What Makes a Public Market Accessible to Shoppers with Disabilities?

A public market is accessible when shoppers with disabilities can get there, move through it, reach goods and services, use amenities and communicate with staff. Here’s what to look for.

A public market is accessible when shoppers with disabilities can travel from their arrival point to the entrance, move through the market, reach goods and services, complete transactions, use public amenities, and communicate with staff. Access must work across the whole visit: an open route does not help if merchandise is unreachable, and an accessible stall is ineffective if a queue blocks the way to it.

For a construction or renovation project, that means considering both the site and the way it will operate on market day. The legal requirements depend on the market’s operator, property and circumstances; practical market-design guidance is useful, but it is not a substitute for checking applicable standards.

Start with the complete route, not just the entrance

Accessibility begins before a shopper reaches the market gate. Where parking, loading areas, sidewalks or transit stops are part of the arrival options, a usable route should connect them with entrances and the areas open to shoppers. The U.S. Access Board explains accessible routes in its Guide to the ADA Accessibility Standards: Chapter 4—Accessible Routes.

Once inside, the path needs to remain usable during business hours. NCHPAD’s Accessible Farmers’ Markets guidance recommends smooth, firm, unbroken paths at least three feet wide. That is a practical recommendation in market-setting guidance, not a statement that this measurement alone establishes compliance with the ADA Standards. Confirm the applicable requirements for the specific site.

Temporary conditions matter as much as the built route. Cords, signs, display tables, merchandise, queue barriers and vendor equipment can narrow or block circulation. Plan where these will go, keep routes clear while the market is operating, and make sure level changes and signs do not make the way difficult to follow.

Make stalls, goods and checkout usable

Shoppers need to be able to approach vendor booths and merchandise, including from a seated position, and use sales and service areas. Review the layout from the shopper’s perspective: Can someone get close enough to see and select goods? Can they reach a counter and complete a purchase? Is the route to that counter still clear when people are waiting?

Staff assistance can be helpful for navigation or gathering items, but it should not be treated as a replacement for access to the goods and services the market offers. The Department of Justice’s guidance for businesses open to the public states: “Businesses must provide people with disabilities an equal opportunity to access the goods or services that they offer.” See ADA.gov, Businesses That Are Open to the Public.

Include restrooms, amenities and communication

If the market offers restrooms, seating, drinking water or other amenities, consider whether an accessible route reaches them as well as the stalls. For temporary events that provide portable toilets, DOJ’s ADA.gov guidance for state and local governments says at least one toilet at each location should be accessible.

Information and communication are also part of access. Clear signs can help shoppers navigate. Depending on the circumstances and a person’s needs, effective communication may involve accessible information, large-print material, communication aids or services such as a qualified interpreter. Vendors and organizers should be ready to communicate in different ways and explain how shoppers can request help.

Keep access working on market day

Accessibility is an operating condition, not only a design feature. A route can be blocked, an accessible counter obstructed, or a facility unavailable on the day shoppers need it. Assign responsibility for checking routes and access features, responding promptly to problems, and telling shoppers how to report a barrier or request assistance.

DOJ’s business guidance discusses maintaining access and responding to temporary obstructions. For public entities, its guidance describes periodic evaluation of programs and facilities. Which legal duties apply depends on whether the market is operated by a public entity or a private business, as well as other site-specific circumstances. Public-entity guidance is available at ADA.gov, State and Local Governments; business guidance is available at ADA.gov, Businesses That Are Open to the Public.

Use a practical checklist when assessing a market

  • Arrival: Check the available parking, loading, sidewalk and transit connections, and whether routes lead to the entrance and market areas.
  • Circulation: Look for a smooth, firm, continuous surface; manageable level changes; useful signs; and paths free of cords, displays, merchandise and queue barriers.
  • Shopping and payment: Check that shoppers can approach booths and products, use service counters and complete transactions.
  • Amenities: Find out whether the route reaches public facilities and, for temporary events with portable toilets, whether accessible units are provided.
  • Information and help: Consider whether signs are useful and staff can communicate accessibly; ask shoppers and local disability organizations what information or accommodations would help.
  • Upkeep: Confirm there is a plan to keep routes and features clear and to address blockages or broken features promptly.

Compare markets using the same questions

If you are deciding where to shop, compare each market on arrival connections, route surfaces and obstructions, access to stalls and checkout, restroom availability, signs and communication, and whether access features are operating that day. This is a practical comparison framework, not a published market-rating system. Calling ahead can clarify time-sensitive details, but needing to ask for help does not make an inaccessible route or service accessible.
