Before signing a builder-buyer agreement, verify five things in writing: who is legally responsible, exactly what will be built, the complete price and payment triggers, how changes and delays are handled, and what happens if defects or a dispute arise. Then have the actual contract and every attachment reviewed by an independent construction lawyer and a qualified design or building professional.
Rules on deposits, cooling-off periods, insurance, warranties and mandatory contract content depend on where the project is located. The examples below from Victoria, New South Wales, California and New Zealand are local guidance, not universal terms for every home build.

1. Identify the parties and the governing rules
Start with the contract’s first page. The legal name of the builder or contracting company should match the entity that will invoice you, receive payments and carry responsibility for the work. Check the business address, licence or registration number, and the name of the owner or authorised signatory. If a salesperson, project manager or related company appears elsewhere, the agreement should explain that person’s authority and the contracting entity’s responsibility.
Check the builder’s licence or registration
Use the official licensing or registration register for your jurisdiction. Match the name and number shown in the agreement to the record, confirm that the credential is current, and check that its class covers the work you are commissioning. The New South Wales homeowner checklist specifically tells buyers to compare the licence name and number with the contract and ensure the licence covers the proposed work. A credential for a different trade or a lapsed registration is not a substitute.

Confirm your own details
Every buyer who will own the property or be responsible for payment should be correctly named. Check the site address, lot or title description, mailing address and contact details. An incorrect lot number or an omitted co-owner can create problems with notices, finance and enforcement later.
2. Make the scope impossible to misunderstand
A price is meaningful only when the work included for that price is defined. The agreement should attach the accepted quote, architectural or builder plans, specifications, schedules and relevant engineering or certification documents. YourHome recommends attaching the quote, council-approved plans, specifications, certified engineering details and schedules. Consumer Affairs Victoria says the contract must contain what was agreed and enough information to clarify its terms.
Check the drawings and specifications together
- Confirm room dimensions, levels, structural elements, roof form, windows, doors, cabinetry and external works.
- Identify fittings, fixtures, appliances, finishes, colours and manufacturers or model numbers wherever a particular product matters.
- Make sure engineering details, energy requirements, accessibility features and site-specific reports are referenced and dated.
- Read the inclusions and exclusions schedule line by line. Items such as excavation, rock removal, retaining walls, driveways, landscaping, utility connections, window coverings, painting or final cleaning are often treated differently by different builders.
Resolve conflicts before signing
If a plan, specification, quote and schedule describe the same item differently, the contract should state which document controls. Ask for a corrected, dated set rather than relying on an email or verbal assurance. Number the attachments and keep the exact version you sign; later pages can otherwise be substituted or misread.

Find the total contract price and determine which amounts are fixed, estimated, provisional or adjustable. A contract can show an attractive headline price while leaving substantial site costs or allowances unresolved.
| Price item | What to verify before signing |
|---|---|
| Total contract price | Whether it includes tax, design and engineering fees, permits, inspections, utility charges, site preparation, waste removal and final cleanup. |
| Deposit | The amount, due date, trust or account treatment where applicable, and the local legal limit. |
| Progress payments | Each stage amount, the work that must be complete, the inspection or certificate needed, and the notice you receive before payment is due. |
| Adjustable costs | Which figures can move because of site conditions, material prices, statutory charges or approved variations, and how the adjustment is calculated. |
| Final payment | What constitutes practical completion, how defects are recorded, and whether disputed amounts have a contractually defined process. |
Do not assume another state or country’s deposit rule applies to your project. California’s Contractors State License Board, for example, publishes a down-payment limit for covered home-improvement contracts, while New South Wales applies its own contract rules. Treat any limit as jurisdiction-specific and check the current official rule before transferring money.
Match payments to observable work
A stage payment should correspond to a measurable milestone, not simply a calendar date or the builder’s cash-flow need. Ask what evidence confirms completion, who inspects it and how incomplete or defective work is recorded. Keep receipts, payment certificates, inspection reports and bank records with the signed agreement.

4. Understand allowances, provisional sums and the cost of uncertainty
Prime-cost items and provisional sums are allowances, not guaranteed final prices. For each one, the agreement should state the allowance, the assumed quantity or scope, how the actual cost will be reconciled and what builder margin, handling fee or administration charge is added.

Questions to ask about each allowance
- Is the figure a supply-only allowance, or does it include delivery, installation, wastage and taxes?
- What happens if the selected product costs more or less than the allowance?
- Can the builder substitute an equivalent item, and who approves that substitution?
- Are labour, equipment and disposal included in a provisional sum?
Request realistic allowances based on the documented design. A low allowance can make the initial price look smaller while transferring selection risk to you.
5. Put a strict variation process in the contract
Read the clause that governs changes to plans, materials, quantities or timing. It should say who may request a change, how the builder prices it, what overhead or margin applies, how the completion date is recalculated and when payment is due.
Use written, signed change orders
Describe every variation precisely: the requested work, reason, price increase or credit, tax treatment, effect on allowances, extension of time and revised completion date. Require both parties to sign before the changed work starts. Victoria’s guidance recommends written variation notices and says variations to plans and specifications must be written and signed.
An email saying “go ahead” may not contain enough detail to establish price or timing. Keep a numbered variation register and attach signed changes to the contract. If an urgent safety issue requires immediate work, record the reason, photographs, instructions and estimated cost as soon as possible, then formalise the variation.

The agreement should state a start date, a completion date or a clear method for determining both, and the duration allowed for the build. Read the list of events that permit an extension: weather, unavailable materials, owner decisions, latent site conditions, authority delays or changes in law may be treated differently.

Confirm notice requirements
Find out how quickly the builder must notify you of a delay, what evidence is required and how an extension is calculated. California guidance identifies permit responsibility and a completion date as contract items to check. Victoria guidance addresses dates, delay allowances and liquidated damages. A stated late-completion amount may be enforceable only under local law and the actual wording, so obtain advice before relying on it.
Assign permits and approvals explicitly
State who obtains planning, building, development, service and inspection approvals; who pays each fee; and who supplies documents or access. Verify that the plans you sign are the approved version and that any owner-supplied approval condition is included in the scope.
7. Allocate site access, safety and insurance responsibilities
Define when the builder receives possession or access, where materials and equipment may be stored, who provides temporary services, and how occupied areas, neighbours, pets and personal property are protected. Clarify responsibility for fencing, security, dust, noise, waste and restoration of access routes.
List the insurance required for the project and identify who obtains each policy. Ask for certificates before work begins and check the insured name, site, period and limits. Depending on the jurisdiction, separate cover may apply to construction risk, public liability, workers, home warranty or defects. Do not assume the builder’s general policy covers your existing structure or possessions.
8. Read warranties, defects and handover provisions
The contract should identify express warranties, any statutory protections that apply, the length of each period and the procedure for making a claim. Distinguish a manufacturer warranty for a product from the builder’s obligation to install it correctly.
Define practical completion and inspection
Find the inspection and handover steps, the documents you receive, and the standard for practical completion. The agreement should explain how defects are listed, who sets priorities, the time allowed for rectification and what happens if a repair is disputed. Record defects with dated photographs and written notices rather than relying on a conversation at handover.

New South Wales and New Zealand guidance identify warranties, defect remedies and related protections as matters addressed by the contract or applicable law. The exact period and remedy depend on the work, value and location.
9. Understand disputes, suspension and termination
Locate the notice address and permitted delivery methods for formal communications. Then follow the escalation path in order: site meeting, written notice, independent assessment, mediation, adjudication, tribunal or court, as applicable. New Zealand Building Performance lists a dispute-resolution process as a contract topic.
Check what happens if the contract ends
Termination and suspension clauses should explain when either party may act, the notice and cure period, access to the site, ownership of materials, payment for completed work, treatment of deposits, removal of equipment, insurance during the transition and responsibility for delay. A builder’s right to suspend for non-payment may operate alongside your rights, so do not withhold a progress payment or terminate solely on the basis of this checklist. Obtain advice on the actual breach, notice and local law.

If you have more than one builder proposal, place the documents side by side rather than comparing only the bottom-line price.
| Comparison axis | What a meaningful comparison looks like |
|---|---|
| Scope | Same plans, specifications, inclusions, exclusions and engineering documents. |
| Price certainty | Clear separation of fixed prices, allowances, provisional sums and adjustment formulas. |
| Payments | Comparable deposit and stage amounts tied to defined completed work. |
| Changes | Written approval, transparent pricing, stated margin and time-effect rules. |
| Programme | Start and completion methods, extension events and notice deadlines. |
| Responsibilities | Permits, site costs, access, insurance, utilities, waste and protection of existing property. |
| Aftercare | Warranty, inspection, defects, dispute and termination procedures. |
The proposal with the lowest initial figure may carry more provisional costs or exclusions. Reconcile the documents until each builder is pricing the same job.

Local rules must be checked separately
Victoria, Australia
Consumer Affairs Victoria describes major domestic building contract requirements above its stated project threshold and addresses documentation, deposits, progress payments, insurance and cooling-off matters. The threshold and requirements can change; verify the current official guidance for the project date and value.
New South Wales, Australia
The NSW Government page updated 29 April 2026 describes written contract requirements and job-value bands, with more extensive requirements for larger jobs. Its homeowner checklist highlights licensing, scope, price, variations and cooling-off provisions. Use the band that applies to your job rather than importing a Victorian rule.
California, United States
The Contractors State License Board guidance covers payment schedules, permit responsibility, completion dates, written change orders, written warranties and a down-payment limit for covered home-improvement work. Those requirements apply to California contracts within its scope, not to projects elsewhere.
New Zealand
Building Performance identifies payment processes, defect remedies, dispute resolution and advance agreement about variations among the topics a residential building contract should address, and recommends legal advice.
Bottom line
Sign only when the agreement and its attachments describe the actual build, the builder’s authority is verified, the price and uncertainty are visible, changes require signed approval, and the programme, insurance, warranties, defects, disputes and exit rights are workable under your local law. Independent legal and technical review is the final check that turns a detailed document into an informed commitment.
