What Questions Should You Ask a Luxury Home Builder Before Signing?

Before signing a luxury-home building agreement, make the builder prove five things: a verifiable record, the right insurance and licenses, a precisely defined scope and price, a realistic plan for managing the work, and a warranty you have read in full. Ask the questions below in writing, compare proposals on identical assumptions, and obtain local legal advice for a significant contract.

Start with the builder’s record, people and fit

A luxury project magnifies ordinary construction risks. Complex design, imported or custom materials, extensive site work and numerous subcontractors create more opportunities for unclear responsibility. The first conversation should establish whether the company has handled work comparable to yours and who will actually run your project.

As an Amazon Associate I earn from qualifying purchases.

Relevant experience

  • How many custom homes similar in size, architectural complexity, finish level and site conditions have you completed recently?
  • Which completed homes and active sites may I visit, subject to the owners’ permission?
  • Who on your team has delivered projects of this type, and who will be the day-to-day site supervisor?
  • Which work is performed by your employees, and which is subcontracted?
  • Can you describe a project that experienced a major change or delay and explain how you handled it?

Ask for addresses or photographs that show both finished quality and construction in progress. A completed home demonstrates the result; an active site reveals housekeeping, sequencing, safety practices and how the team protects unfinished work.

Client references

Request several recent clients, including one whose project had a significant change or delay. Ask those owners whether the builder communicated promptly, kept records, controlled costs, met agreed milestones and resolved defects. Ask the most important question directly: would they hire the builder again, and why?

Identity and supervision

  • What legal entity will sign the agreement?
  • Which entity will obtain permits and contract with subcontractors?
  • Who has authority to approve changes, invoices and schedule adjustments?
  • How often will we meet, who is my primary contact, and how will decisions be documented?

Do not assume the person selling the project will supervise it. Put the names, roles and substitution process in the contract.

Verify licensing, insurance and public history

Licensing, registration, permit, lien and deposit rules depend on the state and municipality where the home will be built. Ask for the builder’s license or registration number, then verify it independently with the relevant government agency. Check available disciplinary records, complaints, lawsuits and liens rather than relying only on the builder’s description.

Insurance questions

  • Can you provide current certificates for general liability insurance?
  • Do you carry workers’ compensation coverage, and does it cover every employee working on my project?
  • What insurance, if any, protects the structure and stored materials while the house is under construction?
  • Will subcontractors provide their own certificates, and will you verify them before they begin?

Confirm that certificates are current and identify the insured legal entity. Insurance limits and exclusions matter; ask your own adviser whether the proposed coverage is suitable for the project’s value and risks.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Complaints, claims and liens

Ask whether the builder has faced relevant complaints, construction claims, unpaid-subcontractor liens or unresolved warranty matters. Request details, dates and outcomes. Independently review public licensing and court or property records where those records are available. A past dispute is not automatically disqualifying, but an evasive answer or unexplained pattern deserves caution.

Define the scope, specifications and exclusions

The contract should let a third party determine exactly what you are buying. Attach the latest plans, engineering documents, finish schedules, appliance schedules and material standards. Mark every item as included, excluded or subject to an allowance.

Questions about the written scope

  • Which drawings, specifications and finish schedules are contract documents, and which are only preliminary?
  • What site preparation, excavation, retaining walls, utility connections, testing, landscaping, driveways, pools, outbuildings, security systems, window treatments, temporary services and cleanup are included?
  • Who pays for design coordination, engineering revisions, surveys, inspections and required testing?
  • What assumptions were made about soil, rock, groundwater, access, existing structures and utility capacity?
  • What work is expressly excluded, and how will an owner-requested addition be priced?

Luxury proposals often look comprehensive while leaving high-cost exterior or infrastructure work outside the headline figure. Require a written exclusions schedule and an explanation of every allowance.

Materials and performance standards

“High-end” is not a measurable specification. Identify manufacturer, model, grade, dimensions, finish, performance rating and acceptable substitutes for important products. For custom or imported items, ask who approves samples, who pays for mock-ups, and what happens if a specified product becomes unavailable. Record approved substitutions and their effect on price and schedule.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Understand how the price is built

Ask whether the proposal is fixed price, cost-plus, guaranteed maximum price or another structure. Each can work, but the contract must explain what is included and how uncertainty is allocated.

Fixed-price proposals

Ask what conditions would permit a price change, whether taxes, freight and installation are included, and whether the builder may substitute materials. A fixed price is meaningful only when the scope and specifications are complete.

Cost-plus proposals

Ask how the builder’s fee, general conditions, overhead, contingencies and reimbursable expenses are calculated. Clarify whether the fee is a percentage or fixed amount, whether it applies to change orders, and what audit or backup documentation you may review. Define treatment of discounts, rebates, delivery charges and unused contingency.

Allowances

For every allowance, ask:

  • What dollar amount is budgeted?
  • What product, quantity and quality assumption produced that amount?
  • Who pays for sales tax, freight, storage and installation?
  • Are credits available if the final selection costs less?
  • How are overruns approved and added to the price and schedule?

Large or numerous allowances shift cost risk to you. Compare the assumptions, not just the total.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Compare bids on the same basis

An unusually low bid may reflect omitted work, lower-grade materials, unrealistic allowances or a misunderstanding of the drawings. Give each serious bidder the same plans, specifications, finish standards and questions, then normalize the results.

Comparison axis What to verify
Scope Included work, exclusions, site conditions and owner-supplied items
Specifications Plans, quantities, brands or performance standards, substitutions and finish quality
Pricing method Fixed price, cost-plus or other method; fees, overhead, contingencies and audit rights
Allowances Budgeted amounts, selection assumptions, credits, overages, taxes and installation
Payments Deposit, milestone triggers, invoice backup, retainage if any and payment timing
Schedule Start assumptions, milestones, completion definition and delay procedures
Change control Written authorization, pricing, schedule effect and treatment of emergency work
Risk and credentials License verification, insurance, references, comparable experience and site supervision
Warranty Coverage, duration, exclusions, claim method, response and dispute process
Communication Meeting frequency, reporting format, approval records and escalation path

Ask the builder to explain every material difference between bids. Do not select on the lowest number until you know that the numbers describe the same home.

Test the schedule and decision process

Request anticipated start, major milestones and completion or substantial-completion dates, together with the assumptions behind them. A credible schedule identifies decisions you must make and the consequences of late approvals.

Schedule questions

  • How are permitting, weather, owner selections, long-lead products and supply interruptions reflected in the schedule?
  • How quickly will you report a delay, and what written information will show its cause and effect?
  • Which selections, samples and approvals are due by each milestone?
  • What happens if an approval or payment is late?
  • How is substantial completion defined, and what remains before final completion?

Ask for a current schedule format you can understand, not only a promised number of months. Require updates when assumptions change.

Permits and coordination

Write down who obtains each building, grading, utility and specialty permit; who pays the fees; and who schedules inspections. Clarify responsibility for coordinating architects, engineers, interior designers, landscape professionals, specialty fabricators and subcontractors. Local authorities determine the actual permit requirements.

Site management and security

Ask how access, gates, cameras, keys, deliveries, storage, weather protection, dust control and protection of neighboring property will work. Establish who may enter the site, how incidents are reported and how your personal information and security systems will be protected.

Control payments and changes

Before signing, every payment should be tied to a defined event or documented progress. Ask what is due at signing, what triggers each later invoice and what backup accompanies it. Keep copies of invoices, receipts, approvals, selections, schedules and correspondence.

Change-order questions

  • How is a requested change documented and priced?
  • Must you approve it in writing before work starts?
  • Does the change add time as well as money?
  • How are credits, deleted work, design fees, taxes and contractor markups calculated?
  • What procedure applies to emergency work needed to protect people or property?

Do not rely on a text message or site conversation for a costly promise. Put the description, price, schedule effect and authorization in a signed change order.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Pausing, termination and nonperformance

Ask what happens if either party must pause or terminate the project, if the builder becomes unable to perform, or if a payment dispute arises. Clarify notice periods, payment for completed work, ownership of purchased materials, protection of the site, access to project documents and the process for replacing the builder. Have counsel check these provisions for your jurisdiction.

Disputes and records

Ask how defective work, disputed invoices and delays are escalated. The agreement may require a particular notice, mediation or arbitration before a lawsuit. Understand deadlines, venue, fees and whether you can withhold disputed amounts. Never make payments without a signed contract and retain proof of every payment.

Read the warranty before you commit

Request the complete proposed warranty and homeowner manual, not a sales summary. A builder warranty is the builder’s or a third-party warranty provider’s promise; it is different from a separately purchased home service contract.

Coverage and duration

  • Who backs the warranty?
  • Which workmanship, material, system and structural defects are covered?
  • What exclusions apply, including maintenance, normal wear, owner-supplied products, landscaping or consequential damage?
  • What duration applies to each category?
  • What notice method and deadline apply to a claim?

The Federal Trade Commission notes that new-home warranties commonly provide limited, component-specific coverage. Its examples include one year for workmanship and materials on many components, two years for heating, ventilation, air-conditioning, plumbing and electrical systems, and up to ten years for major structural defects with some builders. Those are examples, not a promise about your builder.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Claims and remedies

Ask who inspects a claim, who performs repairs, how quickly the response must occur and what happens if the builder disagrees. Ask whether temporary accommodation, storage, moving or other consequential costs are covered; many warranties do not cover out-of-pocket relocation expenses. Determine whether mediation or arbitration is required and what notice language preserves your rights. Review the warranty with counsel before signing.

Use a final pre-signing checklist

  1. Verify the license or registration number with the applicable state or local agency.
  2. Check available complaints, disciplinary actions, claims and liens.
  3. Call recent clients and visit comparable completed and active projects where permitted.
  4. Confirm current liability and workers’ compensation certificates and the insured legal entity.
  5. Match the final plans, specifications, schedules and finish selections to every bid.
  6. Mark every inclusion, exclusion, allowance, owner-supplied item and site assumption.
  7. Confirm the pricing method, fees, contingencies, taxes, credits and overrun rules.
  8. Set payment triggers, invoice documentation and change-order approval in writing.
  9. Assign responsibility for every permit, inspection, consultant and coordination task.
  10. Agree on schedule assumptions, reporting, decision deadlines and delay notices.
  11. Read termination, dispute, mediation, arbitration, lien and warranty provisions.
  12. Have a local construction lawyer review the complete agreement and attachments.

Red flags that justify a pause

  • The builder says a written contract is unnecessary. The National Association of Home Builders’ consumer guidance puts the point plainly: “Don’t hire anyone who tells you a contract ‘won’t be necessary.’”
  • You are pressured to sign before receiving plans, specifications, exclusions or the warranty.
  • The proposal is far below comparable bids without a clear scope-based explanation.
  • Allowances are large, vague or unsupported by quantity and quality assumptions.
  • Insurance certificates, license information, references or public-history questions are avoided.
  • Payment is demanded without a signed agreement or without progress documentation.
  • Verbal promises are not added to the contract or change-order process.
  • No one can identify the site supervisor, permit holder or person responsible for decisions.

The Consumer Financial Protection Bureau’s contractor guidance gives the same practical warning in broader terms: “Never sign a contract without carefully reading it, and always ask questions.” For a high-value custom home, unanswered questions are a reason to delay signing, not a reason to hope the details will work out.

Account for local rules and professional advice

Federal consumer guidance and industry checklists are useful for vetting and documentation, but they do not establish the law for an unidentified state or municipality. Deposit limits, licensing categories, lien notices, permit procedures, required contract language and dispute rights vary by location. Confirm requirements with the authority having jurisdiction and obtain local legal review before committing substantial funds.
