A delayed or changed preconstruction condo does not automatically give every buyer a right to cancel or receive compensation. Your options depend on the province, the agreement date, the signed addendum and disclosure statement, the exact promise that changed, and whether the builder followed the required notice process.
Ontario and British Columbia use different statutory systems. Start by identifying the event—an occupancy delay, a missed outside date, a project cancellation, or a material change—and then match it to the contract and provincial rules before withholding money, refusing to close, or sending a termination notice.

First identify what changed
“Delayed” can describe several legally different situations. A builder may miss the date you expected to move in, postpone final registration and title transfer, cancel the project, or change the unit, amenities or surrounding development shown in the disclosure documents. Each event has different deadlines and remedies.
Occupancy delay versus final closing delay
In Ontario, interim occupancy can begin before the condominium is registered and before title transfers. You may be allowed to move in while still not owning the unit. A delayed occupancy date is therefore not always the same as a delayed closing date. Read the dates and extension provisions in the Condominium Home Addendum and Statement of Critical Dates.

A changed promise is not automatically a material change
A different cabinet colour, appliance model or landscaping detail may be permitted under the agreement. A substantially different unit layout, reduced floor area, removed amenity or major project alteration may raise disclosure and rescission issues. The label used by the developer does not decide whether a change is legally material; the original disclosure, the revised information and the statutory test do.
Collect the documents before taking action
The signed paperwork and delivery dates usually matter more than sales conversations. Assemble a complete file containing:
- the executed Agreement of Purchase and Sale and every schedule;
- the province-prescribed addendum;
- the disclosure statement, amendments and revised disclosure documents;
- the Statement of Critical Dates, where applicable;
- the preconstruction information sheet, warranty information sheet and buyer guide;
- every written builder notice, email, registered letter and revised plan; and
- proof of when each document was received, such as email headers, courier records or signed acknowledgements.
Build a dated timeline showing the original occupancy and closing dates, every permitted extension, the date and method of each notice, the current promised date, and the date you first learned of any change. A phone call or sales statement generally does not amend a signed contract by itself. Ask the developer to confirm its position and provide any revised disclosure or addendum in writing.
Ontario: what a delayed occupancy can mean
The Firm Occupancy Date and Outside Occupancy Date
The Condominium Authority of Ontario (CAO) explains that the Statement of Critical Dates identifies a Firm Occupancy Date, an Outside Occupancy Date and any permitted extension dates. The Condominium Home Addendum clarifies occupancy expectations and prevails if it conflicts with the agreement or another attachment.

If the builder misses the Firm Occupancy Date, you may qualify for Tarion delayed-occupancy coverage, depending on the notice history, valid extensions, the applicable form and the other eligibility conditions. This is not an automatic payment for every late possession.
If the builder misses the Outside Occupancy Date, CAO guidance says the buyer may choose to terminate within 30 days, subject to the governing documents and statutory conditions. The 30-day period is a procedural deadline, not a universal right that applies to every delay. Have the dates and notices checked before sending a termination notice.
Use the addendum version that matches your agreement
Ontario’s current regulation distinguishes agreements made before January 1, 2027 from agreements made on or after that date. Ontario Regulation 293/26 describes prescribed new condominium-home addenda dated August 24, 2026 for agreements entered from January 1, 2027. Do not copy a notice process from an older form into a newer agreement. The form attached to your actual agreement date controls.

Interim occupancy is not ownership
During interim occupancy, you may have possession without registered title. CAO says an interim occupancy fee is payable whether or not you actually move in. The fee is capped by the total of:

Material-change rescission
The Condominium Act, 1998 provides a 10-day rescission window after a material change to the disclosure statement, measured from the latest of specified statutory events. Those events can include receiving a revised disclosure or notice, becoming aware of an undisclosed material change, or a court determination. Written notice and the statutory conditions are required.
A material-change analysis compares what was disclosed with what is now proposed. Preserve both versions, mark the changed specifications and record when you received or discovered them. A lawyer should assess whether the change meets the statutory threshold and calculate the correct 10-day trigger; an informal objection to the sales office is not a substitute for the required written notice.
The general 10-day cooling-off period
Ontario consumer guidance describes a general 10-day cooling-off period after the buyer receives the required signed agreement, disclosure statement and Residential Condominium Buyers’ Guide. It also describes a separate 10-day cancellation period after notice of a significant disclosure change. These rights have exact document and timing requirements. If properly exercised, deposits are generally refunded with applicable interest, subject to the statute and the facts of the transaction.

What happens to the deposit if the project is cancelled?
CAO says deposits and certain agreement payments are generally held in trust. In many project-cancellation situations, buyers receive their deposits back plus accrued interest. Interest treatment depends on the reason for termination and when the agreement was made, so do not assume a particular rate without checking the applicable regulation and current Bank of Canada rate.
CAO also describes Tarion protection of up to $20,000 for a deposit or other covered payment that is not refunded, subject to the category and eligibility rules in force for the transaction. The $20,000 figure is a protection maximum, not a guarantee that every payment or every buyer qualifies.
British Columbia: presale delays, disclosure changes and cancellation
REDMA rescission rights
British Columbia’s Real Estate Development Marketing Act (REDMA) governs development marketing disclosures and specified rescission rights. Section 21 provides a seven-day rescission period in circumstances set out by the statute, including the period after contract formation and written acknowledgement of an opportunity to read the disclosure statement. REDMA also addresses situations in which an entitled disclosure statement is not delivered and specified cases involving an undelivered material amendment.

Estimated dates and developer cancellation
British Columbia Financial Services Authority (BCFSA) warns that construction can run beyond the estimated date range or, rarely, never complete. A changed closing date can affect financing, leases, moving arrangements and rate-locks. A developer may also cancel under specified conditions in the agreement and disclosure statement.
BCFSA’s buyer summary notes cancellation rights within seven days of signing in the circumstances described by the contract and statutory framework, as well as rights connected to a building-permit deadline or material changes shown by a permit where those terms apply. Read the actual agreement rather than treating those examples as universal rights.
Deposits and misrepresentation
BCFSA says deposits are usually returned without interest when the developer cancels a BC presale agreement. “Usually” is important: the agreement, the reason for cancellation and the statutory requirements control the result.
REDMA also permits a damages action for a misrepresentation in a filed disclosure statement, subject to statutory requirements and a limitation period. Not every later change is an actionable misrepresentation. The analysis can depend on what was filed, what you knew, who was responsible and when you discovered the issue. Obtain legal advice before treating a discrepancy as a damages claim.

| Primary documents | Agreement, Condominium Home Addendum, Statement of Critical Dates, disclosure statement and notices | Purchase agreement, filed disclosure statement, amendments and notices under REDMA |
| Typical delay trigger | Missed Firm Occupancy Date or Outside Occupancy Date | Estimated date range, contractual closing date or permit-related deadline |
| Key stated period | Up to 30 days to choose termination after a missed Outside Occupancy Date, if conditions are met | Seven-day rescission period in specified REDMA circumstances |
| Changed disclosure | Possible 10-day rescission after a material change, measured from the latest statutory trigger | Rescission may apply to specified undelivered disclosure or material amendments; the statutory conditions govern |
| Deposit treatment | Generally held in trust; refund and interest depend on the termination ground; Tarion protection is described up to $20,000 for eligible covered payments | Usually returned without interest when the developer cancels, according to BCFSA’s summary and the contract |
| Interim occupancy | Possible before registration and title transfer, with a capped occupancy fee | No Ontario-style interim-occupancy framework is stated here; review the BC agreement |
These systems are not interchangeable. A deadline or deposit rule from one province cannot be imported into the other.
What to do when the condo is late or different
- Identify the province and event. State whether the issue is a firm-date delay, an outside-date failure, final closing delay, project cancellation, unit alteration or disclosure change.
- Locate the controlling dates. Find the Firm Occupancy Date, Outside Occupancy Date, extension clauses, closing date, permit deadline and any contractual long-stop date.
- Preserve evidence. Save plans, brochures, renderings, specifications, emails, notices and photographs. Record delivery dates and how you received each notice.
- Request a written explanation. Ask the developer to identify the contractual clause relied on, the revised date or specification, and any amended disclosure or addendum.
- Check financing and practical exposure. Ask your lender about rate-lock expiry and approval changes; document temporary housing, storage, moving and lease costs. These costs do not automatically create a legal claim, but they may affect decisions and negotiations.
- Get province-specific advice promptly. Have a real-estate lawyer or, where appropriate, a BC notary review the complete file and calculate any rescission or termination deadline.
- Send formal notice only after review. Use the method and wording required by the agreement or statute. Keep proof of delivery.
- Continue or stop payments only on advice. Unilaterally stopping deposits, interim occupancy charges or closing funds can create default consequences if no valid right has been established.
Common mistakes that can cost a buyer a remedy
- Relying on a sales representative’s promise: marketing material may not override the signed agreement and disclosure statement.
- Counting from the wrong day: statutory periods may run from receipt, acknowledgement, awareness or another defined event.
- Assuming every change is material: compare the legal disclosure and the revised information rather than using the builder’s or buyer’s label.
- Missing a notice method: an email, portal upload, courier or registered letter may have different contractual effects.
- Treating interim occupancy as closing: possession before registration does not itself transfer ownership.
- Assuming a deposit refund includes interest: interest depends on jurisdiction, termination ground, agreement timing and applicable rules.
- Using an old form: Ontario agreements entered from January 1, 2027 may use the prescribed addendum described in Ontario Regulation 293/26 rather than an earlier version.
If your purchase is outside Ontario or British Columbia
Canada has no single national rule for delayed or materially changed preconstruction condos. Provincial legislation, the agreement, disclosure requirements and warranty programs differ. Alberta’s government condominium-purchasing guide is dated December 2022, but the specific delay, rescission, deposit and material-change rules should be verified against current Alberta legislation and regulator guidance. The same caution applies in every other province or territory.
Before signing or terminating, obtain advice from a lawyer or notary licensed where the property is located. BCFSA puts the practical point plainly: “It is a good idea to get advice from a lawyer or notary and to review the entire disclosure statement and your purchase agreement with them before signing any agreement with a developer.”
