What Is a Parking Variance and How Does the Approval Process Work?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A parking variance is a formal request to relax a local zoning rule that requires a project to provide a specified number, size, location, or arrangement of off-street parking spaces. The request does not automatically succeed because a site is expensive, inconvenient, or desirable. A local zoning board, hearing examiner, or other authorized official must apply that jurisdiction’s ordinance to the property-specific facts.

There is no nationwide parking-variance procedure. Your local code determines whether parking relief is handled as a variance or another type of application, which findings are required, what plans and notices are needed, and who makes the decision. The usual path is to identify the exact rule, submit an application and evidence, complete staff review, attend any required public hearing, and then satisfy any conditions and separate permit requirements.

What a parking variance changes—and what it does not

Zoning ordinances commonly set minimum off-street parking requirements for uses such as homes, offices, shops, restaurants, and institutional buildings. A parking variance seeks relief from a particular requirement for a particular property. The relief might involve fewer spaces, a different parking layout, or another code standard, depending on what the local ordinance authorizes.

Fairfax County describes a variance as a request to vary certain zoning requirements when special property conditions mean strict enforcement would “effectively prohibit or unreasonably restrict all reasonable use of the property.” That is Fairfax County’s description, not a universal legal definition; another jurisdiction may use different language or a different test. See the county’s Variance Process page.

A variance is also not a building permit, site-plan approval, certificate of occupancy, or authorization to begin construction. The City of Rochester states that variance approval “shall not authorize the commencement of any work” and instead permits preparation, filing, and processing of the other applications its codes require. Read Rochester’s local explanation in its Zoning Variance FAQs.

Start by identifying the rule and the correct decision-maker

Find the exact parking requirement

Obtain the current zoning ordinance section for your parcel and use. Confirm the required number of spaces, accessible-space rules, loading requirements, dimensions, landscaping or screening provisions, and whether the requirement is calculated by dwelling unit, floor area, seat, employee, or another measure. Record the calculation in writing. A request for “some relief” is not specific enough for review.

Confirm that a variance is the available remedy

Ask the planning or zoning office whether the code provides a parking adjustment, administrative waiver, shared-parking approval, special exception, or another procedure instead of a variance. Ask which body has authority: a board of zoning appeals, zoning board, hearing examiner, or administrative official. Also ask whether the request can be combined with a site-plan, special-use, or development application.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Write down the ordinance section and the staff contact who confirmed it.
  • Calculate the required spaces and the spaces your plan supplies.
  • State the precise relief requested, such as a reduction from 40 spaces to 32.
  • Confirm filing deadlines, fees, hearing dates, notice methods, and appeal rules from the local office.

Do not assume that a rule or process used in one city applies in another. The examples below illustrate local approaches rather than national standards.

Understand the findings the board must make

The decision normally turns on legal findings tied to the property, not simply on whether the project would be useful or economically attractive. DeKalb County, Georgia, summarizes five criteria for its Zoning Board of Appeals: exceptional physical conditions, minimum necessary relief, protection of public welfare and nearby property, undue and unnecessary hardship, and consistency with the ordinance and comprehensive plan. Its Zoning Board of Appeals guidance is a local example; your jurisdiction may phrase or apply the standards differently.

1. Exceptional physical conditions

Explain what is unusual about this parcel itself. Examples might include an irregular lot shape, steep grade, recorded easement, flood-related constraint, mature protected feature, or existing structure that the ordinance recognizes as relevant. A condition shared by many nearby properties, a self-created constraint, or a preference for a larger building may not satisfy a locality’s test.

2. The minimum relief necessary

Show that the request is no broader than needed. Compare the code requirement, the maximum practical number of spaces, and the exact shortfall. Explain alternatives you tested, such as a different building footprint, reduced floor area, rearranged circulation, shared parking where allowed, or a revised use. The objective is not to prove that your first design is convenient; it is to demonstrate why a smaller variance would not address the documented site constraint.

3. Effects on neighbors and the public

Address vehicle access, queuing, pedestrian safety, emergency access, visibility, drainage, lighting, noise, and spillover parking. A scaled plan, turning analysis, sight-distance information, parking-management proposal, or landscape and screening detail can make the effects easier to evaluate. If nearby streets have restrictions or limited capacity, acknowledge them and explain how the proposal avoids imposing unreasonable demand.

4. Undue and unnecessary hardship

Connect the hardship to strict application of the ordinance and the property’s physical circumstances. Do not rely solely on lost profit, construction cost, or a desire to maximize floor area unless the local law expressly considers those facts. Use the exact hardship standard in the controlling ordinance and address every required element.

5. Consistency with the ordinance and comprehensive plan

Explain how the request preserves the purpose of the parking rule and fits adopted land-use policies. A proposal can seek a numerical reduction while still protecting access, safety, circulation, and neighborhood character, but the board must make that judgment under local law.

Prepare the application and supporting evidence

Use the jurisdiction’s checklist

Application forms, fees, plan scales, filing copies, and deadlines are local. Fairfax County’s application-acceptance guidance illustrates the level of detail some jurisdictions require: property boundaries; existing and proposed structures; ingress and egress; parking; landscaping and screening; stormwater facilities; and specified environmental features. Fairfax also requires the described layout plan to be prepared by a qualified licensed professional. Review its Zoning Application Process – Application Acceptance page, but do not treat those requirements as universal.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Build a clear plan set

Label the existing and proposed conditions on the same or coordinated drawings. Show every parking space, aisle, driveway, loading area, accessible route, property line, neighboring use, screening element, drainage feature, and point of ingress or egress that affects the request. Include dimensions and a parking-space count that matches the written calculation. If a licensed surveyor, engineer, architect, or other professional is required, confirm the credential and signature rules before filing.

Write an evidence-based narrative

Organize the statement under the exact local criteria. A useful sequence is: code requirement; requested relief; physical condition; alternatives considered; effects on access and neighbors; proposed mitigation; and consistency with adopted plans. Attach photographs, surveys, easement documents, technical calculations, traffic or parking studies where required, and correspondence showing any agency constraints. Every conclusion should point to a plan detail or factual document.

How the approval process usually unfolds

  1. Pre-application confirmation. Contact the local planning or zoning office. Verify the parcel’s zoning, the current parking calculation, the available relief procedure, the decision-maker, required forms, fees, plan standards, notice rules, and filing deadline.
  2. Application submission. File the completed form, plans, narrative, ownership authorization, fee, and supporting documents in the required format. An incomplete filing may not start the formal review clock. Keep a dated copy and proof of delivery.
  3. Completeness and staff review. Staff check the submission, identify the ordinance requirements, distribute materials to reviewing agencies, and evaluate the request against the local criteria. Fairfax County describes acceptance, assignment and agency distribution, pre-staffing, applicant revisions, staffing, and possible further revisions in its variance-process guidance. Respond to each comment in a revised plan or written response, and track which version is scheduled for hearing.
  4. Notice and public hearing. Local law controls the notice form, timing, recipients, posting, publication, and proof. New York’s Department of State states that, under its framework, “A public hearing is required before the zoning board of appeals may grant a variance or rule on an appeal or decide any other matter.” That statement describes New York, not every state; consult the applicable local ordinance. The New York overview is available at this PDF and its explanatory page at Zoning Board of Appeals Overview.
  5. Hearing presentation. Bring the final plan set and a concise explanation of the exact relief. Be prepared to identify the code section, answer questions about site conditions and circulation, explain alternatives, and respond respectfully to staff or public comments. Confirm whether the applicant must attend personally or may use an authorized representative.
  6. Decision and written order. Depending on local authority, the body may approve, approve with conditions, defer for revisions, or deny the request. Obtain the written decision, not just the vote. Check every condition, expiration date, approved plan reference, recording requirement, and appeal deadline.
  7. Follow-on approvals. Submit building, site, access, stormwater, environmental, signage, and other permits that remain necessary. Do not begin work until the locality confirms that all required approvals are issued and any variance conditions have been satisfied.

How long can approval take?

Published schedules are local estimates, not national averages or guarantees. Two current examples show why the starting point and review steps matter:

Jurisdiction and source Published estimate What the estimate covers
Fairfax County Department of Planning and Development Approximately 90 days From filing after submission requirements are met and the application is accepted to the Board of Zoning Appeals public hearing; review, agency comments, and applicant revisions occur before the hearing.
DeKalb County Zoning Board of Appeals Two to three months for most cases From submittal to public hearing, depending on completeness, filing deadlines, legal advertising, sign posting, staff review, and the hearing schedule.

Your locality may publish a different schedule, and an incomplete application, redesign, postponed hearing, deficient notice, or agency issue can extend it. The evidence supplied here does not establish a universal fee amount; confirm current filing and advertising charges with the local office.

Parking-relief rules are not interchangeable

Local codes can differ not only in procedure but also in the amount of relief they permit. Chicago’s zoning code provides a specific example: for certain parking or loading variations, the reduction may be no more than one space or 20 percent, whichever is greater. That limitation applies to the specified Chicago provisions and should not be presented as a general national cap. Read the applicable section at Chicago Zoning Code 17-13-1100, Variations.

When comparing two possible jurisdictions or application strategies, compare the decision-maker and type of relief, the legal criteria and evidence burden, any maximum or minimum scope of reduction, required plan materials and professional credentials, completeness and notice rules, hearing calendar, timeline, conditions, expiration, and post-approval permits. Never assume that a favorable standard in one locality can be imported into another.

Common problems and practical fixes

  • Applying for the wrong relief. Fix: obtain written confirmation of the controlling code section and authorized procedure before paying a fee or preparing final plans.
  • Requesting an undefined reduction. Fix: state the required count, proposed count, numerical shortfall, and every related loading or layout change.
  • Arguing only convenience or economics. Fix: document the site-specific physical condition and explain why strict compliance creates the hardship recognized by the local ordinance.
  • Submitting a plan that cannot be built. Fix: coordinate parking dimensions, turning movements, accessible routes, fire access, drainage, landscaping, and screening before filing.
  • Ignoring agency or public comments. Fix: answer each comment in a revision matrix or written response and submit the corrected plan by the stated deadline.
  • Assuming approval equals permission to construct. Fix: read the written order and obtain every remaining permit before mobilizing work.
  • Missing notice or appeal deadlines. Fix: ask the clerk or planning office for the official calendar and retain proof of posting, publication, mailing, and decision dates.

When professional help is useful

A local land-use attorney can help interpret a complex variance standard, prepare for an appeal, or address an adverse decision. A licensed surveyor, engineer, architect, or planning professional may be necessary when the jurisdiction requires a stamped layout plan or technical analysis. Their usefulness depends on the local checklist and the physical complexity of the site; confirm required credentials with the approving office.

A final pre-filing checklist

  • Current zoning district and ordinance section identified.
  • Required spaces, proposed spaces, and exact relief calculated.
  • Correct decision-maker and relief type confirmed with the local office.
  • Local criteria addressed with property-specific facts and documents.
  • Plan shows boundaries, structures, access, parking, circulation, screening, drainage, and other required features.
  • Professional signatures, copies, file format, fee, and filing deadline verified.
  • Notice, hearing, attendance, and appeal procedures calendared.
  • Written decision reviewed for conditions, expiration, and remaining permits.
