How to Manage Delays in a Construction Project: Causes, Notices, and Recovery Plans

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Manage a construction delay as a documented contract event, not simply as a late activity. Identify what happened and when, determine responsibility and contractual entitlement, test the effect on the accepted schedule and completion date, give notice exactly as the contract requires, and agree a resourced recovery plan. A delay is not automatically excusable or compensable: the result depends on causation, critical-path effect, notice, proof, and the wording of the executed contract.

What legally and operationally counts as a project delay?

An activity can finish late without delaying contractual completion. If it has available float, another crew can work around it, or a successor is not yet driving the finish, the project may remain on time. Conversely, a short interruption to a critical activity can move substantial completion by the same number of days or more.

  • What happened? Identify the event, its start and finish, and the affected work.
  • Who caused or controlled it? The answer may be the contractor, owner, designer, another contractor, a supplier, a public authority, or a combination.
  • What does the contract say? The event must fit the applicable excusable-delay, compensable-delay, change, suspension, differing-site-condition, force-majeure, or other clause.
  • What did it do to the schedule? Show the affected logic path, float consumption, milestone movement, and forecast completion date.
  • Was notice and substantiation compliant? A technically valid event can lose contractual relief if the required notice, recipient, delivery method, or follow-up claim is missed.

Entitlement normally turns on whether a qualifying cause actually delays required completion, not merely whether an isolated task was disrupted. The General Services Administration (GSA) clause for time extensions requires facts and schedule analysis and ties entitlement to qualifying causes delaying substantial completion beyond the required date. Your own contract and governing law may use different tests.

Diagnose the cause before choosing a response

Use the following categories as a diagnostic list, not as a ranking of how often delays occur. The U.S. Department of Veterans Affairs (VA) construction scheduling guidance identifies changed work, faulty schedule logic or unrealistic activity durations, insufficient manpower, and failure to work critical-path activities as major causes of slippage. Federal contract language also gives examples of events that may be beyond a contractor’s control, including government acts, work by another government contractor, fire, flood, epidemics, strikes, freight embargoes, unusually severe weather, and certain qualifying subcontractor or supplier delays. A listed event is not automatically excusable: foreseeability, fault, causation, notice, and the precise clause wording still matter.

Diagnostic cause Evidence to check Immediate management question
Changed or added work Owner or designer instruction, revised drawings, request for information, change proposal, approval date Did the change affect a driving activity, access, procurement, or a milestone?
Faulty logic or unrealistic durations Accepted schedule revisions, predecessor and successor links, original production assumptions, actual productivity Was the forecast ever achievable with the stated sequence and resources?
Insufficient manpower or equipment Manpower and equipment logs, subcontractor staffing, planned versus actual crew levels Is the shortfall contractor-controlled, or did an owner constraint prevent deployment?
Failure to work the critical path Daily reports, site photographs, workface availability, critical and near-critical path history Could available crews have worked the controlling activities?
Government or third-party action Notices, permits, directions, other-contractor records, access correspondence Does the contract allocate this interference risk and require a particular notice?
Weather, fire, flood, epidemic, strike, or embargo Official weather records, incident reports, labor notices, shipping records, site logs Was the event unusual under the contract’s threshold, and did it affect completion?
Subcontractor or supplier delay Purchase order, promised delivery, expediting records, supplier correspondence, replacement options Does the prime contract treat this type of downstream delay as excusable?

No official source cited here establishes a reliable industry-wide percentage for any cause. Do not present a single cause as the “largest” without a defined dataset and method.

Make the accepted schedule your primary evidence record

A current, credible schedule allows the team to distinguish a late activity from a late completion date. GSA describes the project schedule as a rational, reasonable, realistic plan that can be used to evaluate progress, extension entitlement, criticality, and float. Under an applicable GSA alternate, activities must be sufficiently detailed, logically linked, and based on realistic resources and physical or logistical constraints. Other contracts may prescribe different detail or update frequencies.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

At every update, preserve the prior accepted file and identify:

  • Actual start and finish dates, remaining duration, and forecast finish for each affected activity.
  • Predecessor and successor logic, constraints, calendars, and activity status.
  • Critical and near-critical paths, total and free float, and milestone dates.
  • Planned and actual manpower, equipment, workfaces, and production assumptions where the contract or schedule requires them.
  • Submittal, procurement, fabrication, delivery, inspection, and access constraints.
  • Approved changes, owner instructions, suspensions, and revisions to the completion requirement.

GSA’s clause states: “The Contractor understands and acknowledges that the preparation and proper management of the project schedule is a material component of the contract.” Treat that sentence as a requirement of the cited federal provision, not as a universal rule for every project.

Give a delay notice that protects the contract position

At mobilization, create a notice matrix from the executed contract. Record the triggering event, deadline, required content, recipient, service method, continuing-update obligation, and separate deadline for a fully supported time or cost claim. Contract forms differ, so never substitute a familiar deadline for the one actually written in your agreement.

What to record when the event starts

  1. Write down the date and time the event began, how it was discovered, and whether it is continuing.
  2. Describe the event factually: instruction, unavailable area, failed inspection, late information, weather condition, delivery failure, or other constraint.
  3. List the activities, workfaces, crews, materials, and milestones immediately affected.
  4. State the immediate mitigation: resequencing, protection of completed work, alternate supplier inquiry, additional supervision, or other action.
  5. Update the schedule and identify the current forecast effect, while making clear whether the analysis is preliminary.
  6. Send the notice through the contract’s specified channel and retain proof of delivery.

Do not wait for a complete damages calculation if the clause requires early notice. A practical notice can reserve the right to provide a quantified extension or cost submission later, provided the contract permits that approach and the required follow-up is delivered.

Notice deadlines are examples, not universal rules

Contract framework Published requirement Qualification
FAR 52.249-10, fixed-price federal construction clause Written notice within 10 days from the beginning of delay The Contracting Officer may extend the period. This is a clause-specific example; it is not a general U.S. construction deadline.
Philippine government contract FAQ cited by the Construction Industry Authority of the Philippines Notice within 15 days from occurrence for specified delay events This applies to that jurisdictional and contractual framework. The FAQ is undated, so verify the executed contract and current governing rules.
Private or other public contracts Varies Check the event trigger, business-day or calendar-day wording, service rules, time bars, and continuing-notice provisions in the signed form.

Minimum contents of a useful notice

  • Project, contract, and notice reference.
  • Event description and date first known.
  • Contract clause or instruction relied upon.
  • Activities, milestones, access areas, and resources affected.
  • Current or anticipated effect on completion, clearly labeled as preliminary if necessary.
  • Mitigation already taken and assistance or direction requested.
  • Statement that additional schedule and cost particulars will follow when required by the contract.
  • Name, title, signature, delivery date, and evidence of receipt.

Analyze time impact with the project schedule

The objective is to show whether the event moves contractual completion, not simply to count days between two emails. The VA describes time-impact assessment as incorporating delaying activities into the critical-path-method (CPM) network and comparing the schedule before and after insertion. GSA’s time-extension language likewise calls for baseline schedule analysis and a proposed completion date that accounts for the impact.

  1. Select the correct schedule state. Use the accepted baseline and the latest accepted update before the event, subject to the contract’s required method. Preserve both files.
  2. Validate status. Confirm actual starts and finishes, remaining durations, calendars, constraints, and logic. Correcting a known data error is different from rewriting history to create entitlement.
  3. Model the event. Add or revise activities representing the delay, such as an approval hold, unavailable workface, late delivery, or restricted access. Link them to the work they truly control.
  4. Run the without-event and with-event scenarios. The comparison should isolate the event while keeping unrelated progress and approved changes consistent.
  5. Trace the affected path. Identify whether the event consumes float, changes a near-critical path into the critical path, or pushes a contractual milestone or completion date.
  6. Account for concurrent effects. Examine overlapping contractor-responsible, owner-responsible, and external events. The contract and governing law determine how concurrency affects time and cost.
  7. State the result precisely. Report the number of days, if any, by which substantial or contractual completion moves, the assumptions used, and the remaining uncertainty.

An event that delays a non-driving activity may support disruption or mitigation discussions under some contracts, but it does not automatically support a time extension. Conversely, an event that initially has float can become critical after a later change or loss of productivity; keep the schedule history to show when that occurred.

Classify responsibility and entitlement

Situation Typical schedule question Contract administration response
Contractor-controlled delay Did contractor performance or procurement move the completion date? Mitigate, submit a recovery plan if required, and assess exposure to liquidated damages or other remedies under the contract.
Owner- or designer-caused event Did late information, changed work, access restriction, or direction affect the driving path? Give the required notice, preserve instructions and schedule evidence, and follow the change or time-extension procedure.
Excusable event beyond the contractor’s control Does the clause cover the event, and was it unforeseeable or otherwise qualified? Prove causation, critical-path effect, notice, and mitigation. Cost entitlement may differ from time entitlement.
Concurrent delay Did independent events overlap and each affect completion? Analyze each event by period and path; do not assume a blanket entitlement or denial without the contract’s concurrency rules.
Delay with available float Was completion actually pushed? Document the float consumption and monitor later updates before claiming a completion extension.

Separate excusable from compensable. A contract may grant additional time without paying added field overhead, or may require a formal change for costs. The answer depends on the risk allocation, notice compliance, and proof in the applicable agreement.

Build a recovery plan that can actually regain time

A revised completion date is not a recovery plan. A credible plan explains the cause, the controlling activities, the actions, the resources, the constraints, and the date each action is expected to recover. Begin with a joint review by the owner, contractor, scheduler, superintendent, designer, and affected trade partners.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Recovery-plan contents

  • Cause and period of slippage, with responsibility identified for each action.
  • Current accepted schedule and a clearly labeled recovery schedule.
  • Changed sequence, parallel work, workface assumptions, access requirements, and milestone logic.
  • Crew numbers, skill mix, equipment, shifts, workdays, and procurement commitments.
  • Submittal, inspection, testing, commissioning, and handover dates that cannot be skipped.
  • Safety, quality, environmental, and permit controls for the proposed pace.
  • Forecast completion date, float effect, and measurable weekly or other contract-required targets.
  • Owner decisions, design releases, utility coordination, or other assistance needed to make the plan feasible.

Compare recovery measures before committing

Measure When it helps Checks before approval
Resequence or parallel work Separate workfaces or trades can proceed without unsafe interference Physical access, temporary works, design completeness, inspection sequence, and trade stacking
Resolve submittal and procurement blockers Information or materials, rather than field labor, control the path Review duration, approved substitutions, fabrication capacity, shipping, and inspection dates
Reallocate qualified crews or equipment A different workface can use available resources immediately Competence, supervision, productivity assumptions, equipment availability, and downstream impacts
Add shifts or workdays Extended working hours can increase production on the driving path Labor rules, noise restrictions, lighting, permits, fatigue management, neighbors, and inspection coverage
Overtime Short-term acceleration is needed and crews can sustain quality Premium cost, diminishing productivity, fatigue, safety, and contract authorization
Additional plant Equipment capacity is the bottleneck Site access, operator availability, maintenance, congestion, and cost allocation

FAR 52.236-15 permits the contracting officer under that clause to require shifts, overtime operations, additional workdays or construction plant, and a supplementary schedule demonstrating how progress will be regained. That authority applies to the clause and contract in which it appears; it does not authorize unilateral acceleration on every project.

Distinguish mitigation, catch-up, and acceleration

Mitigation limits the effect of an event, such as moving a crew to an available area. Contractor catch-up addresses a contractor-controlled shortfall. Acceleration changes the planned rate or sequence to achieve an earlier date, often at additional cost. Keep the time-impact request, recovery actions, change proposal, and updated working schedule aligned, while preserving all prior accepted updates. Do not assume that spending more to recover time creates a right to reimbursement.

Control cost and commercial treatment

For each proposed action, identify who directs it, who benefits from the recovered date, and which contract mechanism authorizes payment. Track ordinary production, delay-related inefficiency, overtime premium, added supervision, equipment, temporary facilities, subcontractor charges, and extended field overhead in separate cost codes. Link each cost entry to the affected period and schedule activity.

Owner-directed acceleration, mitigation of an excusable event, and contractor-caused catch-up can have different cost outcomes. Obtain written direction or an approved change where the contract requires it before incurring discretionary premium cost. A time extension and a cost adjustment are separate questions even when they arise from the same event.

Set a schedule and records cadence

Use the update interval stated in the contract. GSA 552.236-15 provides weekly updates by default unless another period is specified. Certain GSA alternates instead require monthly updates submitted within five working days after month end. These are contract requirements, not general project-management statistics.

At each update, hold a short delay review and record:

  • Current critical and near-critical activities and changes in float.
  • Open notices, pending owner decisions, and approaching time bars.
  • Actual progress against recovery targets.
  • Manpower, equipment, procurement, submittal, and access constraints.
  • New risks, mitigation owners, due dates, and evidence required.

Retain instructions, drawings, submittals, approval logs, delivery records, daily reports, photographs, weather records, meeting minutes, manpower and equipment logs, inspection records, and schedule files. A contemporaneous record is more persuasive than a reconstruction made after completion.

Worked example: when a 14-day event is not a 14-day extension

Suppose an owner instruction prevents work on Activity A for 14 calendar days. The latest accepted update shows 10 days of total float before the event. The instruction therefore consumes the 10 days of float and initially pushes completion by four days. During the same period, the contractor’s crew was already late starting Activity B by six days, and B is a successor on the same path.

The scheduler should model the owner instruction and the contractor start delay separately, using actual dates and logic. The result might show four days of owner-caused completion movement, while the contractor delay consumes the remaining six days or creates concurrency during part of the period. The parties should not simply award or deny 14 days; they must apply the contract’s responsibility and concurrency rules to the periods demonstrated by the schedule.

Common failure modes and corrections

  • “The event is on the list, so it is excusable.” Corrective action: prove the clause fit, causation, critical-path effect, notice, and mitigation.
  • Notice sent to the wrong person. Corrective action: use the contract’s named recipient and delivery method, then retain receipt evidence.
  • Waiting for a fully priced claim. Corrective action: send the required preliminary notice first if the clause imposes an early time bar; follow with substantiation.
  • Using an obsolete or unaccepted schedule. Corrective action: start with the latest accepted update and explain every status adjustment.
  • Changing logic to make an activity critical. Corrective action: support links and durations with physical, contractual, and resource facts.
  • Calling overtime a recovery plan. Corrective action: show the revised sequence, production assumptions, safety and quality controls, cost authority, and measurable completion effect.
  • Overlooking procurement and submittals. Corrective action: model approval, fabrication, shipping, inspection, and installation as linked activities where they control the path.
  • Erasing schedule history. Corrective action: archive each accepted update and issue a narrative explaining changes and their completion-date and float effects.

Use scheduling tools without losing contract discipline

CPM scheduling software can help maintain activity logic, record actual progress, compare schedule scenarios, load resources, and preserve update histories. It does not decide entitlement. Configure calendars, data dates, constraints, coding, and permissions consistently, and export an auditable native file and PDF or other contract-required format. A spreadsheet may be adequate for a small activity list, but it becomes risky when logic, multiple workfaces, float paths, and contemporaneous revisions must be demonstrated.

The VA CPM guidance refers readers to the Associated General Contractors publication CPM in Construction – A Manual for General Contractors for network-diagram technique. Confirm the applicable edition before relying on it for a project procedure.

Contract and jurisdiction limits

The FAR and GSA provisions described above are federal U.S. contract clauses, not universal construction law. The VA guidance was last updated in 2015 and is technical guidance rather than a substitute for the executed contract. The Philippine government FAQ supplies a contrasting framework and reinforces why a single notice period should not be generalized. Private contracts, design-build forms, local statutes, and project delivery methods can allocate float, concurrency, notice, and acceleration differently.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before denying or asserting an extension, have the contract administrator and, where appropriate, construction counsel confirm the governing law, incorporated clauses, notice service rules, and claim deadlines. Manage the facts and schedule promptly; obtain legal advice for the entitlement conclusion.

Delay-management checklist

  1. Open a dated event record and identify the affected work.
  2. Check the executed contract for notice trigger, deadline, recipient, method, content, and follow-up claim requirements.
  3. Issue the required notice and preserve delivery proof.
  4. Update the accepted schedule without overwriting prior history.
  5. Run a documented with-event and without-event time-impact analysis.
  6. Classify responsibility, entitlement, concurrency, and cost treatment separately.
  7. Agree mitigation and recovery owners, resources, milestones, and safety controls.
  8. Track the recovery schedule at the contract-required interval and revise it with a narrative.
  9. Close the event only when the completion effect, costs, and contractual decision are recorded.
