Do not treat a developer’s brand name or a RERA registration number as proof that an apartment will be delivered on time. Before paying, identify the exact legal promoter and project phase, verify the project on the state or Union-territory RERA portal, reconstruct the promoter’s delivery and litigation history, and have an independent property lawyer examine title, encumbrances, approvals and the sale agreement.
The checks below are designed for Indian apartment purchases. RERA is national legislation, but land records, portal fields and procedural rules are administered locally, so use the authority for the state or Union territory where the apartment is located.

What a developer’s “track record” should include
A useful track record is a documented pattern across specific legal entities and completed or ongoing projects. It is not a star rating, a brochure claim, a bank loan tie-up or the number of years a marketing brand has existed.

- Who is the legal promoter, landowner and contracting entity?
- Which RERA registration, phase, tower or parcel covers the apartment being offered?
- What completion date was originally disclosed, what is the current disclosed status, and were extensions approved?
- Do construction progress and quarterly disclosures match the promised possession date?
- What complaints, final orders, interim orders, court cases or insolvency proceedings involve the promoter or related entities?
- Are title, encumbrances, approvals, development rights and landowner agreements documented?
- Do the approved plans and RERA disclosures match the advertisement and the agreement for sale?
Use records to answer these questions, then compare two or more developers on identical criteria. A single “reliability score” hides the differences that matter to a particular site, phase and contract.
1. Identify the exact legal promoter and project phase
Ask for the registration number before discussing payment
Request the project’s RERA registration number, the registered promoter’s full legal name, the legal address and the phase or tower in which the apartment sits. A group name used in advertising may differ from the company that owns the land, signed the development agreement or received the registration.
Search the number yourself on the RERA portal for the project’s location. Match all of these fields:
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
- Project name and postal location
- Promoter’s legal name and constitution
- Phase, tower, parcel or development area
- Approved layout and apartment details
- Declared completion and possession dates
- Names of landowners or collaborating entities
If the salesperson gives a registration number for a different phase, an adjacent parcel or an earlier project, the result does not establish anything about the apartment you are considering. Save a PDF or screenshot of the record on the date you check it; portal entries can later be updated.
Use the regulator for the apartment’s location
Himachal Pradesh RERA (HPRERA) explains that the public can search registered projects and access authority judgments and interim orders. Other state and Union-territory portals may label fields differently or publish a different set of documents. Treat HPRERA’s interface as an example of the records to seek, not as a nationwide procedure.
RERA registration is a regulatory and disclosure requirement. It is not certification of future completion, construction quality, financial health or clear title. The Ministry of Housing and Urban Affairs describes registration as part of a transparency and accountability framework, not as a guarantee of performance.
“RERA aims to ensure transparency & accountability in the Real Estate Sector, thereby protecting the interests of the homebuyers.”

2. Reconstruct the promoter’s delivery history
Build a project-by-project timeline
For every earlier project developed by the same promoter or related legal entity, record the original completion date, revised date, approved extension, current status and actual handover information where available. HPRERA says registered-project websites should include promoter details and details of projects developed by the promoter in the previous five years. This is a useful state-specific disclosure to look for; other authorities may provide a different period or layout.
Do not rely on a statement such as “possession next year.” Compare the date in the current offer with the date in the RERA record, quarterly updates and the agreement for sale. A pattern of repeated extensions, long periods without updates or materially incomplete common areas deserves a written explanation and a higher risk assessment.
Compare disclosed progress with physical reality
RERA disclosures are a documentary trail, not an independent inspection of construction quality or a promise that work will continue at the same rate. Visit the site, preferably at different times, and note the status of structure, services, lifts, fire systems, roads, utilities and promised amenities. Ask for dated construction photographs and the latest engineer or architect certification that the promoter is required to disclose locally.
Record discrepancies rather than arguing about them at the sales office. For example, if the portal shows a high completion percentage but the promised access road or water connection is absent, ask which work the percentage measures and whether the missing item is part of the registered phase.
Separate promoter history from project history
A company may have completed one development while a newly formed subsidiary, joint venture or landowner entity is responsible for the current one. Map the relationships shown in the title documents, development agreement, RERA registration and corporate filings. A successful project under one entity does not automatically transfer to another entity with different assets, directors, lenders or contractual obligations.
3. Read complaints, judgments and orders for outcomes
Search the regulator’s decisions, not just a complaint count
Use the RERA portal’s orders and judgments section where available. HPRERA provides public access to decisions and interim orders. Read the order itself and classify each matter as an allegation, an interim direction, a final finding, a settlement or a dismissed case.
For each relevant matter, note:
- The legal entity named in the case
- Project and phase
- Issue, such as delay, refund, title, quality, common areas or disclosure
- Date filed and date decided
- Relief ordered and whether compliance is recorded
- Whether an appeal or stay is mentioned
One unresolved complaint can concern a narrow contractual dispute; several final orders involving the same failure across projects indicate a different risk. Do not equate a high complaint count with wrongdoing without reading outcomes, and do not treat a low count as proof that no issue exists: buyers may use other forums or cases may not yet be decided.
Check courts and insolvency records under legal names
Search the exact promoter, subsidiaries, joint-venture partners, landowners and earlier company names in court and insolvency databases. Searching only the consumer-facing brand can miss proceedings filed against the company that actually owns the project or receives buyer funds. Secondary due-diligence guidance recommends these checks, but no database search is complete unless the legal-entity map is correct.

Ask a lawyer to interpret a pending case’s effect on the specific land parcel, receivables, approvals or ability to transfer the apartment. A case involving another project may reveal a pattern, yet it may not legally affect your unit; conversely, a dispute recorded under a landowner’s name can be decisive even if the promoter is not the headline party.
4. Verify title, encumbrances and development rights independently
Obtain the title chain and search report
Haryana RERA rules enumerate authenticated title documents, a title search report and disclosure of encumbrances. Ask for the complete chain of title for the land on which the registered phase stands, not merely a one-page “clear title” letter. The chain should explain every transfer, subdivision, conversion and inheritance relevant to the parcel.
An independent local property lawyer should check the records with the appropriate land and registration offices and explain what they mean under local law. The lawyer should also verify the project boundary against the survey plan and the land described in the RERA filing.
Quick wins for a faster PC:
Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →List every encumbrance and obligation
“Encumbrance” can include a mortgage, charge, lease, easement, right of way, acquisition notice, unpaid government or municipal dues, litigation, attachment or another person’s claim. Ask for written details of each item, the secured party, release conditions and the mechanism for obtaining a release before or at registration of your apartment.
Do not assume that a lender’s project approval eliminates these risks. A lender may assess its own security and documentation; that is not a substitute for your title review or for checking whether the apartment, common areas and access rights can be conveyed as promised.
Review development and collaboration agreements
Where the promoter is not the landowner, obtain the registered development, joint-development or collaboration agreement and any power of attorney that authorizes construction and sale. Confirm who can sign the agreement for sale, collect money, create mortgages, grant possession and execute the final conveyance.
The ICAI guide’s title-diligence checklist also points to approvals, pending litigation, boundary checks and development-agreement review. Your lawyer should reconcile those documents with the RERA promoter name and the entity printed on the booking form.

HPRERA’s FAQ describes promoter, project, financial, quarterly-update and approval information as project disclosures. Compare those disclosures with the plan shown in the sales office. A model apartment, brochure or animation cannot add a floor, parking space, clubhouse, road, open area or amenity that is absent from the sanctioned and contractual documents.
Put material promises in the agreement
Make a list of every material promise: carpet area, balcony, parking identification, handover date, specifications, power backup, water source, maintenance arrangements and amenities. Cross-check each item against the RERA record and the agreement for sale. If a salesperson will not put a promise in the contract, treat it as unavailable for decision-making.
Check clauses on delay compensation, cancellation, interest, possession, defect liability, formation of the owners’ association, conveyance of common areas and allocation of taxes or utility charges. Have the lawyer explain any blank, unilateral-change clause or document incorporated by reference but not supplied.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errors6. Examine payment safeguards and timing
Confirm registration before advertising or booking
The Ministry of Housing and Urban Affairs’ RERA implementation release says registration is required before a project is advertised, marketed, booked or sold. Verify the registration before signing an expression of interest or transferring a booking amount. If the promoter says registration is pending, ask what legal provision permits the specific offer and obtain local advice before paying.
Understand the 70% separate-account rule
The Ministry states that 70% of amounts realized from homebuyers must be deposited in a separate bank account and used for land cost and construction. This rule supports project-fund discipline, but it does not prove that a project is solvent or that every payment will be used correctly. Ask how the account is identified in the project disclosures and how withdrawals are certified under the applicable state rules.
Check the advance limit for your state
HPRERA’s FAQ says a promoter may not accept more than 10% of the apartment cost as an advance or application fee without first entering into and registering a written agreement for sale. This is an HPRERA explanation; verify the current rule and applicability in the state where you are buying before making a payment. Keep the receipt, payment reference, allotment letter and the exact version of every document.
The Ministry also describes a penalty of up to 10% of estimated project cost for contravening the registration requirement, as determined by the Regulatory Authority. That is a statutory penalty framework, not compensation that a buyer should assume will be recovered automatically.
7. Use a consistent comparison scorecard
When choosing between developers, fill the same evidence fields for each one. Leave a cell as “not stated” when the portal or document does not establish the value; do not convert missing information into a favorable assumption.

| Comparison axis | Evidence to record | Decision question |
|---|---|---|
| Legal identity | Promoter, landowner, subsidiaries, joint-venture parties and project-phase registration | Does the entity selling the apartment have documented authority over this phase? |
| Timeline | Original completion date, current disclosed date, extensions and handover status on earlier projects | Are delays isolated, or repeated across projects and entities? |
| Progress | Quarterly updates, approvals, site observations and missing infrastructure | Do official disclosures match visible and contractual progress? |
| Disputes | Complaints, final orders, interim orders, appeals, court and insolvency matters | What issue was decided, against whom, and with what outcome? |
| Title and encumbrances | Authenticated title chain, search report, charges, litigation and development agreements | Can the promised apartment and common rights be conveyed free of unresolved claims? |
| Approvals | Sanctioned plans, building and environmental permissions, fire and utility approvals | Do approvals cover the exact tower, phase, area and amenities being sold? |
| Contract consistency | RERA disclosures, brochure, allotment letter and agreement for sale | Are dates, areas, specifications, remedies and charges consistent? |
Do not award extra points merely because a bank has financed units in the project. Bank participation can be a useful fact to investigate, but it is not a title certificate, completion guarantee or substitute for your own review.
8. Follow a document-first buying workflow
- Define the exact asset. Write down the state, city, survey or parcel reference, project phase, tower, unit and parking promised.
- Collect the legal identity pack. Obtain the RERA number, promoter name, landowner details, development agreement reference and the entity that will sign your contract.
- Download the portal record. Save registration, approvals, quarterly updates, financial disclosures, promoter history and available orders for your files.
- Create a timeline. Enter original and current dates, extensions, construction milestones and any stated reason for delay.
- Search proceedings. Search the promoter and related legal entities in the regulator, court and insolvency records; read outcomes rather than counting entries.
- Commission title diligence. Give a local property lawyer the authenticated title documents, search report, encumbrance details, development agreements and boundary plan.
- Inspect and reconcile. Visit the site, compare construction and amenities with the approved plan, and write down every discrepancy.
- Negotiate only from the written record. Insert material promises, dates, remedies, area definitions, parking rights and possession conditions into the agreement for sale.
- Check payment legality. Confirm registration, the applicable advance limit, payment destination, receipts and the separate-account disclosures before transferring funds.
- Set a stop condition. Pause or walk away if essential title documents are withheld, the legal seller changes without explanation, the phase cannot be matched, or a material discrepancy remains unresolved.
9. Recognize red flags that require a pause
- The salesperson supplies only a group brand or a brochure, not the legal promoter and phase registration.
- The RERA record shows a different tower, parcel, promoter or possession date from the offer.
- Quarterly updates stop, extensions recur, or construction on site is visibly behind the disclosed status.
- The promoter refuses to provide authenticated title documents, the title search report or development agreements.
- A mortgage, litigation, landowner dispute or unpaid dues are described vaguely as “being cleared” without release terms.
- Plans or amenities in marketing material are absent from sanctioned documents or the agreement.
- You are urged to pay a large application fee before a written, registered agreement where local rules require one.
- Important promises appear only in emails or verbal assurances and are excluded from the agreement for sale.
- Searches reveal proceedings against a related company, but the promoter will not explain the relationship or the project’s exposure.
A red flag is a reason to obtain evidence or legal advice, not automatic proof of misconduct. Record the answer, document supplied, responsible entity and date so the issue can be reassessed.
10. Decide what the evidence supports
Proceed when the record is coherent
A comparatively lower-risk file has a legal promoter that matches the registration and contract, a traceable title and development right, current approvals, consistent disclosures, progress that fits the timeline, and orders or disputes that have been understood rather than ignored. “Lower risk” still does not mean guaranteed delivery.
Renegotiate when the issue is contractual
If title and approvals are satisfactory but dates, specifications, parking or remedies are vague, ask for corrected documents before paying. A written change to the agreement is more useful than a sales representative’s assurance.
Walk away when a core legal question cannot be answered
Do not substitute a discount for an unresolved ownership, authority, encumbrance, approval or entity-identity problem. The cost of abandoning a booking is measurable; the consequences of buying land or a phase that cannot be conveyed may not be.
11. Get local professional advice before a large commitment
Use a qualified property lawyer in the project’s jurisdiction to interpret title, encumbrances, approvals, litigation, development rights and contract language. Give the lawyer the exact unit and every version of the documents, and ask for written answers to specific risks rather than a generic “clear” opinion.
Professional review does not replace your own portal search, site inspection or comparison of disclosures. It also cannot guarantee that a promoter will perform. Its value is in identifying what a document legally permits, which condition must be satisfied before payment or registration, and what remedy the contract actually provides.

How long does RERA dispute resolution take?
The Ministry of Housing and Urban Affairs says RERA includes a fast-track mechanism with a provision for disposal within 60 days. This is a statutory provision, not a promise that every complaint will be decided within 60 days. Case complexity, adjournments, appeals and enforcement can affect the practical timeline, so do not base a purchase decision on an assumed quick remedy.
