If a developer misses the promised possession date, you may face extra rent, storage, loan interest and uncertainty—but a late handover is not automatically a breach that gives you a refund or cancellation right. The result turns on the signed agreement, the governing jurisdiction, the type of transaction, the reason for the delay and the notices exchanged.
Your safest first move is to check the contract and local rules, then ask for a written explanation and revised schedule. Preserve every document and obtain local legal advice before withholding a payment, signing a variation, terminating, or settling with unresolved issues.

Start with the contract and the jurisdiction
“Possession” can mean practical access to a completed home, contractual completion, settlement, or handover of a unit and common areas. Those milestones may not occur on the same day. Identify the exact obligation in your agreement before deciding that the developer is late.
The legal position also changes with the transaction. An off-the-plan sale usually involves a developer selling land or a dwelling that is not yet complete. A domestic building contract may instead involve you commissioning a builder to construct or renovate a home. A regulator or tribunal that handles one may not handle the other.

Official guidance from New South Wales, Western Australia and Victoria illustrates why a nationwide answer is unsafe: each system applies its own contract rules, notices and dispute pathways. Treat the examples below as jurisdiction-specific illustrations, not a universal entitlement.
What to do as soon as the date is at risk
1. Locate the legally relevant date
Read the signed contract, disclosure statement and any later variation. Mark every date connected with completion, settlement, registration, occupancy certification and handover. Determine whether the date is:
- a fixed “time is of the essence” date;
- an estimate or target;
- calculated from a permit, registration or another milestone; or
- subject to a period that begins only after the developer gives a notice.
Then locate grace periods, extension events, notice requirements, sunset dates and clauses dealing with delay costs or termination. A developer may have a contractual right to extend for specified events, but the clause may require a particular notice or evidence. Do not assume that a message saying “the project is delayed” satisfies that requirement.
2. Request a written explanation and schedule
Send a calm written request through the communication method specified in the agreement. Ask for:
- the cause of the delay and the event date;
- the clause the developer says permits an extension;
- the current construction, inspection, approval or registration status;
- the revised anticipated possession and settlement dates; and
- the date on which the developer will provide the next update.
These questions are practical evidence-building steps, not a standard statutory form. Keep the request factual and avoid accepting a revised date until you understand whether doing so changes your rights.
3. Build a contemporaneous evidence file
Save the signed contract, disclosure documents, plans, receipts, loan correspondence, notices, emails, text messages, portal updates and photographs. Keep a dated log of every call, including who spoke, what was said and any promised follow-up.

Record additional accommodation, storage, transport, temporary utilities, inspection, loan-interest or other costs separately. Keep invoices and proof of payment. Consumer Affairs Victoria recommends written communication because the record can be given to a third party if a dispute proceeds; that guidance concerns Victorian building work, but the documentation practice is useful generally.
4. Check the correct local pathway
Identify the regulator, consumer agency, ombudsman, tribunal or court with authority over your agreement. Eligibility can depend on the property location, the parties, the contract type and the amount or remedy sought. A state building-dispute process may not decide an off-the-plan sale dispute, and a consumer agency may provide information without deciding compensation.

5. Obtain advice before an irreversible step
A property lawyer or conveyancer in the governing jurisdiction can review the extension clause, notices, deposit arrangements and proposed response. Ask for advice before you:
- stop or defer a scheduled payment;
- sign an extension, variation or settlement document;
- serve a termination notice;
- agree that a new date replaces the original date; or
- settle while defects, missing approvals or material changes remain unresolved.
Taking unilateral action can itself put a buyer in breach, even where the developer has caused a delay.
Separate delay from other project problems
A missed handover date may be only one part of the dispute. Ask whether there is also:
- incomplete or unsafe work;
- a change to plans, finishes, area or common property;
- failure to obtain registration, permits or an occupancy approval;
- developer or builder insolvency; or
- defects discovered during inspection.
Each issue can trigger different clauses, notice rules and remedies. A contract may allow extra time for an approval delay while treating a material change as a separate consent issue. Keep the issues distinct in your correspondence so that agreeing to discuss a new date is not mistaken for accepting a changed product.
Contract questions that determine your options
Is the possession date binding?
A date described as an estimate may be treated differently from a fixed contractual deadline. Some agreements tie completion to an external event such as registration, subdivision or an authority certificate. Read definitions and schedules, not just the front-page date.
What extensions are permitted?
Common clauses address authority delays, variations, weather, shortages, industrial action, buyer default and events outside the developer’s control. The wording matters: one clause may add the actual period of delay; another may grant a fixed number of days. Check whether the developer must notify you promptly and provide a revised date.
What does a sunset clause do?
A sunset clause sets a latest date for a specified milestone, often registration or completion. It may permit either party to end the contract, but the conditions differ. NSW Government guidance says a developer generally needs the buyer’s consent or a Supreme Court application to end an off-the-plan contract using a sunset clause. That is a New South Wales rule and should not be applied elsewhere without advice.
How is the deposit held?
Find out whether the deposit is held in a trust or controlled account, when it can be released and what happens if the developer becomes insolvent. The contract and local legislation may determine whether money is returned, transferred or exposed to a recovery process. Do not presume that a delayed project makes the deposit immediately withdrawable.

What does the agreement say about loss?
Look for provisions on liquidated damages, rent, interest, variations, notices and dispute resolution. Even where a buyer has a claim, recoverability may depend on proving causation, reasonableness and compliance with notice requirements. Keep actual costs separate from estimates.
Possible outcomes—none automatic
Depending on the agreement and local law, a delay may end with:
Quick wins for a faster PC:
Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Clear out junk files and repair common Windows errorsFree Scan →- an agreed revised possession and settlement date;
- continued performance under a valid extension clause;
- a negotiated payment or other adjustment;
- a claim for proven loss or compensation where available;
- a regulator, tribunal or court process; or
- termination and repayment if the contract or legislation permits it.
Do not rely on a generic promise that “buyers always get compensation” or “the developer must refund the deposit.” The availability, amount and procedure are fact-specific.
The Australian Competition and Consumer Commission gives a useful but limited example: a consumer hires a builder for patio repairs, no completion time is discussed, and the builder does not return for a month. The consumer may argue that the service was not supplied within a reasonable time, although rain could make the delay reasonable. This example concerns Australian Consumer Law guarantees and a repair service, not every developer handover. The ACCC also says it does not resolve individual disputes or give legal advice about a person’s entitlement.
Jurisdiction examples and their limits
| Jurisdiction and context | What official guidance highlights | What it does not establish |
|---|---|---|
| New South Wales, off-the-plan purchase | Review completion and extension terms; understand sunset provisions; certain material changes have statutory protections. A developer generally needs buyer consent or a Supreme Court application to end an off-the-plan contract using a sunset clause. | It is not a rule for every state, contract or type of delay, and it does not promise a refund or compensation. |
| Western Australia, off-the-plan purchase | Uncertain completion dates and finance are identified risks. Contracts commonly address completion timetables and sunset clauses. Buyers may retain Australian Consumer Law rights for unreasonable delay, and particular cancellation rights can arise when registration deadlines or statutory requirements are not met. | The cancellation conditions are specific to Western Australian law and the relevant contract; they are not a general right to walk away. |
| Victoria, domestic building work | Contract delay allowances and the reasonableness of the cause matter. Eligible domestic building disputes may use the Building and Plumbing Commission dispute-resolution process after the buyer has tried to resolve the issue. | This process is not automatically the route for an off-the-plan sale or a property outside Victoria. |
Read the applicable government guidance in full and confirm that it covers your transaction. A state label alone is not enough: the same address can involve a land sale, a building contract, a mortgage and a separate owners-corporation arrangement.

When the developer appears entitled to more time
Ask for the clause, event, calculation and notice. If the requirements appear satisfied, you may prefer to preserve the contract while negotiating practical help such as a reliable update schedule. Get advice on whether accepting a new date waives any existing claim.

When the extension is unclear or unsupported
Reply in writing that you are seeking clarification and reserve your rights, without declaring termination yourself. Request the documents needed to verify approvals, registration or the event relied upon. A lawyer can advise whether a formal notice is appropriate.
When costs are mounting
Mitigate reasonably: keep temporary accommodation or storage arrangements proportionate, ask lenders about available options, and document why each expense was necessary. Do not assume that every cost will be recoverable; entitlement may depend on the contract, causation and local law.

When the project is materially different
Compare the current plans, finishes, area and inclusions with the contract and disclosure material. Treat a material change as a separate issue from lateness. In NSW, official guidance identifies statutory protections for certain materially prejudicial changes; seek local advice before consenting or objecting.
When insolvency is a concern
Look for formal notices, missed trades, stopped work or changes in payment instructions. Verify any request to pay a new account independently. Prompt legal advice is important because deposit security, creditor claims and completion arrangements can change quickly.
Preparing for handover while the date moves
Keep your finance approval, insurance, removal arrangements and tenancy decisions under review rather than committing to a date that has not been confirmed. Ask who will issue the occupancy or completion documents and when you can conduct a pre-settlement inspection. An inspection can identify defects, but it does not by itself create a right to postpone settlement; that depends on the agreement and applicable law.
At handover, record unfinished work, missing keys, appliances, certificates and agreed rectification dates. Send the list promptly through the contract’s notice channel. Avoid signing a statement that says all obligations are satisfied unless you understand its effect.
How to escalate without weakening your position
- Internal written complaint: set out the original date, the developer’s stated reason, the clause relied on, the information you need and a reasonable response date.
- Professional review: provide the complete evidence file to a local property lawyer or conveyancer, including every notice and variation.
- Regulator or dispute service: confirm eligibility and jurisdiction before filing. Follow its required pre-action steps and attach the chronology.
- Formal notice or proceedings: use the wording and service method required by the contract or legislation. A professional should draft or check any notice that could terminate the agreement or claim money.
Regulators can explain processes or investigate conduct, but they may not order the remedy you want. A tribunal or court may have different limits, fees and evidence rules.
A practical record template
Maintain one dated chronology with these fields:
- contract milestone and original promised date;
- developer notice, date received and clause cited;
- your response and method of service;
- construction, approval or registration evidence;
- revised dates and whether you accepted them;
- payments made or requested; and
- each additional cost, invoice and mitigation step.
This file lets an adviser see whether the issue is a permitted extension, a missed contractual deadline, a defective notice, a material change or a broader project failure.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesBottom line for a delayed possession
A late developer handover is a contract-and-jurisdiction problem before it is a cancellation decision. Check the date and extension machinery, demand a written schedule, preserve evidence, identify the correct dispute route and obtain local advice before changing payments or ending the deal. Only then can you assess whether staying, negotiating, claiming loss or seeking termination is legally and financially sensible.
