Temporary Construction Wall Permit, Fire-Rating, and Egress Requirements

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Usually, you should not install or move a temporary construction wall until the building department or fire-code official confirms whether a permit and an approved life-safety plan are required. A wall can trigger review when it encloses a temporary structure, separates occupied space from construction, replaces a fire-resistance-rated assembly, or changes an exit route. The required fire rating and egress arrangement come from the jurisdiction’s adopted building, fire, and accessibility codes—not from the fact that the wall is labeled “temporary.”

When a temporary construction wall needs approval

There is no single nationwide permit rule for every construction partition. The authority having jurisdiction (AHJ)—normally the building department, fire marshal, or both—applies the locally adopted code edition to the project’s occupancy, construction type, location, duration, and proposed work. A wall that looks like dust control on one project may be a rated separation or an egress alteration on another.

Common permit and plan-review triggers

  • The wall creates or encloses a temporary structure used by occupants, customers, workers, or the public.
  • It separates occupied areas from a construction zone and is part of the project’s fire, smoke, infection-control, or occupant-protection strategy.
  • It stands where a permanent fire barrier, fire partition, smoke barrier, or other rated assembly is being removed, opened, or reconstructed.
  • It narrows, closes, reroutes, or otherwise changes an exit, exit access, exit passageway, corridor, stair, door, or accessible route.
  • It changes sprinkler, alarm, smoke-control, fire-department access, or emergency-signage arrangements.
  • It is a tent, platform, stage, grandstand, or similar temporary structure subject to a special permit provision.

For example, the 2018 Georgia amendments based on International Building Code (IBC) Chapter 31 require a permit for qualifying temporary structures, including structures over 120 square feet that are used or intended for gatherings of 10 or more people. The same provisions call for construction documents showing a site plan, means of egress, and occupant load, and they apply Chapter 10 egress rules, including an exit-access travel distance of 100 feet or less for covered temporary structures.

New York City’s Building Code section 3103 requires a department permit for temporary tents, grandstands, platforms, stages, and similar structures erected for 90 days or less, subject to stated exceptions for certain small structures and short durations. Its construction-document requirements likewise address location, egress, and occupant load. These examples demonstrate why a permit answer must be checked against the project’s city, state, adopted code edition, and AHJ.

What to submit before installing the wall

Prepare a coordinated temporary-work plan rather than a sketch that shows only the partition line. The reviewer needs to understand what the wall protects, how people leave, and how fire-protection systems remain effective while work is underway.

Minimum plan information

  • Location and dimensions: show the wall, doors, gates, overhead conditions, adjacent rooms, construction limits, and the dates or phases in which each arrangement will exist.
  • Occupancy and occupant load: identify the use of each occupied area and the calculated number of occupants served by each route.
  • Egress diagram: show every exit-access path, exit, exit discharge, door swing, exit sign, emergency lighting, accessible route, and fire-department access path. Mark widths and travel distances.
  • Wall assembly: identify the tested or otherwise approved system, layers, framing, fasteners, joints, head-of-wall condition, doors, glazing, and firestopping. Include the listing or approval information when a rating is required.
  • Opening protectives and penetrations: specify rated doors, frames, dampers, firestop systems, cable pathways, pipes, temporary services, and any protection at the wall’s top, bottom, and ends.
  • Fire protection: show sprinkler heads and obstructions, fire alarm devices, extinguishers, standpipes, fire-department connections, and access to firefighting equipment.
  • Dust, smoke, and security controls: explain how the barrier limits construction dust and smoke without blocking required ventilation, detection, suppression, or egress.
  • Phasing and maintenance: state who inspects the wall, how route changes will be communicated, and what condition must exist before a section is removed.

Submit the plan before closing, narrowing, or rerouting an exit. If the construction barrier affects an exit, obtain the fire-code official’s approval in advance; do not rely on an informal field decision after the route has been blocked.

How to determine the required fire rating

The rating is a project-specific result of the permanent separation being protected, the occupancy, construction type, location, and locally adopted code. “Temporary” does not automatically mean “nonrated.” When a temporary barrier stands in for a fire-resistance-rated assembly in an occupied building, the barrier may have to provide the same fire-resistance rating as the permanent partition.

Rated replacement during construction

California’s Health Care Access and Information (HCAI) 2020 interpretation CAN 9-3301 states that, in occupied buildings, temporary construction installed while fire-resistance-rated assemblies are being constructed or reconstructed must meet the same fire-resistance rating as the permanent partition. The interpretation also prohibits using plastic or vinyl dust barriers instead of fire-resistance-rated separations. This is especially important in hospitals and other occupied health-care facilities, where a dust curtain cannot substitute for a tested rated assembly.

Permanent egress ratings are not a shortcut

For context, the 2024 IBC generally requires interior exit-stair enclosures connecting four or more stories to have at least a 2-hour fire-resistance rating, and those connecting fewer than four stories to have at least a 1-hour rating. Exit passageways generally require 1-hour rated construction, subject to detailed exceptions. These figures describe permanent egress elements. They must not be copied onto a temporary wall without analyzing the project’s actual code conditions, because a temporary barrier may have a different function, location, or required assembly.

Temporary buildings inside another building

OSHA 29 CFR 1926.151 requires a temporary building erected inside another building to be noncombustible or to have fire resistance of not less than 1 hour. OSHA also states that no temporary building may be erected where it adversely affects a means of exit. A freestanding partition used only as a construction enclosure is not automatically the same thing as a “temporary building,” so the AHJ must determine which requirement applies.

What counts as an acceptable assembly

Use a system with a documented fire-resistance test, listing, engineering judgment accepted by the AHJ, or other approval recognized by the applicable code. The documentation should match the proposed height, framing, board type and thickness, joints, fasteners, penetrations, doors, and support conditions. A field-built wall made from ordinary gypsum board, plywood, plastic film, or fabric has no assumed rating merely because it is thick or continuous.

Can plastic sheeting be used as a fire barrier?

Plastic sheeting may be useful for dust control where the AHJ permits it and where it does not replace a required fire or smoke separation. It cannot be treated as a fire-resistance-rated wall by default. California HCAI’s CAN 9-3301 interpretation expressly prohibits plastic or vinyl dust barriers in lieu of fire-resistance-rated separations.

Before using film, vinyl, or another flexible product, determine whether the barrier is being credited for fire resistance, smoke control, compartmentation, or protection of an occupied area. If any of those functions are required, specify an approved assembly that performs the function. Keep combustible sheeting away from ignition sources, heat-producing work, sprinklers, exit signs, and doors, and include its location and removal in the approved phasing plan.

Keeping exits open during renovation

IBC Chapter 10 requires a means-of-egress system and makes it unlawful to alter a building in a way that reduces the required number of exits or the minimum width or capacity of egress. California HCAI states that required means of egress must be maintained at all times during construction, demolition, remodeling, alterations, and additions, unless approved temporary means-of-egress systems and facilities are provided.

Width, capacity, and travel distance

Measure the usable clear width after the wall, protection, equipment, carts, cords, and stored materials are installed. Under the 2024 IBC, egress courts generally must be at least 44 inches wide, or 36 inches for Group R-3 and Group U occupancies, unless a specific exception applies. The applicable code may impose different dimensions on corridors, doors, stairs, ramps, and accessible routes. Do not assume that a route is compliant because a tape measure shows the nominal corridor width; protrusions, door hardware, and construction debris can reduce the usable width.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Recalculate occupant load, required exit capacity, number of exits, and exit-access travel distance for each phase. A route that worked before demolition may fail after a corridor is shortened, a door is locked, or a temporary wall creates a dead end. For qualifying temporary structures covered by the cited Georgia IBC amendments, exit-access travel distance is limited to 100 feet; other occupancies and jurisdictions may use different limits.

Temporary-route controls

  • Keep the approved route free of tools, materials, cords, hoses, lifts, and waste.
  • Maintain exit doors, panic hardware, lighting, exit signs, and emergency power serving the route.
  • Protect an accessible path, including required width, slope, surfaces, door maneuvering clearances, and detectable hazards.
  • Update route diagrams and signs whenever a phase changes. Remove obsolete signs so occupants are not directed toward a closed opening.
  • Coordinate barriers with sprinkler discharge patterns, smoke detectors, fire alarm notification, emergency communication, and fire-service access.
  • Provide a documented inspection routine, with a responsible person checking the route at the start of each shift and after deliveries or demolition.

Fire protection while the wall is in place

OSHA requires the employer to maintain a fire-protection program throughout construction, keep access to firefighting equipment available, and provide equipment without delay as hazards arise. Its rule requires a 2A extinguisher for each 3,000 square feet of protected building area, with no more than 100 feet of travel to the nearest extinguisher. These are construction fire-protection requirements; the AHJ or project conditions may require additional equipment.

Fire walls and exit stairs required for the completed building receive construction priority, and fire cutoffs must remain until operations require their removal. Do not remove a cutoff, disable a sprinkler zone, or cover an alarm device simply because the temporary wall makes work easier. If a system must be impaired, follow the jurisdiction’s impairment procedure, provide the required notification and fire watch, and restore protection as soon as possible.

OSHA guidance for occupied buildings emphasizes fire barriers between occupied and unoccupied areas, complete suppression and alarm systems, and unobstructed egress. It also recommends updating signs and route diagrams as temporary egress and fire-service access routes change. Combustible storage, hot work, charging stations, waste, and flammable liquids should remain outside exit paths and away from the barrier unless the approved fire-safety plan specifically addresses them.

Approval sequence for a compliant temporary wall

  1. Identify the governing rules. Confirm the city or county, adopted building and fire codes, accessibility requirements, health-care rules if applicable, OSHA obligations, and the AHJ’s submittal process.
  2. Classify the wall. Decide whether it is a temporary structure, a rated separation, an occupant-protection barrier, a dust enclosure, or more than one of these.
  3. Survey existing conditions. Record current exits, widths, occupant loads, travel distances, stairs, accessible routes, sprinklers, alarms, smoke compartments, extinguishers, and fire-department access.
  4. Design each phase. Draw existing and temporary routes, wall locations, doors, signs, lighting, emergency access, and the date or work activity that causes each change.
  5. Select the assembly. Use a tested or approved wall that provides the required rating and detail every joint, penetration, opening, support, and interface with existing construction.
  6. Coordinate building systems. Show sprinkler relocations or obstructions, alarm and detection devices, smoke control, extinguishers, firestopping, ventilation, temporary power, and dust-control measures.
  7. Submit for review. Provide the site plan, construction documents, occupant loads, egress calculations, wall details, product approvals, phasing narrative, and contact information for the responsible contractor.
  8. Obtain written approval. Secure the building permit, fire-official approval, and any special authorization before closing, narrowing, or rerouting an exit.
  9. Install and inspect. Build the wall exactly as approved. Verify clear widths, door operation, signs, lighting, alarm and sprinkler coverage, firestopping, and housekeeping before occupying the area.
  10. Manage changes and removal. Stop and obtain approval for a field change that affects rating, egress, occupancy, or fire protection. Remove the wall only after the permanent separation and route are ready and accepted.

Choosing between compliant temporary-wall approaches

When more than one method is technically possible, compare the complete life-safety effect rather than the purchase price or installation speed.

Decision factor Questions to document
Fire resistance Does the system have a tested or otherwise accepted rating for the proposed height, joints, penetrations, doors, and supports?
Egress Will required exit width, capacity, number of exits, accessible routes, and travel distance remain compliant in every phase?
Fire and smoke systems Will the wall obstruct sprinklers, alarms, smoke compartments, ventilation, fire cutoffs, or fire-department access?
Installation and removal Can it be installed without first blocking an exit, and can it be removed without leaving an unprotected opening or impaired system?
Accessibility Are temporary doors, ramps, surfaces, signs, and maneuvering clearances usable by people with disabilities?
Inspection and approval Does the AHJ recognize the assembly, and can the contractor provide the required documentation and inspections?
Operations Can occupants, workers, deliveries, emergency responders, and maintenance staff use the planned routes without conflict?

Frequent failure points and corrections

“It is temporary, so no permit is needed.”

Why it fails: Duration or removability does not erase the effect on a rated assembly, occupied area, or exit. Correction: Submit the wall and phasing plan to the AHJ before installation and obtain a written determination when the permit path is unclear.

“Plastic is cheaper than a rated wall.”

Why it fails: Plastic or vinyl dust barriers cannot replace a required fire-resistance-rated separation where the governing code requires one. Correction: Use plastic only for an allowed dust-control function and specify an approved rated assembly when fire separation is required.

“The corridor is still technically open.”

Why it fails: A route can lose required width or capacity because of framing, door swings, equipment, or stored materials. Correction: Measure clear width in the installed condition, recalculate the phase, and keep the route continuously clear.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The old exit signs are good enough.”

Why it fails: Occupants follow signs, not drawings. A sign pointing to a closed or rerouted door can delay evacuation. Correction: Install, test, and maintain signs and emergency lighting for the approved phase; remove conflicting signs.

“We can move the barrier in the field.”

Why it fails: A small shift can alter travel distance, accessible clearances, sprinkler coverage, alarm placement, or the wall’s rated interfaces. Correction: Treat every life-safety-affecting change as a design change requiring review before work proceeds.

Field checklist before occupants use the area

  • Permit and fire-official approvals are posted or available to the inspection team.
  • The installed wall matches the approved location, height, assembly, joints, doors, and penetrations.
  • Required rating evidence and firestopping records are on site.
  • All exits, exit-access routes, accessible routes, stairs, and doors have the approved clear width and capacity.
  • Exit signs, emergency lighting, alarms, detectors, sprinklers, extinguishers, and fire-service access are operational and unobstructed.
  • Temporary route maps and directional signs match the current phase.
  • Construction materials, combustible waste, cords, and equipment are outside required egress paths.
  • Workers know the route, emergency contacts, impairment procedures, and who can authorize a change.
  • A documented inspection schedule is active for every shift and after phase changes.

Bottom line for project teams

Design the temporary wall as a life-safety component, not as a disposable screen. Confirm the local permit trigger, identify whether a rated separation is being replaced, preserve compliant egress in every phase, and obtain AHJ approval before affecting an exit. A complete plan that combines wall details, occupant loads, route calculations, fire protection, accessibility, signage, and phasing is the most reliable way to keep renovation work moving without creating an unapproved fire or evacuation hazard.
