Repair common Windows errors and clear accumulated junk for a smoother, more stable PC - no reinstall needed.Free scan · no reinstallWhen a construction project exceeds its approved budget or misses a milestone, the result is usually a managed commercial problem rather than an automatic penalty. The owner, contractor and other parties compare the actual work with the contract baseline, identify the documented cause, calculate cost and time effects, and use the agreement’s notice, change-order, extension and dispute procedures. The contract and applicable law—not a universal construction rule—determine who bears which costs and whether damages or other remedies apply.
A cost overrun can require additional funding, scope reduction or a revised delivery plan. A delay can postpone occupancy, operations or expected revenue and may lead to corrective-action demands or contract time charges. A change in work can produce both effects, so the schedule impact must be assessed at the same time as the price impact.

What changes immediately when a project goes over budget or late?
| Variance | Practical consequence | Immediate management question |
|---|---|---|
| Cost exceeds the approved budget | More owner funding may be needed, reserves may be used, or scope and specifications may be reconsidered. | Is the increase caused by changed work, an unforeseen condition, a funding constraint, a construction method, contractor performance or another documented event? |
| Completion date moves | The owner may wait longer to occupy or operate the asset and may incur continuing financing, supervision, inspection or site overhead. | Does the event affect the approved schedule’s critical path, and is a supported time extension available? |
| Both cost and time change | A change order, revised completion date, added direct cost and extended project overhead may need to be negotiated together. | What notice, records, pricing and schedule analysis does the contract require? |
| Contractor performance falls behind | The owner may issue a formal warning, request a corrective-action plan and apply contract time charges or liquidated damages where the agreement permits. | Is the delay excusable under the contract, and what does the current approved schedule show? |
These are management consequences, not a prediction of legal liability. The actual outcome depends on the wording of the contract, the project record, the cause of the variance and the governing jurisdiction.

- the original and currently approved contract price;
- the scope, drawings, specifications and allowances;
- the approved start, milestone and completion dates;
- the latest approved critical-path-method (CPM) schedule;
- approved changes, payment records, contingency use and prior extensions; and
- the date each problem became known and the notice given to the other parties.
Then classify the event without assigning blame beyond the evidence. A design revision is different from a concealed site condition; a funding shortfall is different from a contractor’s failure to staff the work. The classification controls notice deadlines, pricing, time relief and any damages analysis.
| Possible cause | Questions to answer | Records that usually matter |
|---|---|---|
| Unforeseen site or existing-condition problem | Was the condition materially different from what the contract disclosed or reasonably indicated? When was it discovered? | Site reports, photographs, tests, logs, geotechnical information, instructions and cost proposals. |
| Owner- or designer-directed scope change | What work was added, deleted or redesigned, and did it alter the critical path? | Revision clouds, requests for information, directives, change estimates and schedule updates. |
| Funding or authorization constraint | Was money unavailable, released late or capped by an external approval? | Funding approvals, payment records, meeting minutes and written directions to slow, suspend or resequence work. |
| Construction method, procurement or contract-type issue | Did the selected delivery method or estimate omit a foreseeable activity or create a coordination problem? | Estimate assumptions, bid documents, procurement records, baseline schedule and risk register. |
| Contractor performance | Was the contractor’s own failure on the critical path, and did it have a reasonable recovery opportunity? | Daily reports, manpower and equipment logs, schedule updates, submittal records, notices and corrective-action plans. |
Which contract process normally follows a variance?
Most construction agreements turn a variance into a documented contract administration event. The sequence below is a practical framework; the actual agreement may impose different forms, deadlines or approval levels.
- Give the required notice. Identify the event, discovery date, affected work and preliminary cost or time effect. A late notice can limit entitlement under some contracts, so use the agreement’s specified method and deadline.
- Preserve contemporaneous evidence. Keep daily reports, photographs, delivery tickets, labor and equipment records, instructions, meeting minutes and schedule updates. Separate facts observed on site from assumptions about responsibility.
- Price the change or impact. Distinguish direct labor, materials, equipment and subcontract costs from extended supervision, inspection, temporary facilities, financing or other time-related overhead. Apply the pricing rules in the contract rather than an informal estimate.
- Analyze the schedule. Compare the event with the approved CPM schedule, identify affected activities and determine whether the completion milestone or critical path moves. Do not treat every activity slippage as a compensable delay.
- Obtain written authorization. A change order, directive, amendment or time-extension decision should state the revised scope, price, completion date and any reservation of rights. Work performed without the required authorization can create a payment dispute.
- Update the baseline and monitor performance. Once approved, incorporate the change into the schedule and cost report. Track whether the revised plan is being met and escalate new variances promptly.
What happens when the budget is exceeded?
Additional funding or a scope decision
The owner must decide whether to provide more funding, draw on an approved contingency, defer nonessential work or redesign the project. That decision should be recorded with the effect on function, code compliance, quality, life-cycle cost and the completion date. Cutting scope to close a funding gap can create a second change event if the omitted work is later restored.

Repricing and auditability
Use the contract’s measurement and pricing provisions wherever possible. A transparent proposal identifies quantities, unit rates, labor and equipment assumptions, subcontract quotations, markups and schedule-related costs. Owners should be able to reconcile the proposal to field records and approved drawings; contractors should be able to show that claimed costs were actually incurred or contractually allowable.

Funding does not resolve responsibility by itself
Paying an invoice or authorizing interim work does not necessarily decide who ultimately bears the overrun. Parties can document an interim payment while reserving entitlement questions, provided the contract allows that approach and the reservation is clear.
What happens when the contractor is behind schedule?
For U.S. federal highway administration, Federal Highway Administration guidance describes a formal sequence: warn the contractor when progress is behind, request corrective action, review the contractor’s CPM schedule to support time charges, and assess contract time charges or liquidated damages when the applicable terms are satisfied. The guidance is available at FHWA’s construction project management guidance.
- Issue a formal warning. State the missed activities or milestones, the evidence of slippage and the contract provision involved.
- Request a recovery or corrective-action plan. Ask how the contractor will regain time, including resequencing, added resources or other measures, and require the plan to address safety and quality.
- Test the plan against the approved CPM schedule. Determine whether the proposed actions actually change the critical path and whether the promised dates are achievable.
- Document excusable or owner-caused events. A directed change, late access, differing condition or other contract event may support a time extension. Record its duration and the activities it affected.
- Make the time decision in writing. Approve, deny or partially grant an extension under the contract, updating the completion date and schedule records.
- Assess time charges only under the applicable clause. Confirm that the contractual prerequisites, notice, calculation and any required approval have been met before charging damages.
Acceleration can be proposed, but it is not automatically free. Extra shifts, overtime, additional crews or resequencing can increase cost, safety exposure, rework risk and supervision requirements. The parties should state who authorized the measure and how its cost and schedule effect will be evaluated.
How a change can affect both price and time
FHWA advises project personnel to evaluate and document the schedule effect of a contract change and to include an appropriate time extension in the change order where applicable. That means a change estimate should contain two linked analyses:

- Price: the added or deleted work and the resulting direct and time-related costs.
- Time: the activities affected, the critical-path relationship, the supported duration and the revised milestone or completion date.
A change that adds work but does not move the critical path may justify a price adjustment without extra contract time. Conversely, an event can delay completion while producing little direct construction cost but substantial extended overhead. The schedule update and cost proposal should explain which situation applies.
When can liquidated damages apply?
Liquidated damages are not an automatic consequence of every late project. They depend on a clause in the contract, the stated completion obligation, any granted extensions and the law governing that agreement.
For covered U.S. federal contracts, Federal Acquisition Regulation (FAR) Subpart 11.5 says liquidated damages may be used when timely performance is important and probable damages would be difficult or impossible to estimate accurately or prove. It requires a rate that reasonably forecasts compensation for the harm caused by late delivery or untimely performance, and construction contracts with such provisions must state the applicable daily rate or rates. The FAR states: “Liquidated damages are not punitive and are not negative performance incentives (see 16.402-2).” See FAR Subpart 11.5.

That federal policy is an example, not a universal rule for private, state or non-U.S. projects. Before applying a charge, the contracting parties must check the actual clause, approved extensions, excusable-delay provisions, required notices and applicable law. A punitive amount or a charge unsupported by the contract can be challenged.

What unforeseen-condition data shows—and what it does not
The U.S. Government Accountability Office reviewed 18 General Services Administration repair and alteration projects and found unforeseen conditions on 11 of them. On nine of those 11 projects, remediation cost between 1 and 5 percent of the original construction contract award. Those figures describe that named federal sample; they are not an industrywide average or a prediction for a particular project. The report is GAO-16-273.
The practical lesson is to treat concealed or materially different conditions as a documented risk event. Record the discovery, stop or protect affected work when necessary, notify the required parties, obtain direction and price both the remedial work and any supported schedule effect. Do not use the GAO percentages as a contingency formula without project-specific analysis.

GAO’s discussion of the Olmsted Locks and Dam project illustrates the scale of estimate and schedule movement without establishing a typical outcome. The project was authorized in 1988 at $775 million with a seven-year construction estimate. In 2012, the U.S. Army Corps of Engineers sought authorization of $2.918 billion and estimated completion in 2024. GAO identified the construction method, contract type and other factors as contributors. These are historical figures reported in GAO-17-147, not the project’s current status.
For an owner, the example underscores why an early estimate and date should be treated as a baseline subject to controlled change—not as a guarantee. Major method, procurement and contract-type decisions can influence both cost growth and the time needed to complete the work.

Choosing a recovery response
| Response | Potential benefit | Trade-offs to document |
|---|---|---|
| Resequence work | May protect the completion milestone without adding crews. | Temporary works, coordination, access, inspection and rework risks. |
| Add labor, shifts or equipment | Can increase production on critical activities. | Overtime or rental cost, supervision, congestion, fatigue, safety and quality exposure. |
| Approve a time extension | Aligns the contractual date with a documented excusable or directed event. | Delayed use, extended owner costs and possible financing or revenue effects. |
| Reduce or defer scope | Can bring the authorized price within available funding. | Function, durability, compliance, future replacement cost and the price of later restoration. |
| Provide additional funding | Preserves the planned scope and sequence. | Approval authority, funding source, audit trail and whether the added work changes the critical path. |
No single recovery method is best for every project. The decision should compare the revised completion date, total cost, safety, quality, contractual authority and effect on the asset’s intended use.
Records that protect the project’s position
Owners, contractors and consultants should maintain one consistent record set. At minimum, retain:
- the signed contract, amendments, insurance and bonding documents;
- current drawings, specifications, requests for information and approved submittals;
- baseline and updated CPM schedules with logic changes identified;
- daily reports, photographs, weather and site-access records;
- labor, equipment, material, delivery and subcontract records;
- meeting minutes, notices, directives, change proposals and approvals;
- payment applications, commitments, forecast-at-completion reports and contingency usage; and
- the written analysis supporting each extension, corrective action, time charge or liquidated-damages decision.
Records should show what happened, when it happened, who was notified, which activity was affected and what action was authorized. A conclusion that a party was “late” or “over budget” is much weaker than a dated comparison to the approved baseline.
Federal examples versus private and non-U.S. projects
The FAR rules cited above govern applicable federal contracting, and the FHWA material is highway-program guidance. GAO’s statistics concern the specific federal projects it reviewed. They do not establish legal rights, a standard damages amount or a representative overrun rate for an unspecified private construction contract.
For a private or non-U.S. project, review the signed agreement and the law of the project location. Pay particular attention to notice periods, differing-site-condition language, owner-directed changes, suspension and force-majeure clauses, extension procedures, payment terms, dispute resolution and any liquidated-damages provision. A construction lawyer or contract administrator can assess entitlement from the actual documents and project record; no generic article can determine the final allocation.
A practical report for owners and project teams
When communicating an overrun or delay, use a short factual report with these headings:
- Baseline: approved price, scope, milestones and completion date.
- Event: what changed, discovery date and affected location or activities.
- Evidence: records supporting the cause and responsibility analysis.
- Cost effect: direct additions or deletions and time-related costs, separated clearly.
- Schedule effect: critical-path analysis, requested duration and revised milestone.
- Contract route: notice, change-order, extension, corrective-action or dispute provision invoked.
- Decision requested: funding, scope direction, time extension, recovery plan or other authorized action.
- Next review date: the date for checking whether the approved response is working.
