If a pothole damages your car, first get yourself and the vehicle to a safe place. Then record when and where it happened, document the damage, arrange an inspection if needed, and find out which authority manages that road before deciding whether to contact your insurer, submit an authority claim, or do both. A pothole does not automatically make a road authority liable, and claim rules vary by location.
1. Get to a safe place before inspecting anything
Do not stop in a live lane or put yourself in danger to photograph the road. If the car is still controllable, move to a safe place to stop; if it may be unsafe to drive, arrange appropriate roadside assistance rather than continuing. These are practical safety steps, not a universal statement of local law.

In the UK, GOV.UK specifically warns drivers not to visit or try to photograph a motorway pothole location. Do not walk into traffic or return to a dangerous spot for evidence. Your safety is more important than a photograph.

Check whether the car may be unsafe
Look for obvious signs from a safe position: a deflated or visibly damaged tyre, a wheel that appears bent, fluid leaking, unusual steering or vibration, or a warning light. These signs do not diagnose the fault, but they are reasons not to assume the vehicle is safe to continue driving. If uncertain, seek professional inspection or roadside assistance.

A car that appears driveable can still have damage that is not obvious at the roadside. Avoid treating a brief visual check as a repair assessment. If steering, handling, tyre condition, or warning indicators have changed after the impact, explain that to the roadside-assistance provider or repair professional.
2. Record the incident while the details are fresh
Write down the incident date and time, road name, direction of travel, lane if known, and the nearest junction, address, or landmark. Note the exact location as precisely as you can without returning to an unsafe place. Describe what happened and what damage you noticed. GOV.UK’s claim guidance asks for the damage, why you think the organisation is responsible, the specific location, and the date and time; that is a useful record-keeping model, not a universal legal formula.
Build a practical evidence file
- Make a short chronology: where you were travelling, what happened, when you stopped, and what you observed.
- Photograph the vehicle damage from several angles when it is safe. If the road defect and wider location can be photographed safely, capture those too; do not enter a road or stand in an exposed place to get them.
- Save witness names and contact details, if anyone saw the impact or its immediate aftermath.
- Keep relevant communications, including roadside-assistance records, insurer messages, and correspondence with the road authority.
- Record why you think a particular road manager may be responsible, but distinguish what you know from what you are inferring. The responsible body must still be confirmed.
Barbados’ Ministry of Transport and Works asks for incident details and, if possible, photographs at different angles of the vehicle, defect, road, and wider location. That illustrates the value of broad documentation, but each authority sets its own evidence requirements.

Preserve the location details you recorded, vehicle photographs, witness information, and any other documentation you can obtain safely. 3. Arrange an inspection and preserve repair records
If the impact was significant, the car shows signs of damage, or you are unsure whether it is safe, arrange an inspection by a suitable repair professional. Ask for written findings and an estimate before work begins where practical. Keep diagnostic reports, estimates, invoices, receipts, and proof of payment together with your incident notes and photographs.
Take photographs of damage before repairs if practical. Northern Ireland’s nidirect guidance advises keeping damaged items where possible or photographing them if repairs have already happened. Do not delay a safety-critical repair just to preserve a part or wait for a claim decision; document what you can and ask the relevant authority or insurer how to proceed.

Different processes may ask for different repair evidence
There is no single document rule that applies everywhere. Barbados’ process asks for repair receipts, while New South Wales’ public-liability application guidance lists two repair quotes and supporting documents. Northern Ireland lists receipts or estimates among claim materials. Check the current local checklist before authorising non-urgent work, and retain copies of anything submitted.
These documents serve different purposes. An estimate or quote records proposed work and price; an invoice or receipt records work performed and payment. An authority may ask for one, more than one, or supporting records in addition. Do not assume a quote will substitute for a paid invoice, or that a receipt is enough where the form requests multiple quotes. Confirm what is needed before sending your application.
4. Find out who manages the road
The body responsible for a road depends on its classification and location. It may be a local council, state or regional transport authority, national highway agency, or another road manager. Use the official road authority’s site to identify the responsible organisation for the exact stretch of road; the nearest council is not necessarily responsible for every road within its geographic area.
Reporting a pothole and seeking compensation are often separate actions. A defect report can alert the manager to a hazard, while a compensation claim asks it to consider loss already incurred. Filing one does not establish that the authority knew about the defect in time, was legally responsible, or must reimburse you.
When checking responsibility, start with the road name, route number if available, precise location, and road type. The same city or region can have several road managers. For example, the UK routes distinguish some managed motorways and A roads from other roads, while New South Wales separates state and regional roads from local roads managed by councils. Use an official route or authority contact rather than assuming jurisdiction from a map label alone.

5. Choose between an insurance route and an authority claim
Review your policy and contact your insurer to ask what notification rules, coverage, excess, and claims consequences apply to this incident. The available UK insurance guidance advises reporting accidents even when you do not plan to claim, but it is general accident guidance—not a universal pothole-specific rule. Your policy and local requirements govern your situation.

You can also ask the road manager about its claim process. Whether an authority will pay depends on the local legal standard and facts, not simply on the presence of a pothole. Before making a decision, compare the likely repair cost with your policy excess and ask your insurer what making a claim could mean for you. Do not assume either that insurance covers the damage or that an authority will reimburse it.
If both routes may be relevant, ask the insurer how it wants you to proceed and ask the authority what its application requires. Be clear about whether you are notifying the insurer, making an insurance claim, or seeking compensation from the road manager. The right comparison is not simply which route sounds quicker: consider who manages the road, the authority’s eligibility standard and evidence checklist, your policy terms and excess, and whether the evidence requested is an estimate, multiple quotes, or a paid invoice.
6. Submit a complete claim and keep a record
- Confirm the responsible organisation. Check the road classification and the authority’s official route for that location.
- Get the current form and checklist. Requirements may distinguish between estimates, multiple quotes, and paid invoices. Follow the authority’s current instructions.
- Present a concise chronology. Include the incident date and time, precise location, damage, and why you believe the organisation is responsible. Attach the evidence the form requests.
- Keep copies and confirmation. Save the completed form, all attachments, submission confirmation, and later correspondence.
- Ask what happens next. Check the authority’s stated process and any applicable time limits directly. No general deadline or decision timetable applies across the jurisdictions described here.
Do not describe a claim as guaranteed reimbursement. Barbados’ ministry says it investigates and reimburses if it determines that it was at fault; that is a description of its process, not a promise that every claim succeeds.
Before submitting, check that the location and date are consistent across your form and attachments, and that each file is readable. Keep a copy of everything, including quotes, repair records, photographs, and any documents the authority asks you to provide. Requirements can change, so use the current form rather than relying on an old checklist or another person’s claim experience.
How the route differs by location
England, Scotland, Wales and Northern Ireland
GOV.UK says the organisation to contact depends on the road and road type. In England, it directs users to Transport for London for red routes, National Highways for roads it manages, and the local council for other roads. It provides distinct routes for Scotland, Wales, and Northern Ireland. For pothole reports, GOV.UK directs drivers to National Highways for motorways and A roads it manages in England; its page gives different reporting routes for Scotland and Northern Ireland and a postcode-based route for other roads.
For a compensation claim, GOV.UK asks claimants to describe what the damage was, why they think the organisation is responsible, the specific location, and the date and time. Do not visit or try to photograph a motorway location.

New South Wales
Service NSW distinguishes Transport for NSW-managed state and regional roads from public roads managed by local councils within local government areas. Its defect-reporting route asks for the location. A separate public-liability claim process addresses damage caused by road condition; the application guidance lists two repair quotes and supporting evidence. Confirm the current form and requirements before submitting.
California state highways
Caltrans says it does not pay every vehicle-damage claim. Its explanation says a claimant must establish that the state highway was in a dangerous condition, Caltrans knew or should have known about it, and it had sufficient time to fix it. Caltrans also says that after a denial, a driver may file suit to seek a judicial determination. These are California state-highway rules and process information, not a general rule for other US roads or jurisdictions.
Caltrans states, “Caltrans does not pay for any and all damages to vehicles traveling on the state highway, and all drivers must carry adequate insurance.” This is an agency statement, not a promise about the outcome of an individual claim.
Barbados
The Ministry of Transport and Works says a vehicle must first be repaired before a claimant seeks compensation through its process. Its requested materials include the incident date, time and location; contact details; possible photographs; licence, insurance and vehicle-registration documents; and repair receipts showing service-provider details. The ministry says it investigates and reimburses if it determines it was at fault. Check the ministry’s current process and document list.
Northern Ireland and Tasmania
Northern Ireland’s nidirect guidance lists receipts or estimates and insurance details among claim materials. It also advises retaining damaged items where possible, or photographing them if repairs have already taken place. Tasmania’s Transport Services page asks for supporting documentation and information about the alleged cause. These are local examples; use the relevant authority’s current requirements for your own claim.

A pothole can cause real damage without automatically proving that a road manager is liable. The legal test, evidence requirements, responsible organisation, and claim route vary by jurisdiction. Caltrans’ dangerous-condition, notice, and time-to-repair explanation is one specific example; it should not be applied to a different authority or road system. A report made after the incident may help identify the defect, but it does not by itself prove the authority had prior notice.

Deadlines, policy notification duties, coverage, and limitation periods also depend on the applicable rules and policy. Confirm them with the road manager, insurer, or a local legal professional rather than relying on another jurisdiction’s process.
Frequently Asked Questions
What should I do first if a pothole damages my car?
Move to a safe place if you can do so safely. Do not stop in a live lane or put yourself at risk to photograph the road. If the car may be unsafe, arrange appropriate roadside assistance and document the incident when safe.
What evidence should I keep for a pothole damage claim?
Record the date and time, road name, precise location or nearby landmark, direction and lane if known, what happened, and the damage. Keep safe photographs, witness details, repair assessments, estimates, invoices or receipts, and relevant insurer or authority correspondence. Follow the local authority’s current checklist.
Who do I report a pothole to?
It depends on who manages that particular road. Check the official road authority route for the road’s classification and location. For example, England has routes involving Transport for London, National Highways, and local councils; New South Wales distinguishes state and regional roads from council-managed local roads.
Will the road authority automatically pay for pothole damage?
No. A pothole’s presence does not by itself establish liability or guarantee reimbursement. Eligibility standards and evidence requirements vary. Caltrans, for example, describes a California state-highway standard involving a dangerous condition, notice, and sufficient time to repair; that is not a general rule for other jurisdictions.
Should I contact my insurer if I do not plan to make a claim?
Check your policy and ask your insurer what notification duties apply. The available UK insurance guidance recommends reporting accidents even if no claim is planned, but it is general accident guidance, not a universal pothole-specific rule.
Do I need a repair quote or a paid invoice?
It depends on the local process. New South Wales’ public-liability application guidance lists two repair quotes and supporting documents; Barbados asks for repair receipts, and Northern Ireland lists receipts or estimates. Check the current form before authorising non-urgent work.
The Bottom Line
Put safety first, record the incident and damage while details are fresh, and keep inspection and repair records. Then confirm who manages that exact road and check both the authority’s current claim requirements and your insurer’s policy rules. Reporting a defect or submitting a claim does not guarantee compensation; the applicable standard and evidence requirements depend on the location.
