building delays

What to do if your building project is delayed by a shortage of tradespeople

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If your builder says a shortage of tradespeople has delayed your build or renovation, do not rely on a verbal promise of “a few more weeks.” Ask for a written explanation and recovery schedule, compare it with your signed contract, preserve a dated record, and agree to any change only after its cost, quality, warranty and completion-date effects are documented. Continue only the payments the contract actually requires, and use your state or territory’s building-dispute process if the builder cannot provide a credible plan.

1. Get a precise explanation and a recovery schedule

Start with a calm written request. Ask the builder to identify exactly which trades are unavailable, which work packages are affected and how the shortage has changed the critical path. “We cannot get trades” is not enough information to assess your rights or decide whether a revised plan is reasonable.

As an Amazon Associate I earn from qualifying purchases.

  • The trades or subcontractors that are unavailable, and the dates they were expected on site.
  • Work already completed, work currently waiting and work that cannot start until the missing trade returns.
  • The original dates and the dates now proposed for each affected stage, practical completion and handover.
  • What the builder has done to recruit, substitute or resequence labor, and what further steps are planned.
  • The date of the next progress update and the person responsible for providing it.

Ask the builder to state whether the request is an extension of time under a particular contract clause. Keep the exchange factual: ask for dates, affected activities and mitigation steps rather than arguing about blame at the first contact. New South Wales guidance recommends asking the builder for the reasons for a delay and checking the contract; Victorian guidance says whether a delay is reasonable can depend on its cause and whether it could have been foreseen when the contract was signed. See NSW Government guidance on home building delays and Consumer Affairs Victoria’s disputes, defects and delays guidance.

  • the start date, contractual completion date and any separate handover or occupancy date;
  • extension-of-time events, including shortage, industrial disruption, weather, supply problems or events outside the builder’s control;
  • the notice method, evidence and deadline required for an extension claim;
  • owner-caused delay, variations, access obligations and changes to selections;
  • payment milestones, retention, progress-claim objections and interest on late payment; and
  • negotiation, mediation, regulator complaints, arbitration, court or tribunal procedures and termination.

A labor shortage does not produce the same result under every contract or legal system. A clause may require prompt notice, proof of the event and an estimate of its effect. If the builder missed those requirements, that may affect the extension claim, but the effect depends on the wording and applicable law. Ask the builder to submit a formal extension request in the contract’s required format rather than treating an informal text message as approval.

Keep the contract’s governing state or territory in view. Statutory protections, mandatory notices and dispute forums differ. Do not assume that an entitlement described for a project in one state applies to a project elsewhere.

3. Build a dated evidence file

Create one electronic folder and a simple chronology. Save the contract and plans, each programme version, extension notices, variation quotations, invoices, receipts, photographs, inspection reports and all messages. Record when work stopped or slowed, who was on site, what was incomplete and what the builder promised next.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

After a phone or site conversation, send a short email such as: “To confirm today’s discussion, you said the tiler is unavailable until 12 August, waterproofing is complete, and you will send a revised programme by 15 August.” Invite corrections. This turns an uncertain conversation into a contemporaneous record. Victorian consumer guidance specifically notes that written concerns create a record that can be used if a dispute is escalated; its advice is available at Consumer Affairs Victoria.

Photograph the current site from safe, permitted locations, with the date recorded. Do not enter scaffolding, partially demolished areas, locked zones or other unsafe parts simply to collect evidence. Keep copies outside the site office and preserve original files rather than editing them.

  • One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips

4. Test whether the programme can be recovered

Ask for a meeting focused on the remaining critical path. A credible recovery plan should show dependencies, not just a new final date. For example, it might show that electrical rough-in can proceed in one completed wing while a different crew waits for plasterboard, or that external works can continue while an internal trade is unavailable.

Resequencing

Ask whether unaffected work can be brought forward: excavation, cabinetry measurement, external drainage, painting in completed rooms, or documentation and inspections. Resequencing can reduce idle time, but it should not create rework or conceal unfinished work. Require the revised sequence, responsible trade and date for each activity in writing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Additional or replacement trades

The builder may be able to engage another qualified subcontractor. Ask how that person’s licence, insurance, supervision, workmanship warranty and familiarity with the specification will be checked. You should not have to choose an unqualified substitute merely to recover time. Clarify who remains responsible for defects and coordination.

Substitute materials or scope changes

A different product may be available sooner, but a substitution can affect appearance, performance, approvals, maintenance and warranty. Obtain a written comparison that states the proposed product, compliance evidence, finish, lead time, price adjustment and warranty treatment. NSW and Western Australia guidance identify alternatives as possible ways to reduce delay while warning that changes can affect cost or quality. Sources are the NSW delay guide and Western Australia’s Dealing with building challenges guide (October 2025).

Do not approve a verbal substitution. Sign a variation only when it states the revised specification, price (including tax), extension or saving in time, effect on other trades and any change to warranty or maintenance obligations.

5. Compare the three practical paths

Once you have the facts, most owners are choosing among an agreed extension, a negotiated change, or a formal dispute. Use the contract’s notice procedure for whichever path you choose.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Path When it may fit Potential benefit Risks and checks
Accept a documented extension The shortage is supported by evidence, the notice is contract-compliant and the revised programme is credible. Preserves cooperation and gives both sides a clear completion target. Check the number of days, interim milestones, accommodation cost and whether further extensions remain possible.
Agree to resequencing or a substitute A qualified alternative can complete the same work without unacceptable specification or warranty changes. May save time without ending the contract. Record price, finish, performance, approvals, warranty, responsibility for defects and the exact time saving.
Dispute the extension or performance The explanation is unsupported, notices are missing, progress is inadequate or the revised date is not credible. Creates a formal route to seek assistance, directions or compensation where available. Processes take time and can increase cost; obtain local advice before withholding money or terminating.

Assess each path against five questions: how much time is realistically saved; what extra cost is imposed; whether the agreed specification, quality or warranty changes; what evidence supports the builder’s position; and what notices and dispute steps the contract requires.

6. Protect cash flow and account for the delay

Pay only what the contract makes due

Continue payments that are properly due at the specified milestones and for completed work. Do not make an extra payment simply to persuade a builder to return, and do not stop a due payment as a negotiating tactic without checking the contract and obtaining local advice. NSW guidance tells owners to make agreed progress payments after the relevant work is completed and warns that missed payments can lead to recovery action. That is NSW-specific guidance, not a universal rule.

Check every claim against the milestone, site evidence, approved variations and amounts already paid. If you dispute a claim, state the amount and reason in writing and follow the contract’s objection process. Keep a ledger of claims, payments, credits and disputed sums.

Budget for practical consequences

A later handover can mean extra rent, storage, short-term accommodation, school or commuting costs, and rescheduling of movers or utility connections. Ask the builder to identify a realistic handover range rather than a single optimistic date. Review insurance and any accommodation or delay provisions, but do not assume they cover a trades shortage. Western Australia guidance also recommends planning accommodation and setting realistic schedule and budget expectations.

7. Know what a shortage does—and does not—establish

A builder may be entitled to additional time where the contract and local law cover an unforeseeable event outside the builder’s control and the required notice and mitigation steps have been met. A shortage is not automatically an excuse for every missed date, and it does not automatically give the builder a right to raise the price, suspend all work or change the specification. The contract, evidence, foreseeability and statutory rules must be considered together.

Price changes are especially sensitive. NSW guidance says most contracts do not permit a price change without a variation and identifies additional restrictions for contracts over $20,000 unless an applicable clause exists. Verify the current law and the wording of your own contract before accepting any increase. A builder cannot turn a delay notice into an open-ended price adjustment without a valid contractual or statutory basis.

Termination is also not an immediate remedy. A notice that is defective, premature or served without the required opportunity to remedy can expose you to a claim for breach. Obtain independent legal advice before terminating, engaging another builder, or withholding a payment that the contract says is due.

8. Jurisdiction-specific signposts

New South Wales

The NSW Government identifies shortages of skilled workers and materials among causes of home-building delays. Its advice is to discuss timing and flexibility, ask for the reason in advance, check the contract before accepting an extension, consider alternatives with their cost and quality effects, keep accommodation options in view and pay agreed progress claims after completed work. If discussions fail, the guidance directs owners to Building Commission NSW and explains that termination is available only in limited circumstances. Start with Home building delays in NSW.

Victoria

Victorian contracts can have specified start-date information and statutory rules about delay allowances. The Building and Plumbing Commission says that a material or skilled-labor shortage that was not foreseeable when the contract was signed would generally not be treated as a breach, but that assessment is fact-specific and Victoria-specific. Its explanation of start dates and delays is at Building and Plumbing Commission Victoria.

Consumer Affairs Victoria describes dispute assistance through the Building and Plumbing Commission’s process and possible VCAT recourse after conciliation in eligible matters. It also describes a statutory termination route with conditions including a 1.5-times construction-period threshold and signed notice. Those conditions are not a general termination right outside Victoria; read the current Victorian guidance and obtain advice before acting.

Western Australia

Western Australia’s October 2025 government guide discusses skilled-worker shortages, regular contact, alternatives, realistic schedules and accommodation planning. It also describes home indemnity insurance for qualifying residential contracts above $20,000. Thresholds, cover and triggers are jurisdiction- and date-specific, so check the policy and current rules rather than assuming that a delay claim is insured. The guide is available at Dealing with building challenges.

9. Escalate in a controlled sequence

  1. Send a formal complaint. Set out the dates, missing information, contractual issue and outcome sought. Attach the relevant programme and correspondence, and give a reasonable written deadline for a response.
  2. Request a contract-compliant extension decision. Ask the builder to confirm the number of days claimed, the clause relied on, mitigation undertaken and revised milestones.
  3. Use the local regulator or dispute service. Submit the chronology, contract, notices, photographs, payment ledger and your attempted resolution. Follow the authority’s evidence and pre-action requirements.
  4. Get independent advice for high-stakes decisions. A construction solicitor, qualified building consultant or local consumer adviser can assess termination, damages, payment disputes and evidence. Choose advice governed by the law applying to the project.

Keep communicating while the process runs if it is safe and productive. A regulator’s process does not necessarily stop the contractual timetable, payment obligations or site-security responsibilities, so continue recording events and complying with valid notices unless advised otherwise.

Delay-response checklist

  • Written explanation naming affected trades, activities and dates.
  • Revised programme showing critical-path impact and next update date.
  • Contract clause and notice requirements identified.
  • Dated file containing plans, schedules, notices, messages, claims, receipts and photographs.
  • Written comparison of resequencing, replacement trades or substitute products.
  • Variation signed only after price, quality, warranty and time effects are clear.
  • Payments matched to completed contractual milestones.
  • Accommodation, storage, rent and other knock-on costs planned.
  • Formal complaint and local dispute route ready if the builder’s plan fails.
  • Independent advice obtained before termination or withholding a due payment.

When the revised plan is credible

Accepting extra time can be sensible when the cause is documented, the contract permits the extension, the builder is actively mitigating and the new milestones are measurable. If those elements are missing, insist on the contractual process and escalate rather than allowing informal promises to consume more weeks. Your objective is not simply a new completion date: it is a recoverable programme, controlled changes, an auditable payment record and a clear route to help if performance does not improve.
