If road construction blocks your driveway or the only route to your home, do not move barricades or enter the work zone. Identify the road authority and on-site project manager, explain exactly how access is affected, and request a safe temporary access plan and written schedule. If emergency vehicles cannot reach the property, notify the project authority and local emergency services immediately; for an actual emergency, call your local emergency number and describe the restriction.
Notice periods, access rights and complaint procedures depend on the country, state or local authority, project documents and type of work. The examples below show how requirements can differ; they are not a universal rule.

1. Find who controls the work
Start with the construction notice, roadside sign, letter delivered to residents or the public works and transportation department’s project page. Look for the project number, contractor, road authority and a telephone or email contact. Ask specifically for the on-site foreman, superintendent or project manager, rather than relying only on a general switchboard.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsRecord the name, role, phone number and email of everyone you contact. The contractor may control daily staging, while the public agency controls the contract, traffic plan and formal complaint route. Knowing both contacts prevents your request from being passed back and forth.

Describe the access problem in operational terms
Give facts the project team can act on:
- Whether vehicles can enter, leave or turn around.
- Whether pedestrians can reach the home safely.
- Whether this is the property’s only access or one of several driveways.
- Which deliveries, carers, visitors, waste collection or utility services are affected.
- Whether a fire engine, ambulance or other emergency vehicle could reach the address.
- Any household mobility requirement that makes a proposed route unusable.
“The road is inconvenient” produces a different response from “the only driveway is excavated, a resident cannot walk the proposed detour, and a fire vehicle has no clear route.” Include the dates and hours when the restriction is expected to occur.
2. Request a written temporary access plan
Ask the project manager to confirm, in writing, when access will be restricted, how long each closure will last and when normal access will return. Request a plan that addresses vehicles, pedestrians, deliveries, service workers and emergency responders separately. Ask who will notify residents if the schedule changes and how much warning you will receive.
Questions your request should answer
- Can residents enter and leave by vehicle, and during which hours?
- If vehicles cannot use the driveway, where is approved off-site parking and how will residents reach the home?
- Is there a continuous pedestrian route with a stable, reasonably level surface and adequate separation from equipment?
- Can delivery, waste, utility, care and maintenance vehicles reach the property, and by what route?
- How will fire and ambulance access be maintained?
- Who is responsible for installing, inspecting and removing any temporary ramps, plates, walkways or signs?
- What is the contact method for an urgent change or an unexpectedly blocked route?
Texas Department of Transportation guidance provides a useful example of the options to discuss. Its Roadway Design Manual says that where maintaining access is extremely problematic, the contractor should coordinate an agreed written plan covering “offsite parking, pedestrian access, service and fire vehicle access, or total temporary access denial.” That guidance applies to Texas roadway design; it is not automatically a requirement where you live. Read the source at TxDOT’s Property Access Requirements.
Do not create your own route
Never move a barricade, drive over an excavation, walk through an active work zone or ask a worker to make an informal exception. Construction plant, open trenches and temporary surfaces can change without warning. Ask the project team to open or supervise any crossing and to provide a route that is part of its approved traffic-control arrangement.
3. Protect emergency and essential access first
Tell the authority immediately if an ambulance, fire appliance or police vehicle could not reach the address. Provide the exact property number, nearest intersection and the location of the closure. Ask the project manager how emergency responders will be alerted and where the emergency access lane will be kept clear.

For an actual emergency, call the local emergency number. State that road works block or restrict the normal approach, describe the safest available entrance and follow the dispatcher’s instructions. Do not delay an emergency call while trying to negotiate with the contractor.
Also identify time-critical non-emergency needs, such as home-care visits, oxygen deliveries or a scheduled medical transport. These do not replace emergency arrangements, but they can determine whether the proposed pedestrian or parking solution is workable.
4. Keep a dated record and evidence
Save every letter, leaflet, email, text message and screenshot of the project page. Maintain a simple log with the date, time, person contacted, what was promised and whether it happened. Photograph the closure, signs and available route from a safe public location; do not photograph from inside an exclusion zone.
Record each period when the driveway was inaccessible, including whether the restriction was total or limited to particular hours. Note additional facts that explain the impact, such as a missed delivery, an uncompleted care visit or an emergency route that was not clear. Keep receipts for reasonable, directly related costs if local law or the project contract might address them, but do not assume reimbursement is available.
Ask the authority for its written complaint, escalation or dispute-review process when the agreed plan is not followed. A clear chronology is more useful than repeated informal calls.

5. Escalate when the plan is unsafe or not followed
First escalation: project management
Send a concise email to the project manager and the road authority’s named contact. Describe the specific failure, attach the relevant photograph or prior written promise, and state the remedy needed: for example, a continuous pedestrian route, a clear fire lane or a confirmed reopening time. Request a response by a practical deadline, taking account of the urgency.
Second escalation: the authority’s formal route
If the project manager does not resolve the problem, use the agency’s published customer-service, complaint, construction-inspection or contract-administration route. Include the project number, address, dates, names, photographs and copies of previous correspondence. Ask which official is responsible for approving a change to the traffic-control plan.
Urgent escalation
Use the urgent contact immediately—not the ordinary queue—when emergency access is blocked, a trench or barrier creates an immediate danger, or the promised route has disappeared. Notify emergency services of the current restriction as well.
6. Understand why legal rights differ
There is no single nationwide notice period or access rule established by the sources for every road project. The Federal Highway Administration’s Access Management (Driveways) briefing sheet (FHWA-SA-14-080) explains that the U.S. Supreme Court held states should determine the access rights of abutting owners under their own laws, rather than federal law. Read the briefing at FHWA’s Access Management (Driveways).
In practice, the controlling material may include state or local statutes, highway-approach permits, municipal codes, the project’s special provisions, traffic-control plans and construction notices. A driveway closure during short-term paving may be governed differently from a permanent change to a highway approach. Check the actual project documents and ask the road authority which rule applies before asserting that a particular number of hours’ notice is legally required.

Examples of different project terms
| Location and document | Access or notice language | How to use the example |
|---|---|---|
| New York, NYSDOT standard sheet dated January 1, 2024 | Owners whose driveways will become inaccessible are to be notified at least 24 hours before the restriction. Where a property has multiple access points, at least one driveway is to remain open; access should be restored as soon as possible, with suitable ramps for smooth transitions. | This is language in a New York project-standard document, not a general rule for other states or countries. See the NYSDOT standard-sheet PDF. |
| Wisconsin, WisDOT 2026 project proposal | The proposal calls for maintaining resident and emergency-vehicle access, minimizing driveway closures and giving at least 48 hours’ notice for required temporary access closures. | These terms apply to that project document and should not be presented as a statewide or national entitlement. See the WisDOT project proposal. |
| Oregon, ODOT access-management process | For certain final decisions affecting highway approaches, ODOT describes owner notification and possible routes such as collaborative discussion, dispute review or an administrative hearing. | Whether those steps apply depends on the decision and the ODOT process. Details are at ODOT PD03: Access Management in the Project Delivery Process. |
| England, Department for Transport street-works guidance | The department publishes separate statutory guidance for coordinating street works; the updated code applies from April 10, 2026. | England’s procedure illustrates why country-specific guidance matters. See Co-ordinating street works. |
7. Evaluate any proposed alternative route
A proposal is not adequate merely because it technically lets someone pass. Compare the details before agreeing:
- Vehicle access: Can the household’s vehicles enter, leave and turn without crossing unsafe ground?
- Pedestrian access: Is the route continuous, separated from traffic and usable in the expected weather and lighting?
- Dates and hours: Are closures limited to the stated windows, and is there a process for schedule changes?
- Household needs: Can children, older people, wheelchair users or anyone with limited mobility use it safely?
- Services and deliveries: Can carers, couriers, waste collectors and utility workers reach the property?
- Emergency vehicles: Is the route wide, strong and clear enough for the responders who may need it?
- Responsibility: Which named person will inspect the route and correct a problem?
- Communication: How will residents receive notice before each new phase?
Ask for a sketch or marked-up plan when the route is complicated. Written dimensions, opening times and responsible contacts reduce misunderstandings that a verbal assurance may leave unresolved.
8. If construction blocks the only road to your home
Say explicitly that the road is the only access, not simply the most convenient one. Ask whether work can be staged so residents retain vehicle access, even if that requires shorter work sections or temporary surfaces. If that is impossible, request a documented combination of approved parking, a pedestrian route, service access and fire access, with a named person responsible for each element.
Confirm how residents will move vehicles before each closure. Ask where vehicles may be parked legally, how far the walk is, whether the route remains open overnight and what happens to visitors or deliveries. If the authority proposes a total temporary denial of access, request its start and end times, emergency procedure, alternative arrangements and the decision-maker’s written approval.

Consider speaking with a qualified local property-rights or municipal-law attorney if agency escalation fails, access remains seriously impaired, a permanent approach is being changed, or the project documents appear to conflict with the authority’s actions. The applicable law depends on the jurisdiction and property history, so a local professional needs the notices, deed or access instruments, project plans and your dated log.

General information cannot determine whether you are entitled to damages, a particular notice period, an injunction or a permanent access route. Do not rely on the New York 24-hour example, Wisconsin 48-hour example or any other project term without confirming that it governs your property.
