Building codes and zoning rules regulate different parts of the same project. A building code sets technical requirements for construction, alteration, repair, use and occupancy, and related building work. Zoning rules decide whether a proposed use belongs on a particular parcel and how development must be arranged there, including matters such as setbacks, height, lot dimensions and open space. A project can therefore need both land-use approval and a building permit; satisfying one does not automatically satisfy the other.
The difference at a glance
The easiest way to separate the systems is to ask two different questions. Building-code review asks whether the building or regulated work meets the applicable technical requirements. Zoning review asks whether the proposed use is allowed on that parcel and whether the building and other improvements are positioned and sized according to the district’s rules.

| Axis | Building codes | Zoning rules |
|---|---|---|
| Main question | Does the building or regulated work meet the adopted technical requirements? | Is the use allowed here, and how may development be located and arranged? |
| Typical subject matter | Construction, alteration, repair, use and occupancy, erection, modification, demolition and related building work. | Permitted uses, district boundaries, setbacks, height, bulk, lot dimensions and open space. |
| Primary reference | The adopted building or construction code, together with local permit and inspection requirements. | The zoning ordinance text and the zoning map for the parcel. |
| Usual practical check | Confirm the code edition, permit type and inspections that apply to the work. | Confirm the parcel’s district, allowed use and site-development standards. |
These categories overlap in practice because a local government may coordinate the reviews or assign some duties to the same official. The legal questions remain distinct even when the paperwork is combined.

They follow the building work
A building code applies to regulated work on a building or structure. The Florida Building Code example describes coverage of construction, erection, alteration, modification, repair, demolition, use and occupancy of public and private buildings, structures and facilities. The exact scope, exemptions and procedures depend on the code adopted by the state or local jurisdiction and the edition in force when you apply.

They set technical conditions
Code review is concerned with how the work is designed and carried out, rather than whether the parcel is the right place for the use. Plans, specifications, construction methods and the completed work are evaluated against technical provisions. A building department may require a permit, plan review, inspections or completion documentation. Ask which edition has been adopted locally; a code book’s publication date does not by itself establish the law governing your project.
Use and occupancy can trigger code questions
Even when the walls are not changing, a proposed change in use or occupancy can raise building-code issues. The applicable code may treat the new occupancy differently and require work or documentation before the space can be used. That inquiry is separate from the zoning question of whether the new use is permitted on the site.
Code exemptions are limited
An exemption from a technical-code permit is not a general exemption from local regulation. Bellevue’s code language expressly ties land-use approvals to its building-permit process and states that an exemption from a technical-code permit does not excuse compliance with other laws or ordinances. Treat any exemption as applying only to the provision that grants it, and confirm the remaining approvals with the local authorities.

What zoning rules regulate
A map and written ordinance work together
Zoning is usually parcel- and district-oriented. The zoning map places the property in a district; the written ordinance explains what may occur in that district and under what conditions. ICC educational material describes this two-part structure: boundaries appear on the map, while the text sets the rules for uses and development.

Use permissions
The ordinance may identify uses that are permitted outright, uses that require an additional approval, and uses that are not allowed in the district. A proposed home, shop, institutional space, industrial activity or other use must be checked against the district’s current use table and definitions. A building permit cannot legalize a use that zoning prohibits.
Placement and dimensional standards
Zoning can control where development sits and how much of the site it occupies. Common standards identified in the cited materials include setbacks, height, bulk, lot dimensions and open space. These rules can affect a new building, an addition, an accessory structure or a site change even when the construction itself would meet the technical building code.
Local amendments matter
The 2024 International Zoning Code is an ICC model-code publication, not automatically the law in every community. A city, county or state must adopt a model resource, often with amendments, before it governs a project. The controlling source is the ordinance and map adopted for the property, including any overlays, special districts or later amendments that apply there.

One proposal can require two approvals
Suppose an owner wants to add a structure, enlarge a building or change the activity inside it. Zoning review determines whether the use and site arrangement are allowed. Building-code review determines whether the proposed work and resulting occupancy meet technical requirements. Passing one review does not decide the other.

The order and office vary by jurisdiction
Some communities require land-use approval before accepting or issuing a building permit. Bellevue’s example coordinates required land-use approvals with building-permit filing. Other communities combine administration differently. Chicago’s construction-code administrative provisions assign the building official certain duties under the city’s zoning ordinance, showing that the same office may administer responsibilities from both systems. Do not assume that a planning department, building department or combined counter in another city follows the same sequence.
Permit status is not a zoning determination
A permit, inspection approval or technical-code exemption answers only the questions within that approval. It does not, by itself, establish that the use is permitted, that setbacks are satisfied or that other land-use conditions have been met. Obtain written confirmation of the approvals your jurisdiction requires before relying on a permit or exemption.

This language illustrates the conceptual boundary: requirements about land use and zoning are outside the building code when they do not govern the covered design or construction work. It is not a universal statement of every state or municipality’s current law. Check the edition and amendments adopted where the property is located.
ICC: zoning as land-use and development control
ICC’s educational material describes zoning ordinances as controlling land use and development, including permitted uses and the placement or dimensions of buildings. Its 2024 International Zoning Code is presented as a model planning and community-development resource. Neither description replaces the locally adopted ordinance.
Bellevue and Chicago: administration can be integrated
Bellevue’s 2021 example shows land-use approvals coordinated with the building-permit process and warns that technical-code exemptions do not waive other laws. Chicago’s 2019 administrative example gives a building official duties under the zoning ordinance. These examples demonstrate different administrative arrangements, not a nationwide procedure.
A practical approval workflow for a specific property
Use this sequence before finalizing plans or starting work. It is a way to organize questions, not a substitute for the local ordinance or a determination by the permitting authority.

- Identify the exact parcel. Record the street address, parcel or lot identifier and the governing city or county. Nearby properties can be in different districts or subject to different overlays.
- Find the zoning district on the official map. Use the current local zoning map, not a real-estate listing or an old plan set. Note the district name, map date and any overlay or special designation shown for the parcel.
- Read the ordinance for the proposed use. Check the use table and definitions. Determine whether the activity is permitted, requires a discretionary or conditional approval, or is prohibited. If the proposal changes an existing use, check both the current and proposed classifications.
- Check site standards. Review setbacks, height, bulk, lot dimensions and open-space requirements that apply to the district. Confirm how the ordinance measures each standard and whether existing conditions receive any lawful exception.
- Ask the planning or zoning office about land-use approvals. Request the current application path, required drawings, decision-maker, public-notice requirements and any approvals that must precede a building permit. Get the answer in writing when the project is unusual.
- Ask the building department which technical code applies. Confirm the adopted code edition, permit categories, plan-review requirements, inspection stages and rules for a change of use or occupancy. Ask specifically whether the proposed work is exempt from a technical permit and what other approvals remain necessary.
- Coordinate the submissions. Make sure the site plan used for zoning review and the construction documents used for code review describe the same use, dimensions and occupancy. A discrepancy can create a new review even when each document appears acceptable on its own.
- Keep approvals and conditions together. Save the zoning decision, approved site plan, building permit, inspection records and any conditions. Future alterations or a later change of use may depend on what was previously approved.
How common project types split the questions
New construction
Zoning determines whether the proposed use belongs in the district and where the building may sit. The building code then governs the design and construction work. Both reviews are normally relevant, although the local process may combine applications or require one approval first.
An addition or accessory structure
The addition may need to fit setback, height, lot-coverage or open-space standards before technical plans can be approved. Even a small structure can require a building permit, an exemption analysis or inspections under the locally adopted code.
Interior remodeling
If the work changes construction or occupancy, building-code review may apply even when the exterior footprint stays the same. If the business or activity changes, zoning must also be checked; an interior permit does not establish that the new use is allowed.
Change of use without construction
Zoning may require approval for the new use, while the building code may require an occupancy review or upgrades associated with that use. The absence of visible construction does not answer either question.
Mistakes that cause delays
- Relying on the building permit alone. A permit addresses the approved technical work and does not automatically resolve land-use requirements.
- Using an outdated map or code edition. Confirm the current map, ordinance, adopted code edition and local amendments before designing around a standard.
- Assuming a model code is automatically enforceable. The 2024 International Zoning Code is a model publication; only an adopted local version, with its amendments, governs the parcel.
- Treating an exemption as a waiver. Bellevue’s example makes clear that a technical-code permit exemption does not excuse other laws or ordinances.
- Assuming every jurisdiction uses the same counter or sequence. Bellevue and Chicago illustrate different ways to assign and coordinate responsibilities.
- Changing the use after approval. A revised occupancy, tenant activity or operating plan can trigger a new zoning question, a building-code review or both.
What to confirm before you spend money on plans
Before commissioning final drawings, obtain the parcel’s district, the ordinance provisions governing the proposed use, the applicable dimensional standards and the local authority’s list of required land-use approvals. Separately confirm the building-code edition, permit scope, inspections and any change-of-occupancy requirements. Ask whether approvals expire, carry conditions or must be recorded, because those administrative details are local and are not established by the general distinction between the systems.
The governing answer for a particular property comes from the current local zoning map and ordinance plus the building department’s adopted code and procedures. The Florida, Bellevue and Chicago examples explain why both tracks may matter, but they do not determine requirements outside those jurisdictions.
