A pre-launch apartment in Bengaluru is safe to consider only after you verify the exact project and phase, the promoter’s right to sell the land, the competent authority’s approvals, and the written agreement that controls your money and possession. “Pre-launch” is a marketing label, not a legal category or exemption from regulation. Before paying a booking amount, identify the project’s Karnataka RERA status, obtain a title and encumbrance review, match approvals to the survey numbers and tower being sold, and have an independent property lawyer examine the agreement.
The sequence below is designed for a buyer deciding whether to reserve a unit or sign. Keep dated copies of every document and promise; rely on records for the specific project rather than on a brochure or verbal assurance.

1. Establish what “pre-launch” means for this project
Developers use “pre-launch” for several different situations: a project still being marketed before sales open, a phase awaiting registration, or an early sales campaign for a project that already has some permissions. The label does not tell you whether the land is owned, whether construction is permitted, or whether the project is registered under the Real Estate (Regulation and Development) Act, 2016 (RERA).

Ask for the exact registered project name, promoter’s legal name, survey numbers, phase, tower or block, and the proposed unit number. A group may market several phases under one brand while each phase has different approvals, timelines, lenders or development rights.

Search the Karnataka RERA record
Use Karnataka’s official RERA system at rera.karnataka.gov.in and save the project page and downloadable disclosures on the date you check them. The Government of India describes Karnataka’s online project-registration service as requiring promoters to provide project details, approvals, financial disclosures and timelines: Karnataka RERA project-registration service. The Ministry of Housing and Urban Affairs also maintains the RERA Act and links to state authorities: MoHUA RERA Act page.
Compare the portal entry with the brochure, allotment form, payment demand and salesperson’s messages. Check the registered name, promoter, registration number, declared completion date, approved project scope, number of buildings, land details and uploaded certificates. If the salesperson says registration is unnecessary or the project is exempt, ask for the precise legal basis in writing and have it independently checked. Do not infer an exemption from the word “pre-launch.”
2. Prove who owns the land and who can sell you a unit
A RERA entry or attractive brochure is not a title opinion. Have a Bengaluru property lawyer identify every survey number and parcel in the proposed phase, then review the chain of title and encumbrances for the relevant period. The review should establish how ownership moved to the current landowner and whether mortgages, releases, litigation, acquisition notices, easements or other burdens affect the site.

The Bengaluru Urban district government identifies Bhoomi as Karnataka’s land-record management system and explains that ownership or other changes in the Record of Rights, Tenancy and Crops (RTC) are recorded through mutation: Bengaluru Urban land records. Obtain the available RTC and mutation history for the exact survey numbers. These entries can reveal recorded changes or inconsistencies, but they do not replace a lawyer’s marketable-title opinion or the registered instruments in the chain of title.
Confirm development rights in joint-development projects
When a developer is not the landowner, inspect the registered joint-development agreement, power of attorney and any supplemental documents. Confirm that the agreement covers the survey numbers and phase being sold, that it remains in force, and that the signatory has authority to bind the landowner. Review the allocation of saleable apartments so the offered unit is within the developer’s share or is otherwise properly authorised for sale. Ask the lawyer to check pending disputes between landowners and developers, not merely disputes disclosed by a salesperson.
3. Match every approval to the actual site and phase
Request copies of the permissions needed for this parcel and stage of construction. Depending on the location and proposal, the file may include land-use or conversion documents, layout approval, the sanctioned building plan, commencement approval, fire clearance, environmental permission, water and sewage permissions and other departmental clearances. The exact list depends on the project’s size, use, location and authority.

Identify the competent planning authority
Do not assume that every apartment marketed as “Bengaluru” is inside Bruhat Bengaluru Mahanagara Palike (BBMP) limits. The issuing authority depends on the parcel’s planning jurisdiction. BBMP publishes access to plan-sanction, commencement-certificate and occupancy-certificate records at BBMP Building Plan Approval and records; a project outside BBMP must be checked with the authority that legally controls that site.
Compare drawings with the sales material
Ask an architect to compare the sanctioned plan with the floor plan and specification sheet you are being asked to accept. Confirm the survey numbers, site boundary, number of floors, tower count, unit count, setbacks, parking layout, amenity areas and proposed floor area. A sales image can show a future clubhouse or road that is not part of the approved phase. Any difference should be explained in a signed document before you pay.
Understand what a commencement approval does—and does not—prove
A commencement certificate indicates permission to begin specified work; it is not proof that the complete project is approved or that every tower can be occupied. Check its date, issuing body, conditions and the buildings or phases it covers. If construction has started without a document that applies to the relevant building, treat that as a stop-and-investigate issue.
4. Read the project’s RERA disclosures against the contract
For a registered project, compare the portal’s declared completion date, phase scope, approvals, promoter details, land information and quarterly or other disclosures with the documents placed before you. Save each version because online records and marketing materials can change.
Check that the registration covers the tower and phase containing your proposed apartment. A registration for an earlier phase does not automatically cover a later launch on the same land. Look for the sanctioned plans and specifications uploaded for the registered phase, and note any stated litigation, encumbrance, lender charge or extension.
Test the promised delivery date
Place the RERA completion date, the agreement’s possession date and the brochure’s handover promise in one written comparison. Identify any grace period, extension event or force-majeure wording. Ask what notice and evidence the promoter must provide if the date changes, and what remedy the agreement gives you. A short promotional launch date should not override the registered schedule and executed contract.

5. Do not substitute a booking form for the agreement for sale
Read the proposed agreement for sale before signing a booking form or transferring money. Section 13(1) of the central RERA Act, reproduced in the Himachal Pradesh RERA FAQ, states:
“A promoter shall not accept a sum more than ten per cent of the cost of the apartment, plot or building as the case may be as an advance payment or an application fee from a person without first entering into a written agreement for sale with such person and register the said agreement for sale under any law for the time being in force.”
The text is reproduced by Himachal Pradesh RERA at HPRERA FAQs. Confirm the current Karnataka procedure, stamp duty, registration steps and the facts of your transaction with a local lawyer. A booking form cannot silently remove protections or replace the registered agreement required for your situation.

- Identity and property: legal names of the parties, survey numbers, tower, floor, unit number, carpet area, balcony or terrace rights and the undivided share of land.
- Common areas and amenities: what is included, who owns it, whether it is in this phase, and whether operating costs can later be charged to buyers.
- Specifications: brands or performance standards for finishes, doors, windows, lifts, backup power, fire systems and utilities. A vague “equivalent” clause should define who decides equivalence.
- Possession and delay: contractual date, permitted extensions, interest or compensation, cancellation rights and refund timing.
- Changes: limits on unilateral changes to plans, area, specifications, amenities or common facilities, and the consent required for material alterations.
- Defects and maintenance: inspection procedure, defect notification, rectification periods, formation of the owners’ association and transfer of common-area records.
- Default and cancellation: consequences for a buyer’s missed instalment, promoter delay, deductions from a refund and the dispute-resolution forum.
Have the lawyer mark any blank, inconsistent or one-sided clause. Do not sign a version that differs from the copy you reviewed; initial or retain the final executed version and registration receipt.
6. Reconcile the full price with construction-linked payments
Request a complete written cost sheet before committing. It should identify the base price and every addition, including floor or location premiums, parking, taxes, deposits, maintenance, club or amenity charges, utility connection fees and registration-related amounts. Ask which charges are one-time, which recur and which are estimates.
Make each instalment verifiable
Map every payment milestone to an observable construction stage and the agreement’s wording. A demand for a slab, brickwork or finishing instalment should correspond to the relevant work in your tower, not merely to activity elsewhere on the site. Ask how a delay in approval or construction affects the next demand. Keep bank statements, receipts and the demand letter together.

Pay only to the legal seller’s disclosed account and insist that the receipt names the project, phase, unit and purpose. Do not transfer money to a salesperson’s personal account, an unrelated company or an account whose ownership you cannot reconcile with the agreement. A discount or launch price is not a substitute for a clean title and enforceable contract.

7. Preserve every promise in a usable record
Sales conversations often contain the most attractive promises—views, roads, schools, clubhouse opening, rental returns, maintenance caps or possession dates—but an unrecorded statement is difficult to enforce. Keep the brochure, price sheet, floor plan, specification list, payment schedule, email, text message and presentation used when you decided.
Create a dated document file
- Download the RERA project page and disclosures, and save the URL and date checked.
- Scan signed forms, receipts, approvals and title documents into a folder named for the project and phase.
- Keep the original file names and add the date to each copy; do not overwrite an earlier version.
- Send a follow-up email listing material promises and ask the promoter to confirm or correct them.
- Attach the confirmed list or specification sheet to the agreement if the promoter agrees; otherwise treat the promise as unprotected.
This record helps your lawyer identify contradictions and gives you evidence if the final contract or construction departs from the offer.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.8. Plan the completion and handover checks now
An occupancy certificate (OC) is a later-stage document, not evidence that an early booking is currently safe. Before accepting possession, obtain the completion or occupancy certificate applicable to your tower and phase, along with any required fire and utility clearances, as-built information and common-area handover documents.
Verify the certificate’s exact scope
Check the issuing authority, certificate number and date, sanctioned plan reference, commencement approval and the specific building or block covered. BBMP’s public records include individual certificates; a sample 2024–25 certificate shows why the approved plan, inspections and named building matter: BBMP occupancy-certificate example. That document illustrates one project’s treatment of deviations; it does not mean another project’s deviations will be accepted or regularised.

9. Use an independent professional review at the right time
A local property lawyer should review the title chain, encumbrances, revenue and conversion records where applicable, joint-development rights, powers of attorney, approvals and agreement before you pay a substantial amount. An architect can compare the sanctioned plan with the sales drawings and later inspect construction. Their role is different from the promoter’s legal or sales team.
Give the professionals the complete file, including documents the salesperson says are “under process.” Ask for a written list of missing documents, assumptions and conditions rather than a verbal comfort that the project is standard. No lawyer can eliminate all development risk, but an independent review can identify a title gap, unauthorised phase, approval mismatch or payment clause before it becomes expensive.
10. Decision table: compare projects on evidence, not launch excitement
| Comparison area | Questions to answer for each project | Evidence to retain |
|---|---|---|
| Land and sale authority | Are all survey numbers traced to a marketable title? Does the promoter have authority to sell the offered unit? | Title opinion, registered deeds, encumbrance review, joint-development agreement and power of attorney where relevant. |
| RERA status | Is the exact phase registered, and do the promoter, scope and completion date match the offer? | Downloaded Karnataka RERA record and disclosures dated on the day checked. |
| Planning permissions | Has the competent authority approved this site, tower, height, unit count and phase? | Land-use or conversion records, layout approval, sanctioned plan, commencement certificate and departmental clearances. |
| Contract protection | Are carpet area, possession, delay remedies, changes, defects and cancellation terms clear? | Final agreement for sale, registration details and every annexure. |
| Total cost | What is included, what is estimated, and which charges recur after possession? | Signed cost sheet, tax treatment, payment schedule and receipts. |
| Civic infrastructure | Who supplies water, sewage, electricity and roads, and what is already available? | Authority permissions, utility commitments and written scope for the phase. |
| Completion evidence | When issued, does the OC cover the exact tower and phase and match the approved plan? | Certificate, as-built plan, inspection records and common-area handover documents. |
Promised appreciation, launch discounts and amenity lists belong in a separate risk assessment. They cannot compensate for an unresolved title, missing approval or weak agreement.

11. Red flags that should pause the transaction
- The salesperson will not provide the legal project name, survey numbers, promoter identity or phase details.
- The brochure names a different entity from the proposed agreement or the RERA record.
- The project is described as “RERA exempt” without a written legal basis that your lawyer accepts.
- Title, encumbrance, joint-development or power-of-attorney documents are withheld on the ground that they are “internal.”
- The sanctioned plan, commencement certificate or layout approval does not identify the land or building being sold.
- The payment demand arrives before the agreed construction milestone or asks for money into a personal or unrelated account.
- The agreement leaves the unit, carpet area, possession date, refund formula or promised amenities blank or subject to unlimited change.
- The promoter asks you to sign an unconditional possession or no-claims statement before defects and certificates are resolved.
A red flag is a reason to stop and obtain documents, not proof by itself that a project is fraudulent. If the explanation is satisfactory, insist that it appears in the contract or an authority record.
Is it safe to buy an apartment before RERA approval?
There is no blanket “safe” answer. Buying before the exact project or phase is registered removes an important source of public information and may leave you relying on preliminary claims. Some projects may fall outside registration requirements under applicable law, while others may be marketed before the promoter completes registration; the correct treatment depends on the project’s facts and current Karnataka rules.
Do not pay simply because a launch date is limited or because a salesperson says registration is imminent. Ask for the written legal basis for the project’s status, verify ownership and approvals with the competent authorities, and have the agreement reviewed before any payment permitted by law. If the promoter will not identify the land, provide a credible approval path or accept a documented, conditional transaction, the practical answer is to wait or walk away.
A buyer’s go/no-go sequence
- Identify: record the legal project name, promoter, phase, tower, survey numbers and unit.
- Verify status: search Karnataka RERA and save the registration and disclosure records.
- Trace land: obtain title, encumbrance, mutation and joint-development documents for every relevant parcel.
- Check authority: identify the planning jurisdiction and match land-use, layout, sanctioned-plan, commencement and departmental permissions to the site.
- Review economics: reconcile the complete cost sheet with a construction-linked payment schedule.
- Review contract: have an independent lawyer examine the agreement before signing or paying more than the legally permitted threshold.
- Record promises: preserve dated brochures, messages, drawings, specifications, receipts and written confirmations.
- Set handover conditions: require the applicable completion or occupancy certificate for the exact tower and phase, inspect defects and collect common-area records.
Proceed only when the documents identify the same land, promoter, phase and apartment; the competent authority’s permissions support the proposed construction; and the agreement gives you clear payment, possession and remedy terms. Otherwise, keep your money uncommitted until the gap is resolved in writing.
