In the United States, a shipyard does not have one universal construction permit. The required approvals depend on the parcel, acreage disturbed, wetlands and navigable waters affected, dredging and disposal plans, air-emission sources, wastewater, coastal-program rules, and any federal funding or authorization. Most waterfront projects should screen construction stormwater, Clean Water Act Section 404, Rivers and Harbors Act Section 10, Clean Water Act Section 401 certification, coastal-zone consistency, air permits, and federal environmental review before design is finalized.
Start with the project facts, not a generic permit list
This overview describes the U.S. federal framework. State, tribal, territorial, and local governments may administer federal programs or impose additional approvals. A permit inventory cannot be finalized until the project team identifies the site and its activities.

Resolve these questions during site selection and concept design:
- Which state, federal district, tribe, territory, coastal-management program, county, municipality, and port authority have jurisdiction?
- Will construction disturb wetlands, streams, tidal waters, floodplains, or other potentially jurisdictional waters?
- Will the project dredge, place fill, construct a pier, wharf, bulkhead, seawall, launch ramp, pile-supported structure, or other work in navigable water?
- How many acres will be disturbed, including connected phases covered by one common plan?
- Where will stormwater, sanitary wastewater, process water, and vessel-maintenance discharges go?
- What boilers, generators, paint or coating operations, abrasive blasting, fuel systems, or other stationary sources will be installed or modified?
- Is a federal agency providing money, land, a license, a permit, or another approval?
- Could protected species, critical habitat, historic properties, essential fish habitat, or culturally significant resources be affected?
- If dredged sediment is produced, will it be reused, placed upland, placed in a confined facility, or disposed of at sea?
These answers determine which agencies lead, whether a general or individual permit is available, and whether reviews must occur before construction contracts are awarded.

Construction stormwater: the one-acre screen
When coverage is generally required
A Clean Water Act National Pollutant Discharge Elimination System (NPDES) construction-stormwater permit is generally required when construction activity disturbs one acre or more and discharges stormwater to waters of the United States. The same threshold can apply to a smaller phase that is part of a common plan of development or sale that will ultimately disturb at least one acre. The one-acre figure is a permit-applicability threshold identified by the U.S. Environmental Protection Agency, not an industry performance statistic.
“Disturbance” can include clearing, grading, excavation, utility installation, road and parking construction, building pads, drainage work, and staging areas. A project team should map the entire common plan rather than treating each contract package as an isolated parcel.
Who issues the permit
EPA administers NPDES in some jurisdictions. In many states, tribes, and territories, an authorized permitting authority issues the construction coverage under its own program. The applicable state permit may contain different forms, deadlines, electronic-filing rules, inspection frequencies, or numeric conditions. Confirm the issuing authority for the actual parcel instead of assuming that an EPA-issued permit applies.

Construction coverage typically requires an erosion and sediment control design and a stormwater pollution prevention plan (SWPPP). The SWPPP identifies pollutant sources, drainage areas, receiving waters, control measures, inspection procedures, corrective actions, and personnel responsible for implementation. Typical controls include stabilized entrances, perimeter sediment barriers, inlet protection, sediment basins, phased grading, slope stabilization, concrete-washout controls, spill-response measures, and prompt stabilization of inactive areas.
Obtain coverage before the permit’s required start point, maintain the SWPPP as site conditions change, and retain inspection and corrective-action records for the period specified by the permit. Earthwork, waterfront construction, and stockpiled soil often make shipyard sites especially vulnerable to sediment releases, so the drainage plan should address tides, storm surges, dewatering, and contaminated fill where applicable.

Wetlands, dredging, and fill under Section 404
When a wetlands or dredge-and-fill permit is triggered
Clean Water Act Section 404 regulates the discharge of dredged or fill material into waters of the United States, including wetlands. Filling a wetland for a building pad, placing rock for a bulkhead, discharging excavated material during shoreline work, or placing structural fill in a jurisdictional water can therefore require authorization.
“Section 404 of the Clean Water Act (CWA) establishes a program to regulate the discharge of dredged or fill material into waters of the United States, including wetlands.” — U.S. Environmental Protection Agency

Jurisdiction is site-specific and can depend on current statutory, regulatory, and judicial interpretations. Have the responsible authority confirm whether mapped wetlands, streams, tidal areas, or other features are jurisdictional before relying on a desktop map or an old delineation.
General permit or individual review
A general permit may cover activities expected to have only minimal adverse effects when all stated conditions and thresholds are met. Larger, more complex, or environmentally significant work may require an individual permit with project-specific analysis, public notice, alternatives review, and special conditions.
The basic sequencing principle is avoid impacts where practicable, minimize unavoidable impacts, and compensate for remaining unavoidable losses when required. That sequence affects layout: moving a building or access road away from a wetland can be less costly than designing mitigation after the footprint is fixed. Secure a jurisdictional determination and discuss the proposed design with the responsible permitting authority early, particularly where the project includes multiple waterfront structures.

Dredged-sediment management
Dredging creates a separate question: what happens to the sediment? EPA and the U.S. Army Corps of Engineers share responsibilities for dredged-material management under the Clean Water Act and the Marine Protection, Research, and Sanctuaries Act. Reuse or placement in an upland or aquatic location can require different approvals, testing, and containment measures. Ocean disposal may require a permit under the Marine Protection, Research, and Sanctuaries Act. The correct path depends on the disposal location, sediment characteristics, and method of placement; do not treat a dredging authorization as automatic permission to dispose of the material.

Waterfront structures: Section 10 of the Rivers and Harbors Act
Section 10 authorization may be required for structures or work in, over, or affecting navigable waters of the United States. Shipyard features that may require screening include piers, wharves, docks, bulkheads, seawalls, dolphins, pile fields, dredging, and shoreline alterations. Applicability depends on the waterbody, exact location, and activity, so a waterfront address alone does not answer the question.
The Corps’ review considers project benefits and adverse effects through a public-interest process. Submittals commonly need accurate plans, coordinates, construction methods, navigation information, environmental data, and an explanation of how the design avoids or reduces impacts. Section 10 can apply alongside, rather than instead of, Section 404: a project may need one authorization for a structure in navigable water and another for dredged or fill material.
Section 401 water-quality certification
When a federal license or permit may result in a discharge, Section 401 of the Clean Water Act creates a separate state or tribal water-quality certification question. The certifying authority evaluates whether the activity can comply with applicable water-quality requirements and may impose conditions, monitoring, or mitigation.
Screen Section 401 at the same time as Section 404, Section 10, and other federal authorizations. A project can be delayed if the federal permit application is complete but the certification request, public notice, or required information is missing. The certifying state or tribe, filing method, review schedule, and scope of conditions vary by jurisdiction.

Coastal-zone consistency
The Coastal Zone Management Act may require a consistency determination when a project affects coastal-zone land or water uses governed by an approved state coastal-management program. Federal permits such as Section 404, Section 10, and certain dredged-material authorizations can be part of that consistency process.
Being near the ocean does not by itself prove that consistency review applies. Confirm whether the parcel lies within the state’s designated coastal zone, which enforceable policies apply, and whether the project sponsor, a federal agency, or another applicant must submit the determination. Design changes addressing public access, shoreline setbacks, habitat, water quality, or coastal hazards may be needed before the federal authorization can proceed.
Air permits for shipyard construction and equipment
Screen new or modified stationary sources under Clean Air Act New Source Review and the applicable state or federal implementation program. Potential sources can include paint and coating operations, abrasive blasting, welding, fuel storage and transfer, emergency generators, boilers, solvent use, and material-handling equipment. A source may need a construction permit before installation, an operating permit afterward, or both, depending on emissions and jurisdiction.
Do not decide applicability from the label “shipyard.” The project team must identify each emission unit, estimate potential and actual emissions, account for controls and operating hours, and determine whether the modification increases regulated emissions. State thresholds and permit forms differ, and the available facts do not establish that every shipyard needs a particular air permit.

NEPA and related federal environmental reviews
NEPA is tied to federal action
The National Environmental Policy Act is not a blanket approval required for every privately financed shipyard. It applies when there is a qualifying federal action, such as federal funding, federal land, a federal license or permit, or an agency decision to undertake or approve the project. The agency with the federal action generally determines the appropriate level of review, which may be a categorical exclusion, environmental assessment, or environmental impact statement.

For NPDES permits, EPA’s NEPA procedures apply only to certain EPA-issued permits, including permits for “new sources.” A state-issued permit does not automatically create the same federal NEPA pathway.
Consultations that can accompany federal action
Depending on affected resources, the lead federal agency may also need consultation or review under:
- Endangered Species Act Section 7 for listed species and critical habitat;
- National Historic Preservation Act Section 106 for historic properties and cultural resources;
- Essential fish habitat provisions and fish-and-wildlife coordination;
- Coastal-zone consistency requirements; and
- Other resource-specific statutes or executive requirements applicable to the federal action.
Screen the federal nexus before promising an environmental assessment or impact statement. A private project with no federal action may still need state environmental review, wetlands analysis, cultural-resource work, or species surveys under other authorities.

Operating permits after construction
Construction stormwater coverage ends or changes when the construction phase is complete, but an operating shipyard can have a separate industrial-stormwater obligation. EPA sector guidance addresses stormwater discharges from ship and boat building or repair yards. Typical industrial permit elements include an operational SWPPP, best management practices, routine inspections, employee training, and monitoring or reporting.
Operational controls may need to address hull washing, painting and coating, abrasive blasting, welding residues, scrap, oils, fuels, solvents, metals, waste containers, and outdoor storage. The available sector fact sheet is older guidance, so verify the current industrial permit and state requirements before relying on its detailed conditions. Also determine whether process wastewater must receive pretreatment or a separate discharge authorization, or instead be sent to a publicly owned treatment works under its requirements.
A practical permitting sequence
- Define the footprint. Map all buildings, roads, utilities, laydown areas, dredging limits, shoreline structures, and temporary work areas, including future phases in the common plan.
- Confirm jurisdiction. Obtain a wetlands and waters review, identify navigable waters, and contact the applicable Corps district, EPA or authorized NPDES authority, coastal agency, air agency, and local governments.
- Build a discharge and emissions inventory. List stormwater outfalls, dewatering, sanitary and process wastewater, dredged material, coating and blasting sources, fuel systems, generators, and boilers.
- Screen federal triggers. Determine whether Section 404, Section 10, Section 401, coastal consistency, NEPA, species consultation, historic-preservation review, or fish-and-wildlife coordination is implicated.
- Choose the permit pathway. For each activity, document whether a general permit is available or an individual application is required, and record the issuing authority and expected review sequence.
- Design around avoidance and controls. Adjust the layout to avoid wetlands and sensitive resources, phase earthwork, specify erosion controls, and incorporate spill prevention, sediment containment, and emission controls into bid documents.
- Submit complete applications. Coordinate federal, state, tribal, territorial, and local filings so that one approval does not expire while another is still pending.
- Maintain compliance during construction. Keep the SWPPP and drawings current, perform required inspections, document corrective actions, follow permit conditions, and report incidents as required.
- Transition to operations. Close out construction coverage when eligible, obtain industrial-stormwater and air operating approvals, and establish inspection, training, monitoring, and recordkeeping programs.
Common mistakes that cause delays
- Assuming one federal checklist applies everywhere: state authorization, coastal boundaries, local shoreland rules, and tribal or territorial requirements can change the path.
- Splitting a common plan into artificial phases: the one-acre construction-stormwater threshold can consider the total planned disturbance.
- Treating a wetlands map as a permit decision: field conditions and current jurisdictional determinations control.
- Combining Section 404 and Section 10: dredge/fill and navigable-water structures are related but distinct triggers.
- Leaving disposal until after dredging is designed: sediment testing, placement location, and ocean-disposal rules can determine whether the work is feasible.
- Calling NEPA automatic: the federal action and responsible agency must be identified first.
- Stopping environmental planning at construction: industrial stormwater, air, wastewater, waste, and spill controls continue after the yard opens.
- Using old sector guidance as current law: verify the permit in force for the site and date, especially for operating shipyard stormwater.
What a site-specific permit matrix should contain
| Activity or issue | Possible authority | Trigger to verify | Typical phase |
|---|---|---|---|
| Earth disturbance and runoff | NPDES construction stormwater program | At least one acre disturbed, or a smaller phase within a qualifying one-acre common plan, with stormwater discharge | Construction |
| Wetland or water fill | Clean Water Act Section 404 | Discharge of dredged or fill material into jurisdictional waters | Construction |
| Piers, bulkheads, dredging, and other waterfront work | Rivers and Harbors Act Section 10 | Structures or work in or affecting navigable waters | Construction and maintenance |
| Water-quality certification | Clean Water Act Section 401 | Federal license or permit that may result in a discharge | Before related federal authorization |
| Coastal consistency | Coastal Zone Management Act and state coastal program | Covered federal action or permit affecting enforceable coastal policies | Federal authorization |
| Stationary air sources | Clean Air Act New Source Review and implementation program | New source or modification with regulated emissions | Construction and operation |
| Federal environmental review | NEPA and related consultation statutes | Qualifying federal funding, land, permit, license, or agency action | Project approval |
| Outdoor industrial runoff | NPDES industrial-stormwater program | Operational ship or boat building or repair activities with regulated stormwater discharge | Operation |
The matrix is a screening tool, not a legal determination. Final applicability depends on the site, design, discharge route, agency jurisdiction, and permit terms in effect when the project is submitted.
