If the condition has damaged your vehicle or other property, make a separate compensation claim with the responsible authority when required. A repair report is not necessarily a claim, and the correct agency, form, and filing deadline depend on where the incident occurred.
What to do first if a road project is unsafe
Do not enter an unsafe work area or put yourself in traffic to collect evidence. For an immediate threat, use the relevant local emergency channel. For a non-emergency defect, use the road authority’s service-request or road-defect reporting process.
New York City, for example, directs people to call 911 about an unprotected street opening that could cause an accident, while other plate conditions and road defects can be reported through 311. Find the agency responsible for the road
Responsibility may rest with a city, county, state, or another public authority. Identify the road owner before assuming that the project contractor, a nearby city office, or the state transportation department handles the report or claim. Record the city or county, road name or route number, nearest cross street, direction of travel, and a precise point such as an address, mile marker, or GPS location.

Agencies may route reports when responsibility is unclear. NYC says an inspector determines responsibility and refers the repair request as appropriate. Louisiana DOTD directs people to its district for hazards on roads it maintains, but says city or parish roadway incidents should go to that local entity; it asks people to establish the parish, road, date, and time before contacting the district. Submit a service report with useful details
Describe what you observed, where it is, and why it presents a hazard or appears defective. Include the project or work zone if known, and note any signs, barriers, or warnings that were present or missing. Ask for a request or reference number, save the acknowledgement, and keep copies of any messages or forms.

New York City’s construction guidance recommends exact address information and says inspectors review reported defects; the repair request may be referred to the responsible utility, company, or agency. Document the incident and damage safely
Make a dated record as soon as you can. A clear record helps you explain what happened and support a later claim; no single photo checklist or evidence standard applies everywhere.

- Write down the date and time, exact location, direction of travel, relevant weather or visibility, and what happened.
- Note witness names and contact details, and preserve any police or incident report.
- Photograph or video the defect and surrounding signs, barriers, and roadway only from a safe place. Preserve the original files.
- If property was damaged, keep photographs of the damage, repair estimates, itemized invoices, receipts, and relevant insurance records.
- Save the service-report number, claim number, submission receipts, agency replies, inspection dates, and a dated log of follow-up contacts.
North Carolina DOT’s incident form asks for exact location details and whether a police report exists. A Federal Highway Administration manual excerpt for a particular federal claim process describes itemized, signed repair estimates or paid receipts as support for repairable property claims and requires the amount claimed. File a separate claim if you seek compensation
Ask the road owner which office receives property-damage claims, which form to use, how to submit it, and what deadline applies. Describe the incident and damage, attach the materials the form requests, and keep a complete copy and proof of delivery. A service request seeks inspection or repair; do not assume it also starts or preserves a compensation claim.

Caltrans describes its government-claims process as an early resolution route, not an insurance program. For specified claims of $12,500 or less, its current guidance routes claims directly to Caltrans; claims above that amount, or involving a different state department or agency, go through California’s Government Claims Program. Who performed the work and whether the authority had notice may matter, but rules differ. Illinois DOT says a claim may depend on whether the agency had prior notice and adequate time, in the circumstances, to repair or warn, and that it is not a general insurer of motorists. North Carolina DOT says a work-zone claim involving a contracted project may be forwarded to the contractor. These examples do not establish the legal test for another state or road owner. Check deadlines and submission rules immediately
There is no single nationwide filing deadline established by these agency examples. Verify the current deadline and submission method directly with the responsible authority, especially if anyone was injured. Rhode Island RIDOT says it handles incidents only on state roads, sets a seven-day receipt deadline for pothole claims and a 60-day deadline for construction-zone claims, and does not accept supporting claim documents electronically. A Federal Highway Administration manual excerpt accessed in 2026 describes a two-year period for the particular federal claim process it covers. It does not establish a general deadline for public-road damage claims. FHWA claims manual excerpt
Agency pages, contacts, and filing instructions can change. Confirm the correct recipient, form, deadline, and accepted delivery method on the responsible authority’s current instructions rather than relying on a deadline from another state or agency.
Follow up if the defect remains
Keep your report and claim records together. If the hazard continues, report it again through the responsible authority’s channel and refer to the earlier request number. Record follow-up dates, inspection details, and any agency response; a report can prompt inspection or repair, but it does not guarantee that a damage claim will be paid.
