Apply promptly, preserve wage and employment records, and do not assume a 1099 label or subcontractor agreement removes coverage. The administering agency or insurer decides individual eligibility.
Start with the event that stopped your work
Different New York programs answer different problems. Using the wrong application can delay payment or create an overlap problem.

| What happened | Program to investigate | Main eligibility issue | Administrator or payer |
|---|---|---|---|
| A seasonal, temporary or other job ended through no fault of your own | Unemployment insurance (UI) | Covered wages, qualifying separation, ability and availability to work, and active job search | New York State Department of Labor (DOL) |
| An injury or illness arose out of work | Workers’ compensation | Work-related medical condition and resulting treatment or lost work | Workers’ Compensation Board process, employer and its carrier |
| An illness or injury began away from work and prevents working | New York disability benefits | Non-occupational disability, medical certification and timely filing | Employer or disability-benefits carrier, with special-fund rules in some cases |
| You need time to bond with a child, care for a family member, or assist a family member deployed abroad | Paid Family Leave | Qualifying family purpose and the applicable service requirement | Your employer’s PFL insurer or plan |
A single worker can experience more than one event, but benefits are not automatically interchangeable. In particular, disability benefits and UI cannot be paid for the same period. Workers’ compensation and UI can interact when a worker remains capable of some work; ask the agencies handling the claims how to report partial capacity.
Unemployment insurance when a construction job ends
When a seasonal or temporary layoff may qualify
New York describes UI as temporary income for an eligible worker who loses work through no fault of the worker. The end of seasonal or temporary construction employment is listed as a potentially qualifying separation. The DOL still examines the complete record: whether the work was covered, the reason employment ended, wages in the applicable base period, whether you are ready and able to work, and whether you are conducting the required job search.

If you worked in New York during the prior 18 months, you have the right to apply. A former employer’s statement that workers were “not covered” does not decide the claim; the DOL makes the determination after receiving your application and information. File even when coverage or classification is uncertain.
Apply during your first week without work
- Submit the claim during the first week of unemployment through New York’s online UI portal, which the state prefers. Telephone filing is also available.
- Have your Social Security number, mailing address, telephone number, and identification available. Provide an alien registration number if applicable.
- List every employer and address for the preceding 18 months, including employers outside New York. Include the most recent employer’s registration number or federal employer identification number (FEIN) if you have it.
- Submit the claim even if a document is missing. The DOL can accept an application without every item, but missing information can delay the first payment.
- After filing, certify each week you remain unemployed and answer DOL questionnaires or agency calls quickly. Failure to certify or respond can interrupt a claim.
2026 wage test
For claims filed in 2026, the DOL FAQ states that you must have wages in at least two base-period calendar quarters, at least $3,500 in one quarter, and total base-period wages of at least 1.5 times your high-quarter wages. The agency applies a cap to the high-quarter earnings used in the calculation. These are claim-year thresholds, not permanent numbers; check the current DOL guidance when filing in a later year.
When payment arrives and a planned 2026 interruption
For a completed claim, New York says the first payment generally arrives two to three weeks after processing. Requests for additional information can extend that period. The DOL currently warns of a planned system upgrade beginning November 2, 2026. Services are expected to be unavailable for approximately nine to 12 days, and payments may be delayed until claimants file or certify in the upgraded system. Confirm the notice immediately before relying on those dates, because the schedule can change.

Does a 1099 or subcontractor label remove construction coverage?
Not by itself. New York’s Construction Industry Fair Play Act took effect October 26, 2010. For accidents on or after that date, a person performing services for a contractor is generally presumed to be that contractor’s employee for workers’ compensation, disability benefits and PFL, unless the statutory independent-contractor tests are met.

The individual-worker test
The Board describes three core elements for an individual to be treated as an independent contractor: freedom from control and direction in performing the work, work outside the hiring entity’s usual course of business, and an independently established trade, occupation, profession or business. The facts of the working relationship matter more than the label on an invoice.
The business-entity test
A separate, more detailed statutory test applies when the contracting party is a business entity. Incorporation, a business name, or issuing a 1099 does not automatically satisfy that test. Gather the contract, payment records, who directed daily work, who supplied equipment, and whether you operated an established business before asking the Board or an adviser to assess classification.
Workers’ compensation for a job-related injury or illness
What it covers
Workers’ compensation is the route for an injury or occupational illness arising out of and in the course of construction work. The Workers’ Compensation Board overview states that necessary medical care for a work-related condition is covered regardless of how much time you miss. Treatment is provided through Board-authorized medical providers under the workers’ compensation process.
A claim may be medical-only, or it may also seek wage-replacement benefits if the condition keeps you from working. Do not assume that a medical-only report automatically produces lost-wage payments.

When lost-wage benefits generally start
The Board says lost-wage benefits generally begin on the eighth missed day when the worker misses eight to 14 days. If the absence reaches 15 days or more, payments may be made starting with the first missed day. The exact amount and payment decision depend on the claim’s medical and employment facts.
Steps after an injury
- Obtain prompt medical evaluation and tell the provider the condition is work-related.
- Report the injury to the employer promptly and preserve the date, location, witnesses, photographs, work orders and medical records.
- Use the Workers’ Compensation Board’s current instructions to start the claim and identify the employer’s carrier or claims administrator.
- Attend requested medical examinations and keep copies of every form and communication.
- Tell the Board and the carrier whether you are seeking treatment only or also wage-loss benefits.
Filing deadlines and notice rules can vary with the facts. Use the Board’s current instructions rather than relying on a generic deadline remembered from another case.
Disability benefits for an off-the-job condition
How disability differs from workers’ compensation
New York disability benefits address a qualifying illness or injury that does not arise out of employment and prevents you from working. A construction worker with a non-work-related surgery, illness or accident may use this program; a condition caused by a workplace event belongs in the workers’ compensation system.

- Complete your portion with the disability start date, employer information and contact details.
- File generally within 30 days after the disability begins.
- If disability starts within four weeks of your last day worked, send the claim to the employer or its disability carrier.
- If disability starts more than four weeks after work ended during a specified unemployment situation, check the state’s special-fund instructions to determine where it belongs.
Do not collect UI and disability benefits for the same period. UI requires that you be able and available to work, while disability benefits require a condition that prevents work.

Qualifying reasons
PFL provides job-protected paid leave to bond with a newly born, adopted or fostered child; care for a family member with a serious health condition; or assist a spouse, domestic partner, child or parent deployed abroad on active military duty. Covered workers retain health-insurance rights during qualifying leave and are protected against discrimination or retaliation connected with exercising PFL rights.
Ordinary service requirement
The standard requirement is 26 consecutive weeks of employment for a full-time employee or 175 days worked for a part-time employee. Review the current employee-eligibility and claim-form instructions with your employer’s PFL insurer, especially if you work intermittently across projects.

Multiple union-contract employers: change effective January 1, 2027
Legislation signed December 19, 2025 creates a special PFL eligibility standard for certain construction employees who work for multiple employers under a collective bargaining agreement (CBA). The covered work includes construction, demolition, reconstruction, excavation, rehabilitation, repairs, renovations, alterations and improvements for multiple CBA employers.
The announced rule says: “Such employees will become eligible for PFL if they have been in employment for at least 26 of the last 39 weeks with a covered employer signatory to a collective bargaining agreement.” It takes effect January 1, 2027. It is not an eligibility rule for claims filed before that date. As implementation approaches, confirm the definition of a covered employee, the proof required across employers and the correct claim process with the state and your plan.
How to choose and coordinate a claim
Use dates to separate programs
- Record the last day worked and the date the job ended for a UI claim.
- Record the accident or exposure date for workers’ compensation.
- Record the first day the off-the-job condition prevented work for disability benefits.
- Record the date family leave is needed and the relationship or qualifying event for PFL.
Check work capacity before filing
UI requires readiness, ability and availability for work, plus active job search. Disability requires inability to work because of a non-occupational condition. Workers’ compensation can involve medical treatment with or without wage loss. PFL is leave for a qualifying family purpose, not a substitute for either disability program.

Ask before overlapping payments
Tell each agency or carrier about other claims covering the same dates. Disability and UI cannot cover the same period. A worker who can perform some work while receiving workers’ compensation may have a UI issue that requires individualized guidance. Never certify that you are fully available for work without accounting for medical restrictions.
One preparation checklist for any application
- Write a timeline with the last day worked, separation, injury, disability onset or family-leave dates.
- Collect pay stubs, wage statements, schedules, contracts, union records and employer contact information.
- Keep identity and contact information current, including Social Security information and an alien registration number when applicable.
- Save medical reports, provider details, injury photographs, witness names and restrictions when a health condition is involved.
- For UI, apply in the first week and certify every week.
- For disability, use Form DB-450 and observe the 30-day filing period.
- For PFL, locate the employer’s insurer or plan and use its current claim instructions; the Workers’ Compensation Board’s employer-coverage search can help identify the carrier.
- If called a contractor, apply the Fair Play Act tests to the actual relationship rather than relying on a 1099.
- If you work for several CBA employers, track each employer and weeks worked, and mark January 1, 2027 for the new construction-worker PFL rule.
Where to get a decision on your situation
This guide cannot determine an individual claim. The New York State Department of Labor decides UI eligibility; the Workers’ Compensation Board and the employer’s carrier handle work-related injuries; the employer or disability carrier handles non-occupational disability claims; and the PFL insurer or plan handles family-leave claims. Provide complete, consistent dates and respond quickly to requests. Coverage, union agreements, medical evidence, classification facts and filing timing can change the result.
