Managing Wetlands on Your Property: A Practical Guide for U.S. Landowners

A landowner’s guide to identifying potential wetlands, checking authorization before site work, and planning practical, locally informed protection or restoration.

Start by confirming what the wet area is and whether your proposed work needs authorization. A quick look, a wetland inventory map, or a visit after rain cannot establish a wetland’s legal status. Before filling, grading, dredging, draining, or other work that could put dredged or fill material into a wetland, consult the U.S. Army Corps of Engineers district and relevant state or local authorities. For voluntary protection or restoration, set site-specific goals with local expertise, then plan monitoring and long-term care as part of the project.

How to tell whether an area is a wetland

Wetlands are identified using evidence from hydrology, vegetation, and soils together—not simply because a spot is soggy or holds water on one particular day. The U.S. Environmental Protection Agency explains that the Corps’ delineation approach considers all three categories: soils, vegetation and hydrology. Seasonal conditions and past drainage, fill, or other modifications can affect what is visible during a site visit.

Walk the area at different times if practical and make a record of seasonal water patterns, plants, soil conditions, and existing ditches, dikes, drainage, or fill. A wetland inventory map can help with initial screening, but it is not a site-specific legal determination. If federal Clean Water Act coverage matters to a planned project, contact the relevant Corps district about a jurisdictional determination.

Check permits and other rules before disturbing the site

Clean Water Act Section 404 generally requires authorization before dredged or fill material is discharged into covered waters, including wetlands, unless an exemption applies. The Corps administers routine individual and general permit decisions, jurisdictional determinations, and enforcement; some states or tribes administer assumed programs. The applicable pathway depends on the location, the activity, and current law. Review the EPA Section 404 permit program and contact the Corps district before beginning work that could involve a discharge.

Do not assume that private ownership means a project is outside regulation—or that every activity on every wetland requires a federal permit. Some activities may be exempt, and some lower-impact work may qualify for a general permit. The Corps or relevant agencies must assess the facts of the specific site and proposal. The federal process generally requires impacts to be avoided first, minimized where they cannot be avoided, and compensated for when unavoidable impacts remain.

Federal Section 404 is not the only possible constraint. State, tribal, and local wetland protections may differ or be broader; local buffers, protected species rules, and other requirements can also apply. EPA’s Section 404 overview, last updated September 10, 2026, flags a proposed revision to the definition of “waters of the United States.” Because jurisdictional rules can change, confirm current requirements with EPA, the Corps, and local authorities rather than relying on a general summary.

For agricultural land, certain farming and forestry activities are among the examples discussed in federal exemption guidance, but whether an exemption applies is fact-specific. If farm-program benefits could be affected, consult the Natural Resources Conservation Service (NRCS) before clearing, draining, or manipulating wet areas. Do not rely on a general exemption description as a decision for a particular project.

Plan voluntary protection or restoration around the site

If your goal is conservation or restoration rather than construction, begin with what the wetland does and what you want to protect or improve. Hydrology, soils, vegetation, wetland type, existing degradation, and your ownership goals all shape suitable work. A plan should use measurable, ecologically grounded objectives and local expertise rather than a generic intervention.

Set goals and choose appropriate methods

Work with local wetland specialists to assess the site and identify suitable methods. EPA’s restoration guide recommends planning the whole project, consulting local experts, using local reference sites, considering low-impact or passive approaches where appropriate, and including long-term management. Depending on the site, work might involve prioritizing restoration, addressing invasive plants, or changing cultivation practices; no single treatment is right for every wetland. In agricultural landscapes, NRCS may be a useful source of technical expertise.

Planting is not a substitute for addressing site conditions. If a restoration plan calls for revegetation, select locally suitable species and plant material with expert guidance; a generic seed mix may not fit the wetland or its hydrology.

Build monitoring and maintenance into the plan

Decide how progress will be assessed against the project’s goals, who will do the work, and what maintenance may be needed. EPA’s restoration guide states: “All wetland projects must include monitoring to see if goals are being met and to direct the long-term management of the site.” Track results and adjust practices when they are not meeting the objectives; installation alone does not complete a restoration project.

Find local assistance and consider lasting protection

Ask the Corps district, state wetland agency, local conservation district, and NRCS about technical assistance. Depending on your location and goals, a land trust or conservation organization may also help with planning, partnerships, or protection options. EPA points landowners toward organizations including Ducks Unlimited, American Bird Conservancy, Audubon, and Cornell Lab. Available services, program openings, and eligibility vary by place and project, so confirm details directly with the organization.

A conservation easement or deed restriction may help protect a wetland over the long term, sometimes in partnership with a land trust or public or nonprofit conservation organization. These arrangements can limit future uses of the property. Review proposed terms carefully with qualified local conservation and legal professionals before committing.
