Proposed EPA Rule Could Reduce Public Comment on Some Data Center Air Permits

EPA’s pending proposal could give states more discretion over public participation in certain minor-source air permits, but it does not target data centers or require states to end comment periods.

Not across the board. EPA has proposed removing a federal minimum for public notice and comment in certain state and local minor-source air-permitting programs. If finalized, the change could affect a data-center project only if its emissions source is handled under one of those programs and the state or local agency changes its rules. The proposal does not name data centers or require agencies to eliminate public participation.

What EPA has proposed

On July 7, 2026, the Environmental Protection Agency proposed revising the public-participation requirements for state and local minor New Source Review (NSR) air-permitting programs approved into State Implementation Plans (SIPs). The proposed rule, “Minor New Source Review Program Air Permitting Public Participation Requirements for State Implementation Plans”, would revise 40 CFR 51.161.

Under the current federal regulation as described by EPA, these programs generally provide public access to the applicant’s information and the agency’s air-quality analysis, prominent notice in the affected area, and an opportunity to comment, ordinarily for 30 days. The regulation allows an exception for a comment period consistent with certain pre-existing program requirements. The current text of 40 CFR 51.161 sets out those requirements.

EPA’s proposal argues that the Clean Air Act leaves state and local agencies discretion over whether, when, and how much public participation is needed in minor NSR programs to assure that National Ambient Air Quality Standards are met. If the proposal is finalized as written, federal rules would no longer require public notice and comment as a minimum feature of covered programs. Agencies could choose their own approach; they would not be ordered to remove existing opportunities.

When a data center could be affected

The proposal addresses minor-source air permitting generally, not data centers specifically. It could matter when a data-center source or modification is reviewed under a covered state or local minor NSR program and the relevant agency later changes that program. Diesel generators are one possible connection: permits for generators may involve minor-source review, but the permitting category depends on the source’s emissions and other facts. Not every data center or generator is necessarily a minor source or subject to the same permit process.

EPA spokesperson Carolyn Holran told the Associated Press that the proposal also applies to other facilities considered minor sources, including laundromats, repair shops, landfills, and steel mills. The agency’s explanation is that states should lead decisions about their minor-source permitting processes; advocates have raised concerns about what communities could lose if a state reduces notice or comment.

What the proposal would not change

The proposal is limited to participation requirements for state and local minor NSR programs approved into SIPs. The Federal Register notice says it would not change federal participation rules for Title V operating-permit programs, federally enforceable state operating-permit programs, or existing public-participation rules for Tribal minor NSR authorizations in Indian country. Where relevant, Title V oversight may also provide an avenue to review some minor NSR authorizations issued without public notice and comment.

This is separate from EPA’s other NSR action concerning “begin actual construction.” EPA lists that as a distinct proposal on its NSR regulatory-actions page. A September 2025 EPA release about guidance on certain construction activities not related to air emissions addresses permitting timing and construction activity, not the public-participation proposal discussed here: EPA’s September 2025 announcement.

Where the rulemaking stands

The proposed rule appeared in the Federal Register on July 7, 2026, at 91 FR 41591, under docket EPA-HQ-OAR-2025-1212 and RIN 2060-AV67. The deadline for written comments was August 21, 2026. As of October 7, 2026, EPA’s regulatory-actions page still lists it as a proposed rule, and the sources available do not show a final rule. The Associated Press reported on September 3 that EPA was expected to finalize it in 2027; that is a reported expectation, not a binding schedule or a final agency decision.

Why the proposal is contested

EPA’s rationale

EPA says state and local agencies should have flexibility to tailor participation to local circumstances. In the agency’s view, that could let permitting offices direct limited resources toward actions with greater air-quality consequences or public interest. The proposed rule itself does not require any agency to cut public participation.

Advocates’ concern

Critics argue that removing a nationwide minimum could make it harder for residents to learn about and comment on proposed sources in states that choose not to maintain equivalent protections. Southern Environmental Law Center senior attorney Keri Powell told AP: “Data centers and other industrial sources should not be able to get their air pollution permits in secret.” That is an advocate’s position on a possible consequence, not a finding that permits would become secret or that every community would lose a chance to comment.

How to check a state or project

The proposal alone does not establish what a state currently requires or what would happen to a particular permit. For a specific project, check the relevant air agency’s rules, permit record, and any proposed SIP revision. Compare the same details for each project or jurisdiction:

  • Source classification: Is the facility or modification treated as minor or major under the applicable program?
  • Current participation rules: Does the state or local program require notice, a comment period, or a public hearing?
  • Program changes: Has the agency proposed or adopted SIP revisions following EPA’s action? A change to an EPA-approved SIP proceeds through state submission and EPA approval, and must remain consistent with applicable federal and state law.
  • Other permits and oversight: Are other state, local, or federal processes relevant, including Title V where applicable?
  • Access to the record: Where does the agency make permit materials and emissions analyses available?

EPA’s proposal is therefore one possible change to the federal floor for a defined category of permits—not a decision about the public’s role in every data-center air permit.
