New-home warranty vs. homeowners insurance: what construction defects may be covered?

Short answer: A new-home builder warranty and homeowners insurance answer different questions. The warranty asks whether the builder’s written terms cover a defect in workmanship, materials, or a listed component. Insurance asks whether a covered peril caused the loss, subject to the policy’s exclusions, limits, conditions, and deductible. A faulty installation itself may be excluded while separate damage from a sudden, accidental event may be covered.

This is a U.S. consumer guide. Warranty statutes, insurance forms, deadlines, and remedies vary by state and contract. Read the signed warranty and the complete policy before assuming that either one will pay.

  • Builder warranty: A written promise accompanying new construction (and sometimes a remodel) that identifies covered construction components or defects, the warranty period, exclusions, notice rules, and the remedy. The Federal Trade Commission (FTC) describes typical coverage for specified workmanship, materials, and systems.
  • Homeowners insurance: A property policy that responds to causes of loss, or “perils,” covered by that policy form, up to purchased limits and subject to conditions, exclusions, and a deductible. It is not a general guarantee that every defective component will be rebuilt.
  • Paid home warranty or home-protection contract: Usually a service contract for named appliances and systems. It is different from a new-home builder warranty and from homeowners insurance; its service fees, exclusions, and contractor rules come from that separate contract.

A warranty claim and an insurance claim can arise from the same incident, but approval under one does not automatically establish coverage under the other.

Does homeowners insurance cover construction defects?

Usually, the cost of correcting faulty construction is not covered merely because the work was defective. The more precise question is whether a covered peril caused resulting property damage. The National Association of Insurance Commissioners (NAIC) explains that policy forms cover specified perils and pay only up to the limits purchased. Different forms cover different sets of perils.

For example, some homeowners forms list a sudden and accidental discharge from a plumbing system as a covered peril. California Department of Insurance guidance illustrates the distinction: sudden, accidental water damage may be covered, while seepage, long-term leaks, wear, and maintenance problems are generally excluded. The controlling answer comes from the policy wording and the facts, not from the label “construction defect.”

How the distinction works in a water-loss claim

Situation Potential treatment Why the result can differ
A pipe installed incorrectly fails suddenly and releases water The cost to correct the defective installation may fall outside the policy; resulting damage to otherwise covered property may be considered if the policy covers the sudden accidental discharge. The policy may separate the faulty work from ensuing damage and may apply exclusions, limits, and a deductible.
Water has slowly seeped through an improperly flashed window for months Gradual seepage, wear, maintenance, or known damage may be excluded. The loss developed over time rather than from a sudden covered event, and policy conditions may require the homeowner to protect the property.
Rainwater enters because of a construction opening Coverage depends on the policy’s treatment of the specific water source and any applicable flood or surface-water exclusion. NAIC notes that homeowners policies do not cover flood damage; policy forms define covered water events differently.
A covered event damages a wall that contains a construction defect The insurer may evaluate the event-related damage while declining the cost of bringing defective work up to standard. Adjusters apply causation, exclusions, limits, and the policy’s duties after loss.

Do not describe this as “insurance covers the leak” or “insurance never covers defect-related damage.” The insurer must determine what happened, when it happened, what part was defective, and what damage was caused by a covered peril.

What does a new-home builder warranty cover?

A builder warranty covers only the items and defects identified in its written terms and applicable state law. FTC consumer guidance says new-home warranties commonly address workmanship and materials in listed components such as windows, HVAC, plumbing, and electrical work. The warranty may require the builder to repair, replace, or otherwise correct a covered defect rather than pay every expense associated with it.

Common time periods are examples, not a national rule

The FTC gives these common examples: one year for workmanship and materials on many components, two years for HVAC, plumbing, and electrical systems, and up to ten years for major structural defects under some builders’ programs. These figures are examples from consumer guidance, not a federal statutory minimum.

Source or jurisdiction Term described How to use the figure
Federal Trade Commission consumer guidance One year for many workmanship/materials items; two years for HVAC, plumbing, and electrical systems; up to ten years for some major structural defects A general example only; the signed warranty controls.
Florida Legislature, 2025 Florida Statutes §553.837 One year for specified defects in builder-furnished equipment, material, or workmanship that materially violate the Florida Building Code Florida-specific law with exclusions, including normal wear and tear and certain damage outside the builder’s control.
New Jersey Department of Community Affairs New Home Warranty Program One year for materials and workmanship; two years for specified mechanical systems; ten years for major structural defects A New Jersey program schedule, not a nationwide requirement.

Your warranty may use different periods, start dates, definitions, and remedies. Check whether time runs from closing, possession, completion, or another stated date. Also check whether a component has a shorter period than the overall structural coverage.

Terms to locate in the warranty

  • Definition of defect: Some warranties require a failure to meet specified standards or a material violation, not merely dissatisfaction with appearance.
  • Component schedule: Windows, roofing, HVAC, plumbing, electrical work, structure, and builder-furnished equipment may have separate periods.
  • Exclusions: Normal wear and tear, owner maintenance, alterations, misuse, and damage outside the builder’s control are common issues; the exact wording matters.
  • Notice deadline and method: The contract may require written notice through a portal, form, certified mail, or another specified channel.
  • Remedy: The promise may be repair, replacement, or another defined correction, rather than a cash payment.
  • Transfer and dispute rules: Determine whether coverage transfers to a later owner and whether mediation, arbitration, inspection, or another process is required.
  • Consequential expenses: FTC guidance warns that many warranties do not cover out-of-pocket costs such as temporary relocation during a major defect or repair.

Disputes can concern whether a defect is covered or whether the repair was performed properly. The FTC states: “Disputes sometimes happen between a homeowner and a builder, or third-party warranty company, over whether a defect is covered or whether repair work was done properly.”

Will the builder warranty cover a leak?

It may, if the leak results from a covered construction defect and the notice is timely. A warranty claim is strongest when you can connect the water entry to a listed component or installation defect—for example, defective flashing, a failed seal, or improperly installed plumbing—and show that the issue falls within the applicable period.

A warranty is not automatically responsible for every water problem. The contract may exclude owner-caused damage, maintenance failures, normal deterioration, or conditions outside the builder’s control. A warranty also may correct the defective work without paying for all damaged personal property, temporary housing, mold remediation, or other consequential costs unless the contract says otherwise.

Questions to ask when reporting a leak

  • Which component failed, and is it listed in the warranty?
  • When did you first observe the symptom, and when might the defect have begun?
  • What does the warranty require for notice, inspection, and access?
  • Is the requested remedy repair, replacement, or another remedy specified by the contract?
  • Are resulting finishes, contents, relocation, or emergency services treated separately?

Who pays for water damage caused by bad construction?

There may be more than one responsible pathway. The builder or warranty provider evaluates the defective work under the warranty. The insurer evaluates resulting damage under the homeowners policy. The same loss can therefore require two notices and two separate coverage decisions.

Example: sudden plumbing failure

An incorrectly connected supply line suddenly breaks. The builder warranty may address the faulty connection if it is within the covered period. Homeowners insurance may separately consider water damage to flooring, drywall, or personal property if the policy covers sudden accidental discharge and no exclusion applies. The deductible and policy limits still apply.

Example: gradual window intrusion

Rain enters around a window because flashing was defective, and staining develops over many months. The warranty may address the flashing if the defect is covered and timely reported. Insurance may limit or exclude gradual seepage, wear, maintenance, or known damage. Do not wait while an obvious leak continues: failure to protect the property can affect an insurance claim.

Builder warranty vs. homeowners insurance: side-by-side

Issue Builder warranty Homeowners insurance
What triggers protection? A defect in covered construction workmanship, materials, equipment, or a listed component, as defined by the written warranty. A covered peril or cause of loss under the policy form, subject to exclusions and conditions.
What may be repaired or paid? Usually correction of the covered defective work or component through the contract’s stated remedy. Covered resulting property damage, up to policy limits, after the deductible and other conditions.
Duration The periods in the warranty and applicable state program or statute; periods can differ by component. The policy term, with coverage continuing only while the policy is in force and conditions are met.
Typical exclusions or limits Contract-specific exclusions such as normal wear, maintenance, owner alterations, and conditions outside builder control; consequential expenses may be excluded. Excluded perils, gradual seepage, wear, neglect, flood, policy limits, sublimits, deductibles, and duties after loss.
Notice and claim process Follow the warranty’s written notice, inspection, access, and dispute procedure. Report the loss promptly, protect the property, document damage, and cooperate with the adjuster.
Who decides or performs the repair? The builder, warranty company, or its designated process decides coverage and arranges the contractual remedy. The insurer and adjuster evaluate coverage; qualified contractors perform approved repairs, subject to policy and claim handling.

What to do when you discover a suspected construction defect

  1. Collect the controlling documents. Find the signed builder warranty, closing documents, amendments, and any service-contract agreement. Obtain the full homeowners policy, including declarations, endorsements, exclusions, limits, and deductible. Identify your state’s applicable requirements; Florida and New Jersey demonstrate that schedules differ.
  2. Read dates and deadlines before calling. Record the warranty start date, component period, definition of defect, required notice method, and dispute steps. An informal conversation may not preserve a contractual deadline.
  3. Make the situation safe. If an active leak can be stopped safely, shut off the appropriate water supply and take reasonable steps to prevent additional damage. Do not put yourself at risk around electricity, contaminated water, unstable ceilings, or structural movement.
  4. Document before conditions change. Photograph and video the source, stains, wet materials, damaged contents, and surrounding areas. Note dates, weather, sounds, odors, and when you first noticed the problem. Keep correspondence, invoices, estimates, inspection reports, and receipts.
  5. Give both notices when both products may apply. Follow the warranty’s procedure and report a potentially insured loss to the insurer promptly. Describe observed facts rather than asserting a legal conclusion about fault or coverage.
  6. Protect the property, but avoid unnecessary permanent work first. California Department of Insurance guidance advises protecting property against further damage, keeping records, and not ignoring obvious water problems. Emergency mitigation may be necessary, but preserve damaged materials and seek insurer instructions before extensive permanent repairs when conditions are safe.
  7. Investigate possible structural damage. Ask whether the issue could affect load-bearing framing, foundations, roof structure, or another structural element. California guidance says an adjuster may recommend a licensed engineer when structural damage is likely, even without visible signs. A qualified independent inspector or licensed structural engineer can help identify the condition; neither determines insurance coverage.
  8. Obtain detailed repair information. Use qualified contractors and request written descriptions separating correction of the defect from repair of resulting damage. Keep bids itemized so the builder, warranty provider, and insurer can evaluate the appropriate portions.
  9. Request reasons in writing if coverage is disputed. Ask the insurer or warranty provider to identify the specific policy clause, warranty term, exclusion, deadline, or factual finding supporting its decision. Follow the applicable state regulator or contractual dispute process. Local legal advice may be appropriate for a substantial unresolved construction-defect dispute; litigation is not automatically required.

California’s claims guide summarizes the structural warning this way: “If structural damage is likely, even though you can’t see any signs of it, discuss this with your adjuster.”

Documentation tools and professional help

A pinless moisture meter can help record whether an area appears unusually damp during an initial walkthrough, but it cannot identify the cause, assign liability, or determine coverage. Treat readings as supplemental documentation, not as an expert diagnosis.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

For suspected structural issues, an independent qualified inspector or licensed structural engineer is more consequential than a consumer meter. The adjuster may recommend an engineer, particularly where hidden structural damage is possible. For a major unresolved dispute, a local attorney familiar with construction defects and insurance disputes can explain deadlines and remedies under the governing state law.

State and contract limits you should not overlook

  • There is no single national warranty schedule. FTC examples, Florida’s 2025 statute, and New Jersey’s program use different wording and structures.
  • California claims guidance is illustrative, not nationwide law. Its advice about sudden water damage, seepage, documentation, and engineers explains claims practice but does not control another state’s policy or statute.
  • Policy forms differ. Named-peril and broader forms can treat the same water event differently, and endorsements may change exclusions or limits.
  • Deadlines can run separately. A warranty notice period and an insurance reporting requirement may not begin or end on the same date.
  • Coverage decisions are fact-specific. The source of water, timing, maintenance, prior knowledge, mitigation efforts, and exact contract language can all change the result.
