Then put the agreed preparation, materials, drainage work where needed, schedule, permits, cleanup, price, payment milestones, warranty, and change-order rules in a signed contract. Licensing, permits, contract rules, and deposit limits vary by location, so confirm them with the relevant local authorities.
Screen the contractor before comparing prices
Start by confirming who is responsible for the job: the contracting business, the person you will deal with, and any subcontractors expected to perform the work. Check the business’s license number and current status with the state or local authority for the property’s location. Where available, review complaint or disciplinary records. A license from another jurisdiction may not satisfy local requirements.
- Verify insurance: Ask for current proof of the coverage relevant to the job, including liability and workers’ compensation where applicable. California’s Contractors State License Board recommends asking for a certificate or checking with the insurer or agency; requirements and coverage vary by location and workforce. California CSLB guidance.
- Check comparable work: Ask for references from driveway or private-road projects of a similar type. Ask past customers about completion, communication, and how problems were handled; view finished work if practical.
- Look for complaint history: Check whether the licensing authority publishes complaints or discipline, and ask the contractor about any concerns you find.
- Clarify who handles permits and inspections: Get the responsible party named in the estimate and contract rather than assuming it is included.
California CSLB recommends obtaining at least three bids based on identical plans, specifications, and scope. That is a useful comparison method, not a universal legal requirement. See its consumer guidance on hiring a contractor.
Make every bid cover the same job
Give each bidder the same basic description: approximate dimensions, current surface and visible problems, intended vehicle use, access constraints, drainage concerns, desired timing, and finish expectations. Approximate measurements can help communicate the project, but do not substitute for a contractor’s site assessment or establish final quantities. Ask bidders to describe their proposed sequence, inclusions, and exclusions. If they recommend different approaches, request a written explanation before comparing totals.

Use this scope checklist to find omissions that can make a low bid look cheaper than it is:
- Removal, repair, or preparation of existing pavement;
- Subgrade or roadbed preparation and any aggregate base work;
- Grading, runoff, drainage structures, and the intended direction of water flow;
- Paving material and the dimensions or quantities included;
- Edges, tie-ins, aprons, transitions, and protection of nearby property;
- Access restrictions, traffic handling, cleanup, and disposal;
- Start date, expected duration, weather delays, and what counts as completion;
- Permits and inspections, including who arranges and pays for them;
- Warranty duration, coverage, exclusions, and how to report a problem.
These are items to discuss, not a universal engineering design. The available consumer guidance does not establish one correct asphalt thickness, base depth, mix, drainage slope, or warranty period for every driveway or private road. For a shared road, substantial drainage concern, unusual vehicle load, or other complex condition, ask local engineering or public works officials what additional advice is appropriate. A North Carolina municipal paving scope treats roadbed reconstruction, aggregate base, drainage infrastructure, and asphalt pavement as distinct components; those public-project requirements are not automatically suitable for private property. Compare bids on scope and risk, not just the total
Once the proposals use a common description of the job, compare them across the same practical criteria. A bid that leaves preparation, quantities, drainage, exclusions, or payment terms vague is not directly comparable to one that spells them out.

| Permits, inspections, and warranty | Who arranges approvals, what warranty is offered, and how are claims handled? |
Do not assume the lowest bid is the best value. Oregon’s Construction Contractors Board advises consumers not to automatically accept the lowest bid; see its contractor tools and consumer guidance.

Put the agreement and changes in writing
Before work begins, sign a contract that identifies the owner and contractor and clearly states the scope, materials, price, payment schedule, start and completion dates, permit responsibility, cleanup, and any warranty or guarantee. Keep a signed copy along with the bids and related communications. California CSLB says home-improvement projects above $500 require a written contract under California rules; that threshold is an example, not a nationwide rule. Its consumer guidance explains contracts and binding agreements.
Require any change to scope, materials, or price to be documented in a written change order signed before the changed work proceeds. California CSLB specifically recommends written, signed changes; other jurisdictions may set different requirements. See CSLB’s change-order guidance.

Set payment terms that protect both sides
Avoid paying the full price in advance. Agree on reasonable milestones, get receipts, and use a traceable payment method. Oregon advises against full upfront payment and cash; Ohio warns against large down payments or paying in full before completion and inspection; Iowa recommends limiting upfront payment and using traceable payments. Check whether the property’s jurisdiction sets deposit limits or other payment rules before signing.
Pause at pressure tactics and bargain offers
Take time to verify a contractor who pressures you to sign immediately, offers a very low price without a complete scope, resists written estimates or contracts, demands cash or full advance payment, or cannot provide credentials and references. Paving-specific warnings include door-to-door low-cost asphalt offers and traveling crews claiming to have leftover material from another job. Those patterns warrant careful checking; they do not, by themselves, prove that every unsolicited offer is fraudulent. See consumer warnings from Arizona, North Dakota, and Oregon.

Confirm local authority and ownership before signing
Rules for licenses, insurance, bonding, deposits, written contracts, and permits depend on where the work is located. Confirm the applicable requirements with the state contractor regulator and local permitting office. If the road is shared, check the road association’s rules, maintenance agreement, or co-owners’ authority before authorizing work. When a shared-road project or its drainage effects may affect others, establish who can approve the scope and who is responsible for the resulting obligations.
