Before committing to a design, check FAA notice criteria, airport noise information, any marking or lighting requirements, and the approvals imposed by your local authority and airport sponsor. The answer for a specific parcel depends on its location, the proposed structure and equipment, and applicable local rules.
Can you build near an airport?
There is no single nationwide airport setback that answers this question for every parcel. FAA review of navigable airspace is one part of the process; local zoning, building permits, airport-related land-use rules and any property easements are separate checks. An FAA determination is not a local building permit and does not settle whether a proposed use is compatible with airport noise.
Start with the local planning or building authority and the airport sponsor. Ask which airport-overlay or height-district rules apply, whether there are noise standards or recorded easements, and whether airport layout or approach protections affect the parcel. Then screen the structure and construction equipment using FAA notice criteria.
How tall can a building be near an airport?
The FAA’s Part 77 notice criteria are a screening test, not a universal height limit. Notice may be required for construction or alteration more than 200 feet above ground level at the site, or for a structure that exceeds specified imaginary surfaces around qualifying airports. Whether a project meets a trigger depends on exact coordinates, ground elevation, proposed height and airport/runway configuration; use the FAA Notice Criteria Tool for the project rather than estimating from distance.

These are the surface descriptions in FAA Form 7460-1, whose current edition date is April 7, 2025. Other provisions and exceptions apply, so the table cannot determine a particular project’s filing obligation. Include rooftop equipment such as antennas in the proposed height information; the FAA also asks for accurate geodetic coordinates and ground elevation.
What happens if notice is required?
Submit FAA Form 7460-1 through OE/AAA when the current criteria require notice. The FAA reviews potential effects on navigable airspace and air navigation facilities; its determination is not permission to build under local land-use or building rules. FAA regional guidance says to submit notice 45 days before construction, recommends 45–60 days in that region, and another regional page describes typical processing of at least 60 days. These are region-specific guidance statements, not a nationwide processing guarantee. File early and confirm the current instructions for the project’s location.

For work on airport property, FAA regional guidance says coordination may be needed even when the project appears on the Airport Layout Plan. Confirm coordination requirements with the relevant FAA office and airport sponsor.
What airport noise checks should you make?
Ask the airport or local jurisdiction for current, site-specific noise exposure information, such as applicable noise contours, and ask which land-use and building standards apply to the parcel. Noise effects vary with airport operations, flight paths, aircraft mix, time of day, terrain and building design, so a property’s distance from a runway is not enough to establish its exposure.

FAA airport land-use guidance, AC 150/5190-4B, addresses compatibility planning and points to AC 150/5000-9B, Guidelines for Sound Insulation of Structures Exposed to Aircraft Noise, for developing sound-insulation approaches where mitigation is recommended through an applicable noise-compatibility or environmental process. This is guidance on planning and treatment, not a guarantee that a particular product will produce a specified indoor noise level.
The FAA Airport Improvement Program Handbook describes noise-insulation projects for residences, schools, hospitals, places of worship, auditoriums and concert halls within DNL 75 dB or greater noise contours under the cited Part 150 framework, and says those uses are never compatible in those contours. That framework does not establish a universal noise threshold for every jurisdiction or every proposed building. The FAA-published Part 150 footnote states: “The responsibility for determining the acceptable and permissible land uses and the relationship between specific properties and specific noise contours rests with the local authorities.”

If sound insulation is being considered
Have the design team compare proposed assemblies against the project’s ventilation, window, egress and condensation needs, as well as the desired indoor noise reduction and installed cost. A qualified acoustical professional can specify an assembly for the building and exposure. FAA guidance supports sound insulation as a mitigation category; it does not establish product-by-product performance or endorse a particular window insert.

Do not choose warning lights or paint based only on a general estimate of airport proximity. If the FAA evaluation finds a structure to be an obstruction or otherwise calls for safety measures, follow the applicable determination and current standards. As of August 11, 2026, the FAA lists AC 70/7460-1N, Obstruction Marking and Lighting, as its current circular. The FAA says the circular describes standards intended to promote aviation safety, but also states that the circular’s contents alone do not have the force and effect of law. Follow the determination and applicable legal requirements for the project.

What information should you gather before seeking review?
Prepare a project package before asking the FAA, airport sponsor or local authority to assess the proposal. Accurate details help screen both the permanent structure and temporary construction activity.
- Property latitude and longitude, ground elevation and a site plan.
- Nearest airport and runway information, including distances to runways.
- Total proposed height above ground, including antennas and other rooftop appurtenances.
- Project drawings and a construction schedule.
- Construction equipment and temporary features that could affect airspace, such as cranes, boom trucks, concrete pumps, drilling rigs, temporary stockpiles, haul routes, staging areas and temporary lights.
Ask the project team to account for temporary equipment as well as the finished building when checking notice requirements. The FAA’s examples of potentially relevant construction activity include cranes and other tall equipment, so do not assume the permanent structure is the only item worth screening.
Who should confirm the project is ready to proceed?
Use the right decision-maker for each question: the FAA for applicable airspace notice and determinations; the local planning and building authorities for zoning, land-use compatibility and permits; and the airport sponsor for airport-specific coordination and constraints. A project can clear one layer and still need action under another. Obtain the applicable determinations and permits before construction rather than treating an FAA airspace review as an all-purpose approval.
