SpaceX sued Texas officials in September 2026 to block the release of records about its proposed Terafab project, including a tax-abatement application. The $119 billion figure is Grimes County’s estimate of total capital investment if additional project phases are built—not money already spent or a guaranteed commitment. The county’s notice estimates $55 billion for the initial phases.
What is the SpaceX Terafab records fight about?
KBTX reported on September 10, 2026, that SpaceX had filed suit that week in Travis County’s 126th District Court against Texas Attorney General Ken Paxton and Grimes County. The company sought to prevent the release of Terafab-related records, including its tax-abatement application. KBTX said the records requests came from Grimes County Citizens for Responsible Development and a county resident.

As KBTX described the petition, SpaceX argued that disclosure could harm its competitive position. That is the company’s argument, not a court finding. The available reporting does not establish that a judge ruled for either side, that all requested records will remain confidential, or that the records have since been released.
What does the $119 billion Terafab estimate include?
The figure comes from a 2026 Grimes County public hearing notice for a proposed multi-phase semiconductor and advanced-computing fabrication facility at Gibbons Creek Reservoir. The notice identifies Space Exploration Technologies Corp. as the tax-abatement applicant and distinguishes the estimated investment in initial phases from the larger estimate that assumes additional phases are constructed.

These are conditional project estimates in a county notice. They do not establish how much has been spent, whether financing has been secured, or whether every phase will proceed.
What is Terafab, and what has SpaceX said it plans to produce?
SpaceX’s June 2026 prospectus describes Terafab as an initiative with Tesla to extend the company’s integration into chip design and manufacturing. The filing says Intel joined in early April 2026 and describes the planned scope as the design, fabrication, and deployment of advanced logic and memory chips. The prospectus gives a long-term production goal of one terawatt of compute hardware per year. That is a company-stated target, not evidence of current or demonstrated production capacity. SpaceX framed the project’s strategic rationale this way: “The future of AI will be determined by the control of the physical stack.” The quotation expresses the company’s view, not an independently established forecast.

What records is SpaceX trying to keep private?
The September lawsuit concerns Terafab-related records, with KBTX specifically reporting that SpaceX sought to block release of its tax-abatement application. KBTX’s account of the petition says SpaceX argued that disclosure could create competitive harm. The suit does not, by itself, establish that every record covered by the requests is exempt from disclosure.

A separate records request came earlier
The lawsuit followed a distinct records thread reported by KBTX in July. KBTX said it had submitted a public-information request on June 3 for communications among county officials and SpaceX, Tesla, Intel, xAI, and associated parties. On June 25, Grimes County asked the Texas Attorney General to decide whether records responsive to that request could be withheld, citing claimed legal exceptions. KBTX reported that the county’s stated rationale included concerns about “infrastructure vulnerabilities, emergency preparedness, and operational planning.” That phrase describes the county’s argument as reported by KBTX; it is not a judicial determination.

The cited reporting establishes that SpaceX filed suit in September 2026 and describes the relief it sought. It does not establish a later court ruling or the current status of the requested records. The lawsuit is therefore best understood as a dispute over access to public records, not as proof that the project’s estimates are committed spending or that disclosure has been permanently blocked.
