1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsBuying a flat in an unauthorised building can put more than the building’s paperwork at risk: the competent authority may take enforcement action against unauthorised construction, and the buyer may find that a registered sale deed does not protect the structure from that action. A deed and planning approval answer different questions. The legal outcome depends on the location, the specific defect and local law; the Indian court and scheme examples below are not universal rules.
What does “unauthorised” mean for a flat buyer?
A building may be unauthorised because it was constructed without required approval, or because it differs from the approved plan—for example, in its layout, floor or extent of construction. Whether a particular deviation is unlawful, and what can be done about it, depends on the applicable planning rules and the records held by the competent authority.

There are two separate questions to investigate: whether the seller can transfer a valid interest in the property, and whether the building and flat were approved under planning and building rules. Evidence that answers the first question does not necessarily answer the second.
What can go wrong after purchase?
Enforcement may affect the building
Authorities may take action against construction that does not comply with applicable requirements. In a 2024 judgment, the Supreme Court of India affirmed removal of unauthorised construction and rejected the idea that registration, the passage of time or money spent on the property by itself legalises it. The Court stated that “the registration of the property would not in any way amount to regularizing the unauthorized construction.”

That decision establishes a real enforcement risk, not a prediction that every irregularity will lead to immediate demolition. The potential action and procedure depend on the local law, the nature of the violation and the facts of the case.
A registered deed may not resolve the planning issue
A registered sale deed can be important evidence of a transfer, but it is not a substitute for the competent authority’s sanctioned plans and permissions. Nor should a tax receipt, utility connection or long occupation be treated as proof of planning approval unless the applicable local law gives it that effect. In a separate Supreme Court judgment concerning flat purchasers, a reproduced trial-court finding stated: “For immovable properties authorized construction can be shown only by documentary evidence.”

Financing and resale may be uncertain
A lender may decline to finance a property, and a future buyer may face the same questions about approvals and enforcement. The available official example is specific: the Delhi Development Authority (DDA) says that, even under its PM-UDAY rights scheme, loan sanction remains at the financial institution’s discretion. This does not establish that all lenders reject unauthorised properties. Ask the lender to assess the exact flat and documents before committing to the purchase.

Do not assume that an application, payment or seller’s promise means a building has been regularised. In a Supreme Court case involving flat purchasers, the Court reproduced findings distinguishing an unauthorised building from one supported by sanctioned plans. An application for regularisation is not the same as an order granting it.

Delhi: PM-UDAY has a defined scope
The DDA describes PM-UDAY as applying to 1,731 identified unauthorised colonies in Delhi. The scheme provides specified rights subject to its rules; it is not blanket approval for unauthorised construction. Its FAQ also says lending remains subject to the lender’s discretion. The scheme description excludes vacant government land and limits rights over government land to specified built-up footprint and possession conditions. These provisions do not establish that a particular flat qualifies.
Tamil Nadu: consequences described under a state scheme
The Tamil Nadu Building Regularisation Scheme-2017 page says that, where its guidelines do not result in an order of regularisation, the specified unauthorised or deviated building is not to receive electricity, water, drainage or sewerage connections, and is not to be registered under the Registration Act. Those are consequences described for that scheme, not a rule that automatically applies in other states or countries.

- Get the approval file. Ask the seller for the complete sanctioned building plan, any revisions, the building permit, applicable completion or occupancy documents, and the approved floor and layout for the flat.
- Compare the documents with the actual building. Have an independent architect or surveyor check the building and unit against the approved plans. A plan on paper does not establish that the building was constructed in accordance with it.
- Check title and legal records independently. Ask a local property lawyer to review the seller’s title chain, land-use documents, encumbrances, litigation and any authority notices or demolition or regularisation proceedings. The Supreme Court of India has described a buyer’s duty to investigate title and defects: “the doctrine of Caveat Emptor would require the buyer to perform all acts within his capacity to ascertain the title of the seller and the defects in the property.”
- Confirm approval status with the competent authority. Ask whether the required permissions were issued and whether a final regularisation order exists. Do not treat an application or a promise of future approval as an order.
- Obtain a property-specific lending decision. Give the intended lender the relevant documents and ask it to assess this exact flat before you make a non-refundable commitment.
- Put the seller’s statements in writing. Have a lawyer document representations about approvals and disclosed defects, and clarify responsibility for them. Do not rely on oral assurances that an issue will be resolved later.
What should determine your decision?
Before proceeding, make sure the checks establish the answers that matter for this property:

- Has a final regularisation order actually been issued, if one is needed?
- Are enforcement proceedings or notices pending?
- Will your intended lender finance this specific flat?
