The Himachal Pradesh High Court has ordered an immediate stop to construction at a Chakkar site in Shimla, where an inspection report alleges two unauthorised multi-storey buildings, extensive tree felling and several breaches of planning and environmental controls. The court has also ordered police to correct an FIR that initially listed the accused as “unknown.”
What the court ordered
A division bench comprising Chief Justice Gurmeet Singh Sandhawalia and Justice Bipin Chander Negi directed the Shimla municipal corporation to halt all construction at the Chakkar site immediately. The direction concerns two alleged unauthorised high-rise structures and follows a detailed inspection report submitted in the proceedings.

Which buildings are involved
A six-level building above the road
The inspection report identified a six-level building measured above road level. Investigators said its height obstructed the valley view. Photographs and Google imagery were cited in support of the report.

A second structure allegedly beyond its approved plan
The report also identified another multi-storey building that allegedly exceeded the plan approved for the site. The available account does not state the approved building’s exact floor count or the extent of the alleged deviation.
Allegations recorded in the inspection report
The report lists several separate concerns about the site and the way construction was carried out:

- Tree felling: Trees were allegedly cut to facilitate the development.
- Monsoon construction: Work reportedly continued during the monsoon despite restrictions on hill-cutting and excavation.
- Internal road width: An internal cemented road measured 5.10 metres, compared with a prescribed width of 3.50 metres.
- Land classification: Construction was reported on land recorded as Ghasni, a grassland category.
- Muck disposal: The report found no records showing how much excavated muck had been taken to authorised dumping sites.
These points are allegations and inspection findings placed before the court. They still require determination through the legal and administrative processes now under way.
Who was named and what happened to the FIR
The people and company identified in the court’s October 8 order were Geetika Sood, Vivek Sood, Manish Karol and developer Tenzin Construction Pvt Ltd.

Boileauganj police station registered an FIR on October 12 under the Bharatiya Nyaya Sanhita. The initial FIR, however, described the accused as “unknown,” even though the names appeared in the court order. The High Court called that omission “glaring” and said it indicated a “deliberate attempt” by police authorities to shield the culprits. Those are the bench’s reported characterisations, not a final criminal finding against any officer or accused person.
What police must do next
The bench issued specific directions to the station house officer:

- Serve the High Court’s order on occupants of the buildings.
- Add Geetika Sood, Vivek Sood, Manish Karol and Tenzin Construction Pvt Ltd to the FIR.
- Complete the investigation at the earliest.
- File a progress status report before the next hearing.
The next hearing is scheduled for November 4, 2026. The status report should show whether the FIR has been amended, what investigative steps have been taken and how the alleged construction, tree felling, land use and muck disposal issues are being examined.

Until the court changes its direction, construction activity at the site should not continue. The order targets ongoing work; it does not by itself decide whether the completed portions must be demolished, regularised or retained. Those consequences would depend on later findings by the court and the relevant authorities.

- Used Book in Good Condition
Occupants and site managers are directly affected because the station house officer must serve them the order. Continuing work after service could create additional legal exposure, although the available report does not state what specific penalty would apply.
Key unresolved questions
- Whether the two structures ultimately will be held unauthorised under applicable Shimla planning rules.
- Whether the alleged tree felling and monsoon excavation breached criminal or environmental provisions.
- Whether the Ghasni classification permits any part of the development.
- How much muck was generated and where it was disposed of.
- Whether the police investigation will identify further responsible persons or offences.
- What directions the High Court will issue after receiving the November 4 status report.
No final adjudication of guilt or legality has been reported. The immediate, settled position is that construction at the Chakkar site is halted while the police investigation and High Court review proceed.
