality limits; and
- the proposed change-order wording and the date by which a response is required.
Ask whether the calculation is a one-time adjustment or a recurring change, and whether the clause applies symmetrically if the relevant price later falls. Do not accept a round-number surcharge that cannot be traced to the contract’s formula or to documented changed work.
Separate a genuine change from ordinary market escalation
Owner-directed scope or specification change
If you changed the design, quantity, finish, product, access arrangement or sequence, follow the written change process. The contractor should identify the added or deleted work and price it under the contract’s valuation method. A change can increase or decrease the total; insist that credits and deletions are shown, not only additions.
Allowance or provisional sum exceeded
Compare the allowance with the actual approved selection and quantity. Determine whether the allowance included delivery, installation, taxes, waste, overhead and markup. Require a credit if the actual cost is below the allowance and apply the contract’s stated valuation rules.

Some contracts provide a specific process when physical conditions differ materially from what the contract documents indicated. The contractor may need to notify you before disturbing the condition, preserve evidence and explain both cost and time effects. Whether a particular condition qualifies depends on the wording and local law; do not treat every unexpected difficulty as a compensable site condition.

Delay or extended performance
Determine who caused the delay, when it was notified, and which costs are actually tied to the extended period. A supplier increase during a contractor-caused delay may be treated differently from an owner-caused delay or a contract-defined excusable event. Request a contemporaneous schedule analysis rather than a blanket claim for all later costs.
Tax, code or legal change
A tax, tariff, code requirement or other legal change may be covered by a specific clause. Verify the effective date, the affected work and whether the contract allocates that risk. A legal change is not the same as a general market movement.
Supplier price increase with no contractual trigger
If the scope, quantity, site and legal requirements are unchanged and the agreement contains no applicable adjustment mechanism, the contractor may have difficulty establishing a right to reopen the price. That is a contract-specific assessment, not a universal rule. Ask for the clause and records instead of arguing from general statements about inflation.

- the records supporting the amount;
- any conditions for future adjustments; and
- whether the document resolves only this identified event or contains a broader release.
Read release, waiver and “full and final settlement” language carefully. A sentence that appears to settle one material may release unrelated delay, defect or cost claims. If the wording is unclear or the amount is significant, have a local construction lawyer review it before signing.

U.S. Federal Acquisition Regulation (FAR) provisions illustrate how a sophisticated contract can allocate escalation risk without creating a general right to more money. FAR 16.203-2 says a fixed-price contract with economic price adjustment may be used when “there is serious doubt concerning the stability of market or labor conditions that will exist during an extended period of contract performance” and the contingencies can be identified and covered separately. FAR Part 36 also distinguishes federal construction pricing forms and includes clauses for specified differing-site conditions. These are U.S. federal procurement rules, not automatic rules for a private home or commercial project.
The Philippine Construction Industry Authority Panel (CIAP) FAQ discusses written owner changes, valuation methods, supporting records and notice under the standard contract provisions it cites. Those procedures demonstrate why the actual form and notice language matter; they should not be imported as deadlines or remedies in another country.

Japan’s Ministry of Land, Infrastructure, Transport and Tourism reported amendments effective December 13, 2024 that added a required contract term concerning changes to work or contract price based on price fluctuations, along with notice and consultation rules in specified construction contexts. That dated, jurisdiction-specific example does not establish a general rule outside Japan or outside the contracts covered by the amendments.

Keep working, paying and escalating decisions separate
A disputed increase does not automatically authorize either side to stop performing. Before withholding an invoice, suspending work, refusing site access or terminating, check the payment, suspension, cure and termination clauses and applicable local law. An improper stoppage can expose you to interest, delay damages, a lien or bond claim, termination liability or other remedies. Conversely, paying an unverified amount or signing a broad release can weaken later claims.
If safety, weather protection, security, a payment deadline or project continuity is at risk, seek prompt local advice. Continue undisputed performance and payment where the contract requires it, while stating in writing that payment or access does not concede the disputed adjustment if your lawyer advises that reservation is effective. Do not rely on a reservation that conflicts with the contract’s waiver language.
Use the dispute procedure if the request remains unresolved
- Send the required written response identifying the information still missing and your position on the clause.
- Preserve the contract, notices, delivery proof, photographs, schedules, payment records and all communications in chronological order.
- Follow any negotiation, project-manager determination, mediation, adjudication or arbitration step before filing in court.
- Ask a local construction lawyer to assess notice compliance, payment exposure, lien or bond rights and limitation periods.
- Consider a documented interim arrangement only if it states the amount paid, the unresolved issues, the work covered and whether any rights are reserved.
Contract remedies vary by jurisdiction and by the precise wording. A lawyer or relevant building/consumer authority can also help identify mandatory protections that a private contract cannot waive.

Practical checklist
- Locate the signed agreement and every incorporated document.
- Classify the price structure and identify the alleged trigger.
- Check notice deadlines, authorization rules and dispute steps.
- Request the clause, calculation, quantities, records and schedule effect in writing.
- Do not casually approve extra work, sign an amendment or release future claims.
- Record all decisions, meetings, photographs, invoices and delivery dates.
- Get local advice before withholding payment, suspending work or terminating.
Bottom line
When construction costs rise after signing, treat the request as a contract-and-evidence question, not as an automatic entitlement. Read the complete agreement, distinguish market escalation from a defined change or site event, enforce the notice and change-order process, and document any settlement precisely. The correct outcome depends on the project’s jurisdiction, contract form and wording.
