Legends Tower: What Oklahoma City’s Planning Hurdle Actually Cleared

Oklahoma City approved the zoning change needed to make the proposed 1,907-foot Legends Tower legally possible under local height rules. That vote, taken on June 4, 2024, did not approve a building permit, settle the tower’s aviation issues, prove that financing was complete, transfer the development site to the developer, or mean construction had begun.

As of August 12, 2026, Legends Tower remains a proposed centerpiece of the Boardwalk at Bricktown development. The tower could become the tallest building in the United States and Western Hemisphere if it is built at its advertised height, but it is not currently a completed building or a verified active construction project.

The short version

The phrase “clears Oklahoma planning hurdle” refers specifically to a local zoning milestone. Oklahoma City Council removed the prior height restriction affecting the proposed tower site on June 4, 2024. That allowed the developer to pursue a tower of approximately 1,907 feet under the city’s zoning framework.

It was an important entitlement step, but it was only one step. The project still faced Bricktown design review, Certificates of Approval, building permits, aviation coordination, financing, land control, market demand and the practical work of starting construction.

Those distinctions matter because headlines describing Legends Tower as America’s “new tallest” can make a proposal sound like a completed building. The accurate description is that it is a proposed 1,907-foot tower that could exceed One World Trade Center’s 1,776-foot architectural height if it is ultimately built at the planned height.

What Legends Tower is supposed to be

Legends Tower is the headline element of the proposed Boardwalk at Bricktown, a large mixed-use development associated with California-based developer Scot Matteson and Matteson Capital. AO Architects has been credited with the tower’s design.

Public descriptions have identified the tower as approximately 1,907 feet tall and 134 stories. The number references Oklahoma’s admission to the Union in 1907. If completed as proposed, the tower would be more than twice the height of Oklahoma City’s current tallest building, the approximately 844-foot Devon Energy Center.

The wider Boardwalk concept has been described as roughly 5 million square feet of mixed-use development, including residential, hotel, retail, entertainment, parking and multiple towers. Earlier versions featured shorter towers; the 1,907-foot supertall was introduced in a later revision.

Legends Tower is not planned as a single-purpose office building. Public project descriptions have included apartments or other residential units, hotel space, restaurants, retail and entertainment. Earlier materials also described a Hyatt-branded hotel and a substantial residential component. Exact unit counts, floor allocations, tenants and structural details may change unless they appear in final approved construction documents.

What the June 4, 2024 vote actually changed

Before the vote, the site was subject to a height restriction that would not have allowed the advertised tower height. The City Council’s zoning action removed that restriction. In practical terms, the city made a 1,907-foot building permissible under the applicable local zoning rules, rather than automatically disallowed because of its height.

That is the key planning achievement behind the headline. It gave the developer a path to continue pursuing the design and to seek the additional approvals required for a major project in Bricktown.

It did not amount to any of the following:

  • a building permit;
  • a final approval of the tower’s construction documents;
  • a Certificate of Approval from Bricktown’s design-review process;
  • permission to begin excavation, foundations or vertical construction;
  • Federal Aviation Administration approval;
  • a binding confirmation that the project was fully financed;
  • proof that the developer owned or controlled all required land; or
  • a guarantee that the tower would still be 1,907 feet when, and if, final plans were approved.

Engineering News-Record described the proposed development as a $1.6 billion mixed-use project. Earlier coverage in Architectural Record reported a developer estimate of $1.2 billion and the developer’s claim that the project was fully financed at that time. Those different figures and later reporting are a reminder that cost estimates and financing claims should be attributed rather than presented as settled facts.

Why zoning approval was not the same as construction approval

Bricktown has a separate design-review framework. The district’s regulations require review by the Downtown Design Commission for new construction and major site changes unless a narrower administrative approval applies. Major new construction, site work and substantial signage also require Certificates of Approval, and the regulations provide procedures for appeals.

The practical consequence is straightforward: a zoning change can remove a height barrier while other city approvals remain outstanding. Work should not be treated as authorized merely because the zoning map or development standards have changed.

For a project of this scale, the meaningful construction sequence would normally require evidence of additional steps, such as approved design documents, site and building permits, secured land, financing, contractor activity and actual work at the site. The June 2024 vote was not that evidence.

The FAA issue is a serious separate hurdle

The project’s most consequential technical and regulatory complication is aviation safety. In a 2024 aeronautical study, the FAA reported that the proposed structure would have a “substantial adverse effect on air navigation.” The study identified potential effects on aircraft landing, departure and en-route procedures. It also reported 20 letters opposing the construction and two supporting it.

The reported determination was scheduled to become final on January 13, 2025, unless a petition was filed within the applicable period. That record should not be simplified into either “the FAA approved the tower” or “the FAA permanently killed the tower.” The finding was a serious aviation objection or adverse-effect determination, while subsequent reporting indicated that discussions were still continuing.

In June 2026, developer Scot Matteson told News 9 that discussions with the FAA remained active. He argued that the site was outside the relevant protected airspace or flight pattern and suggested that market conditions might ultimately be a greater obstacle than federal approval. Those statements describe the developer’s position; they are not an independent FAA finding.

FAA guidance generally brings structures exceeding 200 feet above ground level, or structures exceeding applicable obstruction standards, into marking and lighting review. A 1,907-foot building therefore requires detailed aeronautical analysis. The general height threshold explains why FAA review is unavoidable, but it does not by itself decide whether Legends Tower will ultimately be built at the proposed height.

The project’s status as of August 12, 2026

The latest available reporting supports a cautious description: the broader Boardwalk proposal remains alive, but Legends Tower has not been verified as under construction.

Issue Best-supported status What that means
Local height zoning Approved June 4, 2024 The prior height restriction was removed, making the proposed height legally possible under local zoning.
Tower concept Still proposed The headline design remains approximately 1,907 feet and 134 stories, but the final design could change.
Bricktown design review Separate approval still required Major construction and site changes must proceed through the district’s design-review and Certificate of Approval requirements.
Building permits No permits were reported as filed in July 2026 coverage There was no verified permit record establishing that vertical construction was authorized.
Construction Not verified as started Recent reporting said no construction was underway.
Land control Unresolved in the latest reporting July 2026 coverage said the developer did not yet own the land.
Financing Contested or uncertain Earlier developer statements described the project as fully financed, while later coverage questioned whether financing and execution were finalized.
FAA review Serious adverse finding; discussions reportedly continued There is no basis in the reviewed material to call the tower FAA-approved or definitively rejected.
Market feasibility Still a central condition The developer has said demand for apartments, hotel rooms, retail and entertainment will influence whether the supertall proceeds.
Completion date 2030 appears in a project tracker That is a provisional third-party forecast, not a firm publicly verified delivery commitment.

What may happen before the supertall

June 2026 reporting described the broader Boardwalk plan as still being pursued, but suggested that the first phase could be built around lower buildings before the supertall. That phase was described as including apartments, an underground parking garage, a dual-branded Hyatt hotel and approximately 150,000 square feet of retail and entertainment space. The buildings in that phase were described as below 500 feet.

The proposed 1,907-foot tower would follow only if leasing and sales demonstrated enough demand, according to that reporting. This creates an important distinction between the development and the tower: Boardwalk at Bricktown could advance in a smaller or revised form without proving that Legends Tower itself is ready to rise.

That sequencing also explains why a project can remain “alive” while showing no tower construction. Developers may continue planning, negotiating, marketing and seeking approvals while waiting to establish whether the first phase can support the larger capital commitment.

Why the 2030 date should not be treated as a schedule

A development-tracking source lists 2030 as a projected completion year and classifies Legends Tower as announced rather than breaking ground, under construction or opening soon. That estimate is useful as a market reference, but it is not a construction contract, permit deadline or guaranteed opening date.

A credible completion schedule would need to be supported by several milestones: land control, final design approvals, building permits, financing close, a documented start of site work and a construction program with a responsible contractor. Without those milestones, 2030 should be described as a provisional forecast.

The engineering challenge behind a 1,907-foot tower

A tower at this height would create demanding design and operational problems involving wind, structural loads, elevators, evacuation, fire protection, utility capacity and severe-weather resilience. These challenges are not limited to making the building stand up. They also affect how people move through the building, how systems operate during emergencies and how the structure responds to Oklahoma’s weather.

Earlier coverage reported that the design team had discussed very thick concrete walls around elevator shafts and windows intended to withstand tornado winds without shattering. Those are reported design intentions, not evidence of completed testing or final engineering certification.

It would be inaccurate to claim that Legends Tower has been tested against tornadoes, that its final structural system has been certified, or that it is guaranteed to withstand a particular wind speed. Those conclusions require final engineering documents and verified testing data, neither of which was established in the reviewed material.

A timeline of the proposal

  • 2023: Matteson Capital and partners presented the broader Boardwalk at Bricktown concept.
  • January 2024: Revised plans publicized the 1,907-foot Legends Tower concept.
  • March–June 2024: Local planning and zoning steps advanced.
  • June 4, 2024: Oklahoma City Council approved the height-related zoning change.
  • Late 2024–2025: FAA concerns and project delays complicated the proposed schedule.
  • 2025: The developer continued to describe the first phase as approaching construction, while independent coverage continued to report delay and uncertainty.
  • June–July 2026: Reporting described the project as still alive but not under construction. Demand, permitting, land ownership, financing and FAA discussions remained material issues.
  • August 12, 2026: The best-supported classification was proposed or announced—not verified as under construction.

What would count as real progress?

For readers trying to distinguish a planning announcement from a construction event, the following evidence would be more meaningful than a new rendering or a repeated groundbreaking prediction:

  1. Land control: a documented purchase, closing or other legally sufficient control of the development site.
  2. Design approval: Downtown Design Commission action and the required Bricktown Certificate of Approval.
  3. Building permits: permits filed and issued for the relevant phase, not merely an application or planning discussion.
  4. FAA resolution: a clear, current record showing how the aviation finding affects the proposed height, lighting, marking or design.
  5. Financing close: evidence that the capital package is committed and available for construction, rather than an earlier unverified claim that the project is fully financed.
  6. Site activity: documented excavation, utility relocation, foundation work or other permitted construction activity.
  7. Market commitments: executed leases, apartment presales, hotel commitments or comparable evidence that the first phase has sufficient demand.
  8. Vertical construction: foundations, a tower crane and above-grade structural work would establish that the project had moved beyond proposal status—but would not necessarily prove that the final 1,907-foot design was unchanged.

So, did Oklahoma approve America’s new tallest building?

No. Oklahoma City approved a zoning change that removed a major local height barrier for the proposed Legends Tower.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

That is a significant planning milestone, especially for a 1,907-foot concept. But the United States did not acquire a new tallest completed building in 2024, and the project had not been verified as under construction by August 12, 2026. One World Trade Center remained the relevant existing comparison in the reviewed reporting.

The most accurate one-sentence summary is: Oklahoma City approved the zoning change needed to pursue a proposed 1,907-foot Legends Tower, while aviation concerns, design approvals, permits, financing, land control, market demand and construction remained unresolved.

Will Legends Tower be the tallest building in the United States?

It could be, if it is built at the proposed 1,907-foot height. That would exceed One World Trade Center’s 1,776-foot architectural height. The tower remains proposed, and its height and design could change.

Has the FAA approved or rejected Legends Tower?

The FAA’s 2024 aeronautical study reported a substantial adverse effect on air navigation and identified potential effects on aircraft procedures. Later reporting said discussions with the FAA were continuing. The reviewed material does not support calling the project definitively FAA-approved or definitively rejected.

Is 2030 the confirmed completion date?

No. A development tracker lists 2030 as a projected completion year, but that is a provisional estimate rather than a firm, publicly verified schedule.

What is the Boardwalk at Bricktown?

It is the broader mixed-use development proposed around Legends Tower. Public descriptions have included apartments, hotel space, retail, entertainment, parking and multiple towers. A reported first phase would use lower buildings and could proceed only if market demand is sufficient.

The Bottom Line

Bottom line: The June 4, 2024 Oklahoma City zoning vote cleared a local height restriction for the proposed Legends Tower. It did not clear every approval or make the tower real. As of August 12, 2026, the project remained proposed, with FAA concerns, design review, permits, land control, financing, market demand and actual construction still separating the concept from a completed skyscraper.
