You still must satisfy building, dimensional, parking, septic, insurance, tax-assessment, and local rental rules. Boston is governed separately. An ADU may change your assessment, insurance premium, and resale prospects, but none of those outcomes has a single statewide formula or guarantee.
What Massachusetts law treats as an ADU
A Massachusetts ADU is a self-contained housing unit on the same lot as a principal dwelling. It must include sleeping, cooking, and sanitary facilities and have its own entrance. Its gross floor area cannot exceed the lesser of one-half of the principal dwelling’s gross floor area or 900 square feet. A municipality may adopt a smaller maximum or other reasonable dimensional requirements.

The state’s protected-use rules are implemented through 760 CMR 71.00, published January 31, 2025. The Affordable Homes Act amended Chapter 40A to protect one qualifying ADU in a single-family residential zoning district from prohibition, unreasonable restriction, or a special permit requirement. Those protections concern the ADU’s use; they do not eliminate ordinary construction approvals or health and safety requirements.
What “by right” does—and does not—mean
By-right approval means the municipality cannot make one qualifying ADU depend on a discretionary special permit or similar zoning approval. You will still generally need building permits, inspections, and a certificate of occupancy. Local rules can address setbacks, height, bulk, site-plan review, parking, utilities, and other reasonable dimensional or operational issues.

The state’s updated ADU FAQ says inconsistent local zoning provisions became unenforceable on February 2, 2025. The same FAQ states that Boston is not subject to the specific Chapter 40A ADU law. A Boston owner must therefore verify the city’s separate zoning, permitting, and rental requirements rather than relying on the statewide by-right framework.
One unit versus multiple units
The protected-use provision covers one qualifying ADU on a single-family lot. More than one ADU requires a special permit under the cited state-law provision. Do not assume that adding a second unit, converting another accessory structure, or combining a new ADU with an existing in-law apartment receives the same treatment.
Can you build an ADU without a special permit?
Usually, yes—if you are creating one qualifying ADU in a Massachusetts single-family zoning district outside Boston. Owner occupancy of either the principal home or the ADU is not required, and a municipality cannot require a special permit for that single protected-use ADU.

“Usually” matters because the exemption from a special permit is not an exemption from every rule. Before design work is finalized, confirm the parcel’s zoning district, lot coverage, setbacks, height, frontage, historic or environmental overlays, parking obligations, and utility capacity with the building and planning departments.
Parking and transit
A municipality may require one additional parking space for a protected ADU. No parking may be required when the ADU is within 0.5 miles of a commuter-rail, subway, ferry, or bus station. Ask the municipality how it measures the half-mile distance and what evidence it accepts; the result can affect site layout and whether a variance or design change is needed for other reasons.

Septic systems and Title 5
Massachusetts Department of Environmental Protection Title 5 requirements can apply to ADUs. MassDEP’s guidance dated April 7, 2025, confirms that 310 CMR 15.000 may govern septic capacity, design, and approvals. If the property uses on-site wastewater treatment, have a qualified designer or engineer determine whether the proposed bedroom count and fixtures fit the system’s approved capacity. A zoning approval does not override Title 5.
Practical approval sequence
- Confirm jurisdiction. Determine whether the property is in Boston or another municipality and identify the applicable zoning district.
- Verify eligibility. Measure the principal dwelling’s gross floor area and confirm that the proposed self-contained unit, entrance, sleeping, cooking, and sanitary facilities meet the state definition and any stricter local size rule.
- Check site constraints. Review setbacks, lot coverage, height, parking, fire access, historic restrictions, wetlands, and utility connections.
- Evaluate wastewater. For septic properties, obtain a Title 5 capacity review before committing to a bedroom count or floor plan.
- Submit construction documents. Apply for the building and trade permits required by the local building department, then schedule inspections.
- Obtain occupancy approval. Do not rent or represent the unit as a lawful dwelling until required inspections and the certificate of occupancy are complete.
Can you rent a Massachusetts ADU?
State law protects rental of one qualifying ADU in a single-family district and does not require the owner to live in either unit. That protection is for lawful ADU use; it does not guarantee that every rental format is allowed.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsChoose the rental model before construction
- Conventional lease: A standard, longer-term tenancy is the clearest use protected by the statewide ADU rules, subject to local landlord, building, and health requirements.
- Furnished medium-term rental: A lease lasting weeks or months may be treated differently by local rules, tax authorities, or insurers. Get the municipality and carrier’s definitions in writing.
- Short-term rental: Municipalities may regulate or prohibit short-term rentals. Registration, local taxes, occupancy limits, safety inspections, and platform-related rules may apply even though the underlying ADU is lawful.
The state ADU page identifies rental income as a possible way to offset maintenance and repair costs. That is a general benefit, not a promised return. Model vacancy, repairs, utilities, management, insurance, taxes, and financing before relying on rent to support the project.
Documents to keep for a rental
- Building permits, approved plans, inspection records, and the certificate of occupancy.
- A written lease identifying the unit, term, rent, utilities, deposits, maintenance duties, and permitted occupants.
- Evidence that smoke, carbon-monoxide, egress, and other safety requirements were met.
- Insurance confirmation that the carrier knows the unit is rented and the exact rental format.
- Septic or utility approvals and records of capacity limits, where applicable.
Will an ADU raise Massachusetts property taxes?
It can, but Massachusetts has no statewide ADU surcharge or fixed tax rate. Local assessors value real property at fair cash value as of January 1 each year. A permitted, usable ADU can increase the property’s market value and therefore its assessed value; the resulting tax change depends on the municipality’s valuation, classification, exemptions, and tax rate.
How assessment timing works
Assessors consider the property’s condition and legally usable features as of January 1. Construction completed, substantially completed, or otherwise recognized under local assessment procedures can affect a subsequent bill. Ask the assessor how the municipality handles partially completed work, newly issued certificates of occupancy, and changes between assessment dates.

There is no reliable statewide percentage that predicts the increase. For a parcel-specific estimate, provide the assessor with the approved plans, finished square footage, construction quality, utility arrangement, and occupancy status and ask how comparable properties are assessed.

Massachusetts Division of Local Services guidance describes a residential affordable-rental exemption that can include a rented ADU when statutory and local conditions are met. The owner generally must apply annually to the local assessors, submit a signed lease covering the fiscal year, and provide household-income documentation. Municipalities may adopt implementation rules, and the exemption is not automatic for every rented ADU.
Before budgeting for an exemption, ask the assessor for the current application, income limits, rent restrictions, filing deadline, and required evidence. Keep copies of the lease and supporting records because eligibility is reviewed for each application year.
What insurance does an ADU need?
Tell your insurer before construction begins and disclose the intended use. The Massachusetts Division of Insurance says an addition or new structure can change the property’s risk profile. An attached or internal ADU may be treated as part of the primary dwelling and require higher dwelling limits. A detached ADU may need an endorsement or separate limits, depending on the policy.
Coverage questions to ask
- Property damage: Are the primary home, attached improvements, detached structure, appliances, and finish materials insured to an adequate replacement-cost limit?
- Liability: Does the policy cover tenant-related claims, guests, contractors, and incidents involving shared areas?
- Rental income: Is loss of rent covered after a fire or other insured event, and for how long?
- Construction period: Are materials, vacant areas, builder risk, and contractor-caused damage covered while work is underway?
- Rental format: Does the policy permit a conventional lease, furnished tenancy, or short-term rental?
If the ADU is rented, landlord coverage may be necessary rather than ordinary owner-occupied homeowners coverage. The Division’s consumer guidance says premiums will “most likely” rise because of replacement cost, liability exposure, and rental activity, but the amount varies by insurer, ADU size and use, and the property’s overall risk.

Non-renewal and hard-to-place coverage
It is possible for an insurer to non-renew after an ADU is added if the changed risk no longer fits its underwriting rules. The Division says an insurer that non-renews must provide 45 days’ notice before policy expiration. If admitted-market insurers decline coverage, a licensed broker can discuss surplus-lines options. The Massachusetts FAIR Plan is the insurer of last resort for basic coverage, not a substitute for comparing broader forms of protection.
Tenant belongings
The owner’s policy does not fully protect a tenant’s personal property. Tell prospective renters to consider their own renter’s insurance for belongings and personal liability. Put that expectation in the lease without representing that renter’s insurance replaces the owner’s required coverage.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Will an ADU increase resale value?
No statewide Massachusetts source establishes a guaranteed resale premium or a universal percentage increase for a home with an ADU. Value is property-specific. A legal, permitted, private, usable unit can attract buyers seeking multigenerational space or rental income, while an awkward layout, unresolved permitting, high insurance cost, limited parking, or inadequate septic capacity can reduce appeal.
What buyers and appraisers will examine
| Factor | Questions that affect value |
|---|---|
| Legal status | Were permits, inspections, and the certificate of occupancy completed? Is the use lawful in the municipality? |
| Usable space | Does the unit have practical room sizes, natural light, storage, a separate entrance, and reasonable privacy? |
| Building quality | Are structure, fire separation, plumbing, electrical, heating, and finishes durable and code-compliant? |
| Utilities and septic | Can water, sewer, electrical service, heating, and wastewater systems support the unit without costly upgrades? |
| Parking and access | Is parking available or legally waived because of transit proximity? Can occupants and emergency services reach the unit safely? |
| Operating economics | What are the documented rent, vacancy, maintenance, insurance, and utility costs? |
| Comparable sales | Do nearby sales involve similarly legal, permitted, and functional ADUs rather than informal conversions? |
Massachusetts requires municipalities to record ADU permit and certificate-of-occupancy information, including square footage, type, and estimated construction value. Those records can improve local market evidence over time, but they do not turn an individual project into a guaranteed investment.

How to prepare for a future sale
- Keep a permanent file with permits, approved plans, inspection sign-offs, the certificate of occupancy, warranties, and septic documents.
- Record the unit’s finished area, bedroom count, entrance arrangement, parking, utility separation, and accessibility features.
- Retain leases, rent ledgers, and expense records while removing tenants’ personal information.
- Ask an appraiser or broker to use legal ADU comparables and explain adjustments rather than applying a blanket percentage.
- Correct any unpermitted work before listing; marketing an illegal dwelling can create financing, appraisal, insurance, and disclosure problems.
Massachusetts ADU activity and what it means
State program reporting lists 2,084 approved ADUs and 2,824 applications for 2025 and the first half of 2026. The figures come from municipal records required by the ADU regulations and describe that reporting period only. They show substantial implementation activity, not a prediction of approval for a particular parcel or a statewide resale premium.
