If rail construction cuts off your driveway or access road, document the obstruction, contact both the rail project and the public-road authority, and ask for a safe, lawful access plan in writing. Do not drive or walk across railroad property or tracks outside a designated crossing. Whether you can demand a temporary route, restoration, damages, or compensation depends on who owns the affected segment, the project approvals, state and local law, and the deed, easement, or crossing agreement governing your property.
Take these steps first
- Record the condition safely. Photograph the blockage from a lawful location, including the date and time. Save project notices, warning signs, contractor information, letters, texts, and emails. Start a log showing each period when access was unavailable and the practical consequences, such as missed deliveries, inability to reach a home, or delayed work.
- Contact the rail project in writing. Use the public-information contact on the project sign or notice, or contact the project owner, sponsor, or railroad representative. Ask for the planned closure dates, the person coordinating property access, the approved route to your property, and whether a temporary driveway or alternate route will be provided. State clearly if residents, fire trucks, ambulances, utility crews, or other emergency vehicles cannot reach the property.
- Contact the road authority separately. If a city, county, or state road is closed or traffic is being diverted, call the agency that controls that road and ask for the closure authorization, permit, detour plan, and project manager. A railroad may control work inside its right-of-way while a transportation agency controls the public road and detour.
- Report an emergency-access problem immediately. Call local emergency services and the relevant project or road authority if responders cannot reach the property. Explain the exact location, the obstruction, and any urgent medical, fire, or life-safety concern. There is no single nationwide emergency-access procedure identified for these situations, so use the local emergency-services channel.
- Do not create your own crossing. Never enter railroad property, walk along the tracks, move barricades, or use an informal crossing. The Federal Railroad Administration (FRA) states: “It is illegal to access private railroad property anywhere other than a designated pedestrian or roadway crossing.”
- Collect the governing documents. Find your deed, title report, recorded easements, driveway or crossing agreements, permits, construction notices, and any temporary-access or compensation documents. Keep copies with your access log.
Why the exact type of blockage matters
“The railroad blocked my driveway” can describe legally different events. Identify which situation you have before assuming what the project must do.

A public-road work-zone closure
A contractor may be working at a grade crossing or along a public road that connects your driveway to the wider road network. The public-road agency may control the closure, detour, and traffic-control permits even if the railroad is performing the work.

A temporary obstruction on private property
Construction equipment, materials, fencing, or excavation may temporarily block a privately owned driveway or access road. The project’s contract, access permission, easement, or other written instrument may specify notice, working hours, temporary access, restoration, or damage procedures.

Work inside a railroad right-of-way
If your route crosses or uses railroad property, the railroad may require a permit, easement, or crossing agreement. The Minnesota Department of Transportation explains that railroad projects require early coordination and that entry onto railroad property requires at least a railroad permit or easement. See MnDOT’s railroad process guidance.
An easement or recorded crossing being affected
Your access may be written into a deed, recorded easement, title document, or crossing agreement. The language may define the location, width, users, maintenance duties, gates, notice requirements, or conditions for temporary closure. A title record can matter more than a verbal assurance from a field crew.
A permanent change or removal
Closing a route for a few days is different from removing a crossing, relocating a driveway, or permanently eliminating the only practical route to a residence or business. A permanent change can raise separate property, access, permitting, and potential taking issues that require a local legal review.
Identify who controls each part of the route
Do not assume one call reaches everyone responsible. Map the route from your property to a public road and identify the owner or controlling agency for each segment.
| Person or agency | Questions to ask | What to request in writing |
|---|---|---|
| Railroad or rail-project representative | Who is coordinating property access? What work is occurring, and when will the obstruction end? | Closure schedule, safe route, site contact, temporary-access plan, and restoration commitment. |
| Project owner or public sponsor | Which contract, permit, or project instrument governs access and detours? | Project manager’s name, approved plans affecting your route, and escalation procedure. |
| City or county road department | Who authorized the road closure or detour, and which road remains open? | Closure authorization, traffic-control plan, detour map, and permit information. |
| State department of transportation | Is the route a state road or interstate, and what permit controls the closure? | Permit number, project contact, and approved detour or reopening date. |
| Emergency services | How will fire, ambulance, and police reach the property during the closure? | Instructions for responders and confirmation that the project authority knows the emergency-access limitation. |
For example, the Indiana Department of Transportation says a permit is required when railroad work closes or diverts traffic on a state road or interstate. Its permit information is available at INDOT’s permits page. That is an Indiana procedure, not a nationwide rule for every road.

Read the documents before arguing about rights
Gather the records and look for the words that define access: “ingress and egress,” “access road,” “crossing,” “temporary easement,” “right of entry,” “closure,” “detour,” “restoration,” “notice,” and “maintenance.” Compare the legal description and map with the route that is actually blocked.
- Deed and title report: May identify an easement benefiting your parcel or restrictions affecting the route.
- Recorded access or crossing easement: May establish who may use the route and what changes are permitted.
- Railroad crossing agreement: May address gates, permits, maintenance, insurance, notice, and closure conditions.
- Temporary easement or construction agreement: May authorize work while reserving temporary access or requiring restoration.
- Project permits and right-of-entry documents: May show what the railroad, sponsor, or transportation agency promised to do.
- Notices and plans: May establish the authorized work period and the planned detour.
State and agency examples show why the wording matters. The Texas Department of Transportation explains that particular work in railroad right-of-way, including widening a roadway over an at-grade crossing, requires a railroad Right of Entry Agreement. Read its Right of Entry Process guidance. Caltrans’ Right of Way Manual (July 2024) includes examples of clauses reserving temporary access and a temporary railroad detour easement. Those examples demonstrate how access terms can be documented; they do not create an automatic entitlement for every property owner.
The FRA’s Compilation of State Laws, 7th Edition contains state-specific crossing provisions and was published in 2021. Use it as a starting reference only, then verify the current law and local rules that apply to your property.
Stay on lawful, safe routes
Do not cross the tracks, climb around a train, use a construction opening, or follow a contractor vehicle through a restricted area. The FRA says trespassing is the leading cause of rail-related deaths in the United States and reports more than 500 trespass fatalities each year on its Trespass Prevention page. The only acceptable route is one authorized by the responsible owner or agency and open to the type of user involved.
If a proposed detour uses a private lane, an agricultural field, a neighboring parcel, or a road with weight or gate restrictions, obtain permission and confirm that emergency vehicles can use it. A route that is physically possible may still be unauthorized or unsafe.

Make a written access request that can be answered
Send one concise email or letter to the rail contact and copy the project sponsor and road authority. Include your address, parcel or driveway location, photographs, the date access was lost, and the practical effect. Ask for specific decisions rather than a general promise to “look into it.”
- What is the authorized start and finish date for the obstruction?
- Who is the on-site access coordinator and after-hours contact?
- What safe route may residents, deliveries, utilities, and emergency responders use?
- Will the project provide a temporary driveway, a posted detour, or an adjusted work sequence?
- What notice will be given before the route changes again?
- Who will restore the driveway or road, and how will damage be documented?
Request an urgent response when the property is completely inaccessible, a resident has a medical need, livestock or essential utilities are affected, or emergency vehicles cannot enter. Keep the message factual and set a reasonable response deadline without claiming a legal remedy you have not confirmed.
Possible routes forward
The available solution depends on control, duration, documents, safety, and urgency. Raise these options with the responsible parties; none is guaranteed solely because construction is inconvenient.
| Option to discuss | When it may fit | Questions to resolve |
|---|---|---|
| Temporary access route | The normal driveway is blocked but a safe connection can be built or opened. | Who authorizes it, who maintains it, what vehicles can use it, and when it closes. |
| Adjusted work sequence | Work can be staged so one lane or route remains available. | Whether the contractor can change sequencing without creating a safety or permit conflict. |
| Posted public detour | A public road closure prevents normal travel. | Whether signs, barriers, lighting, drainage, and emergency access are adequate. |
| Restoration after work | The route will be disturbed temporarily and then reopened. | Restoration standard, inspection process, timing, and responsibility for damage. |
| Formal document review | The project threatens a permanent change or conflicts with a recorded right. | Which instrument governs, whether notice was required, and what dispute process applies. |
Keep evidence that proves duration and impact
A clear chronology is more useful than a collection of angry messages. For every closure, record the date and time, the exact location, the barrier or excavation, who you contacted, what was promised, and whether the route reopened. Keep receipts and records for measurable effects such as hired transport, spoiled materials, missed appointments, or business interruption. Do not enter a dangerous area to obtain a better photograph.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. When to involve a property attorney
Ask a local real-estate, property, or eminent-domain attorney to review the documents when access may be permanently lost, a recorded easement is disputed, the project enters your land without clear authority, the only practical route is blocked, substantial damage occurs, or the railroad or agency refuses to identify its legal basis. Give the attorney the deed, title report, easements, crossing agreements, notices, permits, photographs, correspondence, and access log.

An attorney can help identify the controlling law, interpret an access instrument, preserve evidence, communicate with the project, and evaluate available administrative or court procedures. The correct remedy may depend on state law, the project’s public purpose, the language of the recorded documents, and whether the interference is temporary or permanent.
Compensation is not automatic
There is no nationwide rule shown here that every blocked driveway produces a payment, a fixed amount, or a guaranteed deadline. Compensation may depend on a negotiated construction agreement, documented property damage, an easement or permit, condemnation or eminent-domain procedures, or another state-law remedy. A temporary inconvenience, a public-road detour, and a permanent taking are not legally interchangeable. Do not sign a release or accept a payment labeled “full settlement” until you understand what rights it covers.
Practical playbooks for common situations
Your private driveway is blocked for several days
Photograph the barrier, request the work schedule and a safe temporary route, and ask who will restore the surface. Confirm that the route is usable by emergency vehicles and ordinary delivery vehicles. Escalate to the project sponsor and local road authority if the field contact does not respond.
A public road is closed and the railroad says it is not responsible
Contact the city, county, or state agency that owns the road. Ask for the closure permit, detour plan, and project manager while separately requesting the railroad’s work schedule. The agencies may have different responsibilities.
Your recorded crossing or access easement is threatened
Compare the proposed work with the legal description and any temporary-access language. Request the project instrument and written explanation of how the crossing will remain available or be replaced. Obtain legal advice before consenting to relocation, signing a waiver, or allowing permanent removal.
No emergency vehicle can reach the property
Call emergency services immediately, identify the exact obstruction, and notify the project and road authority in writing. Ask for responder instructions and a verified access route. Do not improvise a track crossing or remove a barricade.
Quick Recap
What to remember
- Document the obstruction and its real-world effects from a safe location.
- Contact the rail project and the public-road authority separately.
- Use only a designated, authorized crossing or detour.
- Let deeds, easements, crossing agreements, permits, and temporary-access clauses guide the rights analysis.
- Seek local legal advice before a permanent closure, major damage claim, or disputed access right becomes harder to protect.
