Do not sign an access agreement or allow unrestricted entry until you know exactly who is asking, which rights are sought, and what law applies. First identify the developer, project, route, regulator and proposed dates. Request the route map, written notice, draft survey or easement terms, insurance details and the legal basis for entry. Preserve every document and keep a dated log. Then have the proposed rights reviewed under the law of the property’s jurisdiction; a local property-rights or eminent-domain lawyer and, where value or land-use effects are material, an independent appraiser can protect your position.
A request to survey land, a temporary construction-access licence, a permanent transmission easement and a project approval are different things. The authority for one does not automatically create the others. Entry rules, negotiation procedures and compensation vary by country, state and project stage.

Start by identifying what the project wants from your property
Ask the project contact to describe the request in writing. A line developer may need permission to inspect or survey land, a temporary route for vehicles and equipment, a permanent right-of-way for poles or underground cables, or several of these at different times. The project may also be seeking regulatory approval without yet having authority to enter private land.
Separate the four common rights
- Survey or investigation access: short-term entry to measure, drill, mark or inspect a possible route.
- Temporary construction access: a defined route and period for workers, vehicles, laydown areas or materials.
- Permanent easement or wayleave: an ongoing right to install, operate, maintain, repair or replace electricity infrastructure, often with limits on buildings, trees or excavation.
- Project approval: permission from a regulator to build or operate a scheme. Approval is not, by itself, a complete answer to private-land entry.
Confirm the project and jurisdiction
Record the developer’s legal name, project name or reference number, proposed voltage and line route, contact details, affected parcel numbers and the regulator handling the application. Ask which country, state, province or local authority’s law governs access. Existing deeds, mortgages, farm leases, prior utility easements and title plans may change what the owner can grant or refuse.

For an interstate transmission proposal in the United States, the Federal Energy Regulatory Commission (FERC) describes a federal permitting process, but it does not replace state and local property or trespass law. Other US lines may be governed principally by state regulators or local approvals.
Use this first-response checklist
- Request the package. Ask for the route map over your parcel, survey plan, construction schedule, proposed access route, draft agreement, insurance information, contact for the field team and the legal authority cited for entry.
- Set a controlled communications channel. Use one email address or named representative, and confirm that no site visit is authorised until dates, personnel, vehicles and purpose are agreed in writing.
- Preserve evidence. Save letters, envelopes, emails, texts, maps, photographs and voicemail transcripts. Keep originals and note when each item arrived.
- Photograph existing conditions. Date-stamped images of gates, driveways, crops, drainage, fences, buildings, trees, wells and other improvements create a baseline for later restoration or damage claims.
- Check title documents. Obtain the deed, title plan, existing easements, rights of way, restrictive covenants, leases and any prior utility agreements.
- Check the regulator’s docket. Find the official case page, public notices, comment deadlines and intervention rules. Deadlines can be short and are project-specific.
- Obtain independent advice before signing. A local lawyer can explain entry powers and negotiation strategy; an appraiser can assess land-use and market effects that a developer’s offer may not capture.
Read every survey, access or easement document line by line
Do not rely on a project representative’s summary. The written instrument controls what may happen on the ground. Ask the drafter to mark the exact affected area on a plan and to explain every incorporated exhibit or standard term.
| Term to check | Questions to answer before signing | Protection to seek |
|---|---|---|
| Land and route | Which parcel, strip, gates, roads, staging areas and working limits are included? | A scaled plan, surveyed boundaries and no expansion without a written amendment. |
| Purpose | Is entry limited to surveying, construction, operation, maintenance, vegetation work or replacement? | Specific permitted activities; prohibit unrelated access or storage. |
| Timing and notice | When may crews enter, for how long and how much notice is required? | Written notice periods, agreed working hours and emergency-entry rules. |
| People and vehicles | May contractors, subcontractors, heavy vehicles or drones enter? | Named responsible party, safety rules, escorts where needed and compliance with biosecurity or farm procedures. |
| Land-use restrictions | Can you build, plant trees, irrigate, graze livestock, drain, excavate or install solar equipment? | A complete schedule of prohibited activities and a process for written consent. |
| Damage and restoration | Who repairs roads, fences, crops, drainage, soil compaction and landscaping? | Baseline photographs, restoration standards, deadlines and a claims procedure. |
| Compensation | What is paid for the easement, temporary occupation, crop loss, disturbance, damage and future restrictions? | Separate amounts for each impact, payment dates, interest on late payment and review of unresolved damage. |
| Term and transfer | Is the right temporary, perpetual, renewable or transferable to another owner or operator? | Defined end date for temporary rights and notice of assignment or transfer. |
| Disputes and insurance | Which law and forum apply, and what insurance covers workers, vehicles and pollution? | Local governing law, accessible dispute process and proof of adequate insurance. |
Compare the proposal with your existing title documents. An old utility easement may cover a different route or purpose, while a farm or commercial lease may give another party notice or compensation rights. Never assume a new document merely confirms an existing right.
How entry authority differs by jurisdiction
United States: the FERC interstate-transmission pathway
FERC says a developer normally seeks to negotiate a right-of-way easement and compensation with each landowner. Compensation can include loss of specified land uses during or after construction, loss of other resources and property damage. If FERC authorizes a project and negotiations fail, the developer may seek eminent domain under section 216(e) of the Federal Power Act; a court determines compensation in that process. This federal pathway does not apply to every US power line.

FERC also states that “State or local trespass laws apply, and procedures can vary by State.” Some states authorize survey access under particular conditions; others may require consent, notice or a court process. Once an easement, survey agreement or court order exists, entry is controlled by its terms. FERC advises landowners to review agreements carefully and notes that disputes over easement wording are generally matters of state law. See the agency’s Electric Transmission Facilities Permit Process.
In the federal proceeding described by FERC, affected owners can file comments and, after an application is filed, may be able to intervene in an open Commission proceeding. The agency’s landowner-rights explainer discusses requesting applicant-representative details, reviewing project information, communicating or declining to communicate, hiring counsel, negotiating or declining an easement and hiring an appraiser. FERC labels that Landowner Bill of Rights a draft agency explainer, not a standalone guarantee that overrides applicable law.
United Kingdom: distinguish current policy from proposed reforms
The 2025 National Policy Statement for electricity networks infrastructure (EN-5) says an applicant must own the relevant land, hold sufficient rights or interests—typically an easement—or have permission, typically a wayleave, for relevant electricity-line activities. EN-5 is a policy framework; it is not a complete statement of every individual landowner’s legal position. Read the current statement at EN-5 (2025).

It discusses a proposed 30-working-day notice period for certain access rights and three months’ notice for new infrastructure works. Those are proposed reforms described by the response, not automatically enacted rules. Verify commencement and the wording of any legislation before relying on them. The response also distinguishes temporary access effects from permanent impacts and says land rights still need to be secured where infrastructure will ultimately be placed. Australia: easements and state project arrangements
The Australian Government’s transmission engagement guidance explains that easements provide safe access for construction, maintenance and repairs, and that landholders with easements are compensated by transmission companies. The amount, process and entry powers depend on state legislation and the project’s agreements. Use the relevant state authority’s notices and valuation rules rather than assuming a national procedure. The federal engagement page is available at Community engagement for transmission projects.
Wisconsin: a state-specific illustration
The Wisconsin Public Service Commission describes a transmission right-of-way as land used to construct, maintain or repair a large power line and explains that an easement governs use of that right-of-way. Its guide is useful for seeing why the written route, permitted activities and restrictions matter, but it is not national US law. Read Rights-of-Ways and Easements for Electric Facility Construction in Wisconsin.
Negotiate temporary access separately from permanent line rights
Ask the developer to price and document each impact rather than offering one unexplained lump sum. A temporary survey licence should not silently become a perpetual easement. A construction-access payment should not be treated as compensation for permanent restrictions on buildings, trees, drainage or future development.

Compare route and access alternatives on the same criteria
If the developer presents several routes, request the same information for each. FERC notes that route alternatives may be assessed, including whether a line can be placed near or within an existing right-of-way. The best comparison is not simply the shortest line; it is the option with the least combined effect on land use, access and future value.
- Total land area and duration affected.
- Temporary survey or construction access versus permanent line rights.
- Entry route, notice period, working hours and permitted purpose.
- Restrictions on buildings, trees, farming, drainage, excavation and future development.
- Restoration standards, damage responsibility and insurance.
- Compensation basis, payment timing and unresolved-claim procedure.
- Available comments, appeals, objections, negotiation or court deadlines.
Ask who makes the route decision and at what stage. A regulator may evaluate public need and environmental effects, while a court or valuer may address compensation; these are different decisions.
Use the regulator’s docket before deadlines pass
Search the regulator’s official site using the project name, applicant and parcel or route reference. Download the application, maps, environmental documents, notices and procedural calendar. Calendar every comment, intervention, objection and hearing deadline, including the time zone and filing method.

Submit specific, documented concerns: an access road that blocks a business, a drainage crossing, a residence or farm operation, an existing easement conflict, safety risk or an inaccurate map. Explain the requested change and attach labelled photographs or plans. Filing a comment does not necessarily replace a private compensation negotiation, so pursue both tracks where appropriate.

When professional advice is justified
Independent advice is particularly important when the proposed route crosses a building site, productive farmland, a commercial access road, a development parcel or land with multiple owners. A lawyer can identify statutory entry powers, title conflicts, negotiation leverage, tax or lender issues and release language. An appraiser can examine the value of the rights taken, severance or remainder damage, temporary occupation, business interruption and restrictions on future use.
Choose professionals licensed or experienced in the property’s jurisdiction and in utility easements or eminent-domain matters. Give them the complete document set, title records, photographs and your preferred route or access outcome. Ask who pays their fees and whether that payment is recoverable under the applicable process; do not assume it is.
Protect the property during construction
Before the first crew arrives, walk the route with the developer and sign a condition report that includes photographs, measurements and the location of utilities, wells, drains, gates and fences. Confirm emergency contacts, daily access windows, traffic controls, biosecurity procedures and where materials may be stored.

During work, keep a dated log of vehicles, incidents, blocked access, dust, noise, crop or livestock effects and damage. Report problems promptly in the method specified by the agreement, and preserve invoices and repair estimates. At completion, inspect against the restoration standard: remove temporary roads or materials where required, repair fences and drainage, decompact or replace soil, reseed or replant, and obtain written confirmation that temporary rights have ended.
If someone enters without agreement
Do not confront a crew unsafely or obstruct lawful emergency work. Ask for identification, the project contact and the document or order they rely on. Record the time, activity, vehicles and visible damage from a safe location. Notify your lawyer, the landowner representative and the relevant regulator or local authority as appropriate. Whether entry is trespass depends on local law and any existing easement, survey statute, written agreement or court order; neither an announcement of a project nor a refusal alone answers that question.
