Start by photographing and measuring the damage, confirm the boundary, and notify your neighbour in writing. In many common-law jurisdictions you may trim branches or roots that physically cross onto your land, but only back to the boundary, from your own property, and without destabilising or killing the tree. Protected-tree rules, trespass laws and the facts linking the tree to the damage can change the result, so identify your country or state before cutting or demanding removal.

Why your location matters

Tree disputes are governed by local property, nuisance, negligence, trespass and planning rules. Guidance from Texas, the UK, Queensland, New Zealand and New South Wales describes a common-law self-help right to deal with encroaching branches or roots, while Victoria and South Australia emphasise nuisance and negligence concepts when damage is proven. Those principles are not a universal rule. Council ordinances, tree-protection orders, conservation-area controls, homeowners’ association covenants and lease terms may impose stricter requirements.

Before relying on any general rule, check the relevant city or council, state or territory and country. A property lawyer can explain the rule that applies to your boundary and the remedy a court could order.

What to do first

  1. Create a dated record. Photograph and video cracks, lifted paving, damaged fences, blocked gutters, fallen limbs and recurring debris. Measure crack width, ground heave and the clearance from limbs to structures. Keep repair estimates, invoices, utility plans, survey or boundary documents, weather and incident records, and every letter, email and text message.
  2. Confirm the boundary. Use your title plan or a licensed surveyor if the line is unclear. Do not enter the neighbour’s land to inspect or cut the tree.
  3. Write a calm notice. Describe the specific damage, attach photographs, ask for a joint inspection and propose a remedy and timetable. Queensland, UK and NSW public guidance all recommend talking first and documenting the issue.
  4. Arrange expert inspection. A qualified or consulting arborist can assess tree risk, likely roots or limbs, appropriate pruning and whether the tree is unstable. Ask for a written opinion that addresses the connection between the tree and the damage, not merely the tree’s condition.

Can you cut branches or roots crossing your boundary?

In many common-law systems, an owner may exercise “abatement” by cutting only the branches or roots that physically extend onto the owner’s land. Texas State Law Library describes this as a common-law right, and similar boundary-limited guidance appears in the UK, Queensland, New Zealand and Newcastle materials. The usual limits are critical:

  • Work from your own land and cut no farther than the legal boundary.
  • Do not climb over, enter or place equipment on the neighbour’s property without permission.
  • Do not cut in a way that injures, kills or destabilises the tree.
  • Check permits, preservation orders and local ordinances before any work.

Cutting large limbs or structural roots without professional advice can make the tree hazardous and expose you to claims for tree or property damage. If the work could affect stability, hire an arborist and use a qualified tree contractor. A boundary right to remove encroaching growth does not automatically give you a right to remove the whole tree.

When damage may support a legal claim

Cracked pipes, foundations, paths or driveways and a documented risk from falling branches may support a private-nuisance, negligence or related property claim. South Australian legal-handbook guidance gives pipe and branch damage as examples of losses for which an owner may seek repair costs or compensation. Victoria’s law-reform material identifies nuisance, negligence and trespass as relevant concepts.

Liability is not automatic. You generally need evidence of causation, foreseeable harm, reasonable notice and the loss claimed. An arborist’s written assessment, dated images, measurements, repair estimates and records showing that the neighbour knew about the problem can be important. A court may award damages or require specific work, but the evidence does not guarantee an order to remove the entire tree.

Protected trees, permits and urgent danger

Search your council or city tree register, tree-preservation-order database and conservation-area rules before pruning, root cutting or removal. GOV.UK and Texas guidance warn that protected trees and local ordinances can require permission even where growth crosses a boundary. Fines or restoration obligations may follow unauthorised work.

If a limb or tree is imminently dangerous, keep people away and contact the local authority or emergency services as appropriate. Do not attempt hazardous removal yourself. High-hedge complaints may use a separate council height and complaint process rather than ordinary tree-nuisance rules.

Choosing a remedy

Option Best use Key risk or requirement Evidence and urgency
Boundary-limited branch pruning Branches physically over your land and can be safely cut without harming the tree Stay on your land; check permits; poor cuts can create liability Arborist advice for large or structural limbs; urgent only where a hazard is present
Boundary-limited root pruning Roots demonstrably entering your land and causing damage Structural-root cuts can destabilise or kill a tree; utilities and drainage must be checked Written arborist and utility information are important before work
Root barrier Preventative measure where roots are confirmed as the cause Design and installation must account for utilities, drainage, tree stability and permissions Use after causation assessment; it is not a substitute for diagnosing the damage
Whole-tree removal Only where lawful and justified by risk or an agreed solution Often requires owner consent, a permit or protected-tree approval; hazardous work needs professionals Use an arborist risk report and check local authority rules first

Escalate in a controlled sequence

  1. Seek a joint inspection. Share the photographs and ask the neighbour to discuss a specific repair or pruning plan.
  2. Obtain professional documents. Commission an arborist report and repair estimates; preserve originals and dated copies.
  3. Check governing rules. Verify permits, protected status, boundary records, HOA or covenant terms and utility locations.
  4. Notify your insurer. If covered property damage has occurred, report it promptly and follow instructions about inspections and mitigation.
  5. Try mediation or a local complaint route. Councils or local authorities may handle certain hazards or high-hedge disputes, and mediation can produce a written access, pruning or cost agreement.
  6. Get legal advice before high-risk action. Consult a property or nuisance lawyer before cutting structural roots, undertaking work that could injure the tree or filing court proceedings. Ask what remedy is realistic in your jurisdiction and how repair costs would be proved.

What a practical written agreement should cover

Put any settlement in writing. Identify the trees and boundary, describe the approved work, name the arborist or contractor, allocate permit applications and costs, set dates, address access and cleanup, and state how future inspection or repeat damage will be handled. Keep proof that both owners accepted the terms.

Common mistakes to avoid

  • Cutting first and investigating permits later.
  • Entering the neighbour’s land or cutting beyond the boundary.
  • Assuming visible roots prove they caused a crack without an arborist or other technical evidence.
  • Demanding automatic payment or whole-tree removal when causation, notice or local law is unresolved.
  • Ignoring a dangerous limb while negotiations continue; use the appropriate authority or emergency service.
