What to Do if Your Contractor Is Under Investigation or Loses Their License

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

First, verify the contractor’s status with the licensing authority, make the site safe, preserve every project record, and ask the building department what happens to permits and inspections. An investigation is not the same as a final violation, and a suspension or revocation does not automatically answer whether your contract is canceled or whether you may stop payment. Because the right response depends on your state, trade, contract, financing and project condition, get local legal advice before withholding substantial money, signing a release or authorizing major new work.

What the status actually means

People often use “under investigation,” “suspended,” “revoked” and “expired” as if they describe the same event. They do not. A complaint may still be screened or investigated without a finding that the contractor violated a rule. A final order may restrict a license, a specific trade, a qualifying individual or a business entity. An expired license can mean the contractor cannot lawfully take new work, but the consequences for an existing project vary by jurisdiction.

As an Amazon Associate I earn from qualifying purchases.

Do not rely on a text message, a rumor, a search-result snippet or the contractor’s own explanation. The controlling record is the official license database or written statement from the agency that regulates the relevant trade. Record exactly what the agency shows and the date you checked it.

Actions to take in the first 24 hours

Make the property safe

If there is an exposed electrical conductor, gas smell, active leak, unstable structure, missing weather protection or another immediate hazard, keep people away and call the appropriate emergency service or building-safety authority. Do not direct an unlicensed person to perform dangerous work merely to keep the schedule moving. If conditions are not immediately dangerous, avoid disturbing incomplete work until you have photographed it and asked the building department how an inspection should be handled.

Pause irreversible decisions

Do not demolish, cover, alter or “clean up” disputed work before documenting it. Do not sign a release, back-charge agreement, settlement or change order presented under pressure. Keep communications factual: identify what was promised, what is complete, what is missing and what safety concern exists. A short written notice that you are investigating the status and preserving your rights is safer than an angry accusation that could later be treated as a factual admission.

Save the evidence now

Download or copy records before an online portal, phone or email account changes. Keep the signed contract and every later version, change order, estimate, invoice, receipt, financing paper, warranty, permit, inspection report, text message and email. Take dated, wide and close photographs or video of each room, exterior elevation, mechanical installation and unfinished detail. Keep the originals and send copies when filing a complaint. The Federal Trade Commission advises consumers to keep notes and copies of letters and documents when trying to resolve a business dispute.

Verify the contractor and the action

  1. Find the correct regulator. Use the official state or local lookup for the trade involved—such as general building, plumbing, electrical, roofing or HVAC. A business may hold different permissions for different work.
  2. Match the identity. Compare the legal business name, license number, qualifying individual and entity shown in the record with your contract, invoices and advertising. Similar names can belong to different companies.
  3. Capture the status. Save the displayed status, public disciplinary order, effective date, expiration date and agency contact details. Print the page or save a PDF with the date and time.
  4. Ask precise questions. Ask whether the matter is a pending complaint or a final order; whether the action applies to this business, person or trade; whether existing projects may continue; and what notice, permit or supervision is required.
  5. Request written confirmation. If an employee gives guidance by phone, ask for the relevant rule, order number or email confirmation. Keep the name and date of the conversation in your chronology.

Describe an allegation as an allegation. Until the regulator issues a final determination, “the agency is investigating a complaint” is accurate; “the contractor committed fraud” may not be.

Protect permits, inspections and the physical project

Contact the city or county building department separately from the licensing board. Ask whether the permit is active, which inspections have passed, whether a named contractor must be changed, and what documents a replacement contractor must submit. Some departments will not allow concealment of work until an inspection occurs; others may require a new permit or a documented transfer. Only the local department can tell you what applies to your address.

Request a written list of open inspections and deficiencies. Photograph permit cards, posted notices and inspection tags. If work is partially complete, obtain a neutral description of visible conditions from a qualified local professional before another contractor covers them. That record can distinguish pre-existing defects from damage caused during a rushed takeover.

Secure materials and equipment without removing items that could be evidence. Check whether the contract says who owns materials stored on site, whether rented equipment must be returned and whether a lender or insurer has inspection requirements. Notify your insurer promptly if there is water intrusion or another covered loss, while making only emergency mitigation that is reasonably necessary.

Decide carefully about work and payments

Do not assume the contract ended

A license event alone may not automatically cancel your contract, create a refund, or give you a risk-free right to terminate. The contract may contain notice-and-cure language, termination triggers, arbitration or mediation requirements, payment milestones and lien notices. State law can also impose rules about unlicensed contracting that differ by trade and location. Read the exact agreement and obtain advice from a construction or consumer-law attorney in your jurisdiction.

Separate completed, paid and disputed work

Create a ledger with four columns: work accepted, work incomplete, amounts paid and amounts claimed. Tie each payment to an invoice, draw request or inspection. Mark deposits, retainage, financing advances and payments made by card separately. Do not pay cash merely to make the contractor disappear, and do not divert money to a replacement contractor until you understand lien and lender requirements.

Withholding and card disputes

Stopping every payment can expose you to breach-of-contract claims, finance charges or lien risk; continuing every payment can increase an unrecoverable loss. Ask counsel how to reserve disputed amounts, provide a contractual notice and protect against a payment or lien deadline. The Federal Trade Commission’s credit-card billing-dispute guidance has specific legal scope and deadlines. It is not a general rule allowing a homeowner to stop paying because a contractor is under investigation. Follow the card issuer’s official process for the particular transaction and keep proof of your submission.

Give a controlled written notice

Identify the project, the status information you received, the work remaining and the documents you need. Request a job-cost and materials accounting, permit information, keys and access credentials, and a proposed plan for safe stabilization. Avoid admitting the contractor breached the contract or promising a final payment until you have reviewed the facts.

Report the matter to the right authorities

Licensing board

Ask the licensing board how to verify status and file a complaint. Attach a factual timeline and copies of the contract, payment proof, photographs and communications. Explain the remedy you seek, such as an investigation, safety review or licensing information, without assuming the board can award damages.

California’s Contractors State License Board states that its investigation process is not intended to obtain restitution and does not guarantee that a complainant will receive money. That is a California description, not a nationwide rule. Other states may offer different administrative remedies or none at all.

Building department and consumer agencies

Use the building department for permit, inspection and safety questions. The FTC identifies state attorneys general and local consumer-protection offices as additional possible sources of help, although each agency’s authority varies. A report to the FTC can help law enforcement identify patterns, but it will not resolve your individual dispute. The FTC puts the distinction plainly: "The FTC doesn’t resolve individual complaints, but your report helps law enforcement detect patterns and might lead to an investigation."

Potential ways to recover money or finish the job

Discipline and compensation are separate tracks. A regulator may suspend a license without collecting your loss, while a court or bond process may require proof that a contract was breached. Compare the available paths before filing so that an early settlement or judgment does not eliminate another remedy.

Path Main purpose Typical questions to answer Money, timing and control
Licensing complaint Investigation, discipline or compliance action Does the agency regulate this trade and conduct? Is the matter pending or final? Restitution, filing deadlines and agency powers vary; the agency controls the investigation.
License-bond claim Payment from a bond posted for licensed contracting Is this contractor covered, is your loss an eligible claim, and must you obtain a judgment first? Limits, proof, deadlines and legal fees vary by jurisdiction and bond.
State recovery fund Limited compensation for qualifying homeowner losses Does the project, license type and claimant qualify? Must a bond or court action come first? Caps, exclusions and prerequisites are state-specific. Arizona’s Residential Contractors’ Recovery Fund, for example, lists conditions involving a residential or dual license and, in some cases, first pursuing the license bond.
Mediation or arbitration Resolve a contract dispute outside a trial Does the contract require it? Is the process voluntary or binding, and who pays the fee? Procedure, cost, enforceability and deadlines depend on the clause and local law.
Small-claims or civil court Seek a money judgment or other legal relief What court has jurisdiction, what evidence proves the loss, and what claim limit applies? Limits, filing fees, service rules, appeal rights and limitation periods vary. A judgment may still require collection.

Ask each program for its eligibility rules, maximum recovery, filing deadline, required notices and effect of accepting a settlement. Do not assume a neighboring state’s fund, cap or sequence applies to your project.

Prepare for a replacement contractor

Build a reliable handoff packet

  • Current contract, change orders and payment ledger.
  • Permit number, approved plans, inspection history and open corrections.
  • Dated photographs and video showing concealed-work locations before coverage.
  • Material invoices, model numbers, warranties and delivery records.
  • A punch list divided into safety, weatherproofing, code and finish items.
  • Contact details for the former contractor, designer, lender and inspectors.

Get comparable takeover proposals

Ask each candidate to inspect independently and state what can be verified, what must be opened, what work they will warrant and what they will not assume. Require proof of the license and insurance appropriate to the trade, a written scope, milestone payments and a change-order process. A low bid that ignores defective concealed work can cost more than a careful investigation.

Preserve claims while stabilizing

Tell the replacement contractor in writing that emergency stabilization is authorized but disputed conditions must be photographed and reported before alteration where reasonably possible. Keep invoices for temporary protection, drying, security and expert inspections. Those costs may be relevant to a later claim, but recoverability depends on your law and contract.

Organize a chronology that an agency or lawyer can use

Use one dated entry for each material event: contract signing, deposit, start date, inspections, changes, missed milestones, notices, discovery of defects, status check and communications after the license event. Attach the document that proves each entry and label opinions separately from observations. For example, “rain entered through the unsealed roof opening on 14 May; photo IMG_2041” is stronger than “the contractor abandoned the roof.”

Keep a running estimate of direct costs, but do not inflate it with unsupported future losses. Separate amounts paid to the original contractor, emergency mitigation, expert fees, permit charges and replacement work. Preserve emails in their original form and export message threads where possible.

Mistakes that can weaken your position

  • Calling a pending investigation a proven offense in public posts or messages.
  • Relying on an unverified license screenshot or a status from the wrong trade.
  • Covering defective work before photographs, inspections or expert documentation.
  • Withholding all money without reviewing contract notice, lien and financing provisions.
  • Signing a final waiver or release in exchange for keys or a quick partial refund.
  • Assuming a regulator, the FTC or a building department will collect your money for you.
  • Hiring a replacement contractor who starts demolition without recording existing conditions.

When to obtain legal help urgently

Seek local advice promptly if the amount at stake is substantial, a lien or foreclosure notice arrives, the contractor demands a release, a lender is involved, an insurer denies a claim, the project has structural or life-safety defects, or a filing deadline may be near. Bring the contract, license record, payment ledger, permit history, photographs and chronology so counsel can evaluate termination, notice, bond, fund, arbitration and court options together.

A practical decision checklist

  1. Confirm the official status, affected license and effective date.
  2. Make immediate hazards safe and notify the proper emergency or safety authority.
  3. Photograph and inventory the site before covering or changing work.
  4. Copy contracts, changes, payments, permits, inspections and communications.
  5. Ask the licensing board and building department for project-specific instructions.
  6. Review payment, termination, lien, financing and dispute-resolution clauses.
  7. Obtain local advice before withholding substantial funds, signing a release or authorizing major repairs.
  8. Compare bond, recovery-fund, mediation, arbitration and court requirements, including deadlines and caps.
  9. Use a written, documented handoff if another licensed contractor takes over.

The safest course is deliberate rather than automatic: verify the status, protect people and property, preserve proof, and choose a recovery or replacement path based on the rules where the project is located.
