If your contractor has stopped showing up or missed a key deadline, first make the site safe, document the project’s condition, and check your contract. Then send a concise written request for a plan and a response by a reasonable date. If direct resolution fails, contact your state or local consumer-protection office and consider the contract’s dispute process or legal advice. A delay alone does not establish fraud or automatically give you the right to end the contract, hire someone else, or recover a specific amount; those questions depend on your agreement and local law.

What to do first if the contractor has stopped showing up

Work through the immediate risks before deciding how to handle the contract. If unfinished work leaves the home open to weather, creates a fall or fire hazard, or affects plumbing, gas, electrical, or structural safety, arrange appropriate protection or a qualified inspection. For an immediate danger, contact the appropriate emergency service or licensed professional. Do not enter unsafe areas or attempt specialized repairs unless you are qualified to do so.

When it is safe, photograph or video the current condition before it changes. Keep receipts for temporary protection, inspections, or emergency work. Record what was done, what remains unfinished, and any damage or exposure you can see. These practical steps help you manage the property and preserve a factual record; they do not, by themselves, determine who is legally responsible for a cost.

Build a clear record of the project

  • Photos or video of completed work, unfinished areas, materials on site, and any condition that needs protection.
  • Texts, emails, call logs, letters, and notes of conversations. For a call, write down the date, who took part, and any promises or proposed dates.
  • A timeline of the agreed start and completion dates, milestones, missed appointments, work completed, notices sent, and responses received.

Keep the original documents and save copies in a place you can access if your phone or computer is unavailable. Separate confirmed facts from estimates or assumptions: for example, note that a visit was missed on a particular date rather than concluding that the contractor has permanently abandoned the job.

The FTC’s home-improvement guidance also recommends looking for contract details such as the contractor’s identity and license number, estimated start and completion dates, the work to be done, and labor and material costs. Contract requirements vary by state, so missing details may call for local advice rather than a one-size-fits-all conclusion.

Check the contract before taking consequential action

Read the agreement alongside your timeline and payment record. Look for:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Scope and milestones: What work was promised, and how does the contract define stages or completion?
  • Dates: Are start and completion dates estimates, firm deadlines, or tied to specific conditions?
  • Payment schedule: What payments are due, when, and for which work or materials?
  • Changes and delays: How must changes be approved, and does the agreement address delay causes or extensions?
  • Notice and termination: How must you give notice, and what steps does the contract require before either party ends it?
  • Warranty and dispute terms: Is there a warranty, mediation or arbitration clause, or another required dispute process?

Compare the terms with the work completed and the payments made. A missed estimated completion date does not automatically establish a right to terminate, hire a replacement, or deduct that replacement’s costs from what you owe. The effect of a date, required notice, and available remedies depends on the contract and applicable state or local law. Before making a consequential decision, ask the relevant consumer or licensing agency, a local attorney, or another qualified adviser about your situation.

Send one specific written request to resolve the problem

Make a clear, factual attempt to resolve the issue directly. Identify the project and agreement, list the unfinished work and missed milestones, and state what you need the contractor to address. Ask the contractor to confirm in writing whether and when they will resume, or to propose another way to resolve the issue. Set a reasonable date for a response based on the circumstances, but do not present that date as a legally required deadline unless the contract or local law makes it one.

Use the notice method required by your contract. If you have discussed the issue by phone, follow up in writing. The FTC recommends sending a letter by certified mail with a return receipt requested so you have evidence of delivery. Keep a copy of the letter and proof it was sent or received, along with any reply.

For example, a letter can use this structure:

  • Identify yourself, the contractor, the project address, and the contract date.
  • List the relevant missed date or milestone and the specific work that remains incomplete.
  • Refer to attached or previously exchanged records, such as dated photos, invoices, or a change order.
  • Ask for a written status and a proposed plan, including when work will resume or how the contractor proposes to resolve the issue.
  • Give a reasonable response date and use the notice method specified in the agreement.

Keep the wording neutral. Avoid threats or claims about fraud that you cannot establish; a contractor’s lateness or absence alone does not prove intentional deception. The FTC’s advice is: “First try to resolve it with the contractor. Many disputes can be resolved at this level.”

Handle payments carefully

Do not treat general consumer guidance as an automatic instruction to stop every payment or cancel the agreement. Check the payment schedule, completed work, approved changes, and any materials or other obligations specified in the contract. Before withholding a payment, making a final payment, or ending the contract, get advice that accounts for your agreement and local rules.

The FTC advises consumers not to pay the full project price up front and not to make final payment until the work is done and satisfactory. Its disaster-recovery guidance notes that some states limit down payments and recommends asking the state consumer-protection agency about local law. Those cautions are useful, but they do not establish a universal payment amount, a right to stop payment in every dispute, or a guaranteed refund.

If you are considering disputing a credit-card charge, contact the card issuer promptly and ask what rules and deadlines apply to that transaction. The outcome depends on the payment and circumstances; a dispute is not a guaranteed chargeback or resolution of the contract itself.

Escalate if the contractor does not respond or resolve the issue

If a direct written request does not produce a workable resolution, identify the local process that fits your problem. The FTC lists a state attorney general, local consumer-protection office, home builders association, and dispute-resolution programs as possible sources of help. Ask the relevant office whether it handles contractor complaints, licensing concerns, mediation referrals, or other local procedures. Keep your timeline and records available.

Route What it may offer What to check first
State or local consumer-protection office Information about complaint procedures, local protections, or dispute-resolution resources. Whether it handles contractor issues and what documents or deadlines apply in your location.
Contractor licensing authority A channel for asking about licensing requirements or filing a licensing complaint, where applicable. Whether the contractor is regulated, the authority’s complaint scope, and any local filing requirements.
Mediation A neutral person helps the parties try to reach an agreement; the mediator does not decide the dispute in the way an arbitrator does. Program rules, cost, participation requirements, and whether any proposed agreement becomes binding.
Arbitration An arbitrator or panel considers the dispute and makes a decision; arbitration may be binding. The contract clause and program rules, including whether the process is binding and what rights or procedures it affects.
Small claims court A court process for many financial disputes, subject to local rules and limits. Your state’s dollar limit, filing steps, deadlines, fees, and whether the issue fits that court’s jurisdiction.
Attorney advice Advice about claims, notices, contract obligations, and potential remedies for your facts. Costs, timing, and whether the lawyer handles construction or consumer-contract disputes in your area.

The FTC explains these general options in its guidance on resolving problems with a business. The appropriate route depends on the amount at stake, urgency, evidence, contract clauses, and local rules. Small-claims dollar limits vary by state; check with the local court rather than relying on a general figure.

Know what a report or cancellation right does—and does not—mean

If you suspect intentional fraud, you can report it to the FTC at ReportFraud.ftc.gov. A report can help authorities identify patterns, but submitting one does not itself decide your individual contract claim, recover money, or replace a local complaint or court process.

The FTC’s home-improvement guidance discusses a three-business-day cancellation right for qualifying contracts signed at home or away from the seller’s permanent place of business. It is conditional, not a universal cancellation period for every home-improvement contract. Eligibility and exceptions depend on current law and the circumstances of the sale; check the FTC’s guidance and obtain advice before relying on that rule.

Make the next decision based on urgency, evidence, and risk

Before choosing between continued negotiation, a complaint, mediation, arbitration, small claims, or legal advice, weigh the factors that can change the best route:

  • Evidence: Can you show what the agreement required, what was completed, what was paid, and what communications occurred?
  • Amount at stake: Does the likely financial dispute fit local small-claims limits, or is another process more appropriate?
  • Contract terms: Does the agreement require a particular notice method or dispute process, or specify payment and termination conditions?
  • Local requirements: Are there licensing rules, consumer procedures, or filing deadlines in your state or municipality?
  • Process consequences: Would arbitration be binding, and what time, cost, or participation requirements apply to another route?

For jurisdiction-specific answers, start with official state or local consumer-protection and contractor-licensing resources. General federal guidance can help organize your next steps, but it cannot determine the rights or deadlines in an individual construction contract.

Frequently Asked Questions

What should I do if my contractor stopped showing up?

First address any immediate safety or weather exposure with qualified help. Photograph the work when safe, keep receipts, and assemble your contract, payment records, messages, and a timeline of missed visits and unfinished work. Then send a concise written request for a status and proposed plan, using the notice method in your contract.

What if my contractor missed the completion date?

Check whether the date is an estimate, a firm deadline, or subject to extensions under the contract. A missed date alone does not automatically give you the right to terminate, hire a replacement, or recover a particular amount. Document the delay and ask for a written plan; consult local consumer or legal resources before consequential action.

Should I stop paying my contractor or hire someone else?

There is no universal rule that applies to every project. Review the payment schedule, completed work, change orders, notice terms, and local requirements before withholding payment or ending the agreement. The FTC advises against paying the full price up front and says to wait on final payment until work is done and satisfactory, but that is not a blanket instruction to stop every payment.

How can I tell a trustworthy contractor from a scammer?

No single warning sign proves fraud, and a delay alone is not proof of intentional deception. The FTC recommends checking whether the contract identifies the contractor and license number, estimated start and completion dates, the scope of work, and labor and material costs. It also advises against paying the full price up front. Verify applicable licensing and contract requirements with your state or local agency.

The Bottom Line

Prioritize safety, preserve a factual record, read the contract, and make one clear written attempt to resolve the problem. If that fails, use local consumer-protection, licensing, dispute-resolution, court, or legal resources that fit your agreement and situation. Payment, termination, and recovery rights depend on the contract and state or local law.
