There is no single national percentage that every new tower must make affordable. The obligation depends on the parcel’s city or state, zoning district, whether the site was rezoned, the project’s size and history, and whether the developer is choosing an affordability incentive. In New York City, a qualifying project in a Mandatory Inclusionary Housing (MIH) area generally commits 20–30% of residential floor area to permanently affordable homes. A different NYC program, the Universal Affordability Preference (UAP), can permit 20% more housing in R6–R10 districts when the added homes satisfy income limits. California’s density-bonus law trades qualifying affordable homes for additional development capacity and other incentives. The project team must identify the governing local rule before designing or pricing a tower.
What “affordable housing” means in a new tower
In a development regulation, “affordable” is a legal status, not a marketing description. The homes are reserved for households within specified income bands, with rents or sale prices calculated under the applicable program. A recorded restriction or regulatory agreement controls those units for the required affordability term—permanently in the New York City programs described here.

The requirement can be measured in different ways. A rule may count residential floor area, a number of units, or only the extra homes made possible by a density incentive. It may also prescribe income tiers, unit sizes, locations within the building, marketing procedures, and whether the homes are rentals or for-sale units. Those details determine the tower’s layout and operating economics as much as the headline percentage.

A mapped inclusionary area
Some cities map neighborhoods where a zoning change creates substantially more residential capacity. In those areas, the additional capacity is conditioned on affordable housing. New York City’s MIH program is this type of rule. It applies in designated MIH Areas created through land-use actions that significantly increase permitted residential density.

A project-specific rezoning or land-use action
A tower may become subject to an affordability requirement because its owner seeks a rezoning, special permit, or other action that increases residential capacity. The land-use approval can select among program options and can establish the obligations that run with the property.
A voluntary density incentive
Other programs are optional exchanges: the developer supplies qualifying affordable homes and receives additional floor area, units, height, or other incentives. NYC’s UAP and California’s state density-bonus law illustrate this model. A project that does not elect the incentive may not have the same set-aside, although another local rule could still apply.
New York City example: Mandatory Inclusionary Housing
New York City adopted MIH in March 2016 and updated its zoning text in December 2024. The New York City Department of Housing Preservation and Development (HPD) states in its 2025 MIH fact sheet that, within MIH Areas, 20–30% of residential floor area in qualifying new developments, enlargements, and conversions to residential use above 10 units and 12,500 square feet must be permanently affordable for low- and moderate-income New Yorkers. That is a NYC program figure, not a rule for every tower in the United States.

- New residential developments in a mapped MIH Area.
- Residential enlargements and conversions that meet the program thresholds.
- Projects with more than 10 units and more than 12,500 square feet, subject to the applicable zoning text.
The applicable MIH option is determined through the Uniform Land Use Review Procedure (ULURP) and the zoning text for the site. Where more than one option is available, the developer may select among the permitted options. The options differ in the income mix they require, so two towers with the same total floor area can have different affordable-housing obligations.
What the percentage is measured against
MIH’s 20–30% figure is a share of residential floor area, not automatically a share of the unit count. A building with large market-rate apartments and small affordable apartments will not necessarily have an affordable-unit count equal to 20–30% of all units. Unit distribution, bedroom mix, and location requirements in the zoning text still matter.
Tenure and permanence
HPD’s fact sheet allows MIH homes to be rental or homeownership units, depending on the selected option and project. “Permanently affordable” means the restriction does not simply expire when the first occupant moves out. The affordability requirements are secured through a recorded instrument against the property.

Vesting and the December 2024 changes
Projects vested under earlier zoning text can receive different treatment from projects reviewed under the December 2024 amendments. A tower’s filing date, land-use approvals, permits, and other vesting facts therefore matter. HPD advises owners to consult agency representatives and land-use counsel to establish which text governs the parcel rather than applying the newest summary automatically.
New York City example: Universal Affordability Preference
UAP, established in December 2024, is an incentive in R6 through R10 districts—not a mandate imposed on every development. HPD describes a 20% increase in housing when the additional homes are permanently affordable and meet the program’s income-band conditions.
Income test for the added homes
The additional UAP homes must be affordable to households at or below a weighted average of 60% of Area Median Income (AMI). The proposal may use no more than three income bands, and no band may exceed 100% AMI. If the site contains at least 10,000 square feet of affordable floor area, at least 20% of that affordable floor area must be provided at or below 40% AMI.
“Weighted average” is important: the average is calculated across the approved income bands and their floor area or unit allocation, rather than by labeling every home at 60% AMI. A plan with some homes at a higher band must include enough lower-income homes to satisfy the average and the separate 40% AMI condition when it applies.
How UAP differs from MIH
| Feature | MIH | UAP |
|---|---|---|
| Basic trigger | Mapped MIH Area and qualifying development, enlargement, or conversion | Voluntary use of the preference in an R6–R10 district |
| Capacity relationship | Affordable obligation is tied to the residential project and applicable MIH option | Up to 20% more housing capacity in exchange for qualifying additional homes |
| Calculation highlighted by HPD | 20–30% of residential floor area | Additional homes must meet a weighted average of 60% AMI |
| Lower-income condition | Depends on the selected MIH option and zoning text | At least 20% of affordable floor area at or below 40% AMI when affordable floor area is 10,000 square feet or more |
| Tenure | Rental or homeownership, subject to the option | Rental or homeownership |
| Duration | Permanently affordable | Permanently affordable |
The table compares the program mechanisms, not a choice available at every parcel. A site’s zoning, map status, land-use history, and current HPD worksheets determine whether either program can be used.
How compliance becomes part of the building permit
For NYC HPD programs, affordability is not resolved by a promise in a planning memo. HPD describes a sequence that connects the housing commitment to construction and occupancy:

- Submit the program application. The filing identifies the project, proposed affordable floor area or homes, income bands, tenure, and other required information.
- Obtain HPD review and approval. HPD checks the proposal against the applicable program and zoning requirements.
- Execute and record the restriction. A restrictive declaration or regulatory agreement is recorded against the property, creating a continuing obligation that can affect ownership, financing, and future alterations.
- Coordinate the permit notice. HPD sends a notice to the New York City Department of Buildings (DOB) so the affordability commitment is reflected in the permitting record.
- Construct the affordable housing. The approved homes and required common facilities must be delivered as part of the project.
- Receive the completion notice. HPD issues a completion notice after the required work and documentation are satisfied. DOB may then issue a certificate of occupancy.
Because the certificate of occupancy is tied to the completion notice, an unresolved affordable-housing condition can delay the point at which residents can legally occupy the tower.
California comparison: density bonus under Government Code §65915
California uses a statewide density-bonus framework rather than one universal tower set-aside. The California Department of Housing and Community Development describes state law as requiring local jurisdictions to provide density bonuses and development incentives to developers who propose qualifying affordable housing. The bonus amount and the number of incentives vary with the affordable units proposed and the statutory category they satisfy.
California Government Code §65915 is the starting point for a project-specific analysis, but the current statutory text, local zoning implementation, and the project’s facts must all be checked. The comparison matters because “affordable-housing requirement” can describe a negotiated trade: the developer supplies qualifying homes and receives additional development capacity or incentives. It does not establish a single statewide percentage comparable to NYC’s MIH range.

What a California team must establish
- Which statutory affordability category the proposed homes satisfy.
- How many qualifying units are proposed and how that count affects the available bonus.
- Which incentives, concessions, waivers, or other benefits are available under the current law and local process.
- How the city or county will verify income limits, rents or prices, unit distribution, and long-term restrictions.
A practical method for determining a tower’s obligation
1. Identify the governing jurisdiction and program
Start with the parcel’s city or county, state, zoning district, and any overlay or mapped inclusionary area. Do not use a percentage from another jurisdiction as a planning assumption.
2. Check the zoning map and land-use history
Confirm whether the site is in an MIH Area, whether a rezoning created the residential capacity, and whether approvals or permits vested the project under an earlier zoning text. Record the relevant effective dates.
3. Define the calculation base
Determine whether the rule counts residential floor area, total units, or only incremental capacity. For an illustrative calculation—not a universal requirement—a 100,000-square-foot residential floor area subject to a 20% floor-area obligation would produce 20,000 square feet of affordable floor area. The actual project must use the definitions and exclusions in its governing text.

4. Model income bands and unit mix
Obtain the current AMI limits, rent or sales schedules, bedroom requirements, and any very-low-income share. For UAP, test the weighted average of no more than three bands, the 100% AMI ceiling, and the at-or-below-40% AMI floor-area condition when the 10,000-square-foot threshold is met.

6. Price the permanent obligation
Include below-market revenue, additional design and compliance work, marketing and monitoring, legal recording, financing effects, and the cost of delivering affordable homes alongside market-rate units. The recorded restriction can affect refinancing, transfers, and future redevelopment.
7. Build the approval schedule into the critical path
Allow time for the housing-agency application, review comments, agreement execution, recording, permit notice, construction inspections, completion documentation, and certificate-of-occupancy coordination. Treat the affordability package as a permit milestone, not a post-construction administrative task.

AMI limits, rents, and program worksheets are updated periodically. HPD has said it is temporarily allowing 2025 or 2026 AMI calculations for relevant applications while adoption of 2027 AMI is pending. That temporary policy does not freeze a project’s numbers permanently; the team should confirm the schedule accepted for its filing date and program.

Common mistakes and how to avoid them
Assuming every tower owes 20% or 30%
The 20–30% figure belongs to qualifying NYC MIH projects and is measured in residential floor area. It is not a national rule and does not automatically apply to a tower outside an MIH Area.

Counting units instead of floor area
Where the rule uses floor area, unit count alone can misstate the obligation. Calculate the regulated area first, then design the unit mix that satisfies the applicable bedroom and distribution rules.
Using an old AMI schedule
Income limits and rent schedules change. Tie every feasibility model to the schedule and temporary policy accepted for the actual application.
Ignoring vesting
A project reviewed under earlier zoning text may not follow the same requirements as a new filing after the December 2024 NYC amendments. Establish vesting before selecting an option or promising a percentage to lenders.
Leaving the agreement until the end
The recorded restriction, HPD notice, and completion notice are connected to permitting and occupancy. Draft and review the agreement early enough to resolve title, financing, and construction conflicts.
Treating an incentive as a mandate
UAP and California density-bonus benefits are capacity trades. Verify that the owner is electing the incentive and that the proposed affordable homes satisfy every condition before counting the extra units in the tower’s financial model.
What this means for owners, architects, and contractors
Owners need a parcel-level legal and financial feasibility analysis before acquiring additional development rights. Architects should reserve affordable floor area, unit types, circulation, services, and amenity access from the first test fit. General contractors and trade teams need the approved affordable-unit specifications in the same quality-control system as market-rate work; substituting materials or layouts late in construction can jeopardize completion approval. Lenders and title professionals should review the recorded restriction and its effect on collateral, transfers, and refinancing.
The decisive fact is always local: the tower’s address, zoning text, land-use history, size, unit program, and chosen compliance route. Until those facts are verified with the relevant housing agency and current law, a percentage is only a preliminary planning assumption.
