What documents to prepare for a land acquisition NOC in Pune

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no single, Pune-wide “land acquisition NOC” checklist. The documents depend on what the NOC is for, which project or notice names it, the parcel’s location, and whether the issuing body is handling public acquisition, development permission, revenue approval, highway work, or access across another owner’s land.

Start by identifying the named authority and statutory route in the notice. Then obtain that office’s latest application form and document list. The checklist below separates acquisition work from related planning and revenue permissions so you do not file a development-permission pack as though it were an acquisition application.

First establish what “land acquisition NOC” means

“NOC” means no-objection certificate, but the phrase does not identify one legal procedure. In Pune, at least four different situations can be described this way:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Public land acquisition: A government body or public authority is acquiring land for a named project. The governing statute may be the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, a highway law, a Maharashtra notification, or a negotiated-acquisition route.
  • Development permission: An owner or developer is seeking permission to build or change land use. The planning authority may ask for NOCs “wherever required” as part of that application.
  • Revenue permission: A revenue NOC can be required for a particular permission, such as the service listed by Maharashtra’s Aaple Sarkar portal under section 42-A of the Maharashtra Land Revenue Code.
  • Access or third-party consent: A proposal may require the owner of another parcel to consent because an approach road or other facility crosses that parcel.

These routes can involve similar words—ownership record, tax receipt, consent, NOC—but they are not interchangeable. The title of an email, broker’s message, or internal file is not enough to identify the correct checklist.

Questions to answer from the notice

  1. What is the exact project name, survey number or plot number, and village or municipal location?
  2. Which office issued the notice or requested the NOC?
  3. Does the document cite an Act, rule, development-control regulation, section number, or application form?
  4. Is the authority acquiring the land, approving construction or land use, clearing a revenue issue, or recording consent from another owner?
  5. Who is the applicant: the recorded owner, a co-owner, a developer, an acquiring body, or an authorised representative?

If any answer is unclear, contact the office named in the notice before collecting documents. Ask for the current checklist for that exact NOC and parcel. Keep the written reply, acknowledgement, or service-request number with the file.

Build a core document file before requesting the final checklist

The following is a preparation pack, not a universal legal checklist. It helps the responsible office identify the parcel and tell you which additional records apply.

Parcel and ownership evidence

  • Prepare the latest record that identifies ownership, such as an extract of the record of rights or a property register card, where applicable.
  • Keep the registered deed, allotment letter, lease, conveyance, or other instrument by which the applicant claims an interest available for inspection if the office requests it.
  • Record every survey number, subdivision number, plot number, village, taluka, district, and area exactly as shown in the official record. Differences in spelling or area can cause the office to treat the documents as relating to different land.
  • If the applicant is not the sole owner, prepare a current list of all recorded co-owners and the document establishing the applicant’s authority to act.

Site and access information

  • Keep a site plan or location sketch that matches the survey or plot identifiers in the ownership record.
  • Mark the existing and proposed approach road, boundaries, adjoining parcels, and any portion of the proposal that depends on another owner’s land.
  • Separate facts shown by a registered plan or government record from measurements or sketches prepared only for discussion. Label the latter as proposed or indicative.

Payment and administrative records

  • Retain the latest property-tax receipt if the application route asks for it.
  • Keep the scrutiny-fee receipt or other fee acknowledgement in the format requested by the office. A payment screenshot is not necessarily a substitute for an attested receipt.
  • Prepare a document index, page numbers, and a copy of the submission acknowledgement. This makes it easier to prove what was filed if the office later raises a deficiency.

Do not assume that every item above must accompany an acquisition NOC. The purpose of the pack is to prevent an avoidable second visit while the authority confirms the statutory requirements.

What PMRDA publishes for development-permission applications

PMRDA’s DCPR-2018 development-application material gives a useful example of a related planning process. It is not an acquisition-NOC checklist. The published general list includes the following items:

Document or consent How to interpret it
Extract of the record of rights, property register card, or another ownership document Shows the applicant’s claimed ownership or interest. Use the record appropriate to the parcel and application.
Consent of co-owners where a third-party interest is created Conditional. It becomes relevant when the proposal creates or relies on an interest affecting co-owners.
Attested receipt for scrutiny fees Proof of the prescribed planning-application payment; retain the attested form requested by PMRDA.
Latest property-tax receipt Include the current receipt for the property covered by the planning application.
NOC or NOCs, wherever required for the proposal Not an automatic list of every possible NOC. The proposal, site and other laws determine which ones apply.

This list answers a planning-application question: which general papers PMRDA asks for when seeking development permission. It does not establish what a public acquiring body must receive from a landowner, nor does it replace the checklist attached to an acquisition notice.

When a co-owner or neighbouring owner must be involved

Co-owner consent

Where a development proposal creates a third-party interest, PMRDA’s general material identifies consent of co-owners as a conditional document. Before filing, compare the ownership record with the proposed transaction or development arrangement. If more than one person is recorded, obtain the authority’s preferred consent format and signing requirements rather than relying on an informal letter.

Access across another parcel

A Maharashtra non-agricultural-permission form illustrates a separate, access-related condition: it asks for an NOC from the owner of another parcel when the applicant’s approach road crosses that parcel. This is an example tied to that form and circumstance. It should not be treated as a rule that every acquisition file requires an adjoining owner’s NOC.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Map the access route early. If the road, utility corridor, staging area, or other project component touches land outside the applicant’s title, tell the authority exactly where the overlap occurs and ask whether it requires consent, an easement document, a separate permission, or no additional paper.

Identify the acquisition law and acquiring body

Pune District’s land-acquisition information points to several possible legal routes. The page links the National Highways Act, 1956; a Manual of Guidelines on Land Acquisition for National Highways; the Maharashtra Land Acquisition Notification dated 27 August 2014; the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and associated 2015 rules; and a 2017 government decision concerning private negotiation.

Those references help you identify the framework that matches the named project. They are not a combined NOC checklist. A highway acquisition, a state-led public project, and a negotiated purchase can have different notices, authorities, forms, compensation records, and consent requirements. Use the law and guidance cited in the actual notice, not the most convenient document found online.

Why the acquiring authority matters

PMRDA describes its Land and Estate Department as handling acquisition of land for public use, allotment, government-land procurement, and land-record-related work within its area. That description does not make PMRDA the authority for every Pune parcel or every project. Confirm that the land lies within PMRDA’s jurisdiction and that the project is one for which PMRDA is acting.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For a highway, the highway-acquiring body may control the process. For another public project, the district administration or a designated department may issue the notice. For a development-permission application, the planning authority may be the relevant office even though no acquisition is taking place.

Step-by-step document preparation

  1. Read the latest notice in full. Capture the project name, authority, statutory reference, deadline, parcel identifiers, and the exact wording of the requested NOC.
  2. Classify the purpose. Mark the file as acquisition, development permission, revenue permission, access consent, or another purpose. If it fits more than one category, maintain separate sections rather than merging checklists.
  3. Verify the parcel. Match the survey or plot number, area, village, taluka, district, and owner name across the notice and ownership records. Flag discrepancies before submission.
  4. Request the current form and checklist. Ask the named office whether it wants originals for verification, self-attested copies, attested copies, a particular affidavit, a prescribed consent format, or online uploads.
  5. Assemble the ownership section. Include the applicable record-of-rights extract, property register card, or other ownership evidence, followed by the title instrument and authority-to-act documents requested for that route.
  6. Check third-party interests. Identify co-owners, lessees, mortgagees, access holders, or neighbouring owners whose land is crossed by the proposal. Obtain only the consent or clearance the office confirms is necessary.
  7. Complete fees and supporting records. Add the required scrutiny-fee or service-fee receipt, current property-tax receipt where applicable, plans, and any NOCs specified by the form.
  8. Submit and preserve proof. File through the channel stated by the authority. Keep the acknowledgement, inward number, uploaded-file list, payment receipt, and a complete copy of exactly what was submitted.
  9. Respond to deficiencies in writing. If the office asks for another document, request the deficiency in a written or traceable form and add the item to the index. Do not substitute a similarly named NOC without confirming that it satisfies the request.

Common mistakes and how to correct them

  • Using a planning checklist for an acquisition case: Separate PMRDA development-permission papers from acquisition documents and ask the acquiring body for its own list.
  • Assuming “Pune” identifies the authority: Pune district, municipal areas, and the Pune Metropolitan Region can involve different offices. Use the project and parcel jurisdiction stated in the notice.
  • Submitting an old ownership record: Ask whether the office requires the latest extract or property register card and check that the names and area match the notice.
  • Overlooking co-owners: Compare the ownership record with the proposed transaction. Where a third-party interest is created, obtain the prescribed co-owner consent before filing.
  • Ignoring an access crossing: Trace the approach road on the plan. A neighbouring owner’s NOC may be relevant in the specific non-agricultural-permission situation described above.
  • Treating a reference law as a form: Acquisition Acts, rules, notifications, and manuals explain the route; they do not automatically supply the current application checklist.
  • Relying on an advertised service period: A stated processing period belongs to the service that publishes it. It does not promise a decision time for a different NOC.
  • Filing without an indexed copy: Without a submission copy and acknowledgement, it is difficult to show which version of a plan, receipt, or consent was filed.

What the 30-day period does—and does not—mean

Aaple Sarkar lists a revenue NOC service for development permission under section 42-A of the Maharashtra Land Revenue Code with a 30-day period for that listed service. Treat that number as an administrative period attached to that revenue service only. It is not a general deadline for a land-acquisition NOC, a highway acquisition, a PMRDA planning application, or a private-negotiation transaction.

For any other route, rely on the deadline and acknowledgement issued by the responsible authority. If a notice gives a filing date but no checklist, submit a written request for the checklist promptly and retain proof that you asked.

A practical filing index

Use an index that lets an officer locate each document without guessing. A simple structure is:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Cover letter quoting the project, notice number, applicant, and parcel identifiers.
  2. Notice or application form and the authority’s checklist.
  3. Ownership record and title or allotment document.
  4. Co-owner or third-party consents, if the authority has confirmed they apply.
  5. Site plan, access plan, and other drawings requested for the proposal.
  6. Property-tax receipt and scrutiny or service-fee receipt, where applicable.
  7. Other NOCs or clearances expressly named by the form.
  8. Identity, authorisation, or representative documents requested by the office.
  9. Submission acknowledgement and payment proof.

Number the pages consistently and keep one electronic and one paper copy. If the authority requires a different sequence or file format, follow that instruction instead of this index.

Before you file: a final decision check

  • The project and parcel are identified in the latest notice.
  • The issuing authority and statutory route are confirmed.
  • The application is clearly separated into acquisition, planning, revenue, or access material.
  • Ownership names, survey details, area, and boundaries agree across the papers.
  • Any co-owner or neighbouring-owner issue has been disclosed and its required consent format confirmed.
  • Fees, attestations, copies, uploads, and deadlines match the current form.
  • You have a dated acknowledgement and a copy of the complete submission.

If the authority has not published a definitive checklist for the particular NOC, the safest answer is not to guess. Identify the office handling the named project, obtain its current instructions, and use the general documents above only as a preparation aid.

Frequently Asked Questions

Can one NOC be used for both land acquisition and development permission?

Not automatically. These are separate purposes with potentially different authorities and legal routes. Ask each responsible office whether it accepts the same certificate or requires a separate application.

What should I do if the notice and my property record show different survey details?

Do not file the mismatch silently. Ask the issuing authority and the land-record office which identifier controls, then submit the correction or supporting record they specify.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is a private agreement with a landowner enough for a public acquisition file?

Only if the applicable authority and route expressly recognise that arrangement. A private-negotiation decision or agreement does not by itself replace the documents required under the named acquisition process.
