In March 2023 the CFMEU WA branch raised alleged structural defects at Shenton Quarter, a 157-apartment development in Shenton Park, Perth. The claims rested on worker reports and union-released video, not on an independent engineering finding. The developer said remedial work had begun and that issues found during construction were not unusual. The builder, BGC, later left the site after a dispute with the developer over engineering and design, and Gowdie Management Group was appointed to complete the project. The developer’s project listing now shows the development as completed in 2024. A report dated 12 August 2026 says insolvency practitioners have taken control of the entity behind the project. No published source reviewed here establishes that the building is unsafe, and none confirms that every disputed defect was independently resolved.
What the union alleged in 2023
PerthNow reported on 29 March 2023 that the CFMEU WA branch had received reports from experienced construction workers about structural defects at Shenton Quarter, then being built by BGC on the corner of Seymour Avenue and Selby Street. The union released video that it said showed:
- steel props holding up sagging concrete slabs between floors;
- a large crack in a slab, with a pen inserted to show its width;
- balconies warped by several centimetres.
State secretary Mick Buchan attributed the condition to a lack of structural steel and slab integrity. PerthNow also reported his account that workers had told him the builder would not fill the rooftop pool or build gardens because of concern about the load on the floors below. These are the union’s claims and the accounts of its sources. They were not independently verified engineering findings.
The union said it had written to BGC and Tribis Developments asking for assurances that the building was safe and fit for purpose. At the time of the 2023 article it had not received replies.

The developer’s response
The developer, Iris Residential, told 7NEWS that remedial work had already started and that issues arising and being rectified during construction were not unusual. Later reporting refers to the same developer as Iris-PW. In November 2023 Iris-PW told ABC News that the project was 95 per cent complete, had been comprehensively monitored, and had had its design, engineering and core structural integrity assessed during construction. It said it was on track for certification on completion. That was the developer’s own assessment at the time, not an independent measurement of progress or safety.
Why BGC left and who finished the build
ABC News reported in November 2023 that BGC had left the site amid a commercial dispute with Iris-PW over engineering and design. Australian Property Investor Magazine, reporting on 28 November 2023, said the developer had replaced BGC with Gowdie Management Group.
The two parties gave opposing accounts of the engineering record. The table below sets out each position as reported in 2023. Where a party did not address a point in the reporting, the cell says so.

The reporting does not show which engineering interpretation was correct. Neither the union’s video nor either party’s statements amount to an independent adjudication.

What buyers were told
ABC News described off-the-plan buyers facing delays and uncertainty. Buyer Bethany Evans told the program she had paid a $100,000 deposit and wanted strong validation that there were no structural concerns before proceeding. That figure describes one buyer’s circumstances, not the project as a whole. Her words were: “I have bought a promise – not a property, a promise,” she said.
The same 2023 report recorded a policy debate rather than a legal assessment. WA Commerce Minister Sue Ellery pointed to general remedies under the Australian Consumer Law and to changes to WA strata laws that made it easier for owners’ corporations to sue builders over negligent or defective work. Lawyer Bronwyn Weir argued for stronger independent oversight. A Property Council representative said regulation had to be weighed against housing supply and construction pressures. These are attributed views from 2023, not current legal advice. Anyone relying on the buyer-protection position should check the current WA legislation and official legal guidance, because the law may have changed since that report.

Iris Residential’s project page lists Shenton Quarter as a 157-apartment development with one-bedroom, loft, two-bedroom and three-bedroom apartments, completed in 2024. The listing is the developer’s own description of the project. It is not an independently audited count, and it does not show how each disputed defect was resolved. A completed listing therefore tells readers that the developer regards the project as finished. It does not, on its own, confirm that the 2023 allegations were independently settled.
The 2026 administration report
Business News, reporting on 12 August 2026, said insolvency practitioners had taken control of the entity behind the $140 million Shenton Quarter project. That value is the figure given in that report.
