NHS Health Centre Planning Permission and Building Regulations in England: FAQ

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Short answer: an NHS health centre in England does not automatically need a fresh planning application merely because healthcare is provided there. Health centres are generally within Use Class E, and moving between primary uses in the same class is normally not development. However, a material change of use, a restrictive planning condition, listed-building or site constraints, new construction, an extension or other physical work can trigger separate approvals. Building-regulations approval is a different control and may be required even where planning permission is not.

This guide applies to England. Scotland, Wales and Northern Ireland have different planning and building-standards regimes. A local planning authority must assess the planning facts, while a building control body determines how the Building Regulations apply to the proposed work.

What is the immediate answer for an NHS health centre?

Start by treating the project as two questions, not one:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Planning: does the existing lawful use, proposed use or associated development require planning permission?
  2. Building control: must the construction, alteration or change of use comply with the Building Regulations and receive approval before work starts?

GOV.UK states: “Building regulations approval is different from planning permission.” Approval under one system does not grant approval under the other. A health centre may be able to operate within its existing planning use while still needing building-regulations approval for an extension, structural alteration, electrical installation or other controlled work.

The answer depends on the building’s lawful planning history, the exact services delivered, how the premises operate, the physical works, planning conditions and constraints such as listing. Ask the local planning authority about the specific site and proposal. Ask a local-authority building control department or a registered building control approver about regulated work.

Does a health centre need planning permission under Use Class E?

Health centres are generally in Use Class E

In England, health centres fall within Use Class E. National planning guidance says movement from one primary use to another within the same use class is generally not development, so it normally does not require planning permission. This is why a change between certain compatible commercial, professional or health-related uses can sometimes proceed without a new application.

That rule is not a blanket exemption for every NHS project. The lawful existing use must be established, the proposed operation must genuinely fit the relevant class, and any condition attached to an earlier permission can restrict what happens on the site. A planning condition can require a particular user, hours, layout or purpose even where the broad use class appears suitable.

When a change of use becomes material

Planning guidance treats a material change of use as a matter of fact and degree. There is no universal percentage or checklist that decides every case. The local planning authority considers the significance of the change and its resulting effects, such as traffic, parking, noise, opening hours, servicing, waste, patient attendance and impacts on neighbours or the highway.

For example, converting a building already lawfully used for a compatible Class E purpose into a small medical facility may remain within the same class. Converting a dwelling, warehouse or other use into a busy medical centre can create a material change because the use and its effects are substantially different. The correct conclusion cannot be reached from the label “NHS” or “GP surgery” alone.

Existing permission and conditions must be checked

Review the planning register and the decision notices for the building. A permission may have an expressly limited use, approved plans, restricted hours, parking obligations or a condition preventing a later change. The fact that a previous occupier operated a health-related service does not by itself prove that the proposed operation is lawful.

Do extensions, new buildings and alterations need planning permission?

Planning use and physical development are separate questions. A project that does not need permission for its change of use may still need permission for:

  • a new health-centre building;
  • an extension or enlargement;
  • demolition or substantial external alteration;
  • new access, parking, servicing or plant;
  • changes to elevations, roof form, windows or doors;
  • signage, lighting, fencing or external equipment; or
  • development controlled by a local or site-specific condition.

Permitted development rights may cover some works, but they have detailed limits and exclusions. Check the relevant order, the site’s planning history and any article 4 direction before relying on them. Listed-building consent is a separate requirement for work affecting a listed building; planning permission alone does not replace it.

The limited hospital-building Class M route

The Town and Country Planning (General Permitted Development) (England) Order 2015 includes a Class M route for erection, extension or alteration of certain existing hospital buildings. It is narrow. Among its conditions, the development must be within the hospital’s curtilage, be used as part of or incidental to the hospital, and satisfy restrictions on floor area, boundaries, height and listed buildings. The premises must also have the required predominant medical or health-services use.

Do not assume Class M covers every community health centre or GP surgery. The building’s legal use and the detailed criteria must be tested against the actual proposal. If any condition is not met, a full planning application or another route may be needed.

When is building-regulations approval required?

The Building Regulations 2010 apply to construction and extensions and can also apply to many alterations. Examples identified in England guidance include:

  • replacement windows or doors;
  • roof coverings;
  • heating systems and radiators; and
  • other work that affects structure, fire safety, ventilation, drainage, energy performance or access.

This list is illustrative, not exhaustive. Even a modest refurbishment can involve several controlled elements. Ask a building control body to confirm whether the proposed work is exempt, notifiable or subject to a full application.

Building-regulations approval does not decide whether the use is lawful in planning terms. Conversely, planning permission does not demonstrate compliance with structural safety, fire precautions, accessibility, ventilation, sanitation or energy requirements.

Which approval route applies?

For ordinary work that is not higher-risk building work, the client can use the local authority building control department or a private registered building control approver. The building control body reviews the plans or notices, inspects the work as required and issues the relevant completion documentation when the requirements are met.

Qualifying higher-risk building work requires Building Safety Regulator approval before work starts, subject to the exceptions in the current regime. The project team should identify the route at the design stage rather than assuming that a health-related label determines it. Planning permission may also be required before building-control approval is sought.

Can changing a building into a medical centre trigger special Building Regulations duties?

The Building Regulations 2010 contain material-change-of-use provisions. They address changes that result in use as an institution or public building and specify work needed to meet applicable requirements. The obligations depend on the existing use, proposed use, the parts of the building affected and whether the change applies to the whole building or only part.

A conversion can therefore require upgrades even where no major extension is planned. The building control body may need information about compartmentation, escape routes, fire detection, structural loading, ventilation, sanitary facilities, electrical systems, drainage, energy performance and access. Obtain a written scope from the building control body before construction begins and retain approved drawings, inspection records and the completion certificate.

Is an NHS health centre automatically a higher-risk building?

No. “Healthcare” and “hospital” are not interchangeable for the higher-risk building regime in England.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The higher-risk criteria combine a height or storey threshold with a qualifying use. The relevant building must meet the threshold and be or contain a hospital, care home or at least two residential units. Official guidance says that a building used to receive and treat people, provide convalescence or medical rehabilitation needs at least one overnight bed to count as a hospital for this regime. A GP surgery that does not permit overnight stays does not meet that hospital definition.

That does not mean every health centre is outside the regime. Mixed-use arrangements, residential accommodation, the building’s configuration and the exact statutory criteria still matter. Have a competent designer or building control professional assess the whole building, not just the NHS or GP description.

Where the building is qualifying higher-risk work, Building Safety Regulator building-control approval is required before specified new construction or work on an existing higher-risk building, subject to current exceptions. Starting work without the required approval can create serious enforcement and project-delay risks.

What accessibility guidance applies?

Approved Document M is England’s statutory guidance on access to and use of buildings. Volume 2 applies to buildings other than dwellings, which is the relevant category for a health centre. The GOV.UK page records an update on 1 October 2024 incorporating the 2024 amendments.

Use the current government publication as the primary reference and design against the actual premises, users and circulation routes. A generic layout cannot guarantee compliance. The design team should coordinate entrances, level access, doors, corridors, sanitary accommodation, reception areas, waiting rooms, treatment rooms, changing facilities and signage with the building control body’s interpretation of the project.

Approved Document M is guidance for demonstrating compliance with the Building Regulations; it is not a planning permission document and does not replace an access appraisal for a particular health centre.

What fire-safety guidance applies to healthcare premises?

The Home Office publication Fire safety risk assessment: healthcare premises is intended for responsible persons at premises whose main use is healthcare. It expressly includes hospitals, medical centres and other healthcare premises. It was first published on 25 September 2006, and the GOV.UK page was updated on 12 September 2023 to explain its legislative status.

Use it for the separate fire-risk-assessment process. It does not replace project-specific building-control review or the need to design and certify the building in accordance with the applicable Building Regulations. The responsible person must still manage risks in the completed premises, maintain systems, train staff and keep the assessment under review when layouts, occupancy or services change.

Planning permission versus building regulations: a practical comparison

Project situation Planning question Building-control question
Existing lawful Class E premises, same primary use, no physical development Movement within the class is generally not development, but check conditions and material effects. Confirm whether any alteration or installation is controlled.
Conversion from a dwelling, warehouse or other different use Assess whether the change is material; permitted development rights may or may not apply. Assess material-change-of-use requirements and all affected building work.
Extension or new health-centre building New development commonly requires planning permission unless a specific permitted-development right applies. Construction and structural work require Building Regulations approval.
Work to a listed building Check planning permission and listed-building consent separately. Building-regulations requirements still apply to regulated work.
GP surgery with no overnight beds Assess use, impacts and physical development in the normal planning way. It is not automatically a hospital for higher-risk classification; check all other criteria.
Qualifying higher-risk building work Planning permission may still be required. Building Safety Regulator approval is required before specified work starts, subject to current exceptions.

How to establish the correct route before work starts

  1. Define the proposal. Record the existing lawful use, proposed services, patient numbers, opening hours, staffing, overnight accommodation, deliveries, parking and every physical alteration.
  2. Collect the planning history. Obtain decision notices, approved plans, conditions, certificates, listed-building information and details of article 4 or other local constraints.
  3. Test the use class. Ask whether both uses are within Class E and whether the operational change could be material because of its effects.
  4. Separate external development. Identify extensions, new access, plant, signs, lighting, parking, drainage and changes to elevations. Check whether a planning application, prior approval or another consent is needed.
  5. Appoint the building control body early. Provide existing and proposed plans, structural information, services drawings, fire strategy, access strategy and the intended programme.
  6. Screen for higher-risk status. Check the height or storey threshold, qualifying uses, residential elements, overnight beds and building configuration. Escalate uncertain cases to a professional familiar with the Building Safety Regulator regime.
  7. Coordinate specialist requirements. Design to the applicable access guidance, prepare the healthcare fire-risk approach and resolve listed-building, highways, drainage, environmental or other consents.
  8. Secure approvals before the relevant activity. Do not start work that requires building-control approval or higher-risk approval before the correct notice or approval is in place. Keep inspection and completion records.

Common mistakes that cause delays

  • Assuming “NHS” means permission is automatic. The operator’s identity does not answer the use-class, materiality or physical-development questions.
  • Using Use Class E as a universal exemption. Same-class movement does not remove the need to check conditions, material impacts, listed-building controls or construction work.
  • Applying hospital rules to every GP surgery. A surgery without overnight stays is not a hospital under the cited higher-risk definition, although other criteria may still bring a building within scope.
  • Starting construction after receiving only planning consent. Building-regulations approval and inspections remain separate.
  • Leaving access and fire design until the end. Door widths, escape routes, compartmentation, ventilation and sanitary layouts can be expensive to alter after construction begins.
  • Relying on an old approval or a previous occupier’s arrangements. A new operational model, extension or change of use can create fresh obligations.

Questions to put to the authorities

Give the local planning authority a concise written brief covering the address, lawful existing use, proposed use, floor plans, external works, hours, patient capacity, parking, deliveries and any overnight accommodation. Ask specifically whether the proposal is a material change of use, whether conditions limit the use and whether any permitted-development route is available.

Give the building control body the same brief plus structural, fire, access, drainage, ventilation, electrical and mechanical information. Ask which parts are controlled work, whether material-change-of-use provisions apply, which application route is appropriate and whether the building could be higher-risk. Written responses and a clear approval trail are valuable if the project is later inspected, refinanced or transferred.
