Tech Park vs IT SEZ: How the Two Business Parks Differ for Companies and Employees

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: A tech park is usually a business campus or property category. An IT SEZ is a formally approved Special Economic Zone operating under India’s SEZ Act and Rules. The labels can overlap, but they are not synonyms: a technology park may contain approved SEZ space, while another building on the same campus may not. A company’s rights and obligations depend on the specific zone, building, unit approval, business activity and applicable law—not simply on the address.

That distinction matters when a company is choosing premises, budgeting occupancy, assessing customs or export procedures, or comparing jobs. It also prevents a common mistake: assuming that renting an office inside a campus called an “SEZ” automatically creates a current income-tax holiday or special employee rights.

What is a tech park?

“Tech park” generally describes a real-estate and business-campus concept rather than a single statutory status. It may be a privately developed office complex, a public-sector campus, or a mixed-use district planned to attract information-technology, engineering, research, electronics or other knowledge-based companies. The name can describe the location’s commercial positioning, infrastructure and tenant mix without establishing any special treatment under India’s SEZ framework.

A tech park can therefore include several kinds of occupants: companies serving domestic customers, exporters, shared-service teams, start-ups, consultants, laboratories, training providers and support businesses. Each tenant remains subject to the approvals and laws that apply to its own activities. Ordinary commercial permissions, building approvals, labour compliance, tax registration, environmental requirements and local levies do not disappear because a property is marketed as a technology campus.

What the label tells you

  • It identifies a business location or property category.
  • It may signal high-capacity telecom, power, security, parking, meeting space or managed facilities, but those features are site-specific.
  • It does not by itself prove that the land, building or tenant unit has SEZ approval.
  • It does not by itself establish customs treatment, export obligations or a tax incentive.

What the label does not tell you

The name does not establish which activities are permitted, whether a particular floor is inside an approved zone, whether a tenant has been admitted as an SEZ unit, or which government clearances apply. Those questions require documents for the specific campus and company.

What is an IT SEZ?

An IT SEZ is a formally approved Special Economic Zone for information-technology or related activities under India’s SEZ framework. The Special Economic Zones Act, 2005 and its supporting Rules came into effect on 10 February 2006, according to the Department of Commerce’s SEZ overview. The framework gives approved zones and units a defined legal status, with conditions attached to their operations.

The Department of Commerce describes SEZ arrangements as including designated-enclave treatment, facilities for authorized operations, customs and procurement procedures, and single-window clearances. These are conditional facilities. They apply only where the zone, unit, activity and transaction satisfy the relevant approvals and legal requirements.

Zone approval and unit approval are separate questions

A campus can have land or buildings approved as part of an SEZ while a particular company still needs its own unit approval and must operate within the activities covered by that approval. Conversely, a tenant in a large technology campus may occupy ordinary commercial space outside the approved SEZ area. The practical question is not “Does this park have an SEZ name?” but “Which premises and which unit are approved, for which activities, on what dates and under what conditions?”

Why the legal status matters

Formal status can affect how authorized procurements, customs interactions, reporting and exports are handled. It also creates compliance duties. A company considering SEZ premises should obtain the applicable approval letters, operating conditions and procedures before signing a lease or making procurement assumptions.

Is every IT park an SEZ?

No. “IT park” and “tech park” are broad location terms; “IT SEZ” identifies a zone approved under the SEZ framework. Some parks contain approved SEZ land or buildings, while other portions operate as ordinary commercial property.

The Tamil Nadu Information Technology Department provides a practical example. It describes ELCOT-promoted IT parks and notes that SEZ approval has been obtained for certain park lands. That wording is important: approval for certain lands does not automatically convert every building, floor, tenant or activity on a wider campus into an SEZ operation.

  • One-Handed Loading - Keep one hand free with a 1/4 in. hex chuck that accepts 1 in. bit tips

How to verify a campus

  1. Ask the developer or landlord for the official notification or approval identifying the zone, boundaries and approved premises.
  2. Confirm whether the exact building, floor or unit you will occupy lies inside those boundaries.
  3. Check whether your proposed business activity is covered by the unit approval or must be added or changed.
  4. Identify the designated authority and procedures for procurement, customs, reporting and other authorized operations.
  5. Obtain written advice on current tax treatment for your company’s dates, activity and approvals before relying on an incentive.

How SEZ facilities work for companies

SEZ treatment is a package of conditional facilities, not a blanket exemption attached to an address. The Department of Commerce FAQ discusses customs and procurement facilities for authorized operations and units, along with single-window clearances. Each facility is tied to the activity and documentation approved for the unit.

Authorized operations

Procurement, construction, fit-out, equipment acquisition and other spending may be treated differently when they qualify as authorized operations. “Authorized” is the operative word: a company should not assume that every purchase made by an SEZ tenant receives the same treatment. The unit should map each category of expenditure to the applicable approval and procedure before placing orders.

Customs and movement of goods

SEZ procedures can affect customs handling and the movement of goods connected with authorized operations. The exact documentation, approvals and controls depend on the transaction. Finance, procurement and logistics teams need a process for maintaining records and demonstrating that goods and services were used for permitted purposes.

Single-window clearances

The SEZ framework is designed to consolidate specified clearances through a single-window approach. That can reduce administrative duplication, but it does not remove the need to meet technical, safety, labour, environmental or sector-specific requirements that remain outside the relevant window.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Exports, domestic sales and reporting

SEZ units must understand how their approved activities, exports, domestic sales and reporting duties interact. Domestic sales are not simply treated as ordinary internal transfers because the seller happens to be located in an office park; the applicable SEZ rules and conditions govern the transaction. The company should document its reporting calendar, authorized operations, inventories and approvals, and assign responsibility for each filing or record.

Does renting office space in an IT SEZ create a current tax holiday?

No automatic tax holiday follows from the address. The Department of Commerce FAQ summarizes historical Section 10AA relief phases and states that the sunset clause for units became effective from 1 April 2020. Those historical descriptions do not establish that a new tenant today receives an income-tax holiday.

Actual tax treatment depends on the relevant law, the unit’s approval and commencement dates, the business activity, export and other conditions, and the company’s facts. Transitional provisions or other incentives may require separate analysis. A lease, brochure or campus name is not a substitute for a current written position from qualified tax counsel or the relevant authority.

Questions to resolve before budgeting an incentive

  • When was the unit approved and when did the relevant activity begin?
  • Which statutory provision is being relied on, and is it currently operative for those dates?
  • Does the proposed activity meet the conditions attached to the approval?
  • Are there export, reporting, domestic-sale or record-keeping requirements that affect the calculation?
  • Does the benefit belong to the approved unit, the developer, a supplier or another party rather than automatically to every tenant?

Tech park versus IT SEZ: company comparison

The right choice depends on the company’s operating model, not on the prestige of the campus name. Use the following distinctions as a diligence framework.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Decision area Tech park IT SEZ
Nature of the label Business campus or property category Formally approved zone under India’s SEZ framework
Approval focus Commercial property and local permissions; tenant requirements vary Zone approval plus unit approval, approved activities and operating conditions
Customs and procurement Ordinary procedures unless another law or approval applies Conditional facilities for authorized operations and units
Clearances Depends on the property and the company’s ordinary regulators Specified clearances may be handled through an SEZ single-window system
Exports and domestic sales Handled under the rules applicable to the company Must be assessed against SEZ procedures, approvals and reporting conditions
Tax expectation No special tax result from the label alone No current income-tax holiday should be assumed from the address; verify law, dates and eligibility
Employee consequences Determined mainly by employer, job and site Also determined mainly by employer, job and site; the zone name does not create universal rights
Commercial considerations Rent, services, transport, facilities and local costs are site-specific The same commercial factors apply, plus compliance and approval costs

How a company should evaluate a proposed location

Use a documented comparison rather than relying on a property brochure. The first three checks below address the legal and operational distinction; the remaining checks determine whether the site works commercially.

1. Confirm the exact legal footprint

Obtain the zone notification, approved boundaries and building identifiers. If the campus contains both SEZ and non-SEZ space, mark the boundary on the proposed lease plan. Do not treat a shared campus entrance or common brand as proof that every area has the same status.

2. Validate the unit and activity

List the services, software, engineering work, support functions, trading activity or other operations you intend to perform. Compare that list with the unit approval and any permitted-activity conditions. If the business model may change, ask how an amendment or fresh approval would work.

3. Map obligations before signing

Assign owners for customs records, procurement approvals, inventory controls, export documentation, domestic-sale treatment and periodic reporting. Include professional fees, systems, training and management time in the operating model.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

4. Test the incentive assumptions

Prepare a written schedule showing the legal provision, approval date, commencement date, qualifying activity and conditions behind every claimed incentive. Have tax counsel confirm the position under current law. Remove any benefit that cannot be tied to the company’s facts.

5. Calculate total occupancy cost

Compare rent, common-area charges, utilities, security, fit-out, insurance, parking, transport, local levies, maintenance and compliance administration. An SEZ-related facility may reduce one category while adding documentation or control costs elsewhere.

6. Assess infrastructure and supply-chain access

Review power reliability, connectivity, building access, loading arrangements, data and physical security, meeting capacity, expansion rights, proximity to suppliers and the commute for critical staff. These are site-specific commercial questions, not consequences of the SEZ label.

7. Confirm contracting boundaries

Ensure the lease identifies the approved premises, permitted use, landlord obligations and access rules. Clarify who handles authority interactions, shared utilities, visitor controls, fit-out approvals and any change in zone status.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

8. Set a review trigger

Recheck the position when the company changes activity, adds a floor, begins domestic sales, imports new equipment, restructures the unit or relies on a new incentive. Approval status and tax law are date-sensitive.

What is the difference for employees working in an SEZ?

The zone name does not determine an employee’s salary, leave, benefits, employment security, remote-work policy, working hours or statutory rights. Those terms come from the employment contract, employer policies and applicable labour law. The Department of Commerce identifies employment creation as an SEZ policy objective, but that objective is not a universal promise about an individual workplace.

What employees should compare

Factor Questions to ask
Role and progression What are the duties, reporting line, skills path and performance criteria?
Pay and benefits What is fixed pay, variable pay, insurance, retirement contribution, leave and any allowance?
Work arrangement How many days are on site, what are the shift or attendance rules, and how are exceptions handled?
Commute What is the realistic peak-hour travel time, transport availability and late-shift support?
Building facilities Are there reliable power and internet services, food options, medical support, accessibility features and secure entry?
Nearby services Can employees reach childcare, housing, banking, healthcare and public transport conveniently?
Employer practices How does the employer handle overtime, leave, grievances, privacy, safety and workplace conduct?

What employees should not infer

  • An SEZ campus does not automatically mean higher pay or better benefits.
  • It does not guarantee remote work, flexible attendance or a particular shift pattern.
  • It does not create a personal income-tax benefit merely because the office is inside the zone.
  • It does not replace the employer’s obligations under applicable employment and safety laws.

Common mistakes and how to correct them

Mistake: treating the park name as legal proof

Correction: Verify the approved land, building and unit. Keep the documents with the lease and compliance file.

Mistake: assuming every tenant receives the same treatment

Correction: Match the company’s activity and transactions to its own approval. A neighbouring unit’s permissions do not transfer automatically.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Mistake: budgeting a historic Section 10AA benefit as current income

Correction: Start with the current law and the unit’s dates. The Department of Commerce FAQ records historical phases and a sunset clause effective 1 April 2020; it is not a blanket promise for new tenants.

Which option fits which situation?

A domestic-facing company seeking flexibility

A conventional tech park may be simpler when the business primarily serves domestic customers and does not need SEZ-specific procurement or export procedures. The decision still depends on rent, infrastructure, access to talent and local approvals.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

An export-oriented unit with approved operations

An IT SEZ may be suitable when the company’s activities fit the approved unit framework and the value of customs, procurement or single-window procedures exceeds the compliance effort. Confirm the approvals before committing capital.

A company choosing between two buildings on one campus

Compare the exact legal status of each building, not the campus marketing name. One may be approved SEZ space and the other ordinary commercial space, with different procedures and costs.

An employee comparing two offers

Use the employer, role, pay, working arrangement, commute and facilities as the decision criteria. Treat “SEZ” as a location descriptor unless the employer provides a specific, lawful benefit in writing.

Practical checklist before commitment

  • Exact zone and building boundaries confirmed.
  • Unit approval and permitted activities reviewed.
  • Authorized-operation, procurement and customs procedures documented.
  • Export, domestic-sale and reporting duties assigned.
  • Current tax position verified for the company’s dates and facts.
  • Rent, fit-out, utilities, levies, transport and compliance costs modelled.
  • Lease, access, fit-out and landlord responsibilities clearly drafted.
  • Employee commute, facilities, safety and working arrangements assessed.
  • Review triggers set for changes in activity, premises or law.
