Before appointing a contractor for school construction, establish the project scope and procurement rules, then verify each bidder’s legal eligibility, financial capacity, insurance, relevant experience, safety systems, proposed team, programme and price assumptions. Compare complete bids against criteria disclosed in the tender—not price alone—and put payment evidence, change control, safeguarding, reporting, quality standards and completion sign-off into the contract.
Procurement law, licensing, insurance limits, safeguarding checks and prequalification requirements depend on the project’s country, state or territory, funding source and contract form. The process below is a defensible framework; your local authority, school board, funding body and professional advisers determine the rules that actually apply.

Identify who owns the procurement and which rules govern it. A maintained school, academy, independent school, faith school, further-education college and university may follow different governance, funding and approval routes. Check the funding agreement, local-authority or diocesan procedures, public-procurement thresholds, framework obligations and any rules for conflicts of interest or bidder debarment.
Decide whether the work is a new building, extension, refurbishment, modernisation, repair or a package combining several types. The contract form and procurement route should suit the risk, design maturity and value of the work. Record the decision and the people authorised to approve the tender, award and variations.

Define the project brief
Write down the outcome the school must receive, not merely a list of trades. Include the site, existing buildings and services, access restrictions, required standards, room schedules, performance requirements, planning or building-control assumptions, sustainability targets, information-technology interfaces, school term dates and the conditions for acceptance. State what must remain operational and how temporary accommodation or phased handovers will work.
Appoint the right client-side expertise
Assign a project lead with authority to coordinate decisions. Depending on complexity, the client team may also need an architect or designer, building-services and civil or structural engineers, an asbestos consultant, cost consultant, contract administrator, health-and-safety adviser, procurement adviser and digital or information-technology support. Smaller projects can still need specialist input where hazardous materials, structural changes or occupied-site logistics are involved.

In England, the Department for Education’s Construction Framework 2025 is available to local authorities, schools, academies, further-education colleges, universities and other eligible public bodies. Its handbook sets out framework procurement routes, award options and evaluation processes. It is England-specific and must be used with the current handbook and project documents. DfE estate guidance also says schools can use its school-buildings construction framework for large projects estimated above £1 million; treat that figure as route-specific guidance, not a universal threshold, and verify current eligibility before relying on it.
2. Prepare a tender that every bidder can price fairly
A weak tender creates incomparable bids and disputes later. Issue a complete pack containing the scope, drawings and specifications available at that stage, site information, surveys, programme requirements, preliminaries, pricing or cost schedule, health-and-safety requirements, deliverables and the evaluation method.
State the evaluation before bids arrive
Publish the weighting or scoring method for price and quality, the pass/fail requirements, minimum insurance or experience thresholds, interview or presentation arrangements and the timetable. Explain how abnormally low bids, qualifications, alternatives and exclusions will be handled. Use the same questions, evidence requirements, assumptions and deadlines for all bidders. Share material clarifications and addenda with every bidder through the applicable procurement system.
Specify payment and acceptance evidence
If the contract will use staged payments, define the measurement or evidence for each stage in the tender documents. For example, identify the documents, inspections, tests, commissioning records or percentage-complete rules that allow an application for payment. Describe how practical completion, partial occupation, defects correction, commissioning and final sign-off will be determined. DfE guidance recommends considering sign-off during procurement rather than leaving acceptance undefined until the end.

Do not demand speculative design without a lawful reason
Ask for the method statements and design information genuinely needed to evaluate the proposal. Extensive unpaid design work can distort competition and create intellectual-property and liability problems. Some framework routes defer significant design work until after appointment; follow the route’s rules instead of asking every bidder to produce a full design package.
3. Verify the contractor with documents
Request documents in a consistent format, check validity with the issuing body where practical and record expiry dates. A signed declaration is not a substitute for verification.
| Check | Evidence to request | Questions the check answers |
|---|---|---|
| Legal identity and eligibility | Company registration, trading names, ownership information, current contractor or trade licences, tax or registration status and any required debarment declaration | Who is contracting, and is the entity legally permitted to perform this work? |
| Insurance and security | Workers’ compensation or employers’ liability, public or general liability, professional indemnity where design is included, project-specific cover, policy limits and expiry dates; bonds or other security where required | Are the risks insured at the limits and for the period required by law and the contract? |
| Financial capacity | Recent accounts or approved financial information, credit or bank references where permitted, current commitments and aggregate workload | Can the firm fund labour and materials, absorb payment timing and staff this project without overextension? |
| Relevant performance | Named references for comparable schools or occupied public buildings, scope and value, dates, client contact details, defects history and explanation of any dispute or termination | Has the contractor delivered a similar building while protecting occupants and maintaining operations? |
| People and supply chain | Named project manager, site lead or superintendent, design team where relevant, key subcontractors, qualifications, availability and substitution rules | Are the people evaluated actually assigned, and who controls specialist work? |
| Safety and quality | Project-specific safety plan, training records, incident and enforcement history, quality plan, inspection and test plans, method statements and compliance procedures | Does the contractor have a workable system rather than generic policy language? |
| Programme and price assumptions | Baseline schedule, sequencing, milestones, lead times, exclusions, allowances, alternates, inflation assumptions and resource histogram where useful | Is the price complete and is the proposed completion date credible? |
Use local examples as examples, not universal rules
Los Angeles Unified School District requires applicable California licences and annual prequalification for covered bids. Its published requirements include workers’ compensation, insurance, bonding, references or financial statements, district compliance and performance scoring; prequalification must be complete at least five business days before bid. Those are LAUSD-specific requirements and cannot be transplanted to another state or country.
Victoria’s Department of Education contractor occupational-health-and-safety procedure directs a principal or delegate to verify workers’ compensation and public-liability insurance, relevant licences, training and qualifications before work starts. It also calls for contractor records, task documentation and induction. New Jersey’s law for covered school-facility projects requires sworn certification concerning registration and licences, quality and safety programmes, insurance and contract capacity, and uses cost, schedule adherence and quality in performance evaluation. Check your own jurisdiction’s current legislation and school policy.

4. Test the plan for an occupied school
A school is not an ordinary vacant construction site. Require a project-specific plan explaining how the contractor will protect pupils, staff, visitors and neighbours while maintaining teaching and essential services.
Access, separation and safeguarding
- Show hoardings, locked gates, controlled delivery points, pedestrian routes, emergency access and separation between work zones and occupied areas.
- Identify who may enter the site, how identity is checked, where vehicles wait and how deliveries avoid arrival, dismissal and break periods.
- Confirm any background screening, child-safety clearance or visitor-badge requirement mandated by local law or school policy.
- Set supervision arrangements for workers near pupils and a process for reporting safeguarding concerns.
Disruption, hazards and incidents
- List noisy, dusty, odorous or vibration-producing tasks and schedule them around examinations, assemblies and critical teaching.
- Explain controls for asbestos, lead, silica, hot works, temporary services, fire routes, utilities and water shutdowns.
- Require risk assessments and task methods before relevant work, with named approvers and a process for communicating changes.
- Define emergency contacts, incident notification times, evacuation interfaces and coordination with the school’s emergency plan.
Ask for evidence that the proposed site lead has managed an occupied school or similarly sensitive public facility. A generic corporate safety manual does not show that the controls will work on this site.

5. Compare bids on value and deliverability
First check that each bid responds to the same scope. Normalize arithmetic, provisional sums, allowances, exclusions, taxes, alternates, escalation assumptions and owner-supplied items before scoring. Seek clarification through the stated process; do not let one bidder quietly change the rules.
| Evaluation area | What strong evidence looks like | Warning sign |
|---|---|---|
| Price completeness | Line-by-line response, clear inclusions, realistic allowances and reconciliation to drawings and specifications | Unpriced requirements, unexplained exclusions or a total far below every other compliant bid |
| Technical approach | Site logistics, sequencing, temporary works, interfaces and methods tailored to the school | Copied narrative that ignores access, term dates or existing services |
| Programme | Logic-linked activities, procurement lead times, approvals, testing, commissioning, float and phased handovers | Impossible start dates, no allowance for approvals or no plan for long-lead equipment |
| Team and capacity | Named available staff, credible subcontractors and workload evidence | Key people assigned to several projects or replaced after tender without approval |
| Safety and quality | Project-specific controls, inspection and test plans, defect prevention and closeout process | Only generic policy statements or no evidence of corrective action on past incidents |
| Handover and lifecycle value | Commissioning, training, as-built information, warranties, maintenance data and defects response | “Complete” defined only as physical construction with no operating information |
The lowest price is not automatically best value. A bid that omits temporary protection, testing, supervision or realistic preliminaries may become expensive through variations and delay. Apply only the criteria disclosed in the procurement, document moderation and keep an audit trail showing why the preferred bid met the requirements.
6. Make controls contractual before notice to proceed
Have procurement and legal advisers review the proposed form. Reconcile the final scope, drawings, specifications, programme, price breakdown, allowances, exclusions, alternates, insurance, bonds and approved subcontractors into the executed contract.
Include clear operating mechanisms
- Payment: stages, measurement rules, required records, retention or withholding rights where lawful, and payment dates.
- Changes: who may instruct a change, quotation format, time and cost assessment, emergency authority and the rule that unauthorised work is at the contractor’s risk.
- Reporting: progress frequency, cost forecast, risk register, safety statistics, design status, schedule updates and escalation thresholds.
- Quality: inspection and test plans, hold points, samples, commissioning, non-conformance correction and independent inspection where needed.
- School operations: access hours, permits, safeguarding, communications, shutdown approvals, cleaning and reinstatement obligations.
- Completion: objective practical-completion criteria, phased acceptance, defects periods, warranties, training, as-built drawings, operation and maintenance manuals, asset data and final account requirements.
- Remedies and termination: delay processes, recovery plans, rights concerning insolvency or persistent default, and step-in or replacement arrangements where lawful.
Assign an owner-side project lead and contract administrator. Set regular progress reviews, decision deadlines and escalation routes. Use independent inspection and qualified professional sign-off when the nature of the work requires it; acceptance should not depend solely on the contractor’s own certification.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.7. Keep a defensible procurement record
Store the approved brief, tender issue, bidder questions and shared answers, submissions, verification checks, scoring sheets, conflicts declarations, moderation notes, approvals, award notice and executed contract. Record why any bidder was rejected and how clarifications affected the evaluation. Track licence, insurance, screening and bond expiry dates through the works, not just at award.
Proportion matters. Department for Education guidance states: “Your procurement arrangements should ensure that contractor checks are proportionate to the size and duration of the contract.” A small repair still needs appropriate competence and insurance; a complex occupied-campus programme warrants deeper financial, technical, safety and safeguarding review.

Common warning signs and what to do
| Warning sign | Response |
|---|---|
| Certificate or licence expires during the programme | Require renewal evidence and a contractual obligation to maintain coverage; do not assume a pending renewal is valid. |
| Reference client cannot confirm scope or dates | Seek a different comparable reference and investigate the gap before scoring experience. |
| Bid relies on numerous provisional sums | Clarify the basis, obtain surveys or design information where possible and price risk transparently. |
| Named site manager is unavailable | Require an equivalent replacement for approval and reassess capacity before award. |
| Schedule ignores term dates or commissioning | Return it for compliant clarification or reject under the published rules; do not repair the bid informally. |
| Contractor resists site separation, induction or reporting | Treat the refusal as a material capability or compliance concern, not a minor negotiation point. |
Further background
Building and Renovating Schools: Design, Construction Management, Cost Control, fourth edition (Wiley, September 2004, 432 pages, ISBN 978-0-87629-740-7), includes a chapter on contracts and contractor selection. It can provide historical background, but its age means it is not current licensing, safeguarding or procurement guidance. Pair any general principles from it with the rules issued by your current authority and funding body.
Frequently Asked Questions
Should a school always choose the cheapest compliant contractor?
No. The award must follow the published criteria. A complete assessment considers price, relevant experience, team capacity, safety, programme, quality, financial strength and handover obligations; an unusually low price may indicate omissions or an unrealistic plan.
How early should a school appoint a construction professional?
Before the tender documents are finalised, appoint the project lead and any architect, engineer, cost, safety, procurement or contract specialists needed to define the scope and evaluation. Their involvement should match the project’s complexity and risk.
What if a contractor has excellent references but incomplete insurance documents?
Do not treat references as a substitute for mandatory cover. Obtain and verify the required policies and limits before award, subject to the applicable procurement rules; if the bidder cannot meet a stated requirement, follow the published pass/fail process.
