A line on a cycle-route consultation map does not, by itself, mean that your land has been acquired or that a legal order has been made. First identify who is promoting the scheme, where the proposal sits in the process, exactly what land or rights are affected, and which legal power is being used. Then answer the particular consultation or notice by its stated deadline, using specific evidence and a workable alternative or mitigation where possible.
The detailed statutory examples in this guide are for England. Wales, Scotland and Northern Ireland use different institutions and procedures, so the notice you receive and advice for your jurisdiction take priority.

- the promoter and its legal identity;
- the current route alignment and any plan or parcel references;
- whether it needs ownership of land, a permanent right, a temporary construction right, or only permission to alter a highway;
- the statutory power or order it expects to use;
- the timetable for consultation, making an order, examination or construction; and
- the officer and postal or electronic address for representations.
A route can change during design. An authority may consult more than once, and early engagement is intended to identify alterations that reduce impacts. Treat every plan as the version it says it is: do not assume a later drawing has the same boundary, width or access arrangements.
Identify the stage and legal mechanism
Do not send the same response to an informal consultation and a statutory objection. They have different deadlines, decision-makers and issues that can be considered.
| What you have received | What it usually means | What to do |
|---|---|---|
| Early consultation or engagement leaflet | The scheme is being developed. The route, design and land requirements may still change. | Explain the precise impact, provide evidence and propose a feasible change. Ask what information the authority still needs and when the next decision will be made. |
| Planning application or planning consultation | The proposal is being considered under planning rules, often alongside other permissions. | Use the planning reference and the authority’s planning portal instructions. Raise planning-relevant effects, while checking whether a separate highway, rights-of-way or acquisition process is also planned. |
| Traffic or highway notice | The authority may be proposing controls or alterations to how a road is used, such as restrictions, crossings or closures. | Follow the notice’s objection method and deadline. Explain access, safety and operational consequences with a plan or photographs. |
| Public path order notice | The authority is proposing to create, divert, extinguish or otherwise alter a public right of way. The land may not be purchased. | Object or make representations to the address in the notice. In England, the covered procedures provide at least 28 days; the particular notice controls the exact period. |
| Compulsory purchase order (CPO) notice | The authority has made an order seeking power to acquire specified land or rights without the owner’s agreement, subject to confirmation. | Submit a written objection to the confirming authority by the notice deadline. In England, a CPO notice must allow at least 21 days for objections; use the date and address printed in your notice. |
Some schemes use several mechanisms. For example, a cycle track may involve planning permission, a highway order and a CPO for a small strip of land. Respond to each document separately and cross-reference your evidence.
What an English compulsory purchase order means
In England, certain acquiring authorities can use compulsory purchase to acquire land or rights without the owner’s consent. A made CPO is advertised and sent to the confirming authority, which invites objections. The order is not the same thing as a line on an earlier consultation map, and a made order is not automatically confirmed.

- One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips
The Ministry of Housing, Communities and Local Government’s current Guidance on the compulsory purchase process states that the objection period must be at least 21 days. The notice sets the relevant address, closing date and method. If you object, write to that address even if you have already complained during consultation.
The earlier England procedure guide, Compulsory purchase and compensation: guide 1 – procedure (17 December 2021), distinguishes between objections to the scheme, requests for changes and matters such as compensation. A compensation claim may follow a different route; an objection should not be treated as a complete compensation claim.
Can the council take your land?
It may be able to seek compulsory acquisition if it has the necessary statutory power and can justify the scheme, but it cannot take land merely because a preferred route appears on a public consultation drawing. The order, the confirming decision and any conditions determine what can ultimately be acquired. If your title, access or business operation is at stake, obtain advice promptly rather than relying on an informal assurance.

How a public path order differs
A cycle route may be delivered by creating or diverting a public right of way instead of purchasing the underlying land. In England, the council advertises the order and accepts objections or representations as its notice explains. If objections remain, the local highway authority may submit an opposed order to the Planning Inspectorate.

The Planning Inspectorate then sets the timetable for further comments, a statement of case and evidence. Its guidance for specified Highways Act 1980 and Town and Country Planning Act 1990 orders describes a minimum 28-day period for objections or representations and says people who duly object to those orders are entitled to be heard by an inspector. Check the exact order type: other definitive-map and rights-of-way procedures can differ.
A path order can affect how people cross your property without transferring ownership. It can still alter privacy, security, gates, farm operations, maintenance and liability. State those effects and any practicable alignment or access condition in your representation.
Build a property-specific evidence file
Authorities need to understand what happens on your land, not just that you dislike the route. Compare the latest plan with your title plan, tenancy plan or measured boundary and identify every affected feature.

Write an effective consultation response or objection
Use a calm, numbered response so the officer or inspector can match each point to evidence. You can support the scheme’s objective while objecting to its alignment, construction method, access arrangement or acquisition of rights.
- Identify the proposal. Give the scheme name, consultation or order reference, your address and the parcel or plan number.
- State your position. Say whether you support the cycling objective but object to the particular alignment, or object to the proposal in principle. Avoid leaving the authority to infer your position.
- Describe the impact. Link each effect to a location on the plan and explain how it arises. For example, identify the gate that would become inaccessible, the drainage channel that would be crossed or the building whose privacy would be exposed.
- Provide evidence. Refer to numbered photographs, measurements, title documents, operating records or proportionate professional advice.
- Request a specific change. Suggest a different alignment, narrower land requirement, retained access, construction condition, screening, drainage solution, timing restriction or other mitigation.
- Ask for clarification. Request confirmation of the land or rights required, the statutory power, temporary working areas, maintenance responsibility and the next decision stage.
- Submit correctly. Use the address, online form or email in the consultation or order notice. Send before the stated deadline, retain a copy and keep proof of delivery or submission.
Grounds must be relevant to the process. A CPO confirming authority can consider objections to the scheme and requests for changes, while a separate compensation issue may be handled elsewhere. The fact that an alternative feels preferable does not establish that it will be accepted; explain its engineering, safety, land and delivery advantages with evidence.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Compare alternatives rather than stating a preference
If the promoter offers or you develop another alignment, compare options against the same criteria:
| Question | Evidence to provide |
|---|---|
| How much land or which rights are required? | Measured areas, affected parcels, permanent and temporary rights, and any severance of the remaining land. |
| Can people, vehicles, livestock and emergency services still use the property safely? | Access widths, turning movements, sightlines, gates, crossing points and operating schedules. |
| What are the privacy, security, drainage and construction effects? | Photographs, levels, drainage routes, distances to buildings, screening proposals and construction constraints. |
| Does the alternative deliver the scheme’s purpose? | Continuity, connections, gradients, crossings, visibility and any stated design or accessibility requirement. |
| What delivery constraint changes the balance? | Utilities, structures, third-party land, programme, maintenance and approvals, identified where known rather than assumed. |
Early engagement can lead to design changes, but no consultation response guarantees that the route will move or that an objection will succeed. Ask the authority to record why an alternative was accepted or rejected.

Deadlines and what to do if you are late
The deadline printed on the relevant notice governs. For an English CPO it must be at least 21 days for objections; for the specified English public path order procedures, the minimum is 28 days. Those are not general UK deadlines and should not be substituted for the date on your notice.
If you discover the process after the deadline, contact the named officer immediately, explain when and how you received the notice, and ask whether a late representation can be accepted. Continue preserving evidence and attend any later stage you are entitled to attend. Do not assume a late email has been treated as a valid objection until the authority confirms that in writing.
When specialist advice is sensible
Consider prompt advice from a solicitor or surveyor who handles compulsory purchase, compensation and land rights where:
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →- the notice proposes acquisition of land, an easement or temporary possession;
- your only home, business access or essential services may be affected;
- boundaries, title restrictions, mortgages, tenancies or multiple owners complicate the response;
- the route may reduce the value or usable area of the retained land;
- you need technical evidence on highways, drainage, structures, noise or valuation; or
- an opposed public path order is moving toward an inspector’s hearing or inquiry.
Ask the adviser to separate advice on the order, negotiations, mitigation and compensation. The appropriate remedy and recoverable costs depend on the actual notice, order and jurisdiction; no general guide can promise a particular outcome.
A practical record-keeping checklist
- Keep a dated chronology of every contact and promised follow-up.
- Store the notice, envelope, plans and later revisions in an unchanged folder.
- Number photographs and mark their locations on a plan.
- Record measurements, access times, deliveries, livestock movements and seasonal conditions relevant to the impact.
- Send one consolidated response where possible, with attachments listed and cross-referenced.
- Use the exact reference number and contact address from each separate notice.
- Keep proof of posting, delivery receipts, portal confirmations and sent emails.
The key decision is not whether a coloured line looks alarming. It is which legal process is actually underway, what land or rights it seeks, and what evidence-backed change would reduce harm while still meeting the scheme’s purpose.
