What to do if construction noise, dust or vibration affects your home

If nearby building work is disrupting your home in England, start with a dated record of the noise, dust or vibration and contact your local council’s Environmental Health or noise nuisance team. That is the main public route for construction impacts on residents. The council can assess whether the facts may amount to a statutory nuisance and, where appropriate, require controls. Check the site’s planning conditions separately, because working hours and mitigation are site-specific.

This guidance covers England. Residents in Scotland, Wales, Northern Ireland or other countries should check their own council or environmental regulator because complaint routes and legal tests differ.

Take these steps first

1. Start a dated incident log

Record each event while it is fresh. Note the date, the time the activity starts and stops, how often it happens, what work appears to be under way and where in your home it can be heard or felt. Describe the practical effect: interrupted sleep, difficulty working, inability to use a room, dust settling on windows or outdoor areas, or concern about a new crack.

Government guidance identifies the level, duration, frequency, time of day and character of noise, together with the locality, as relevant when authorities assess a complaint. A consistent log gives the council those facts instead of a general description that the site is “always noisy”.

2. Preserve supporting evidence

Keep emails, letters and complaint reference numbers. Take dated photographs of visible dust deposits, blocked vents or apparent new damage, using the same viewpoints where possible. Write down when a photograph was taken and what it shows. Your records do not have to prove the legal case; they help the investigating officer understand the pattern and decide what evidence is needed.

3. Ask the council how it accepts complaints

Use the local authority’s Environmental Health, environmental protection or noise nuisance contact route. Ask whether it wants an online form, telephone report, email, diary sheets or another format, and what information it needs before an investigation can begin. For construction noise and dust affecting the public, the Health and Safety Executive (HSE) directs residents to the local authority because “HSE does not have responsibility for environmental health matters.”

Which organisation should you contact?

Concern First contact in England What to request Separate issue to check
Construction noise affecting your home or public areas Local council Environmental Health or noise nuisance team Advice and an investigation of possible statutory nuisance Planning conditions may set site hours or other controls
Construction dust affecting public areas Local council Environmental Health team Advice and investigation of possible public nuisance Describe where dust settles and how often it occurs
Site appears to be working outside its approved hours Local council planning enforcement or the planning contact named for the permission Confirmation of the permission and any working-hour condition Environmental Health can still assess noise as a nuisance
New cracks, movement or other apparent property damage Qualified building professional, with written notice to the site contact and relevant council Prompt inspection and advice on whether damage is present and what caused it Felt vibration alone does not establish structural damage

These routes can overlap. A planning-hours concern is not a substitute for a nuisance complaint, and a nuisance complaint does not determine whether a crack is structurally significant.

How the statutory nuisance test works

In England, a council investigates a qualifying complaint that may be a statutory nuisance. The legal question is whether the interference is unreasonable and substantial in relation to using or enjoying a home, or whether it causes, or is likely to cause, injury to health. The outcome depends on the facts and the locality; not every disruptive event meets the test.

Noise

Construction noise may be controlled through requirements about noise levels, machinery, working hours and mitigation. Officers may consider how loud the activity is at the affected property, how long individual episodes last, how frequently they recur, whether they occur at night or other sensitive times, and what is normal for the area. A short, occasional event and repeated overnight breaking may be assessed very differently.

Dust

Dust from business premises can fall within statutory nuisance guidance when it affects the public. Tell the council what you can see, where it lands, how frequently it occurs and whether it enters rooms or affects outdoor areas. HSE’s construction guidance states that if dust is causing a public nuisance, residents can contact their local authority Environmental Health Department.

Vibration

Describe vibration separately from noise. State when it occurs, whether it coincides with piling, compaction, demolition or vehicle movements, which rooms are affected and whether objects visibly move. A sensation of vibration is evidence of an impact on occupants, but it is not proof that the building has been damaged.

Check the site’s permission and working hours

Look up the planning permission for the site on your council’s planning portal or ask the planning department for the relevant reference. Read any construction management plan, environmental statement or condition dealing with hours, deliveries, noisy plant, dust suppression or monitoring if those documents are available.

Do not assume that one set of “standard construction hours” applies everywhere. HSE notes that some permissions include hours such as 7:30am to 6:00pm, but the actual condition depends on the site and the local authority. A permission may also contain different weekday, Saturday or bank-holiday limits, and later applications may have varied the original terms.

If work appears to breach a stated condition, give the planning team the site address, permission reference if known, exact dates and times, and photographs or logs. Continue to report the actual noise or dust to Environmental Health: planning enforcement and statutory-nuisance investigations address different questions.

Prepare a complaint the council can act on

Send a concise account with the site’s address or a clear location, the affected address, the incident dates and times, duration and repetition, and the type of impact. Explain which rooms or outdoor areas are affected and what the consequence is for sleep, work, ordinary use of the home or property condition.

Attach a short chronology rather than an unedited collection of messages. Include representative photographs and identify the date and time of each image. Ask for a reference number, the name of the team handling the case and the expected next step. The following wording is a practical format, not a required official form:

I am reporting repeated construction noise, dust or vibration affecting my home at [your address] from the site at [site address]. The incidents occurred on [dates] between [times], usually lasting [duration] and repeating [frequency]. The activity appears to be [description]. It affects [rooms or outdoor areas] and has caused [sleep disruption, inability to work, dust deposits or other specific effect]. I have attached a dated log and photographs. Please confirm the complaint reference, whether this should be assessed as a possible statutory nuisance, and what information or access you need for an investigation.

Use factual language. Say that vibration was felt or that a crack was observed; do not state as fact that the work caused structural damage unless a qualified assessment has established that.

What the council may do

The council may ask for more diary entries, arrange an officer visit, contact the contractor or request information about the activity. It may assess the issue at your property, including the timing, duration, frequency, level and locality. Keep recording events while the case is open and send material in the format the officer requests.

If the council agrees that a statutory nuisance exists or is likely to occur, it can serve an abatement notice. Construction noise can also be controlled by specifying operating hours, machinery and mitigation measures. The notice or other direction should identify what must change and by when. Ask the council what happens if the problem continues and how to report a breach.

A council may decide that the evidence does not meet the statutory test, that the activity is temporary or that another route is more appropriate. That decision does not make your log useless: ask for the reasons, the relevant planning conditions and the next step available for a recurring problem.

Protect yourself while the issue is being assessed

Keep windows and doors closed during short periods when visible dust is passing, and use rooms or times of day that are less affected where that is practical. Do not enter the site or interfere with machinery. If anyone in the household has a health condition that may be aggravated by dust or noise, seek medical advice about personal precautions.

A particulate respirator can be an optional exposure-reduction aid for brief dusty conditions if it is suitable and worn correctly, but it does not control the source, establish a nuisance or replace a council complaint. Consumer sound-meter apps and vibration monitors may help you describe timing, but they do not substitute for an official assessment and should not be presented as definitive measurements.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If you see cracks or other apparent damage

Photograph the mark promptly with a scale such as a ruler, note its location and date, and repeat the photograph if it changes. Notify the site contact and the relevant council in writing, keeping copies. Arrange an assessment by a qualified building professional, such as a structural engineer or building surveyor, who can inspect the property and advise whether the change is significant and what further investigation is appropriate.

Official permit guidance explains that, except for a low-frequency qualification, vibration would generally be physically intolerable to people before reaching levels capable of structural damage. That means feeling shaking is not, by itself, evidence of damage. Visible new movement, widening cracks, displaced finishes or a door that suddenly binds still warrant prompt documentation and professional inspection.

If there is an immediate safety concern, leave the affected area and contact the appropriate emergency service. Do not wait for a nuisance investigation to address a dangerous condition.

Follow up without losing the thread

  1. Keep one file containing the incident log, photographs, emails, letters and reference numbers.
  2. Reply to council questions by the requested deadline and identify any change in frequency, hours or affected rooms.
  3. Ask for written confirmation of the investigation outcome, any abatement notice or planning information, and the next escalation step if the problem continues.
  4. Report new incidents under the existing reference where possible so the pattern remains connected.

Common mistakes to avoid

  • Assuming that construction is automatically allowed until a particular hour. The permission and local rules for the site control the answer.
  • Reporting only that work is “too loud” without dates, duration, frequency or effects.
  • Sending a vibration reading or app screenshot as if it proves structural damage or statutory nuisance.
  • Claiming that every crack was caused by the site before obtaining a professional assessment.
  • Contacting HSE as the primary route for a public environmental nuisance; HSE directs these matters to the local authority Environmental Health team.
  • Applying England’s process to another nation or country without checking its own regulator and legal test.
