It is not a statewide ban on construction or a cancellation of every project. On October 6, 2026, Governor Kathy Hochul and U.S. Representatives Alexandria Ocasio-Cortez and Pat Ryan discussed the policy and local concerns during a visit to Fishkill Farms in East Fishkill.
What happened in East Fishkill
Hochul, Ocasio-Cortez, and Ryan met with local farmers, advocates, and businesses at Fishkill Farms in Dutchess County to discuss proposed data-center development and concerns involving land use, water, energy costs, and local impacts. What the statewide moratorium does—and does not do
Announced July 14, 2026, the state measure directs the Department of Environmental Conservation not to issue specified discretionary environmental permits for new hyperscale data centers while New York develops a generic environmental impact statement and regulatory framework. The Governor’s Office described the pause as lasting up to one year. Projects whose permit applications had already been deemed complete are outside the pause, according to the announcement. For construction and development, the key distinction is between a permit pause and a blanket prohibition. The announcement concerns specified state environmental permits; it does not say that all data-center construction, all permitting, or all local decision-making stops. A project’s status may depend on which permits it needs and whether an application had already been deemed complete. The announcement does not provide a project-by-project determination.

How the state pause differs from East Fishkill’s local action
The two measures operate at different levels. The statewide measure pauses issuance of specified discretionary state environmental permits for up to one year. East Fishkill’s separate action was described at the event as a three-year local moratorium. The event account does not establish the local measure’s full legal scope or precisely which local applications or approvals it covers.

What New York plans to evaluate
The state says its generic environmental impact statement will assess potential effects of data centers on energy demand, water use and quality, and air quality. These are subjects for analysis, not findings that every proposed facility will cause a particular level of harm. The Governor’s Office sources do not provide a quantified statewide estimate of data-center energy or water demand.

Hochul summarized the administration’s concern in July: “The bottom line is progress shouldn’t arrive with a higher utility bill, deleted water supply or noise pollution.” Governor’s launch transcript, July 14, 2026. The state’s stated rationale is to examine potential pressure on energy demand, water resources, the grid, and nearby communities before setting consistent standards.

Community benefits and energy measures are still being developed
The July announcement laid out several next steps, but it should not be read as proof that every proposed measure is already in force.
- Community Investment Framework: Empire State Development was directed to issue guidance within 60 days to help local entities negotiate community benefits. Examples included infrastructure improvements, childcare investment, and direct financial support.
- Workforce provisions: The announced framework was expected to address organized labor, prevailing-wage standards, project labor agreements, local hiring, apprenticeships, and workforce development. These were intended topics for guidance, not a statement that each is a current requirement for every project.
- Grid and power costs: The Department of Public Service was directed to consider a New York Grid Acceleration Fund and approaches that could require data centers to fund new clean generation or contribute to grid infrastructure. The state also said it had begun a proceeding under which data centers would either pay more for energy or supply their own power.
- Sales-tax exemptions: The administration said it would pursue legislation to repeal sales-tax exemptions for massive data centers; the announcement described a legislative aim, not an enacted repeal.
The Governor’s Office framed the objective as setting strong standards while ensuring local residents share in the benefits: “New York will lead the way in creating the strongest standards in the nation for data center development, ensuring that when companies succeed because of New York, New Yorkers succeed too.” Governor’s Office announcement.

What the policy means for communities and project teams
For local governments, the pause creates time to consider land-use choices and community priorities while the state develops environmental standards. The state’s announcement explicitly leaves local zoning and approvals relevant to future projects. The community-benefits guidance is intended to help local entities negotiate, but the release does not make those examples automatic conditions of approval.
For developers, owners, and construction teams, the immediate practical issue is permit status: whether a project needs one of the specified discretionary state environmental permits and whether its application was already deemed complete. Separately, local zoning and approval requirements remain important. The state’s proposed energy and community-benefit measures could shape future project costs or negotiations, but their final terms and implementation should not be assumed from the July announcement alone.

The administration has characterized the moratorium as nation-leading. The cited announcements do not provide a peer-state comparison establishing that ranking, so it is best understood as the Governor’s Office’s description rather than an independently demonstrated comparative finding.
