A stop-work order pauses construction; a building-permit revocation removes the permit’s legal authorization. They are different enforcement actions, although a building department can issue both in the same case. A stop-work order may cover the entire project or only specified work and is often lifted after the listed hazards or code violations are corrected. Revocation changes the permit’s status because the application, approved plans, permit issuance, or actual work no longer satisfies governing law. The exact notice, deadlines, appeal forum, and steps for restarting work depend on the state or municipality that issued the order.
If you have received either notice, identify the issuing authority and the jurisdiction first. Follow the written order—not assumptions about what a permit “usually” allows—and obtain written confirmation before resuming covered work. For an active dispute, the building department and a locally licensed attorney or permitting professional can explain the rules that apply to your property.

The essential difference
These actions address different legal questions:
- Stop-work order: Is construction activity currently unsafe, unlawful, or otherwise subject to immediate enforcement? The order directs the owner and contractors to stop some or all work.
- Permit revocation: Is the permit still legally valid? Revocation withdraws the authorization that allowed the work to proceed.
A stop-work order is therefore directed primarily at activity in the field. Revocation is directed at the permit’s legal status. A stop order does not, by itself, prove that the permit has been revoked. Conversely, a revoked permit cannot be treated as continuing authorization simply because no stop-work notice was posted.
| Comparison point | Stop-work order | Building-permit revocation |
|---|---|---|
| Immediate effect | Stops the work identified in the order; the scope may be full or partial. | Withdraws the permit’s authorization to perform the permitted work. |
| Typical concern | Unsafe conditions, code violations, or construction proceeding unlawfully. | Defects in the permit or application, substantial departure from approved documents, misrepresentation, or other legal noncompliance. |
| How it ends | Usually when the stated corrections and other conditions are satisfied and the authority lifts or rescinds the order. | Usually through a corrected, new, reissued, or otherwise reinstated permit under the local process. |
| Can the two be combined? | Yes. An authority may stop work while investigating or correcting a problem. | Yes. A jurisdiction may revoke a permit in addition to issuing a stop-work order. |
These are general distinctions, not a nationwide rule. The controlling language is the ordinance, regulation, statute, and notice issued for the particular project.

What a stop-work order does
It commands an immediate pause
A stop-work order is an enforcement command. Pennsylvania’s Uniform Construction Code regulation states that a building code official may issue a written order when construction violates the code or is being performed in a dangerous or unsafe manner. The regulation also requires the order to contain the reasons for the order and the conditions required before construction can resume.
New York City’s code uses similarly direct language: “Upon issuance of a stop work order by the commissioner, all work shall immediately stop unless otherwise specified.” The order can be served verbally or in writing, but a written order stating the reason must follow promptly when verbal service is used. Treat the effective time stated by the authority as controlling; do not wait for a later inspection if the order has already been served.
It may be full or partial
The order should identify what is covered. New York City Department of Buildings guidance distinguishes two types: full and partial stop-work orders. A full order generally halts the project, while a partial order halts only the work or area described. A partial order is not permission to continue every other task automatically. Read the scope, drawing references, floor or lot descriptions, and any exceptions word for word. If the scope is unclear, ask the issuing office for written clarification before directing crews to another activity.
It identifies the problem and the conditions for resuming
The reasons can include a code violation, unsafe work, work outside an approved permit, or another condition authorized by local law. Pennsylvania’s rule specifically requires the reasons and the conditions for resumption to appear in the written order. Those conditions may require correction of a physical hazard, revised plans, an inspection, payment of an assessed charge, or another step stated by the authority. Do not substitute a contractor’s opinion that the issue is “fixed” for the authority’s required release.
Continuing work can create a separate violation
Once the order has been served, work within its scope must remain stopped. Pennsylvania provisions allow penalties for continuing after service, with an exception for work necessary to remove the violation or unsafe condition. That exception is narrow: confirm with the issuing official exactly what abatement work is allowed and document the authorization. New York City’s code likewise requires immediate cessation unless the order itself says otherwise. Moving workers to a different portion of the site does not avoid the order if that portion is covered.
What building-permit revocation does
Revocation removes legal authorization
Revocation is a decision that the permit should no longer authorize the project. The inspector or building official gives written notice stating the reason and may require the permit’s return. Once revoked, the permit cannot be used as the legal basis for continuing construction. Work may need a corrected application, a new permit, or another approval route specified by the jurisdiction.

Common statutory grounds
North Carolina’s statute illustrates the types of grounds a law may list. An appropriate inspector may revoke and require return of a building permit when there is:
- A substantial departure from the approved application, plans, or specifications.
- Refusal or failure to comply with applicable law.
- A false statement or misrepresentation in the application or supporting information.
- A permit mistakenly issued contrary to law.
These grounds focus on the validity of the authorization, not only on a dangerous condition observed that day. Other states and municipalities may use different wording or add procedures, so do not assume that North Carolina’s list applies elsewhere.
Revocation is not the same as expiration
An expiration date, a lapse caused by inactivity, a denial of an inspection, and a formal revocation can have different consequences and appeal rights. Use the exact term in the notice. If the document says “revoked,” ask what application or reissuance process is available; if it says “suspended,” “expired,” or “cancelled,” ask which separate rule governs that status.
How the two actions interact
A stop order can come first
An authority may stop work while inspectors investigate a suspected violation, determine whether plans were followed, or require immediate correction of an unsafe condition. If the permit remains valid and the listed conditions are met, the stop order may be lifted without revocation. The existence of the order alone is not proof that the permit has been cancelled.

Revocation can follow
If the investigation finds a substantial departure, false information, or another defect that makes the permit unlawful, the authority may revoke it. New York City’s code allows a stop-work order when a proposed revocation is pending. In that situation, the project remains stopped while the permit question is decided; a contractor cannot resume simply because the revocation hearing or review has not concluded.
Both can be issued together
Philadelphia’s code expressly gives the department, in addition to issuing a stop-work order, the option to revoke permits previously issued. A combined notice means there are two separate compliance tasks: obey the immediate stoppage and address the permit’s legal status. Correcting a field condition may satisfy the stop-order conditions but will not automatically restore a revoked permit.

What to do when a stop-work order is served
Use this sequence as a practical starting point, then follow the jurisdiction’s own instructions.
- Secure the site and stop covered work. Tell the general contractor, subcontractors, suppliers, and employees what areas and activities are covered. Protect the public and workers from hazards without performing unapproved construction.
- Obtain the complete notice. Keep every page, posting, email, inspection report, photographs, and proof of service. Record the date, time, issuing official, permit number, and exact scope.
- Read the cited authority and reasons. Identify each code section, unsafe condition, plan departure, or missing approval. A vague verbal explanation is not a substitute for the written reasons required in jurisdictions such as Pennsylvania.
- Ask the issuing office what evidence is required. Confirm whether the office expects revised drawings, engineering certification, testing, removal of work, a correction affidavit, payment, or a reinspection. Ask who may request the inspection and how it must be scheduled.
- Separate permitted abatement from prohibited construction. Some laws allow work necessary to remove the violation or unsafe condition. Obtain written instructions describing that limited exception before anyone performs it.
- Check the appeal deadline immediately. Deadlines can be measured in calendar days from service, posting, or mailing. Missing the deadline can eliminate or narrow review rights.
- Choose whether to correct, appeal, or do both. An appeal does not automatically authorize continued work. Follow any rule that keeps the order in effect while the appeal is pending.
- Request written release. After corrections and inspection, obtain a signed or otherwise official notice that the order is lifted or rescinded. Keep it with the permit file and distribute it to everyone controlling site activity.
Appeals: why the deadline and forum matter
There is no single national appeal process. The issuing state, city, county, or special code authority determines who may appeal, where the appeal is filed, the filing fee, the deadline, whether work must remain stopped, and whether a hearing is available.

North Carolina example
North Carolina law gives an owner or builder five days to appeal a qualifying stop order. The statute also bars work in violation of the order while the appeal is pending. This is a short deadline; waiting for a scheduled inspection or negotiating informally does not extend it unless the authority confirms an extension under applicable law.
Seattle example
The cited Seattle procedure uses a hearing examiner. It provides a 15-day filing deadline, notice of the hearing, and a written decision. The fact that another jurisdiction uses 15 days does not change a five-day deadline elsewhere, and neither example should be imported into a different city without checking its code.
Preparing an appeal record
- Attach the order, proof of service, permit, approved plans, revisions, inspection reports, and relevant photographs.
- Address each cited violation separately rather than arguing generally that the project is safe.
- Explain the relief requested: dismissal, modification from full to partial, permission for specified abatement work, or another remedy the rules allow.
- Identify any deadline-sensitive request for a stay, while recognizing that a stay may require a separate motion and is not automatic.
- Have counsel or a licensed permitting professional review the filing when the project value, safety risk, or potential penalties justify it.
How construction can legally resume
Resumption requires more than an informal conversation with an inspector. The order should tell you the conditions, but the following checkpoints help prevent an accidental violation:
- Scope resolved: Every item within the stop order has been corrected, removed, or otherwise addressed as directed.
- Permit status confirmed: The original permit is still valid, or a replacement, revised, or reissued permit has been approved if revocation or another status change occurred.
- Required inspection completed: Any requested inspection, test, certification, or plan review has occurred and passed.
- Written release received: The authority has lifted or rescinded the stop order in the form required by local practice.
- Site records updated: Keep the release, revised plans, inspection results, and correspondence on site or in the project record accessible to supervisors.
In New York City, work without a permit cannot resume until a permit is issued and the stop order is rescinded. That illustrates why solving the physical condition alone may not be enough. In another jurisdiction, the required sequence may differ; ask the issuing office to state the exact restart conditions in writing.

Examples that show the difference
Unsafe excavation with a valid permit
An inspector finds an unsafe excavation and issues a partial stop order covering excavation and foundation work. The permit may remain valid for other permitted activities, but only if the order does not cover them and local officials confirm that interpretation. The contractor corrects shoring, requests the required inspection, and receives a written release. No revocation is necessary if the permit documents and work remain lawful.
Construction materially departs from approved plans
A project is built substantially differently from the approved application and specifications. The authority may stop the affected work and begin a permit action. If the permit is revoked, the owner must pursue the correction or new-permit process identified by the jurisdiction; merely fixing one field condition will not restore the withdrawn authorization.
False information in an application
If an inspector determines that a material statement was false or misleading, a statute such as North Carolina’s may authorize revocation and require return of the permit. A stop-work order may accompany that action to prevent further construction while the permit’s status is resolved.
Common mistakes and safer alternatives
- Mistake: treating a partial order as permission to improvise. Safer approach: map the order’s exact areas and ask for written clarification about borderline tasks.
- Mistake: assuming an appeal pauses the order. Safer approach: check the statute and appeal notice; continue to obey the order unless a lawful stay or written exception is granted.
- Mistake: relying on a verbal release. Safer approach: obtain the written rescission or lift notice required by the authority.
- Mistake: correcting work without preserving evidence. Safer approach: photograph conditions, retain invoices and test results, and keep dated correspondence for the inspection and appeal record.
- Mistake: assuming one jurisdiction’s deadline applies elsewhere. Safer approach: calculate the deadline from the notice and verify the filing destination with the issuing office.
- Mistake: continuing because the permit is posted. Safer approach: treat the stop order as controlling until formally lifted; a posted permit does not override an active order.
Questions to put to the building department
When the notice is difficult to interpret, ask concise, documented questions:
- Is the order full or partial, and what locations, trades, and activities are included?
- What exact conditions must be met before release?
- What abatement work, if any, is permitted while the order is active?
- Is the permit currently valid, suspended, expired, or revoked?
- If revocation is proposed or complete, what correction, reapplication, or reissuance process applies?
- What is the appeal deadline, filing forum, required form, and effect of filing?
- Who will issue the written lift or rescission, and how will it be delivered?
Keep answers in the project file. If the authority will not interpret the notice informally, obtain advice from a professional licensed in that jurisdiction rather than guessing.
Bottom line for owners and contractors
A stop-work order is a command to stop identified construction, often while a safety or code problem is corrected. Building-permit revocation withdraws the legal authorization itself because the permit or the work no longer meets governing requirements. Either action can occur alone, or both can be used in sequence or together. Work remains stopped until the authority’s stated conditions are met and the order is lifted or rescinded, and a revoked permit requires the jurisdiction’s approved path to regain authorization. Because procedures and deadlines vary sharply, identify the issuing jurisdiction, follow the operative notice, protect the appeal deadline, and obtain written permission before restarting.
