1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsDo not commit to a Florida building lot until its flood map, elevations, drainage outfall, permits, and long-term maintenance responsibilities are documented. A lot outside a mapped flood zone can still collect runoff from higher ground, depend on a private pond or culvert, or require costly grading and stormwater controls. Use this checklist with a Florida-licensed surveyor, civil engineer, and the agency that has jurisdiction over the site.
1. Verify the flood and drainage setting before you make an offer
Start with the current FEMA Flood Insurance Rate Map (FIRM) panel for the parcel, not a real-estate listing’s summary. Record the mapped flood zone, any floodway, the base-flood or design-flood elevation, and the map’s effective date. Check whether a Letter of Map Revision (LOMR) or other revision changes the panel information. Florida floodplain plan-review guidance also calls for checking nearby watercourses, wetlands, and local drainage outfalls.

A “not in a flood zone” statement is not a drainage conclusion. FEMA maps describe mapped flood hazards; they do not prove that a particular finished lot will drain during a storm. A parcel can be outside a Special Flood Hazard Area (SFHA) and still be low relative to the street, receive runoff from adjacent land, or rely on an undersized or privately controlled outfall.
Documents to obtain
- The applicable FEMA FIRM panel and any LOMR or map-revision documentation.
- Local floodplain-ordinance requirements and the community’s adopted design-flood information.
- Records identifying nearby canals, creeks, wetlands, ponds, ditches, culverts, pipes, and legal drainage outfalls.
- Recorded drainage, access, conservation, utility, and maintenance easements affecting the lot.
2. Require a boundary and topographic survey that answers elevation questions
Order an accurate boundary and topographic survey from a Florida-licensed land surveyor before finalizing site design or waiving inspection rights. Florida’s development-plan checklist says the site plan should be based on an accurate boundary-line survey. For a new home, the survey should show lot lines, rights-of-way, street and driveway grades, existing spot elevations, significant breaks in slope, structures, water features, and applicable flood hazards.

Elevations to ask for
- Existing ground elevations across the lot and at adjoining properties.
- Street, curb, swale, ditch, and driveway elevations at the points where water can enter or leave.
- Proposed finished grade, slab or lowest-floor elevation, finished-floor elevation, and garage or equipment-pad elevations.
- The applicable base-flood or design-flood elevation and the vertical margin between that elevation and the proposed building.
- Locations and elevations of pipes, inlets, culverts, pond control structures, and the receiving water or outfall.
An elevation certificate may be useful for documenting a building’s relationship to mapped flood elevations, but it does not replace a complete boundary and topographic survey or a drainage design.
3. Have the civil engineer prove the drainage concept
Ask the civil engineer to put the complete runoff path on the plans: where rainfall is collected, how it is conveyed, whether it is detained or retained, how it is released, and how every discharge point is protected from erosion. The design must address the lot and the land it could affect. The Southwest Florida Water Management District (SWFWMD) states that permitted stormwater systems must be designed not to cause adverse water-quantity or flooding impacts onsite or on adjacent land.

Questions the plans should answer
- What are the drainage areas contributing runoff to the lot, and where does roof, driveway, and yard runoff go?
- What storage volume is provided by a pond, swale, exfiltration system, or other facility?
- What is the permitted discharge point, and is there a legal easement and adequate downstream capacity?
- How are emergency overflow routes handled if the primary inlet, pipe, or control structure is blocked?
- What slopes, inlets, pipes, headwalls, or erosion controls are required to keep water away from the foundation and neighboring lots?
- Will the proposed grading preserve required floodplain storage rather than displacing it with fill?
4. Determine whether an Environmental Resource Permit or local stormwater permit is required
Florida’s water-management districts and delegated local governments administer different portions of the permitting system. The South Florida Water Management District (SFWMD) states that an Environmental Resource Permit (ERP) is required for development or construction activities to prevent flooding, protect water quality, and protect wetlands and other surface waters. Confirm the responsible district or delegated government for the parcel before earthwork begins.

Screening checklist
- Identify the water-management district and whether a local government has delegated stormwater authority.
- Ask whether the proposed clearing, grading, fill, driveway, pond, swale, or outfall is “development” requiring an ERP.
- Check wetlands, other surface waters, conservation areas, and crossings that may trigger additional state or federal review.
- Obtain the issued permit, approved plans, operation-and-maintenance documents, and all conditions before closing or starting work.
Do not assume that a subdivision’s original approval covers every later lot alteration. A new home, expanded driveway, pool, retaining wall, or fill placement can change the permitted drainage system.

5. Identify construction-stormwater obligations before breaking ground
Florida Department of Environmental Protection (DEP) Construction Generic Permit coverage applies to qualifying construction stormwater discharges. The small-construction threshold is at least 1 acre of disturbance when the project discharges to state waters or a municipal separate storm sewer system (MS4); a smaller disturbed area can also qualify when it is part of a common plan of development.
| Requirement | Florida DEP figure or timing | What the owner or contractor must document |
|---|---|---|
| Small-construction Notice of Intent (NOI) fee | $250, as stated on the current DEP webpage; year not stated | Coverage application and project disturbance/discharge information |
| Large-construction NOI fee | $400, as stated on the current DEP webpage; year not stated | Coverage application and project disturbance/discharge information |
| NOI timing | At least 2 days before construction | Proof of timely submission and permit coverage |
| Coverage term | Five years | Permit records retained through the project |
| Notice of Termination | Within 14 calendar days after final stabilization | Evidence that stabilization is complete and termination was filed |
Coverage also requires a Stormwater Pollution Prevention Plan (SWPPP) and implementation of best management practices (BMPs). The plan should show stabilized entrances, perimeter controls, inlet protection, sediment controls, stockpile management, inspection records, corrective actions, and stabilization of disturbed soil. The contractor and owner should assign who updates the SWPPP when grading or drainage details change.

6. Apply the stricter rules for a floodway or Special Flood Hazard Area
In a floodway or SFHA, use the Florida Building Code together with the local floodplain ordinance and the conditions of any floodplain or ERP approval. A floodway is the channel and adjacent area reserved to carry flood flows; placing fill, walls, or structures there can raise flood levels. A no-rise analysis may be required to demonstrate that a proposed activity does not increase the permitted flood elevation. The local reviewing authority determines the required modeling and documentation.

- Building and lowest-floor elevations relative to the applicable design-flood elevation.
- Foundation type, openings, anchorage, and flood-resistant materials required by the code and local ordinance.
- Location and elevation of electrical equipment, HVAC equipment, tanks, generators, and other utilities.
- Limits on fill, grading, fences, retaining walls, driveways, and accessory structures in the floodplain.
- Compensatory storage or other mitigation required when earthwork displaces floodplain volume.
7. Document every cubic yard of earthwork
Before excavation or fill placement, put the earthwork limits in the civil plans and contract. Record the fill source and quantity, excavation limits, existing and proposed grades, stockpile locations, and the destination of unsuitable soil. Florida’s development-plan checklist calls for this information and for copies of applicable state and federal permits.

Minimize fill in hazard areas. If the design requires fill or grading that displaces storage, the engineer should calculate and show the compensatory storage required by the applicable agency. Keep as-built elevations and surveyor certification so the owner can prove that the constructed grades match the approved plans.
8. Assign operation and maintenance before closing
A pond, swale, ditch, culvert, pipe, or control structure is not “the developer’s problem” after the deed records. SWFWMD notes that private stormwater infrastructure is generally the owner’s responsibility; subdivision systems are commonly assigned to a homeowners’ association or another operation-and-maintenance entity.
Get these records at closing
- The ERP and approved stormwater plans, including the operation-and-maintenance (O&M) manual.
- Recorded easements and access rights for inspection, mowing, dredging, repairs, and emergency work.
- The entity legally responsible for each pond, swale, ditch, culvert, pipe, inlet, and discharge structure.
- Inspection frequency, required forms, vegetation and sediment standards, and escalation procedures for defects.
- Funding arrangements, reserve requirements, assessments, and contractor access provisions.
For recurring inspections, DEP publishes Stormwater Facility Inspection Checklist Form 62-330.311(3), effective June 28, 2024. Use it as a reference alongside the facility’s permit-specific O&M requirements; the form does not transfer responsibility or replace required professional inspections.
9. Compare candidate lots on the same risk worksheet
| Comparison item | Lower-risk indication | Follow-up when the answer is unfavorable or unknown |
|---|---|---|
| Flood zone, floodway, and elevation margin | Mapped hazards and proposed elevations are documented with usable vertical margin | Obtain floodplain review, survey, and possible no-rise analysis |
| Existing versus proposed grades | Grading routes water away from the home without relying on a neighbor’s property | Require engineered grading and written drainage easements |
| Outfall capacity and legality | Permitted outfall with recorded access and adequate downstream capacity | Verify permits, easements, downstream owner, and emergency overflow |
| Wetlands and surface waters | No unverified impacts or crossings | Obtain wetland delineation and agency jurisdiction determination |
| Permit complexity | ERP, local approvals, and construction coverage are clearly identified | Make contract deadlines contingent on approvals |
| Construction stormwater | Disturbance area, SWPPP, BMPs, NOI, inspections, and termination are assigned | Name the responsible party and retain compliance records |
| Long-term maintenance | Recorded O&M obligations, access, inspections, and funding are clear | Do not close until the responsible entity accepts the system |
10. Use a staged due-diligence process
- Before the offer: collect the FIRM panel, local floodplain rules, subdivision plats, drainage easements, and available permit records.
- During the inspection period: commission the boundary/topographic survey and have a civil engineer review grades, outfalls, storage, wetlands, and constructability.
- Before design approval: obtain written ERP and local-permit determinations, set building and finished-floor elevations, and resolve floodway or SFHA requirements.
- Before construction: finalize the SWPPP, BMP plan, NOI and fees when coverage is required, approved grading, and erosion-control details.
- Before closing or final payment: receive as-builts, O&M documents, easements, inspection records, permit conditions, and the identity of the maintenance entity.
Common warning signs and corrective actions
- “The lot has never flooded.” Treat that as anecdotal. Require mapped hazards, elevations, and an engineered drainage review.
- No legal outfall is shown. Stop design until ownership, easement rights, capacity, and permit authority are documented.
- Plans rely on unapproved fill. Require revised grading, flood-storage calculations, and agency approval before placement.
- A pond is shown but no O&M party is named. Obtain the recorded assignment, inspection schedule, access rights, and funding mechanism.
- Construction starts before coverage. Confirm whether the disturbance and discharge require CGP coverage, submit the NOI at least two days before work, and implement the SWPPP and BMPs.
Who should sign off
A Florida-licensed land surveyor should establish boundaries and elevations. A Florida-licensed civil engineer should design or review grading, stormwater storage, conveyance, outfalls, and any required no-rise analysis. For ERP, NPDES, or SWPPP work, use professionals who routinely prepare and manage those permits. Have the local floodplain administrator and applicable water-management district confirm jurisdiction and conditions in writing.
Make the purchase agreement and construction contract reflect the findings: retain a drainage and flood-risk inspection period, require delivery of permits and O&M documents, identify who pays for redesign or mitigation, and make closing conditional on legally usable drainage rights. That documentation is the difference between a mapped answer and a buildable, maintainable lot.
