Professional Indemnity Insurance for Structural Waterproofing: UK Cover Explained

Professional indemnity insurance (PII) is most relevant when a structural-waterproofing business designs, specifies, surveys, supervises or advises on work and could be accused of causing loss through a professional error. It is not a universal substitute for public liability, product liability, contractors’ all-risks insurance or a waterproofing guarantee. Whether a policy responds depends on its insured activities, exclusions, limits and claims conditions.

For below-ground projects, the practical question is not simply whether a contractor has “PI”. You need to establish that the wording covers the firm’s actual role, the relevant construction stage and the types of structural waterproofing being undertaken, then check how claims-made cover handles earlier work, notification, renewal continuity and run-off.

What professional indemnity insurance does in structural waterproofing

PII protects against civil-liability allegations arising from professional services. In this sector, that may include an allegation that a waterproofing design, specification, survey, report, detail, inspection or advice was negligent and caused a client or another party financial loss. The Architects Registration Board (ARB) explains that professional indemnity policies can cover third-party professional-negligence or civil-liability claims, subject to the policy’s definition of loss, limit of indemnity, excesses and exclusions. Legal defence costs and damages may be covered, but only under the terms actually agreed.

Typical professional exposures

  • A designer selects a system that is unsuitable for the recorded groundwater conditions.
  • A specification omits a critical junction, drainage detail or construction-stage requirement.
  • A survey or report fails to identify a defect, constraint or change in site conditions.
  • Advice given to a client, principal contractor or design team is alleged to have caused delay or additional cost.
  • A design-and-build firm is alleged to have made a professional error while also carrying out installation.

These examples describe the type of allegation that can create a PI exposure; they do not establish that a particular policy will pay for defective work, water damage, remedial construction or consequential losses. Those outcomes depend on the wording, endorsements, exclusions, causation and the facts of the claim.

Do waterproofing contractors need professional indemnity insurance?

There is no single answer for every installer. A business that only performs physical installation to another party’s design may have a different insurance profile from a firm that designs systems, selects products, prepares specifications, surveys existing structures or accepts design responsibility under a design-and-build contract.

When PI is especially relevant

  • The firm produces designs, calculations, drawings, specifications or written technical recommendations.
  • It carries out surveys, investigations, inspections or condition reports that others rely on.
  • It supervises or certifies work, approves substitutions or makes design changes on site.
  • Its contract includes design responsibility, fitness-for-purpose wording, collateral warranties or third-party reliance.
  • It subcontracts installation but remains responsible for the waterproofing design or coordination.

When the question still needs a contract review

An installer may not provide a conventional design service yet could assume professional obligations through a contract, warranty, method statement, technical submission or advice given during construction. Conversely, a policy marketed as “waterproofing PI” may not include every service the firm performs. Ask a broker to map the actual activities—design, specification, surveys, advice, supervision, installation and subcontracted work—to the insured-activities clause rather than relying on the trade description alone.

How claims-made professional indemnity insurance works

PII is generally written on a claims-made basis. ARB’s architect guidance states that the policy in force when a claim is notified is the one that may come into effect, even when the work was carried out earlier. Delta Membranes has described the same distinction in its structural-waterproofing article, noting that defects may only become apparent after construction. The precise operation must be confirmed in the policy.

A simple timeline

  1. Work is performed. A design, survey or installation-related professional service is delivered while one policy is in force.
  2. A circumstance or allegation emerges. A complaint, notification of a potential claim or demand may trigger policy conditions before a formal lawsuit exists.
  3. Notification is made. The insured must follow the policy’s notice requirements and notify the insurer or broker within the required time and in the required form.
  4. The policy responding is identified. Normally this is the policy in force when the claim or qualifying circumstance was notified, subject to retroactive dates, continuity and other terms.
  5. Defence and settlement are handled. The insurer’s obligations depend on the insuring clause, limit structure, excess, exclusions and consent requirements.

Why continuity and run-off matter

Changing insurer, allowing a policy to lapse or closing a practice can create gaps if earlier work is later alleged to be negligent. Check the retroactive date, whether prior work is included, how known circumstances are treated, and whether renewal continuity is preserved. If the firm stops trading, ask about run-off cover. ARB recommends run-off for architects and warns that potential liability periods can extend for years; those profession-specific recommendations should not be transplanted automatically to waterproofing businesses. The appropriate period depends on contracts, limitation rules, jurisdiction and the policy.

Notification discipline

Do not wait for a quantified demand if the wording requires notification of circumstances that may give rise to a claim. Keep a written record of when the issue was discovered, what was communicated, documents supplied and which insurer or broker was notified. Late notification, unauthorised admissions or remedial commitments can affect cover. Obtain advice before accepting liability or promising to pay for corrective work.

PI compared with other construction insurance

These covers address different risk categories, but the boundaries are not universal. The policy wording and project contract control.

Cover Risk it is generally intended to address Question for a waterproofing firm
Professional indemnity Alleged negligence or civil liability arising from professional services such as design, specification, surveying or advice. Are the firm’s exact waterproofing services and project types insured, and are defence costs, damages and sublimits clear?
Public liability Third-party injury or property damage arising from business or site activities, subject to wording. Does it respond to accidental site damage, and how does it treat damage connected with the firm’s work?
Product liability Liability associated with products supplied, subject to the policy definition and exclusions. Are supplied membranes, components or systems within scope, and is the firm a manufacturer, distributor or installer for policy purposes?
Contractors’ all-risks Physical loss or damage to works or materials during a project, according to the contract and policy. Who insures temporary works, stored materials, existing structures and defects discovered during construction?
Guarantee or warranty A contractual promise about performance or rectification, not automatically an insurance policy. Who provides it, what triggers it, and does it cover design liability or only specified defects?

Do not assume one policy pays because another policy exists. A waterproofing failure may involve a design allegation, physical damage, defective workmanship, a product issue and a contractual promise at the same time. The insurer, contract and facts determine which sections may respond and whether exclusions allocate the loss elsewhere.

Why below-ground waterproofing needs careful risk definition

The Property Care Association’s Type C waterproofing guidance, dated March 2017, recommends involving waterproofing specialists early. It says site investigation affects both waterproofing choices and structural design, and warns that site conditions can change over time. The guidance also emphasises trained, experienced installers, compliance with manufacturer instructions and PI covering the relevant construction stage as one installer-selection criterion. Confirm whether a newer edition exists before treating that 2017 document as current technical guidance.

Below-ground structural waterproofing can involve water pressure, ground movement, drainage maintenance, interfaces with structural elements and difficult access after completion. A design decision that appears minor on a drawing may affect excavation, concrete sequencing, penetrations, sump arrangements or future maintainability. This is why the insured activity should identify structural waterproofing and the project types involved, rather than merely stating “general construction”.

The PCA’s separate surveyor-advice article describes a challenging market for professionals seeking PI and distinguishes the risk profile of below-ground structural-waterproofing design from high-rise development. Those are qualitative industry observations, not a measured premium index or claims-rate statistic. No reliable waterproofing-specific premium or claims figure should be inferred from them.

Policy comparison checklist

Use the following questions when obtaining quotations or renewing cover. Ask for answers in writing and keep the quotation, schedule, wording and endorsements together.

Scope and project fit

  • Are design, specification, surveys, advice, site supervision, installation and design-and-build activities individually identified?
  • Are basements, retaining structures, tunnels, podiums, refurbishment and other intended project types within scope?
  • Does the policy cover work performed by subcontractors for whom the firm accepts responsibility?
  • Are structural waterproofing and below-ground work expressly included rather than assumed from a broad trade description?

Financial terms

  • What is the limit of indemnity, and is it each claim, in the aggregate or subject to another structure?
  • Are defence costs inside or outside the limit?
  • What excess applies, including separate excesses for particular causes of loss?
  • Are there sublimits for design defects, pollution, water ingress, remedial costs or consequential loss?

Claims and continuity

  • What events must be notified, and how quickly?
  • What is the retroactive date, and is prior work covered without an exclusion for known circumstances?
  • How is continuity handled when changing insurer or broker?
  • What run-off option is available if the firm closes, changes activity or retires?

Contract and professional obligations

  • Do appointments, collateral warranties, third-party reliance clauses or liability caps impose insurance requirements?
  • Does a client require a particular limit, insurer rating, territory or policy wording?
  • Are professional-body rules relevant to the firm’s status?

UK regulatory and membership requirements

RICS says regulated firms should make insurance consistent with the nature of their practice and proportionate to its risks. Its risk guidance, published 4 October 2023, highlights scope of work, fee basis, liability caps and third-party reliance when assessing exposure.

For RICS-regulated firms in the UK and Republic of Ireland, RICS publishes detailed PII requirements, approved minimum policy wording, listed insurers and an Assigned Risks Pool for firms unable to obtain cover in the open market. Its requirements page lists UK and Republic of Ireland minimum policy-wording publication dates of 1 July 2026. These are requirements for that regulated population, not a universal legal rule for every waterproofing contractor or every country.

ARB’s PII guidance is written for architects. It is useful for understanding claims-made mechanics, limits, exclusions and run-off, but an architect-specific minimum or recommendation should not be presented as a waterproofing-industry requirement without checking the applicable law, contract, regulator and policy.

How to verify specialist cover cautiously

Start with the firm’s own insurance schedule and the full policy wording, not a website badge or a certificate showing only a generic trade description. Ask the broker or insurer to confirm that the named insured, turnover, territories, activities and project types match the work being proposed.

A practical verification sequence

  1. Write a one-page description of the firm’s actual services, including design responsibility, surveys, advice, supervision, installation and subcontracting.
  2. List the project types, contract values, locations and any unusual below-ground conditions.
  3. Send that description, the draft appointment and any collateral warranty to a broker experienced in construction professional risks.
  4. Request confirmation of insured activities, limit structure, excess, exclusions, retroactive date, notification terms and run-off.
  5. Ask the insurer or broker to explain whether defence costs reduce the limit and how remedial or consequential-loss allegations are treated.
  6. Record the response and compare it with the contract before signing or starting work.

Delta Membranes has stated that it partnered with PHL Insurance, describing it as a specialist construction broker with experience accessing PI for waterproofing design and design-and-build professionals. That is a source-disclosed lead, not proof that the broker currently accepts every trade, project, territory or risk, and it does not establish policy terms. Verify present availability and suitability directly.

Training and competence are separate from insurance. The PCA guidance identifies trained, experienced installers as important and describes CSSW as a recognised industry qualification. A qualification may help demonstrate competence, but it does not expand an insurance policy or replace checking the insured scope.

Common mistakes and safer alternatives

Buying a generic “contractors’ PI” label

Problem: The schedule uses a broad occupation that does not clearly include design or below-ground waterproofing.

Safer approach: Have the insurer endorse or confirm the precise activities and project types in writing.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assuming PI guarantees the waterproofing

Problem: A certificate is treated as a promise that every leak or defect will be repaired.

Safer approach: Read exclusions and sublimits, and distinguish professional negligence from workmanship, product, physical-damage and contractual warranty issues.

Allowing continuity to break

Problem: A policy lapses or a firm changes insurer without addressing earlier work.

Safer approach: Discuss retroactive cover, known circumstances and run-off before renewal, closure or a change of business model.

Notifying too late

Problem: The firm waits until a formal claim or court papers arrive.

Safer approach: Follow the policy’s circumstance-notification condition and obtain broker or legal guidance before admissions or settlement promises.

What a well-supported decision looks like

A suitable decision is documented: the firm has identified its professional services, matched them to the policy wording, checked limits and exclusions against its contracts, understood claims-made notification and continuity, and confirmed any RICS, ARB or client-specific requirement that actually applies. For structural waterproofing, early technical involvement, competent installation and a policy expressly aligned with the relevant construction stage are more meaningful than a generic certificate or an assumed guarantee.
