What to do if construction damages your driveway, landscaping, or utilities

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If construction damages your property, protect people first, stop activity that could make the damage worse, and call 911 for an immediate hazard. For a damaged utility, notify the utility owner and your local 811 center as soon as it is safe. Then photograph the scene, notify the contractor in writing, and ask your insurer about notice and inspection requirements before permanent repairs. Responsibility, claim deadlines, and permit duties depend on your state, contract, permits, the line or property involved, and the facts.

Start with safety, not blame

A damaged driveway or planting bed is usually a property problem. A damaged gas, electric, water, sewer, communications, or other utility can become a life-safety emergency. Do not approach a line that is sparking, smoking, hissing, leaking, exposed to traffic, or otherwise unstable.

When to leave and call 911

Move everyone, pets, and vehicles away from the area if there is escaping gas, smoke, sparks, fire, an electrical hazard, a strong chemical odor, flooding that threatens people, or any other immediate danger. Call 911 from a safe location and follow the emergency operator’s directions. Arkansas 811, California guidance, and Alabama safety guidance all emphasize emergency response and avoiding unauthorized repairs. Do not touch, cover, move, cut, reconnect, or attempt to shut off a damaged utility unless the utility or emergency responders specifically direct you.

Stop work that could worsen the incident

If no immediate evacuation hazard exists, ask the crew to stop nearby work that could crush an exposed line, undermine a slab, spread contaminated soil, or enlarge a trench. Do not enter an excavation or unstable area to inspect it. Keep children and bystanders out, and use only safe, temporary measures that do not hide evidence or interfere with the utility’s inspection.

Report a utility strike promptly

Once people are safe, call the affected utility owner and your local 811 center. Tell them the property location, what was damaged, when it happened, whether anyone is injured, and whether gas, electricity, water, sewage, or another service is involved. Have any excavation or locate-ticket number available. Ask the utility what it wants you to do about shutting off service, providing access, protecting the area, and arranging repairs.

811 is a notification and locating service, not a repair service. Member utilities generally locate their own facilities. A privately owned line—such as a line from a meter to an outbuilding, private well, irrigation system, landscape lighting, or another customer-owned installation—may not be marked by the public locate process. Arkansas 811 specifically warns that private lines can remain unmarked. Ask the utility whether it owns the line and, if not, arrange a qualified private locator or the appropriate licensed professional. The absence of a paint mark does not by itself establish who is liable.

Response by hazard and damage type

Situation Immediate action Contact
Escaping gas, fire, sparks, or imminent electrical danger Leave the area; do not operate switches, vehicles, tools, or phones near the hazard; do not repair the line. 911 first, then the gas or electric utility from a safe location.
Exposed or broken utility with no obvious immediate danger Keep people away, stop work that could aggravate it, and avoid touching or covering the line. Utility owner and local 811 center promptly; follow their instructions.
Broken water, sewer, or communications service Stay clear of contaminated water, open trenches, and unstable ground. Use only a utility-directed shutoff if it can be done safely. Utility owner, 811 when excavation is involved, and 911 if there is a safety emergency.
Driveway, paving, wall, fence, or landscaping damage without a utility hazard Keep traffic off unsafe areas and take reasonable steps to prevent additional damage without permanently altering the work. Contractor in writing; insurer if your policy may apply.

Preserve evidence before conditions change

Document the scene as soon as it is safe and before debris is removed, soil is backfilled, or temporary work changes the appearance. Take wide photographs showing the property and work area, followed by close images of cracks, tire tracks, displaced soil, broken plants, exposed lines, water, debris, and damage to fixtures. Include a ruler or another recognizable scale where practical, and record the date, time, and location for each set of images.

Write a factual timeline while events are fresh. Record the construction company’s legal name if known, crew names, supervisor and contact information, vehicle or equipment descriptions, the work being performed, the last time the area was intact, when the damage was discovered, and what each person said. Identify witnesses and preserve doorbell-camera, security-camera, or cellphone video. Keep copies of texts, emails, voicemail, work orders, contracts, permits, locate-ticket details, utility case numbers, estimates, invoices, and receipts for necessary temporary protection.

The Tennessee Attorney General’s consumer guidance recommends visual documentation and saving receipts in a disaster-claim setting; the same recordkeeping is useful when construction causes damage. Preserve original files and back them up rather than relying only on edited or compressed images.

Protect the property without destroying the claim

Take reasonable temporary measures to prevent a foreseeable increase in damage: keep people and vehicles off a failing driveway, place a safe barrier around an opening, cover contents from rain if that can be done without touching a utility, or arrange emergency pumping when directed by the utility or responders. Keep receipts and note who authorized the work.

Temporary protection is different from permanent restoration. Do not repave, regrade, replant, replace buried lines, backfill an excavation, or remove damaged materials before the contractor, utility, or insurer has had a reasonable chance to inspect, unless emergency conditions require it. Tennessee consumer guidance advises delaying permanent repairs until an insurer has inspected and repair costs are agreed in its disaster-claim context. Your policy and the incident facts control, so ask the insurer what it requires.

Driveway and hardscape

Photograph the full driveway, edges, drainage paths, joints, curbs, retaining walls, and any pre-existing cracks. Note whether damage is cosmetic, prevents vehicle use, creates a trip hazard, or threatens the base or drainage. Do not accept a quick patch as a complete resolution until you know whether heavy equipment caused subgrade settlement or drainage changes that could reappear.

Landscaping and irrigation

Record the location and condition of trees, shrubs, lawn, beds, edging, irrigation heads, drainage features, fences, and soil before cleanup. Note broken trunks, compacted soil, severed irrigation, rutting, erosion, and displaced topsoil. Keep receipts for temporary erosion control or watering. Replacement of a mature tree or re-establishment of a landscape may require a scope different from simply replacing visible plants; obtain a written assessment rather than agreeing to an informal cash amount.

Notify the contractor in writing

Send a factual notice promptly by a method that preserves delivery, such as email followed by certified mail when appropriate. Describe when and where the damage occurred, identify the work being performed, attach representative photographs, and request an inspection and written restoration proposal. Ask for the proposed scope, materials, responsible subcontractors, schedule, permits or utility coordination records relevant to the incident, and how temporary protection will be handled.

Do not accuse a person of criminal conduct, admit that you caused the damage, sign a release, or state that the matter is fully resolved before the scope and responsibility are understood. Keep the original message and attachments, and maintain a log of responses and missed appointments.

Plain-language notice example

Subject: Notice of construction damage at the property

In the body, identify the property address, date and approximate time, the work underway, the observed damage, any utility or safety report number, and the immediate steps taken. Request a site inspection by a named date, a written repair scope, and confirmation of the contractor’s insurance contact. State that the notice is a factual report and that you are preserving all rights while the cause and repair scope are evaluated. Attach copies, not your only originals, of photographs and receipts.

Ask your insurer what must happen before repairs

Contact your homeowners, renters, commercial, or other potentially relevant insurer promptly and ask whether the policy may apply, what notice is required, whether an adjuster must inspect, and which emergency expenses are reasonable. Contractor-caused damage is not automatically covered, and a policy may exclude some causes while covering resulting damage or temporary protection. Do not promise a coverage outcome to the contractor or neighbors.

Give the insurer the contractor’s written notice, utility reports, photographs, estimates, and receipts. Ask whether you may obtain independent estimates and whether the insurer wants damaged materials retained. Keep claim and adjuster numbers, and confirm important instructions in writing. If the insurer denies or limits a claim, request the specific policy language and the factual basis, then consider the complaint or appeal process available in your jurisdiction.

Understand why liability is not automatic

The party who caused visible damage is not always the only legally responsible party. A contract may allocate site protection, utility locating, access, restoration, or notice duties. A permit may impose conditions. Ownership of the line, the accuracy of the locate request, private-line status, pre-existing conditions, weather, and the actions of subcontractors can all affect the analysis.

Issue Why it matters What to collect
Contract and change orders They may define responsibility for access, locating, restoration, insurance, notice, and releases. Signed agreement, exhibits, payment records, amendments, and written instructions.
Permits and local rules Permit conditions or right-of-way rules can create duties that differ by location. Permit numbers, approved plans, inspection records, and agency correspondence.
Utility ownership and locating Public marks may not cover private facilities; a locate ticket does not answer every ownership question. 811 ticket, utility case number, maps, private-locator report, and photographs of marks.
Pre-existing condition A contractor may dispute whether a crack, tree decline, or drainage problem existed before work. Older photographs, maintenance records, prior estimates, and witness statements.
Deadlines and notice Claim, contract, permit, and governmental deadlines vary by state and incident type. Policy, contract notice clause, agency instructions, and a dated communications log.

California agencies publish reporting windows for defined categories of utility damage, but those are California rules, not national deadlines. An Oregon rule discussed in official materials concerns a particular highway-approach permit context. Oklahoma 811 guidance illustrates a state-specific role for contacting 811 before digging. These examples show why you must check the law, permit, and contract for the property where the incident occurred rather than rely on a nationwide rule.

Escalate a dispute methodically

  1. Review the documents. Read the contract, warranty, change orders, insurance provisions, permits, and any clause requiring notice, mediation, arbitration, or a particular method of service.
  2. Request a joint inspection. Invite the contractor, utility, insurer, and relevant expert when appropriate. Keep the invitation factual and record who attends.
  3. Get independent scopes. For structural, drainage, tree, electrical, gas, or environmental questions, use the appropriately licensed professional. Ask for a written cause assessment and separate temporary, repair, and replacement costs.
  4. Use regulators and consumer agencies. If a licensed contractor refuses to respond, check your state contractor-licensing board or consumer-protection authority for complaint procedures. An agency complaint does not automatically decide private damages.
  5. Obtain local legal advice when needed. Consult a lawyer licensed where the property is located if the loss is substantial, a deadline is approaching, a release is requested, a government right-of-way is involved, or responsibility remains disputed. Bring the contract, timeline, photographs, reports, estimates, and receipts.

Common mistakes to avoid

  • Entering an excavation, touching an exposed line, or trying to make an emergency repair yourself.
  • Assuming a public 811 mark means every private line was located.
  • Relying on a verbal promise instead of a dated written notice and repair scope.
  • Destroying evidence through cleanup, backfill, repaving, or replanting before required inspections.
  • Signing a release or accepting a final payment before hidden damage and future restoration needs are evaluated.
  • Using a state deadline, permit rule, or insurance assumption as though it applied everywhere.
  • Hiring a replacement contractor for permanent work without coordinating access, inspections, utility requirements, and payment responsibility.

A documented path from incident to resolution

The safest sequence is: secure people and the site; call 911 for immediate danger; notify the utility owner and 811 for utility damage; preserve photographs, video, reports, and receipts; give the contractor written notice and request an inspection; ask the insurer about notice and inspection requirements; then obtain written scopes and check the contract, permits, and local rules before permanent restoration. If the parties cannot agree, use the applicable agency and legal processes rather than guessing at liability or deadlines.

South Carolina Attorney General Alan Wilson warned on April 2, 2021: “You may think the digging you do at your house is too small to bother with calling 811, but if you hit an electrical or gas line you could injure or kill yourself or someone else.” The warning is about the danger of striking a line, not a determination of who must pay for a particular construction claim.
