What Renters Should Check Before Leasing an Apartment in a Converted Office Building

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do not sign until you can verify that the specific apartment is approved for residential occupancy, inspect its life-safety features, understand what the conversion work covered, and have repair and outage responsibilities in writing. An office-to-residential project is not automatically lawful or complete just because a listing calls the space an apartment. Confirm the address and unit with the local building authority, then use the showing and lease review to test whether the home works safely and practically for everyday living.

1. Verify that the specific unit is legal to occupy

The most important question is not whether the building has been marketed as residential. It is whether the building’s approved use includes the particular unit you would rent, and whether required permits and inspections are complete. A building can have a legitimate conversion project while an individual floor, room, or apartment remains outside the approved occupancy.

  • approved use or occupancy classification;
  • the certificate of occupancy or equivalent occupancy document;
  • conversion, alteration, and change-of-use permits;
  • inspection status and sign-offs;
  • open violations, stop-work orders, or unresolved complaints; and
  • records identifying the floors or units covered by the approval.

New York City’s Department of Buildings directs prospective tenants to building-history records, its Buildings Information System (BIS), and Certificate of Occupancy records to investigate legal use and occupancy. Those tools are NYC-specific examples, but the method applies elsewhere: use the official record for the address rather than relying on an advertisement or verbal assurance.

Ask the landlord to identify the approval

Ask the owner or agent to name the residential approval that covers your unit and provide the document number or a copy. Ask whether any permit or violation remains open and whether it affects occupancy of your floor or apartment. If the answer is vague—such as “the conversion is grandfathered” or “everyone lives here”—pause and contact the local building authority yourself.

NYC describes an illegal conversion as adding apartments without the permits or approvals required for lawful use. The city’s renter guidance says, “Before you sign your lease, you should verify if the building you are interested in can be legally occupied as presented by the owner.” The same principle matters in every jurisdiction, even though the document names and online systems differ.

Do not confuse a building approval with a finished apartment

A certificate or permit may cover a project without proving that every promised feature is installed or operating. Check that the apartment you will receive matches the approved layout, number of bedrooms, exits, and services. If the unit was subdivided after the main conversion approval, ask whether that alteration was separately permitted.

2. Prepare questions before the tour

Doing the records check first makes the showing more productive. Bring the address, unit number, a copy of the listing, and a written list of questions. Ask for the conversion scope, not just cosmetic information.

Ask what work was performed

San Diego’s Development Services Department identifies these review topics for a commercial-to-residential change of occupancy:

  • egress and exit routes;
  • structural design;
  • accessibility;
  • sound transmission;
  • fire protection and life-safety systems;
  • elevators;
  • water and sewer systems;
  • electrical systems; and
  • energy requirements.

Use that list as a set of questions, not as a universal code checklist. Ask which items were upgraded, which inspections were completed, and where the documentation is held. Portland’s permitting guidance similarly describes review by multiple bureaus—including building, fire, housing, transportation, and water agencies—and highlights seismic design as a conversion issue. The agencies and standards vary by place, so the local authority’s answer controls.

Ask about construction still under way

Find out whether work remains in other floors, the lobby, elevators, or mechanical rooms. Ask about planned shutdowns, construction hours, dust control, and access changes. A lease should state how notice is given and what happens if essential services are interrupted. Do not assume that an attractive finished unit means the entire building project is complete.

3. Check exits and life-safety features in person

At the showing, walk the route you would use in an emergency instead of only viewing the apartment’s finishes. These observations are practical renter checks, not a substitute for a code inspection.

Identify two usable ways out

Locate the normal exit and an alternate route. Confirm that each path is accessible, clearly identifiable, and not blocked by stored materials, locked gates, furniture, or construction barriers. NYC renter guidance specifically tells tenants to verify two ways to exit. A route that exists on a plan but cannot be opened or reached during a showing deserves an explanation before you proceed.

Look for smoke and carbon-monoxide detectors

Check the apartment and any required common areas for smoke and carbon-monoxide detectors. Note whether devices are installed where you can see them and ask who maintains or replaces them. The NYC guidance describes checking for these devices; it does not tell renters to purchase their own as a substitute for a building’s required systems. Local placement and maintenance rules differ, so ask the building department or fire authority if the arrangement is unclear.

Inspect bedroom windows, light, and ventilation

Open each bedroom window if permitted and confirm that it operates, is not permanently sealed, and provides natural light and ventilation. NYC tenant guidance says bedrooms must have a window, and NYC materials flag windowless or inadequately ventilated rooms as possible illegal-conversion indicators. That does not establish a universal rule for every city: window dimensions, emergency-opening requirements, and exceptions are local. An interior room is not automatically unlawful, but it should be verified against the local occupancy rules before you sign.

Test ordinary functions

Without dismantling anything or using specialized equipment, test what a normal resident can observe:

  • open and close apartment doors and windows;
  • run taps and check for leaks;
  • flush toilets and observe drainage;
  • turn on lights and test accessible outlets with a normal device or tester;
  • check heating, cooling, and ventilation controls; and
  • ride an elevator during the visit if it is available.

Record defects with photographs and ask for a written repair plan, including the expected completion date. A promise to fix something verbally is difficult to enforce if it is absent from the lease or an attached condition report.

4. Evaluate noise and the building’s surroundings

Office buildings can have different floor plates, façades, mechanical systems, and neighboring uses from purpose-built apartments. Listen inside the unit, in the corridor, and near bedrooms. If possible, visit at more than one time of day, including a busy commute period and evening.

Ask about sound separation

Ask whether the conversion included acoustic testing, floor-ceiling insulation, upgraded windows, or mechanical-noise controls. Request any available assessment and ask which walls or floors share structure with offices, restaurants, loading areas, gyms, or plant rooms.

Consider roads, rail, and airports

San Diego’s bulletin identifies sound-transmission review and special noise considerations in some airport, rail, and freeway contexts. It does not establish one renter threshold for every location. Treat proximity to those sources as a reason to investigate, not as proof that a unit fails. Stand quietly in the bedroom, close the windows, and ask how nighttime noise is addressed.

5. Review utilities, elevators, and access systems

Older office conversions may retain central equipment designed for daytime commercial schedules. Ask how heating, cooling, hot water, ventilation, and electrical service operate in residential use. Clarify whether utilities are separately metered, included in rent, or allocated by a formula, and identify who pays for internet or access-control equipment.

Ask about service reliability and maintenance

Request the normal maintenance schedule for elevators, fire alarms, generators, pumps, and domestic-water systems. Ask how residents are notified of planned outages and whom to contact for an emergency. If an elevator is essential because of the unit’s location or a resident’s mobility needs, confirm the building’s accessibility arrangements and backup plan in writing.

Look beyond the apartment door

Inspect the lobby, corridors, stairwells, mail area, refuse rooms, and routes to the street. Check lighting, handrails, door operation, signage, and apparent water damage. These observations do not prove code compliance, but they can reveal unresolved work or maintenance problems that a staged apartment hides.

6. Read the lease for repairs and interruptions

Lease duties and tenant protections are local. Do not assume that a rule from another city or a general “landlord maintains the building” statement answers every situation.

Get responsibilities in writing

Identify who is responsible for:

  • heating, cooling, hot water, and ventilation repairs;
  • appliance and plumbing failures;
  • smoke and carbon-monoxide detector maintenance;
  • elevator and access-system problems;
  • pest control and water intrusion;
  • common-area cleaning and security; and
  • damage caused by ongoing conversion work.

Check the notice method, emergency contact, response process, and any stated repair timeframes. If the lease incorporates building rules, read those rules before signing rather than treating them as a later handout.

Clarify what happens during an outage

Ask what happens if an elevator, heat system, water supply, electrical service, or access system is unavailable. Determine how the landlord communicates, whether temporary measures are provided, and how rent, relocation, or access is handled under the applicable local law. The answer must come from the actual lease and local tenant resources; there is no single nationwide rule established by the examples here.

Document the starting condition

Keep the listing, emails, permit references, written answers, and a dated move-in condition report. Photograph windows, detectors, exits, fixtures, walls, floors, and any unfinished work. Send material discrepancies to the landlord before signing and attach agreed repairs or credits to the lease.

7. Use a decision checklist before committing

  1. Confirm jurisdiction: identify the city or county building, fire, housing, and utility authorities that regulate the address.
  2. Search the official record: verify approved residential use, occupancy documentation, permits, inspections, and open violations.
  3. Match the unit: confirm that your floor, apartment number, bedroom count, and layout are included in the approval.
  4. Question the conversion scope: ask about exits, structural work, fire protection, sound separation, elevators, utilities, electrical service, energy measures, accessibility, and any seismic review required locally.
  5. Walk the life-safety routes: locate two exits, check that paths are usable, and inspect smoke and carbon-monoxide detectors.
  6. Check bedrooms and basic operation: verify windows, light, ventilation, plumbing, doors, outlets, climate controls, and elevator operation.
  7. Assess noise: listen at different times and investigate nearby roads, rail lines, airports, loading areas, and mechanical rooms.
  8. Set lease terms: record repair duties, utilities, access, construction notice, outage procedures, and emergency contacts.
  9. Preserve evidence: save documents and photographs and obtain every promised repair or representation in writing.

8. When to pause or walk away

Pause the lease if the owner cannot identify the residential approval, refuses to provide a unit-specific answer, minimizes an open violation, or says records are unnecessary because other tenants already live there. Also pause when an emergency exit is blocked, a bedroom lacks the required local light or ventilation, alarms are missing, major systems are unfinished, or the lease leaves essential repairs and outages undefined.

Contact the local building or housing authority with the address and your specific question. Ask what document proves lawful residential occupancy, whether the listed unit is included, and whether any open matter affects a tenant’s right to occupy it. A written answer from the authority is more useful than a general assurance from a leasing agent.

What the conversion changes for a renter

Residential use introduces conditions that ordinary office occupancy may not have addressed. San Diego’s Development Services Department explains that residents may sleep in the building, include children and other sensitive occupants, and remain there around the clock, whereas offices are typically occupied during working hours. That is why a change of occupancy can trigger distinct review of egress, fire protection, sound, elevators, utilities, electrical systems, energy performance, and related safeguards.

The exact requirements depend on the property’s jurisdiction, construction date, scope of work, and approved use. NYC, San Diego, and Portland illustrate different local processes rather than a single national standard. Treat official records and the lease as separate checks: approval establishes whether the unit may be occupied, while inspection and written terms help you judge whether the home is safe, functional, and supportable day to day.
