Contractors on a nuclear project usually need the same core construction covers used on a major power project—workers’ compensation, employers’ liability, commercial general liability, excess liability, automobile liability, equipment, builder’s or erection all-risks, and transit insurance—plus a clearly allocated nuclear-risk layer. The decisive boundary is often introduction of nuclear fuel: the International Atomic Energy Agency (IAEA) describes a market in which the owner or operator assumes nuclear-damage risks after fuel loading, while EPC contractors and subcontractors retain the ordinary liabilities assigned to them by contract and law.

There is no universal “nuclear contractor package.” Required coverage depends on country, nuclear-liability regime, contract allocation, project phase, named insureds, policy endorsements, and the actual wording of exclusions. Treat the schedules, definitions, and phase provisions in the project’s binder and policies as controlling.

What insurance does a nuclear construction contractor typically need?

The IAEA’s technical publication STI/PUB/1408, appendix I, presents nuclear construction as a large-project construction risk with an additional nuclear layer once fuel enters the project. A contractor’s procurement documents may require some or all of the following covers.

Coverage What it generally addresses Points to confirm for a nuclear project
Workers’ compensation and employers’ liability Employee injury or disease arising from construction work, other than nuclear damage. Statutory requirements, occupational-disease provisions, employer limits, and whether an owner-controlled program replaces the contractor’s separate policy.
Commercial general liability (CGL) Bodily injury and third-party property damage caused by construction operations, often continuing into the post-completion operations period. Radiation, contamination, nuclear-material, completed-operations, contractual-liability, and care-custody-control wording.
Excess liability Additional limits above employers’ liability and CGL, generally intended to be at least as broad as the underlying policies. Whether the excess follows form, preserves nuclear exclusions, and responds to an occurrence involving several insured parties.
Automobile liability Liability arising from owned, hired, and non-owned vehicle use. Site access rules, heavy-haul operations, radiological areas, and any project-specific minimum limits.
Construction equipment insurance Loss of or damage to cranes, tools, vehicles, and other equipment used on the project. Location limits, unattended-equipment conditions, off-site storage, transit, and nuclear-site exclusions.
Builder’s all-risks or erection all-risks Physical loss of or damage to the plant and works under construction, subject to exclusions. Total insured value, probable maximum loss, deductibles, quota-share participation, testing stages, temporary works, storage, and transit.
Delay-in-start-up (DSU) Financing-related protection for delay caused by insured physical damage. The IAEA notes that DSU is triggered only by physical damage covered by the builder’s all-risks policy; waiting periods, sublimits, and a transit-delay extension must be checked.
Marine transit Loss or damage to equipment and materials shipped to the site. Voyage, unloading, inland legs, temporary storage, and the point at which the project policy takes over.
Professional liability Claims arising from engineering, design, consultancy, or other professional services. Design responsibility split among owner, EPC contractor, reactor-technology supplier, and specialist subcontractors.
Marine liability Liability connected with loading or unloading equipment from navigable waterways where the project requires it. Terminal responsibilities, charterer exposure, and interaction with cargo and transit policies.

Builder’s all-risks cover is not unlimited “everything” insurance. The IAEA describes it as applying only to the extent a loss is not excluded. The publication also discusses cover through cold testing and hot testing using non-nuclear steam; the policy must state exactly what happens when testing, commissioning, fuel delivery, or fuel loading changes the risk.

Owner-controlled programmes versus separate contractor policies

An owner or general contractor may arrange a project-wide construction insurance programme covering multiple participants instead of requiring every contractor to buy separate workers’ compensation/employers’ liability, CGL, and excess policies. The IAEA identifies this structure as a way to reduce duplicated insurance over the project’s total value when EPC and nuclear-steam-supply participants divide responsibilities. Some programmes are rated on actual losses.

An owner-controlled programme does not automatically erase a contractor’s obligations. Unless the policy schedule and contract expressly say otherwise, a contractor may still need its own workers’ compensation, professional liability, automobile, equipment, pollution or specialty cover, and insurance for work outside the controlled programme. Confirm who is an insured, which entities are additional insureds, whether cross-liability or severability applies, and whether a subcontractor is covered or merely required to maintain its own policy.

Comparison points before choosing a structure

Issue Owner-controlled project policy Separate contractor policies
Insured parties May include owner, EPC contractor, subcontractors, and suppliers listed in the schedule. Each contractor’s policy identifies its own insureds and any additional insureds.
Limits and deductibles Central limits and deductibles may apply across many parties and losses. Each policy has its own limits, deductibles, aggregates, and insurer conditions.
Nuclear and contamination wording One programme may provide more consistent wording, but an exclusion can affect every enrolled party. Wording can vary by contractor, creating gaps or disputes at interfaces.
Testing and fuel-load boundary Must state when the project policy changes, ends, or requires a separate nuclear placement. Each contractor must verify that its own policies do not terminate or exclude the relevant phase.
Transit and storage Can coordinate off-site storage, inland transit, marine cargo, and installation cover. Responsibility follows purchase terms and each contractor’s policy; hand-offs need written rules.
DSU May be placed for the project, subject to physical-damage triggers and waiting periods. Usually unavailable to a contractor unless its own policy and financial interest support the claim.
Contractual allocation Waivers, indemnities, and subrogation provisions must align with the programme. Each contractor must ensure assumed liabilities and indemnities are insurable.

The IAEA’s account is a possible structure, not evidence that a particular project uses it or that it is cheaper. Obtain the procurement documents, insurance schedule, endorsements, and evidence-of-insurance requirements before deciding what to buy.

Why fuel loading changes the insurance question

Before nuclear fuel is introduced, the principal exposures resemble those of other large power projects: construction-worker injury, third-party injury or property damage, equipment loss, transit, testing, and delay caused by insured physical damage. After fuel is introduced, nuclear liability and nuclear damage—including decontamination—must be addressed under the applicable national regime.

The IAEA publication states that, in the market context it describes, EPC contractors, subcontractors, and technology or equipment providers did not have an insurance market for post-fuel-load nuclear damage to the project and facility site. It presents the owner or operator as the party positioned to obtain the relevant nuclear insurance and assume the risks it covers. This is a description of that publication’s market account, not a universal rule for every country, reactor technology, or current placement.

Consequently, the contract should identify a precise hand-off: fuel delivery, fuel loading, initial criticality, hot functional testing, commissioning, commercial operation, or another defined milestone. A contractor should not infer the boundary from the phrase “all risks” or from a certificate of insurance.

“The construction risks and insurance requirements associated with large nuclear plant construction are only different from non-nuclear large power construction projects because of the introduction of nuclear fuel onto the site.”

Common nuclear exclusions and the wording checks that matter

No single exclusion list applies in every market. One UK project-construction policy wording published by Munich Re/HSB, for example, excludes insured property at sites or installations directly involved in producing, using, or storing nuclear material. That wording is an example, not a standard for all policies.

Read the definitions first

  • “Nuclear material,” “nuclear energy,” “radioactive contamination,” and “nuclear installation” may have technical definitions that are broader or narrower than ordinary language.
  • Determine whether the exclusion applies to property damage, liability, bodily injury, radiation, contamination, decontamination costs, or only specified locations and activities.
  • Check whether the exclusion is absolute or has a carve-back, manuscript endorsement, or exception for specified construction activities.

Check the project phase and location

  • Ask whether cover changes at cold testing, hot testing, fuel delivery, fuel loading, commissioning, handover, or commercial operation.
  • Confirm treatment of off-site fabrication, temporary works, warehouses, inland transit, marine transit, unloading, and laydown yards.
  • Verify whether the policy responds to damage caused by testing with non-nuclear steam and what happens when the test regime changes.

Check who is insured and how liability is shared

  • List the owner, operator, EPC contractor, subcontractors, lenders, suppliers, and consultants that qualify as insureds or additional insureds.
  • Look for cross-liability and severability wording so one insured’s act does not automatically remove protection for another, subject to the policy terms.
  • Compare contractual indemnities, waivers of subrogation, assumed liabilities, and hold-harmless clauses with the policy’s contractual-liability exclusions.

Check the financial mechanics

  • Record each limit, sublimit, deductible, waiting period, aggregate, and reinstatement provision.
  • Identify any insurer quota-share structure and the claims authority for a major loss.
  • For DSU, confirm that the delay follows insured physical damage, not merely a missed milestone, defective design, or an uninsured transit event.

U.S. federal contracting and indemnification

For applicable U.S. federal work, FAR 50.104-3 (the Acquisition.gov page identifies FAC 2026-01, effective March 13, 2026) requires a contractor seeking indemnification for unusually hazardous or nuclear risks to identify the contract and define the risk and exposure. The supporting insurance statement addresses:

  • insurers and policy numbers;
  • coverage types and insured risks;
  • limits and deductibles;
  • exclusions for the hazardous or nuclear risks;
  • applicable workers’ compensation;
  • the availability, cost, terms, and controlling factors for additional protection; and
  • existing government approval or other indemnity.

The request is subject to the prescribed review and approval process. The rule also considers whether indemnification should extend to subcontractors; that is not an automatic flow-down. A contractor should preserve the submission, approval, endorsements, and subcontract language as one integrated record.

DOE acquisition rule 970.5070-3 directs inclusion of a Nuclear Hazards Indemnity Agreement clause in specified management-and-operating contracts involving public-liability risk from a nuclear incident or precautionary evacuation, and in certain DOE facility-design contracts. It excludes contracts where the contractor is subject to NRC financial-protection requirements or specified NRC indemnity agreements for the contract activities. This is a contract-specific federal example, not a general exemption from purchasing nuclear or ordinary construction insurance.

UK NDA-site construction indemnity: a narrow current example

In a June 24, 2026 written statement, UK Minister of State for Energy Michael Shanks described a contingent liability intended to indemnify the Nuclear Decommissioning Authority (NDA) for construction project losses and damage across NDA sites. The arrangement was expected to start enduring October 1, 2026.

Element Term stated in the parliamentary announcement
Risks addressed Terrorism, fire, flood, and other natural hazards in construction projects.
Nuclear-law exclusion Risks covered under the Nuclear Indemnity for the Nuclear Installation Act 1965 are excluded.
Insurance layer Claims up to £20 million.
Indemnity layer Above £20 million up to £650 million per claim and per year.
Who is indemnified The statement says contractors receive joint protection with the NDA, but the NDA is the only indemnified party.
Expected saving At least £1 million per year compared with insurance premiums under the described arrangement.

The minister’s wording is explicit: “The indemnity will provide joint protection to all procured construction contractors, and NDA, but NDA are the only ones being indemnified.” This is a specific government arrangement, not a product generally available to contractors. A contractor working on an NDA site still needs to read its procurement documents, insurance requirements, and liability allocation.

A contractor’s pre-signature insurance checklist

  1. Map the phases. Mark construction, delivery, storage, cold testing, hot testing, fuel delivery, fuel loading, commissioning, handover, and operations on one schedule.
  2. Build an exposure register. Include employee injury, third-party injury and property damage, design responsibility, equipment, transit, contamination, decontamination, delay, and contractual indemnities.
  3. Identify every insured. Reconcile the contract’s insured-party list with each policy schedule and additional-insured endorsement.
  4. Test the exclusions. Ask the broker and insurer to explain nuclear-material, radiation, contamination, testing, location, and assumed-liability exclusions in writing.
  5. Reconcile limits. Compare project values, probable maximum loss, DSU values, excess layers, deductibles, sublimits, and aggregates.
  6. Confirm hand-offs. Allocate storage, transit, unloading, installation, testing, and fuel-load responsibility without relying on informal statements.
  7. Check federal or government indemnity. Where applicable, complete the required insurance statement and obtain approval; do not assume subcontractor protection.
  8. Preserve evidence. Keep the signed contract, policy wording, endorsements, certificates, schedules, waivers, indemnities, and approval letters together.

What contractors should not assume

  • “All-risks” does not mean nuclear damage, contamination, or decontamination is automatically covered.
  • An owner-controlled programme does not necessarily replace every contractor policy.
  • A certificate of insurance does not show all exclusions, phase limits, deductibles, or endorsements.
  • Owner or government indemnity does not necessarily make the contractor an indemnified party.
  • A policy that responds during construction may change or end when fuel is introduced.
  • There is no reliable general statistic for typical nuclear-construction premiums, limits, or claim frequency; pricing is project- and jurisdiction-specific.
