Otherwise, document what you can see without disturbing it, notify the landlord, owner, manager or building representative in writing, and ask the local building or housing authority how to arrange an inspection and check permit records. Whether work is defective or unauthorized is a legal and technical determination for the responsible authority, not something a resident should settle by dismantling finishes or confronting a contractor.
1. Decide whether the condition is an immediate danger
Safety comes before proving who is responsible. Leave the affected area if you see active structural movement, a sagging or falling ceiling, sparking or exposed wiring, a gas smell, a blocked fire exit, missing fire separation, active flooding near electricity, or construction work that appears capable of injuring occupants. Contact emergency services for a credible threat to life, the gas or electricity utility for a suspected utility emergency, or the local emergency authority that handles the hazard.

Do not touch live electrical components, enter an unstable area, remove ceilings or walls, test concealed wiring, operate questionable equipment, or ask an unqualified person to make a temporary repair. If construction is underway and appears dangerous, report it through the urgent channel used by your local authority. Los Angeles Housing Department guidance, for example, treats illegal construction in progress as an urgent complaint; that classification applies in Los Angeles and should not be assumed elsewhere.
After moving to safety, tell the building manager or owner what happened and ask that the area be secured. A housing or building authority may also need to know, particularly where other apartments or a shared escape route are affected.

2. Preserve evidence without changing the condition
Good records help an owner, inspector or tribunal understand what happened and when. Make the record before cleaning, covering or repairing the condition unless doing so is necessary to prevent immediate harm.
- Photograph the setting. Take wide images showing the room, wall, ceiling, corridor or exterior location, then take close images of cracks, stains, gaps, detached materials, damaged sockets, altered doors or other details.
- Record date and time. Keep the original files and note when each image or video was made. NSW Fair Trading identifies detailed, time-stamped photographs as useful evidence that can reduce disputes.
- Describe observations, not conclusions. Write where the issue is, when you first noticed it, whether it is getting worse, and what you heard or saw. “Water is entering below the bedroom window after rain” is more useful than asserting a particular code violation.
- Keep a running log. Record calls, emails, visits, notices, missed appointments, temporary measures and any change in the condition.
- Collect related documents. Save the lease or ownership records, move-in condition report, building notices, renovation schedules, contractor communications, inspection reports and replies from the owner or manager in one dated folder.
- Do not create new damage. Do not drill, open a wall, pull down a ceiling, disconnect a device or repair suspected unsafe work merely to obtain proof.
NSW Fair Trading says condition reports capture a property’s general condition and recommends recording visible electrical hazards such as loose wiring or damaged sockets. Some electrical problems may qualify as urgent repairs under NSW rules, but the exact treatment depends on local law.
3. Give the responsible party written notice
Send a factual report to the landlord, property manager, owner, condominium or strata representative, or other building contact identified in your agreement. Use a channel that preserves the message and delivery record. Attach representative photographs and request an inspection, protection of the area and a written response.

Identify the apartment and precise location, state what is observable, explain the effect on safety or use, and say when it was noticed. Ask who will attend, when access is needed, and what interim safety steps occupants should follow. Avoid accusing a named person of illegal conduct when you have not verified the permit or rule.
Subject: Request for inspection of apartment condition
Your message can then state the location, the date first observed, the visible symptoms, attached photographs, any immediate risk, and the response you seek. Keep a copy of the complete message and proof of delivery. NYC Housing Preservation and Development advises tenants to notify the owner or manager and retain written records. British Columbia’s repair process likewise calls for written requests and tells tenants to keep a copy; these are examples of sound documentation, not a universal notice formula.
4. Find out whether a change was approved
A renovation can look unusual without being unlawful, while concealed work can be dangerous without being visible. Residents generally cannot determine legality from appearance alone. Ask the local building department, permit office or housing/code enforcement body:

- Which agency handles the type of work or defect?
- Whether permits, approvals or inspection records can be searched for the address or unit.
- Whether an inspection can be requested and what evidence or access it requires.
- Whether the issue belongs to rental-housing enforcement, building safety, fire enforcement, utilities or another office.
Describe facts such as a newly removed wall, relocated plumbing, an altered fire door or active construction. Let the authority decide whether a permit was required, whether work complied with approved plans and whether a violation exists. Permit records may not prove that every part of a renovation is safe, and the absence of a record may require confirmation from the local office rather than an assumption of illegality.

Search the official website for your city or county building department, housing or code-enforcement office, fire authority and tenant regulator. If you are unsure, call the general municipal line and ask for routing. NYC HPD describes 311 as a route that directs reports to the appropriate agency. Los Angeles distinguishes housing complaints from some building-safety matters and directs issues outside its Housing Code to the Department of Building and Safety.
| Situation | Likely first contact | Information to provide |
|---|---|---|
| Immediate threat, dangerous work or blocked exit | Emergency service, utility or urgent local complaint channel | Exact address, hazard, whether anyone is at risk, and whether work is occurring now |
| Rental habitability or neglected repair | Landlord or manager, then housing/code-enforcement authority | Written notice, dates, photographs, access attempts and effect on use or safety |
| Unpermitted alteration or structural concern | Building or permit department | Observable alteration, location, work dates and any permit information found |
| Fire separation, alarm, exit or common fire system | Fire authority and building manager | Blocked or missing protection, affected floors and whether occupants remain exposed |
| Shared roof, façade, structure, plumbing or electrical service | Owner or manager plus condominium, strata or owners’ corporation | Common-area location, unit impact, photographs and prior notices |
An agency may inspect, issue a notice, refer the matter or explain that another office has authority. Keep the complaint number and every response.

6. Handle common-property defects differently
Problems involving a roof, façade, load-bearing structure, shared plumbing or electrical service, fire doors, corridors, lifts or other common systems often require action by the building owner and the condominium, strata or owners’ corporation as well as a public authority. Report the issue to each relevant representative and ask who is arranging the inspection. Do not assume that the individual contractor who performed work is the correct person for you to pursue.
Building Commission NSW illustrates why ownership structure matters. Its process for certain regulated apartment buildings concerns serious defects in common property and requires a Class 2 building complaint from an authorized owners’ corporation representative. The listed categories include waterproofing, fire-safety systems, building enclosures, structural elements and electrical, lift, hydraulic and mechanical services. Eligibility, building classifications, evidence requirements and any warranty periods belong to that NSW scheme and are not general rules for other places.
7. Escalate when the response is inadequate
Maintain a timeline from your first notice through every inspection and proposed repair. If the responsible party ignores the issue, delays without explanation or performs an inadequate fix, ask the local housing authority or tenant regulator about an inspection, formal notice, dispute-resolution process or legal referral. A tenant-support organization or local legal-aid service can explain deadlines and procedural safeguards.

Repair costs and rent
Do not withhold rent, deduct repair costs, hire a contractor and seek reimbursement, or move out solely because an online guide suggests it. Rules differ by jurisdiction and by the seriousness of the condition. British Columbia guidance allows a tenant to seek dispute resolution when a health, safety or usability repair has not been addressed within a reasonable time, but its emergency-repair procedure requires specified steps. It also warns that an improper deduction can become a rent dispute.
England’s habitability remedy
Government guidance on the Homes (Fitness for Human Habitation) Act 2018 says landlords in the private and social rented sectors must keep covered homes, including relevant common parts, fit for human habitation. A qualifying tenant may seek a court order for remedial action and/or damages. Coverage, exceptions and occupancy arrangements matter, so this England-specific remedy does not establish rights in another country or region.
8. Choose the next step by risk, location and status
| Question | If the answer is yes | Practical route |
|---|---|---|
| Could someone be injured now? | Prioritize evacuation and emergency or utility contact. | Secure the area, then notify the manager and urgent local authority. |
| Is the condition inside your unit and are you renting? | Your lease and rental-housing rules govern notice and remedies. | Give written notice, preserve records and contact the tenant regulator if unresolved. |
| Is it in a shared structure or service? | More than one unit may be affected. | Notify owner, manager and condominium, strata or owners’ corporation. |
| Is work still underway? | Evidence and safety conditions may change quickly. | Use the local urgent construction or inspection channel and do not confront workers. |
| Is a permit question central? | Housing enforcement may not control construction approvals. | Ask the building or permit department to check records and jurisdiction. |
| Are you considering a legal or financial remedy? | Deadlines and protections can apply. | Obtain local legal or tenant advice before withholding rent, deducting costs or ending occupancy. |
9. Common mistakes to avoid
- Waiting for a visible collapse instead of reporting progressive movement, water intrusion or exposed wiring.
- Calling a condition “illegal” before checking the local permit and code process.
- Relying on a verbal promise and losing the date, scope or identity of the person who made it.
- Removing finishes or cleaning away evidence before an inspection.
- Entering a restricted work area or touching electrical, gas or structural components.
- Sending the complaint only to an individual contractor when the owner or building body controls access and repairs.
- Assuming a housing department handles every construction, fire or structural issue.
- Applying a repair deadline, rent remedy or retaliation rule from another jurisdiction.
10. What a complete resolution should include
A satisfactory response should identify the responsible party, document the inspection findings, explain whether permits or approvals were checked, and state what will be repaired, secured or monitored. For a shared defect, it should also explain how residents will be protected while work continues and who will coordinate access. Keep the final reports, invoices, photographs and notices with your original log. If the condition remains unsafe or the promised action does not occur, return to the local authority or dispute-resolution route with the complete timeline rather than starting over with an undocumented complaint.
